FROM: Jeff Jones, City Manager / Finance Director
SUBJECT: Approval of A Resolution of the City Council of the City of Arvin Approving Red Curb Marking for City Bus Stop Located on South Side of Varsity Road As A No Parking Zone.
BACKGROUND:
City staff have noticed a potential parking safety hazard at the bus stop located in front of Arvin High School on the south side of Varsity Road. Since there are no parking markings, drivers park in front of the bus stop to either drop off students or temporarily park to visit the high school. This prohibits the City transit buses from legally parking in front of the bus stop to load and/or unload bus passengers. This creates double parking issues and pedestrian visibility issues.
Section 10.08.040 of the Arvin Municipal Code authorizes the Chief of Police to place curb markings and signs indicating parking restrictions are in place when directed to do so by resolution of the City Council and Section 10.08.040 (A) (1) of the Arvin Municipal Code indicates that a red painted curb marking shall mean no stopping, standing or parking at any time, except as permitted by the California Vehicle Code, and except that a bus may stop in a red zone marked or signed as a bus zone.
Due to potential safety hazards, City staff recommends the Council approve the Resolution to authorize the Chief of Police to place red curb marking in front of the City bus stop located on the south side of Varsity Road between Comanche Drive and Campus Drive. This curb marking shall permit loading and unloading access to City Transit buses. This red curb marking shall depict no parking zones in efforts to increase visibility of pedestrians and to prohibit other vehicles from parking in front of the bus stop creating parking issues for City Transit buses.
STAFF RECOMMENDATION:
Staff recommends approval of the Resolution.
FINANCIAL IMPACT:
Minimal costs for red paint and staff time to paint the curb. This will be paid with the General Fund.

Staff Report
Meeting Date: January 10, 2023
TO: Arvin City Council
FROM: Christine Viterelli, Grants Manager
Jeff Jones, City Manager / Finance Director
SUBJECT: Approval of An Agreement (Non-fiscal Memorandum of Understanding) with CivicWell for Hosting Civic Spark Fellows for Fiscal Year 2022-2023 BACKGROUND:
The City of Arvin staff has been actively hosting Civic Spark fellows in partnership with CivicWell to provide additional staff capacity in both the Community Development Department and Grants Department. The City of Arvin already has a contracted Housing Accelerator fellow and a planned Environment Justice fellow who will be onboarding on January 16, 2023. The grants manager has recently been able to obtain full funding for both positions through a full sponsorship from the California Department of Housing and Community Development (HCD) and the California Energy Commission (CEC). This will result in a net saving to the City’s general fund that had allocated funds for the fellow positions. As such, staff requests approval for a new non-fiscal MOU now required by CivicWell.
STAFF RECOMMENDATION:
Staff recommends approval of the Agreement (Non-fiscal Memorandum of Understanding) with CivicWell for Hosting Civic Spark Fellows for Fiscal Year 2022-2023.
FINANCIAL IMPACT:
Provides a beneficial fiscal impact on the general fund.

