Arvin Power Company business case
Our plan reduces the cost of electricity in Arvin from the August 2023 PG&E projected $0.40 cents per kWh price to APC’s price of $0.19 cents per kWh, providing the Arvin consumer an average savings in excess of 50%.

The rate of $0.19 per kWh is fixed for a term of 25 years. An inflation escalation of maximum 2% term per year is required.

The solar farm project is estimated to cost $85 million to build.

The City of Arvin’s current franchise fee to PG&E is approximately $225,000 per year. verify
APC is offering an annual franchise fee of $400,000.00 to the City of Arvin.

It is expected to generate revenue to Arvin City yearly income received from PG&E $225,000 up to $400,000 a year once it is operational. Franchise fee … compensate Power Line Infrastructure
The existing electrical power line infrastructure will be leased from PG&E. Some APC improvements and extensions will be required to include some potential roadway improvements for Buena Vista Road. All best efforts will be made to have power lines installed underground.

The exact cost of leasing power lines from PG&E, which are typically averaged, is yet to be determined.

The Letter of Intent (LOI) with the city of Arvin needs to be completed before the agreement for power lines leases can be executed.

This project plan recommends that LahavGE pursue the construction of a solar farm to facilitate options for electrical power for the people of Arvin over PG&E.

The city will provide and transfer to APC the advantage of Tax Credits, Federal-State incentives, and subsidies available to reduce the cost of the project.

The people of the city of ARVIN consume collectively an estimated 105,709 MWh annually.

Power Price / kWh fee
105,709 MWh $.38 kWh $ 39,900,000.00
105,709 MWh $.19 kWh $ 19,950,000.00
To produce and offset this electricity with solar panels, an installation of up to 50 MW would be required. MW = Megawatts
Two hundred acres would be required for a solar installation of this size.

Phase 1
The project proposes to install a solar array of up to 50 MW to support the electricity needs of the ARVIN residents, and individuals from the immediate surrounding areas.

Phase 2
An Additional 200 acres for an additional 50 MW of power is available for the growing needs of the people of Arvin and its neighboring communities.

There are 40 acres of Garcia Family Trust land available for Agrovoltaics within the city limits. In this model, people will live and grow produce beneath the same panels that generate power for their homes and food garden energy needs.

This will be the nexus of a sustainable farm to table community in Arvin. This innovative approach to power generation will help alleviate food scarcity concerns of impoverished communities, making the city of Arvin a pioneering community of energy independence and a more desirable place to live.

Agrivoltaics is the use of land for both agriculture and solar photovoltaic energy generation.

It's also sometimes referred to as agrisolar, dual use solar, low impact solar.

Solar grazing is a variation where livestock graze in and around solar panels.

Career and Employment Opportunities
Construction and Solar installers
APC has met and conferred with Dave Teasdale of Bakersfield College (BC). APC will make all best efforts to hire staff that are licentiates of BC’s Field solar installation program, with an emphasis on Arvin resident graduates. More specific APC training will be conducted once staff is hired.

Marketing and Client acquisition plan
LahavGE has been working with cities, communities, businesses and governmental agencies in southern California to pursue the development and construction of renewable energy / energy storage systems with fuel cell generators to meet their ongoing energy needs.

This costs will include of the solar panels and other related equipment, Backup batteries
Fuel Cell Generators
Sun Tracking Equipment
the cost of labor of installation
the cost of any necessary permits, and any other associated costs.

The Garcia Landowners with control of nearly 800 acres have signed an initial Phase 1 200 acres LOI
OPhase 2 with Prosun Solar
indicating their willingness to sell or lease the rest of the property for development of this solar / storage / Fuel Cell project.

LahavGE / Prosun now needs to perform due diligence on the properties that have been secured, have a grid interconnection study performed if needed, a Micro- Utility study for Garcia Land and assist the City of ARVIN and APC with the formation of the new municipal utility district, as allowed under California state statutes, and comply with California state regulatory filings and permit requirements.

Prosun Solar has identified technology, construction, accounting, and legal firms in California that will be able to assist with the full project effort.

Provided funding will initially be used to begin the due diligence process, and complete initial project design.

Financial Considerations
The project has an overall estimated cost for the “Proof of Concept” of 50MW at $85 million.

Project IRR with full utilization of tax offsets is projected up to 12%.

