PROCLAIM FEBRUARY 2022 AS SAFE SURRENDER BABY
AWARENESS MONTH IN THE CITY OF ARVIN
(Fiscal Impact: None)
The purpose of this letter is to ask the Arvin City Council to proclaim February 2022, as Safely Surrendered Baby Awareness Month and to advise the Board of the campaign planned to highlight the ongoing efforts of the Safely Surrendered Baby Coalition and the importance of the Safely Surrendered Baby Law.
The Safely Surrendered Baby Law responds to the increasing number of newborn infant deaths statewide due to abandonment in unsafe locations. First enacted in January 2001, the law’s intent is to save the lives of newborn infants at risk of abandonment by encouraging parents or persons with lawful custody to safely surrender the infant within 72 hours of birth, with no questions asked. Since 2006, Kern County has had 90 babies safely surrendered.
Throughout Kern County, a newborn baby can be safely surrendered into the hands of any hospital emergency room or Fire Station staff. The Safely Surrendered Baby Coalition, under the coordination of the Department of Human Services, works to educate all Kern County residents about this important law. The coalition is made up of a small group of dedicated individuals representing the following: First 5 Kern, Kern Family Health Care, Kern County Fire Department, Bakersfield City Fire Department, Kern Medical, Adventist Heath Bakersfield, Dignity Health’s Mercy & Memorial Hospitals, Delano, Tehachapi & Ridgecrest Regional Hospitals, Bakersfield Pregnancy Center, and Kern County Public Health.
The Coalition will work again this year to increase public awareness about the Safely Surrendered Baby Law with a social media campaign, Movie Theater and radio ads and several proclamations throughout the County of Kern.
Therefore, IT IS RECOMMENDED that your City Council proclaim February 2022 as Safely Surrendered Baby Awareness Month, prepare a proclamation and make presentation.
Sincerely,
Dena Murphy
Director

CITY OF ARVIN
Staff Report
Meeting Date: February 04, 2022
TO: Arvin City Council
FROM: Adam Ojeda, P.E., City Engineer
Jeff Jones, Interim City Manager / Finance Director
SUBJECT: Approval of A Resolution of the City Council of the City of Arvin Approving A Task Authorization Between the City of Arvin and Veolia North America for Replacement of A Digester Blower at the Wastewater Treatment Facility.
BACKGROUND:
The City of Arvin has a wastewater treatment facility (WWTF) near the intersection of El Camino Real and Rancho Road. The WWTF is managed for the City by Veolia North America (Veolia).
The treatment train for waste water that enters the facility includes three aerobic digester blowers. One such blowers failed completely in 2020 and has been offline since that time. Veolia has been operating the two remaining blowers which adds wear and tear to each at a greater rate.
In order to minimize the wear and tear on the two remaining blowers, and to remain in compliance with Wastewater Discharge Permit 5-00-093 and other requirements from the California Water Board, the failed blower must be replaced.

3.F.1
Attachment: Staff Report-Task Order Authorization for WWTF Blower Replacement_020822 (Task Order for Replacement of Digester Blower at Staff Report – Task Order between City of Arvin and Veolia for replacement of digestive blower at WWTF.
Veolia has solicited pricing and have provided the attached Task Authorization for a total cost of $39,967.00 which includes the cost of the new blower, labor to install it, necessary electrical work, and management and oversight by Veolia. The City Engineer has reviewed the TA and believes the pricing to be reasonable and appropriate for approval.
It is recommended that the total authorized amount should include a 10% contingency in the event that unforeseen circumstances arise that would require a change order. The City Engineer should have discretion to approve such change orders as necessary. The total cost would then be $43,963.00.
FINANCIAL IMPACT:
No general funds are proposed to be allocated to this effort. The proposal is to allocate $43,963.00 in discretionary sewer funds to be approved to pay for this project. The finance department has indicated that this fund has sufficient resources to pay for this project, and that a budget amendment will be included at a later date.
RECOMMENDATION:
Staff recommends the following:
1) Approval of allocating up to $43,963.00 from the sewer fund to pay for the replacement of the blower.
2) Authorize Veolia to proceed with this project and to act on the behalf of the City as necessary to complete the project.
3) Authorize the City Manager or his designee to sign the task order between Veolia and the City of Arvin.
4) Authorize the City Engineer to approve change orders up to the 10% contingency limit of $43,963.00 after which point additional funds would need to be approved by the City Council.