CIVICSPARK FELLOWS
THIS MEMORANDUM OF UNDERSTANDING (“MOU”) is made and entered into as of January 16, 2023 (“Effective Date”) by and between the City of Arvin (“Partner”) and CivicWell (formerly, Local Government Commission), a California nonprofit public benefit corporation.
RECITALS
A. CivicWell administers the CivicSpark program, as part of the federal AmeriCorps program. The CivicSpark program provides capacity building services to -local organizations in through project implementation activities performed by CivicWell teams, CivicWell staff and CivicSpark Fellows (“Fellows”). Fellows can only work on contracted and allowable service activities. CivicSpark will provide this service to local organizations by conducting assessments, implementing planning or action projects, engaging volunteers, and transferring knowledge to Partner staff.
B. Partner desires to engage CivicWell to provide certain services through the CivicSpark program and CivicWell desires to provide those services. Compensation for these services is being provided through third party funding. This document is to establish the basic guidelines and expectations between Partner and CivicWell.
C. Partner desires to be a host to 2 Fellows, and CivicWell desires to provide Fellows’ service to Partner. This document is to establish the basic guidelines and expectations between Partner and CivicWell.
D. Partner and CivicWell enter into this MOU in order to memorialize the terms of CivicWell’s performance of the services and Partner’s obligations with respect thereto.
AGREEMENT
Article I. Contracted Performance Measures and Policies
1.1 CivicWell has contracted with AmeriCorps to implement CivicSpark as an AmeriCorps program. Fellows can only work on service outlined in performance measures approved by AmeriCorps and must abide by Federal guidelines for AmeriCorps program implementation. Performance measures define how CivicSpark will provide service to local organizations by: conducting assessments; implementing planning, research or implementation projects; engaging volunteers; and transferring knowledge to local organization staff. The project scope in Article II below must align with the measures below:
(1) Capacity Building for Local Organizations – Fellows’ direct service hours should be spent building capacity for local service recipients to address their relative needs with regard to specific issues (e.g., climate, water, housing etc.). Fellows will address these needs by assisting one or more local service recipients to develop or implement projects that they would otherwise not be able to complete. Capacity building for Fellows will be delivered in three stages, including: (1) gap assessments; (2) research, planning, and implementation service projects; and (3) transition of knowledge. (2) Volunteer Engagement – All Fellows should have the opportunity to build further capacity by engaging, recruiting, and supporting volunteers. Volunteers may be engaged as either one-time volunteers (e.g., volunteers to assist for a specific event such as Earth Day or service activities) or as on-going volunteers such as interns.
4.H.2
Attachment: 202 - ArvinCivicSpark non-fiscal MOU - FINAL (Approval of an Agreement (Non-fiscal MOU) with CivicWell for Hosting Civic Spark {00022644.1} Page 2 of 10
(3) Training and Professional Development for Fellows – Fellows can spend up to 20% of their service year (340 of their 1700 total hours) on training. Training includes the 1-week orientation at the start of the service year, mid-year gathering, continued monthly trainings, and professional development and networking opportunities. Training hours ensure that Fellows have the training and tools they need to succeed in their service work and to grow as professionals.
The majority of the service provided by CivicSpark to local organizations via direct service only involves the first measure (Capacity Building). The second and third measure is predominantly met through training, service and professional development activities provided to the Fellows by CivicWell. Some activities that occur while working with local service recipients or other project partners may be considered training and professional development, such as networking events and trainings conducted by or attended in partnership with Partner.
1.2 Federal guidelines further restrict certain activities, which cannot be engaged in by CivicSpark Fellows or Supervisors while charging time to the AmeriCorps program, accumulating service or training hours, or otherwise performing activities supported by CivicSpark program or AmeriCorps, and this includes direct fundraising or grant writing which are not allowable activities in CivicSpark. In addition to only working on contracted performance measure service activities, the following activities are prohibited (see 45 CFR § 2520.65):
(1) Attempting to influence legislation;
(2) Organizing or engaging in protests, petitions, boycotts, or strikes; (3) Assisting, promoting, or deterring union organizing; (4) Impairing existing contracts for services or collective bargaining agreements; (5) Engaging in partisan political activities, or other activities designed to influence the outcome of an election to any public office;
(6) Participating in, or endorsing, events or activities that are likely to include advocacy for or against political parties, political platforms, political candidates, proposed legislation, or elected officials; (7) Engaging in religious instruction, conducting worship services, providing instruction as part of a program that includes mandatory religious instruction or worship, constructing or operating facilities devoted to religious instruction or worship, maintaining facilities primarily or inherently devoted to religious instruction or worship, or engaging in any form of religious proselytization; (8) Providing a direct benefit to—
(i) A business organized for profit;
(ii) A labor union;
(iii) A partisan political organization;
(iv) A nonprofit organization that fails to comply with the restrictions contained in section 501(c)(3) of the Internal Revenue Code of 1986 except that nothing in these provisions shall be construed to prevent participants from engaging in advocacy activities undertaken at their own initiative; and (v) An organization engaged in the religious activities described above, unless AmeriCorps assistance is not used to support those religious activities; (9) Conducting a voter registration drive or using AmeriCorps funds to conduct a voter registration drive;
(10) Providing abortion services or referrals for receipt of such services; and (11) Such other activities as AmeriCorps may prohibit.