Then, the amount of electricity generated by the solar farm must be taken into consideration to estimate the potential revenue the solar farm will generate.

This revenue can be generated through selling the electricity to Arvin City or other businesses, or through selling renewable energy credits.

Finally, the operating costs of the solar farm, such as maintenance and repairs, must be taken into account when calculating the net profit and loss of the project. With all of these factors considered, a net profit or loss can be determined for the project.

As a result of that effort, we have an immediate opportunity to provide baseload renewable energy from the Garcia Land in ARVIN and APC municipal utility district that will be created for the benefits of the City of ARVIN in KERN County, California.

The Garcia Family Land Trust will sign an LOI with APC and LahavGE, indicating that they are prepared to form a new municipal Micro-utility district which will sell electricity to the entities within the boundary of the district which residents will purchase under a Power Purchase Agreement PPA with Prosun Solar.
- California state law allows local units of government the right to form a municipal utility district and electricity to all consumers in the district without an RFP (See attached letter in Powerpoint presentation).
- The district can buy energy and resell it to local consumers. - A new municipal utility district in KERN County, to be created by the City of ARVIN, could be the buyer of the electricity under a 25-year power purchase agreement.
- The electricity from the solar/storage project could be sold to the municipal utility district at a rate of – Nineteen (0.19) cents per kWh.

CITY OF ARVIN
Staff Report
Date: August 08, 2023
TO: Arvin City Council
FROM: Nori Sanchez, Building Official
Jeff Jones, City Manager
SUBJECT: Consideration and Direction from Council Regarding Request for Waiver of Work Without City Permit Fee from Cana Rose Realty Holdings, LLC.

BACKGROUND:

On or before April 14, 2020, Cana Rose Realty Holdings, LLC (formerly JCM Realty Holdings, LLC) was issued a “stop work” order and assessed a fee of $8,597.12 from the former City of Arvin Building Official for commencing work prior to obtaining permits from the City at 901 Potato Rd, Arvin.

The City of Arvin received the attached request for waiver of permit fee from Cana Rose, dated July 13, 2023. Cana Rose states they were erroneously fined a permit fee for a construction project that had not yet commenced. They believe there was a misunderstanding due to miscommunication between the City and their team, leading to the mistaken belief that construction had begun.

The purpose of this staff report is to provide the Council with the necessary information and recommend that the Council consider the request outlined in the attached letter and provide direction to staff accordingly.

Attached is a copy of the letter from Cana Rose along with a copy of the receipt of fees for your review.

STAFF RECOMMENDATION:

Staff requests that the City Council review the attached letter from Cana Rose Realty Holdings, LLC and provide direction to staff regarding the appropriate course of action. The options available include waiving the fee in its entirety, partially waiving the fee, or maintaining the fee as originally assessed. The City Council’s guidance will enable staff to promptly address this matter and provide a resolution to Cana Rose.

FINANCIAL IMPACT:

The fee assessed for working without a permit is $8,597.12.

Subject: Request for Waiver of Permit Fee ($8,597.12)
Dear Jeffrey Jones and City Council Members,
I hope this letter finds you in good health and high spirits. I’m writing to address a situation that transpired involving a permit fee, which I believe we are not liable to pay. I kindly request your assistance in resolving this matter.

On our about 2019, our company at the time, JCM Realty Holdings, LLC, was erroneously fined a permit fee by the City for a construction project that had not yet commenced. This misunderstanding arose due to miscommunication between the City and our team, leading to the mistaken belief that construction had already begun.

When the issue was first brought to the attention of the City Manager, Mr. Jerry Breckinridge, they acknowledged the mistake and expressed their willingness to waive the permit fee. However, we were later informed that only the City Council has the authority to waive such fees.

Given the circumstances, we respectfully request that the City Council consider our plea for the waiver of the permit fee. We firmly believe that we should not be held accountable for a fee imposed in a miscommunication, especially considering that construction had not yet commenced at the time of the fee was imposed. In addition, after the misunderstanding the city agreed that it was a miscommunication.

Our company has always been committed to maintaining a positive and cooperative relationship with the City. We have in good faith, to the best of our ability, adhered to all regulations and requirements in the past and will continue to do so in the future. We place great value on the mutual trust and collaboration between our organization and the City of Arvin.