CITY OF ARVIN
Staff Report
Meeting Date: February 08, 2022
TO: Arvin City Council
FROM: Jeff Jones, Interim City Manager / Finance Director SUBJECT: AN ORDINANCE OF THE CITY OF ARVIN AMENDING ARTICLE 8, BY ADDING AND ENACTING CHAPTER 8.33 – PUBLIC CAMPING, OF THE
ARVIN MUNICIPAL CODE
BACKGROUND:
On April 1, 2019, the Ninth Circuit Court of Appeals issued a decision in the case of Martin v.
City of Boise (Boise). This case involved multiple homeless individuals who had been cited for camping on public property or sleeping in public buildings or places, in violation of the city's ordinance. The court concluded that it is a violation of the Eighth Amendment, which prohibits cruel and unusual punishment, for a municipality to criminalize the act of sleeping outside where no sleeping space is practically available in any shelter. As a result, ordinances completely prohibiting the act of sleeping on public property when an individual has no other option have been deemed unconstitutional, as are those that ban camping in public where there is not a clear distinction between the act of simply sleeping and the act of camping. The United Supreme Court declined to hear the case in December 2019, making the Ninth Circuit’s opinion controlling law.
The City currently has no ordinance related to sleeping and or/public camping, or the prohibition of encampments. Staff proposes that the City Council adopt the attached ordinance to enact the applicable sections of the Arvin Municipal Code. First reading of the Ordinance was held at the City Council Meeting of January 25, 2022.
ANALYSIS
Although the Boise decision limited how municipalities may regulate their own property as it relates to sleeping in public, the decision does not amount to a total ban on a city's right to regulate the acts of camping or sleeping in public. As noted in the concurring opinion, “[o]n the merits, the opinion holds only that municipal ordinances that criminalize sleeping, sitting, or lying in all public spaces, when no alternative sleeping space is available, violate the Eighth Amendment." The opinion does not require cities to allow camping or sleeping at any time and in every publiclyowned location.
The proposed City Code prohibits both camping and storing property on public or private property, absent an exception, while allowing the act of sleeping, on public property, if no shelter is available.
Additionally, the City may abate unlawful encampments with 24 hours’ notice under the proposed ordinance, thereby minimizing risks to public health and safety and adverse impacts to protected habitat and other open spaces. Furthermore, the ordinance contains detailed provisions pertaining

STAFF RECOMMENDATION
Staff recommends that the City Council adopt an ordinance amending Title 8 of the Arvin Municipal Code through the enactment of Chapter 8.33 relating to camping, sleeping. and storage of personal property in a public and private property.
Staff recommends the City Council open the public hearing, receive public testimony, waive the second reading of the ordinance text in its entirety, read by title only, and adopt the Ordinance Amending Article 8, By Adding and Enacting Chapter 8.33 – Public Camping, of the Arvin Municipal Code.
FISCAL IMPACT
There is a minimal fiscal impact associated with modification of the Ordinances. Other than staff and attorney time, the ordinance will have minimal financial impact.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARVIN AMENDING ARTICLE 8, BY ADDING AND ENACTING
CHAPTER 8.33 – PUBLIC CAMPING, OF THE ARVIN MUNICIPAL
CODE
Section 1. Recitals.
WHEREAS, Adoption of this Ordinance will provide uniform and comprehensive regulations and standards related to Public Camping within the Arvin Municipal Code.
WHEREAS, Adoption of this Ordinance is in furtherance of the City’s goals and objectives while reducing the potentially negative impacts arising from incompatible Municipal Code Chapters.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ARVIN DOES ORDAIN AS FOLLOWS:
Section 2. Chapter 8.33 of the Arvin Municipal Code is hereby adopted to read as follows:
ARTICLE 8 – HEALTH AND SAFETY
Chapter 8.33 – Public Camping
Section 8.33.010 – Purpose.
The streets and public areas within the city should be readily accessible and available to residents and the public at large. The use of these areas for camping purposes or storage of personal property interferes with the rights of others to use the areas for which they were intended. Such activity can constitute a public health and safety hazard which adversely impacts neighborhoods and commercial areas. Camping on private property without the consent of the owner, proper sanitary measures and for other than a minimal duration adversely affects private property rights as well as public health, safety, and welfare of the city. The purpose of this article is to maintain streets, parks and other public and private areas within the city in a clean, sanitary and accessible condition and to adequately protect the health, safety and public welfare of the community, while recognizing that, subject to reasonable conditions, camping and camp facilities associated with special events can be beneficial to the cultural and educational climate in the city. Nothing in this article is intended to interfere with otherwise lawful and ordinary uses of public or private property.
Section 8.33.020 – Definitions.
Unless the particular provisions or the context otherwise requires, the definitions contained in this section shall govern the construction, meaning, and application of words and phrases used in this article.