1.3 Reasonable Accommodations: Per Federal Guidelines and CivicWell policies, the CivicSpark program and activities must follow equal opportunity employment requirements and be accessible to persons with disabilities by providing reasonable accommodation in support of this:
(1) CivicWell and Partner will comply with Equal Opportunity Employment guidelines. (2) CivicWell and Partner will endeavor to make reasonable accommodations to known physical or mental limitations of qualified AmeriCorps members with disabilities unless the accommodation would impose an undue hardship on the program operations.

(4) CivicWell and Partner will not allow any form of retaliation against individuals who raise issues of equal employment opportunity or reasonable accommodation.
1.4 Non-Duplication and Non-Displacement: Federal guidelines further restrict engagement of CivicSpark Fellows to duplicate or displace staff (see 45 CFR § 2540.100(e)-(f) 1) Nonduplication. AmeriCorps assistance may not be used to duplicate an activity that is already available in the locality of a program. And, unless the requirements of paragraph (f) of this section are met, AmeriCorps assistance will not be provided to a private nonprofit entity to conduct activities that are the same or substantially equivalent to activities provided by a State or local government agency in which such entity resides.
2) Nondisplacement.

Staff Report Presentation and Approval for Purchase of Two Police Canines for the Arvin Police Department - Jan. 10, 2023.
CITY OF ARVIN
Staff Report
Meeting Date: January 10, 2023
TO: Arvin City Council
FROM: Alex Ghazalpour, Acting Chief of Police
Jeff Jones, City Manager
SUBJECT: Presentation and Approval for Purchase of Two Police Canines, Program Startup Costs and Payment for Basic Handler Courses for the Arvin Police Department BACKGROUND:
On October 25th, 2022, City Council approved the implementation of a Police K9 Program and budget authorization for implementing the program. On December 13th, 2022, upon presentation to council for approval the item was tabled and continued with the request of looking at additional funding options to implement a program for sustainability. Prior to the approval of this program during the October 25th, 2022, council meeting staff and I had already looked for additional funding options through grant programs, asset forfeiture and potential interagency agreements. Staff wholeheartedly will continue to look for and garner such financial opportunities throughout the existence of this program within the police department.
The Arvin Police Department, as a small agency, with a high volume of calls for service, need tools to do the work with greater efficiency and effectiveness. With all additions to the Police Department, there should be a benefit to the community as well as the department. The addition of a K9 unit would provide an additional feeling of safety to the community by quicker apprehensions of criminals and better detection of illegal contraband.
A well-managed and successful Police K9 Unit can be an essential asset to a department if staffed and used strategically. Police K9’s assist with reducing Officer’s time in the searching for suspects, narcotics, explosives, or weapons. A Police K9 has been shown to reduce the need and incidents precipitating uses of force.
A K9 unit for a police department is a specialized unit that assist patrol. Specialized units, like K9, within a police department provide opportunities for established officers to diversify their career beyond patrol duties. For a smaller department like Arvin Police Department adding specialized units can aid in retention of experienced Police Officers and attract high caliber recruits.
RETENTION:
The City of Arvin Police Department has experienced consistent change and turn over in the staffing. In the last 12 months, we have lost four talented officers to larger agencies and several looking outside for more opportunity.
5.B.1
Attachment: Staff Report Police Canine_011023 (Approval for Purchase of APD Canines)
Staff Report Presentation and Approval for Purchase of Two Police Canines for the Arvin Police Department - Jan. 10, 2023.
In doing some assessments of what we can do to prevent this turnover within the police department while also enhancing public safety, implementing specialized units within the Arvin Police Department will help. The first is the Police K9 Unit. This program will be spearheaded by one of our own that has extensive experience and knowledge in this arena. Sergeant Bret Barker has spent much of his life surrounded by Police Service dogs and will offer so much to our department in leading this charge.
The time frame to bring on officers is typically 3 months or longer due to the three-phase hiring and background duration. Additionally, each new officer costs the city in upwards of $20,000.00 per officer for training, equipment, FTO, backgrounds, etc. The new standards of California POST and the guidelines set forth by City administration also adds a layer of additional vetting to ensure our officers being brought on board have the appropriate experience, background, and share our key values of not only upholding the law but doing it with community policing and empathy at the paramount in their profession.
K9 DEPLOYMENT EFFECTIVENESS:
Handlers typically deploy their K9 partners in a variety of situations such as, vehicle searches for narcotics, area searches and where a violent suspect is fighting with or fleeing from officers.
They are also utilized to locate suspects who may be hiding in heavy vegetation, debris or inside buildings. The K9’s speed, agility and heightened sense of smell make them a powerful tool in locating and apprehending dangerous criminals.
The approval and adoption of this program will allow us to retain officers, make the APD a more desirable agency to work for as the K9 handler position is a highly sought after and coveted position in all agencies, and add a layer of protection to the officers and apprehend subjects in a highly effective and safer way.
Studies have found that the mere presence of a K9 can resolve most conflicts.
STAFF RECOMMENDATION:
Staff from the Arvin Police Department have met with vendors for police dog procurement and training. The vendors visited were Gold Coast K9 in Ventura, California and Adlerhorst International in Jurupa Valley, California. After the visits, staff reviewed service proposals, and received quotes for the purchase of police canines, and cost for initial handler courses and certifications.
Staff is recommending the City Council authorize the City Manager to purchase two (2) police canines and payment for each Basic Handler’s course from Adlerhorst International of Jurupa Valley.
Adlerhorst International has been in business since 1976 and has supplied police service dogs to more than 500 law enforcement agencies throughout the world. Adlerhorst International provides the option of purchasing a titled dog that has proven experience and more flexible pricing options for the initial certifying courses. Adlerhorst International is currently under contract with other agencies in Kern County, including the Kern County Sheriff’s Department. With the working relationship in place already, this will help solidify a cooperative between local police canine teams in times of critical incidents and in terms of training and support. The opportunity

