CITY OF ARVIN
Staff Report
Meeting Date: SEPTEMBER 27, 2022
TO: ARVIN CITY COUNCIL
FROM: MEGAN MILLER, HUMAN & COMMUNITY RESOURCES MANAGER

JEFF JONES, CITY MANAGER
SUBJECT: ADOPTION OF THE POLICE DISPATCH & RECORDS SUPERVISOR

CLASSIFICATION AND CORRESPONDING SALARY SCHEDULE
BACKGROUND:

The Arvin Police Department is a small agency in comparison to other similar sized cities. With that, the work and demands are not always relative to the size of the agency. The 911 calls for service trend much higher than the typical calls for service with a population size such as the City of Arvin. In the last 12 months we have worked to remedy staffing deficits in various capacities and brought on two additional Police Dispatchers. The staff increase has necessitated additional training and oversight to ensure all calls for service are handled with the utmost consideration.

In the State of CA, the Police Officer Standards and Training (POST) and other regulatory/governing agencies reporting, and compliance do not take exception to our agency size. The consistent demand for record maintenance, providing the public various records from U-visa documents, immigration reference letters, background check inquiries for other law enforcement agencies, DOJ validations just to name a few.

The job description was formed by dialog with the APD administration and the incumbent performing this role and aligning with the job classifications of Kern County and other similar roles in like size agencies.

The adoption of this classification and selection in accordance with City of Arvin Municipal Code

2.06.100 - Power of appointment and removal and Resolution 87-13 Personnel Rules, Rule IX Transfer, Promotion, Demotion, Suspension and Reinstatement - Section 2 and the City Manager shall approve final selection.

STAFF RECOMMENDATION:

Adoption of the Police Dispatch & Records Supervisor job description and corresponding salary schedule FINANCIAL IMPACT:

This hybrid role has been historically performed by a long standing APD Police Dispatcher working out of class substantiating a 5% out of class increase. The total annual impact of this classification addition is less than $8,000.

CITY OF ARVIN
Agenda Report
Meeting Date: September 27, 2022
TO: Arvin City Council
FROM: Jeff Jones, City Manager
SUBJECT: Approval of Special Event Permit for Arvin Chamber of Commerce Annual Christmas Parade and Request for Assistance from the Arvin Police Department and Public Works Division
RECOMMENDATION:

Staff recommends approval of the Arvin Chamber of Commerce’s Special Event Permit Application due to Caltrans’ requirement for authorization from the City to approve an encroachment permit, which is necessary for the parade route on State Highway 223. Staff also recommends the City Council consider waiving costs associated with this event.

BACKGROUND:

The Arvin Chamber of Commerce has submitted a Special Event Permit Application for their annual Christmas parade. The parade is scheduled for December 5, 2022 and will begin at 7:00pm. Setup for this event will begin at 5:00pm and the event is expected to conclude by 9:00pm. The parade route is Campus Drive, Bear Mountain Boulevard, Derby and Tucker Streets. The parade will be rescheduled to December 8, 2022 if it rains on December 5, 2022 and the road conditions are not suitable to hold the parade.

In the past, the City has provided an in-kind contribution of city staff time to support this event.

After reviewing the current budget, staff has determined there are sufficient funds to cover the cost of this year’s event as well.

ENVIRONMENTAL REVIEW:

Staff has conducted an assessment of this event as required by the California Environmental Quality Act (CEQA) and determined that it is categorically exempt under CEQA Guidelines section 15301(Existing Facilities) and 15323 (Normal Operations of Facilities for Public Gatherings) as there is a past history of using the existing road and sidewalk facilities for public gatherings such as parades, and the event will not involve expansion of use of these facilities beyond that currently exist. Further, none of the exceptions to the Categorical Exemptions under CEQA Guidelines section 15300.2 are applicable.

FISCAL IMPACT:

The estimated cost of city staff time is approximately $1,500, which includes $1,000 for police staff time and $500 of Public Works staff time.

CITY OF ARVIN
Staff Report
Meeting Date: September 27, 2022
TO: Arvin City Council
FROM: Cecilia Vela, City Clerk
Jeff Jones, City Manager
SUBJECT: A Public Hearing to Consider Introduction of An Ordinance of the City Council of the City of Arvin Amending the Arvin Municipal Code Sections 5.04.090 and

5.04.120; and Removing Section 5.04.100; and Sections 5.04.140 through

5.04.180 of Chapter 5.04 of Title 5 Business Taxes, Licenses and Regulations.

BACKGROUND:

City staff conducted an analysis of business license fees assessed by other Kern County cities including Tehachapi, McFarland, California City, Taft, Ridgecrest, Wasco, and Delano. The fee schedules from these cities are included as part of the agenda handouts. Some cities base their fees on annual gross receipts which in most cases result in significantly higher business license fees than those assessed by the City of Arvin, ranging between $50 to $500+ per year and some cities charge a quarterly or annual base fee or review fee ranging from $15 to $150, plus additional fees such as gross receipt fees ranging from $20 to $500+, plus an additional fee per working/hired employee, and/or an additional fee depending on the type of business.

For example, an administrative office may be charged a $15 base fee plus a $100 annual fee, plus a sales and services fee ranging from $65 to $2,000 depending on annual gross receipts. Another example, a barber/beauty shop is charged a $15 base fee, plus a $65 annual fee per barber/beautician, plus a sales and services fee ranging from $65 to $2,000 depending on annual gross receipts.

The City desires to continue its established policy of recovering the full costs reasonably borne, as established by Chapter 3.32 Fee and Services Charge Revenue/Cost Comparison System and desires to increase certain existing fees to more accurately reflect the current costs of providing such services. Several sections of Chapter 5.04 are outdated and no longer provide reasonable or feasible licensing fees and regulations.

Pursuant to Government Code Sections 66014, 66016, 66017, and 66018, the specific fees to be charged for certain regulations, services and products may be adopted by ordinance or by resolution, following notice and public hearing.

City staff proposes that business license fees, authorized under this title, are to be determined from time to time in the amount prescribed by resolution of the City Council. City staff will return with a Resolution for proposed fees for business licensing to be added to the Citywide Master Fee Schedule to be considered by the City Council at a future meeting.

BACKGROUND:

The Political Reform Act (Government Code Sections 87302, 87302.6, 87303, 87306, 87306.5, 87307, 87309, 87310, 87311, and 87314) requires each city to review its conflict of interest code biennially and notify the City Council as to whether or not the code needs to be amended. A conflict of interest code tells public officials, governmental employees, and consultants what financial interests they must disclose on their Statement of Economic Interests (Form 700). The City Council is the code reviewing body for City agencies. The completed biennial notice must be submitted to the City Council no later than October 1, 2022. An agency’s amended code is not effective until it has been approved by the City Council.

There have been changes to the City of Arvin’s organizational structure including positions that were eliminated or re-named and new positions added since the code was last approved. Staff has prepared the Ordinance that includes these changes, and it is attached to the agenda handouts for Council’s review and approval. First reading for this item was held during a public hearing at the previous City Council meeting of September 13, 2022.

STAFF RECOMMENDATION:

Staff recommends the City Council consider adopting the Ordinance to be read by title only, open the hearing, allow for public testimony, close the hearing, waive second reading of the Ordinance, and approve the adoption of the Ordinance.