for joint training is also possible, thereby lowering costs for maintenance training, and travel expenses.
A well-managed and successful Police K9 Unit will be an essential asset to our department if staffed and used strategically. Arvin Police K9’s will assist with reducing Officer’s time in the searching for suspects, narcotics, explosives, or weapons. A Police K9 has been shown to reduce the need and incidents precipitating uses of force. Therefore, careful selection and recommendation coupled with a previous working relationship makes the recommendation to use Adlerhorst International the appropriate vendor for our program.
FINANCIAL IMPACT:
As this program is currently an unbudgeted general fund expense it is the intent of staff to aggressively pursue grant funding opportunities. As mentioned earlier in this staff report additional funding sources, partnerships, program donations, interagency agreements from the city, state and the federal level and asset forfeiture funds will be placed in a K9 coffer for program sustainability, growth, and future expenditures.
The cost of each dog will be $20,200.00 which is inclusive of the Basic police K-9 Handler’s course. Internal Police Staff who are certified, knowledgeable, and deemed an expert in the field of K9 narcotics detection will conduct the narcotics detection training in-house therefore offsetting and saving the police department for a savings of $11,400.00. We will see additional savings as well due to not having to pay for travel and per diem expenses for that course. The cost breakdown is attached to this report.
The total, approved by the City Council, for the purchase, training, equipment, and certifications to establish the Arvin Police K9 Unit is $86,000, not including monthly maintenance training and veterinary care.

Proposal for Police Service Dog and Training
Thank you for your interest in Adlerhorst International LLC. We are a family owned business situated on 7½ acres in Western Riverside County, California.
Our principal owner/operators are Dave & Pip Reaver and Michael & Veronique Reaver.
Since 1976, we have provided quality Police Service Dogs to over 500 law enforcement agencies in the United States and several foreign countries. We have evolved into being one of the largest private Police Dog Schools in the world. During this era, we have introduced many theories and techniques that are considered industry standard.
Instructor Staff
We offer an optimal combination of law enforcement and canine experience. All our staff has a minimum of 10 years’ experience training police service dogs. Additionally, we have a continual training program for new instructors. Three of our instructors are former police canine supervisors and four are former handlers with law enforcement agencies. Our instructors are certified California P.O.S.T. evaluators, as well community college instructors.
Our training director, Michael Reaver, has over 45 years’ experience both in the United States and in Europe training dogs; 35 of those years are police service dog training. He has a Lifetime Teaching Credential from the State of California with a specialty in Police Science

Attachment: Vendor Adlerhorst - K9 Proposal (Approval for Purchase of APD Canines) Service Dog Procurement
We are the innovators of procuring dogs with a strong genetic as well as a working background. From inception, we purchased dogs with a European working title, hips, backs and elbows x-rayed and a vet check done personally in Europe prior to shipping.
We have a vehicle in Europe capable of transporting 17 dogs, as well as a trailer for an additional 10. We lease kennel facilities in Holland capable of holding 40 dogs.
Procurement trips are made every 6 weeks. Each dog is tested comprehensively by Michael Reaver. All European titled dogs are not equal. Our testing process is conducted on neutral turf, often in a building. Many European handlers / trainers consider our testing process the most comprehensive they have observed. The techniques and testing standards we introduced over the years have caused many European agencies to reassess their testing and procurement policies.
Because of our procurement methods, all our dogs are guaranteed against all congenital issues for 12 months, and performance guaranty for 12 months if handler and dog are being trained by Adlerhorst. 6-month performance guaranty for Agencies conducting their own basic handler courses. (No money refund) Training
• All our classes are community college credit classes sponsored by Santa Ana Community College.
• Currently we are the only presenter of a 24-hour California P.O.S.T. certified recertification class. • Our 240-hour basic patrol class is based on a comprehensive published standard. The program has been tested 50+ times in court with a 100% success rate! Graduate teams are guaranteed to meet any required National or International standard.
• Our detection classes include narcotics, explosive, arson and cadaver training.
All licenses are in place from DEA and ATF, as well as a CHP license to transport explosives.
• We offer a 16-hour agitator class that not only teaches proper techniques but behavior theories as well. A limited advanced agitator class is available also. • Additionally, we offer a monthly maintenance program either on site in Riverside or off site as required. Currently we train in multiple areas in California, as well as Arizona, New Mexico and Texas. An informational brochure describing this service is on our web site.

• Currently the Arvin Police Department has a high
number of calls for service with just a few Officers
each shift. • Of those calls there are burglary calls, domestic disturbance calls, missing persons calls, and violent
crimes. • Arvin Police Department is experiencing an issue recruiting and retaining top candidates as there are
no specialized units to provide additional
opportunities to Officers as they gain experience.

BENEFITS
• Community safety by quick apprehension
of criminals and use in locating and seizing
illegal contraband through K9 detection • K9 unit supports a higher level of officer safety due to saving critical time during
searches, reduces resistance during
apprehensions thereby protecting Officers
from unnecessary injury gaining compliance. • One dog team can save a department over 700-man hours a year in looking for
contraband, and people. • Increase effectiveness of Officers by reducing use of force incidents. Studies have
found that the mere presence of a K9 can
resolve most conflicts.
5.B.5
Attachment: Arvin Police K9 Powerpoint (Approval for Purchase of APD Canines) COST
• A K9 Unit has more than just an initial
cost of the dog and basic training for the
team. A department will need to provide
food, veterinary care, maintenance training,
and handler per diem. • The dog can cost $10,000 to $15,000 • Initial training and certification of the Officer and the dog is $11,500 to $15,000 • Monthly maintenance training per year $3,500 - $18,000
• Initial cost to convert a patrol vehicle to
a K9 unit - $7,000
• Annual cost of food will be $700 -
$1,000. • Veterinary care will include an initial
health screening, annual vaccinations, teeth
cleanings, and care for any injuries. It can
average $300 - $500 annually.

COMMON BREEDS
• The most common breeds for police service dogs are
the Dutch Shepherd, the German Shepherd, and the
Malinois. • These breeds have proven to be the most consistent and reliable for detection and apprehension work. • Most police dogs are imported from Europe and selected from breeders specializing in this temperament of dog. • Police dogs will generally start their career around 1 1/2 - 3 years old.

SEARCHES, APPREHENSION, AND
DETECTION
• The K9 unit typically responds to the scene for
searches for people or contraband. • They are used to search vehicles, buildings, and large areas like fields. • A K9 unit will generally respond to alarm calls as the swiftness that a trained K9 can search a
building is faster and safer than an Officer
searching. • Studies have found that the mere presence of a K9 unit at the scene of a disturbance will resolve
most conflicts.

CITY OF ARVIN
Staff Report
Meeting Date: January 10, 2023
TO: Arvin City Council
FROM: Jeff Jones, City Manager / Finance Director
SUBJECT: A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SUCCESSOR AGENCY TO THE DISSOLVED ARVIN COMMUNITY
REDEVELOPMENT AGENCY, APPROVING AND ADOPTING A RECOGNIZED OBLIGATION PAYMENT SCHEDULE COVERING THE PERIOD OF JULY 1, 2023 THROUGH JUNE 30, 2024, PURSUANT TO HEALTH AND SAFETY CODE SECTION 34177(l) AND (o).
BACKGROUND:
As part of the RDA wind down process, each successor agency is responsible for drafting a Recognized Obligations Payment Schedule (ROPS) delineating the enforceable obligations of the former RDA and their source of payment every year. ROPS are subject to the approval of the local oversight board.
In the past, the ROPS were presented every six months. The State of California has changed the reporting period to be an annual report. In compliance with this requirement, Staff has prepared ROPS 23-24 for the Period July 01, 2023 to June 30, 2024 which is due to the Department of Finance (DOF) by February 1, 2023. Attached is the ROPS that Staff is recommending for submittal. This list includes all obligations that have been identified and the amounts requested for payment in this cycle. Items are listed under the RPTTF column for Admin or Non Admin obligations. “RPTTF” stands for Redevelopment Property Tax Trust Fund. These are the revenues collected through the property taxes. These funds must be used first to meet debt obligations and any remaining obligations may be funded with the RPTTF.
The rows highlighted in red on the “Obligation Payment Schedule” are items that have been denied in previous ROPS requests. Staff has kept them on the ROPS schedule in order to keep them active and give the City an opportunity to revisit these requests in future submissions. The main item identified for payment during this cycle will be the funds to meet bond obligations for a principal and interest payment in March and September. In addition to the bond principal and interest payments, a modest amount for general maintenance expenditures for the properties currently owned by the Successor Agency. The allowable amount for Administrative Costs is estimated to be $175,000 and will be included on this schedule. This amount is below the ‘minimum amount’ of $250,000 which is authorized per ROPS guidelines and State law. Staff has determined that $175,000 is sufficient to support all administrative costs of the Successor Agency. Administrative costs include staff time, appraisals of property owned by the Successor Agency, City Attorney expense, and other consultant costs.
6.A.1
Attachment: ROPS 23.24 SR (Approval of ROPS 23/24)
In prior years, and most recently in 2014, the total available RPTTF through property taxes was less than the amounts being requested on the ROPS. Should this situation happen during FY 23- 24, the obligations that cannot be funded in this cycle will be carried over into the next ROPS cycle, and the City will be asked to provide a short-term loan to the Successor Agency to cover the shortfall.
Once the ROPS is approved by the Successor Agency, it will be submitted to the Kern County Oversight Board for approval and then to the DOF, Kern County Auditor Controller and the State Controller’s Office for review and approval.
RECOMMENDATION:
Staff recommends that the Successor Agency Board approve the ROPS 23-24 for the period of July 01, 2023 to June 30, 2024 and authorize staff to submit this also to the Kern County Oversight Board for approval.
FISCAL IMPACT:
None. There is cost recovery for staff time which City staff spends on Successor Agency business. Such cost recovery is paid via an administrative allowance that the City requests on the ROPS.
