SUBJECT: Consideration and Adoption of a Resolution of the City Council of the City of Arvin, CA, Updating the City of Arvin’s Transit Title VI Compliance Program (2023)

The 2023 Transit Title VI Compliance Program is essentially identical to the 2020 version. This is now before the City Council for approval.

FISCAL IMPACTS
There will be no fiscal impact to the General Fund. All expenses, printing and translating costs will be paid from the Arvin Transit Division fund.

TITLE VI PROGRAM
FISCAL YEARS 2023-2024 to 2025-2026
Reference: FTA Circular 4702.1B Title VI Requirements and Guidelines for Federal Transit Administration (FTA) Recipients (October 1, 2012).

INTRODUCTION
The purpose of this Title VI Program is to establish guidelines to effectively monitor and ensure that the City of Arvin transit services (“ArvinTrans”) are in compliance with FTA Title VI requirements.

Title VI states that “no person in the United States shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.” The FTA is required to ensure that federally supported transit services and related benefits are provided consistent with Title VI. The Title VI Program requires an update every three years.

The City of Arvin (ArvinTrans) will ensure that its programs, policies, and activities comply with Department of Transportation’s (DOT) Title VI Regulations (49 CFR Part 21) and with Limited English Proficient (LEP) Persons requirements (70 FR 74087, December 14, 2005). The City of Arvin is committed to creating and maintaining a public transportation system that is free of all forms of discrimination. The City of Arvin will take necessary preventive corrective and disciplinary actions to stem behavior that violates this policy or the rights and privileges it is designed to protect. FTA requires recipients to document compliance with DOT Title VI regulations by submitting a Title VI Program once every three years.

City of Arvin - Title VI Policy Statement
The City of Arvin is committed to ensuring that
no person is excluded from participation in or denied the benefits of its services on the basis of race, color, or national origin, as provided by Title VI of the Civil Rights Act of 1964, as amended.

3.D.3
Attachment: TITLE VI Program (003) (City of Arvin 2023 Transit Title VI Compliance Program)

ENVIRONMENTAL JUSTICE REQUIREMENTS
The City of Arvin shall integrate an environmental justice analysis into its National Environmental Protection Act (NEPA) documentation of construction projects. The City of Arvin is not required to conduct environmental justice analyses of projects where NEPA documentation is not required.

City of Arvin will consider preparing an environmental assessment (EA) or environmental impact statement (EIS) to integrate into its documents the following components when performing construction projects:
• A description of the low-income and minority population within the study area affected by the project, and a discussion of the method used to identify this; • Population (e.g., analysis of Census data, direct observation, or a public involvement process);
• A discussion of all adverse effects of the project both during and after construction that would affect the identified minority and low-income populations; • A discussion of all positive effects of the project that would affect the identified minority and low-income populations, such as improvements in transit service, mobility, or accessibility;
• A description of all mitigation and environmental enhancement actions incorporated into the project to address the adverse effects, including, but not limited to, any special features of the relocation program that go beyond the requirements of the Uniform Relocation Act and address adverse community effects such as separation or cohesion issues; and the replacement of the community resources destroyed by the project; • A discussion of the remaining effects, if any, and why further mitigation is not proposed; • For projects that traverse predominantly minority and low-income and predominantly nonminority and non-low-income areas, a comparison of mitigation and environmental enhancement actions that affect predominantly low-income and minority areas with mitigation implemented in predominantly non-minority or non-low-income areas.

In addition, the State of California through the California Environmental Quality Act (CEQA), is a statute that requires state and local agencies to identify the significant environmental impacts of their actions and to avoid or mitigate those impacts, if feasible. When NEPA documents are prepared, the City will also comply with CEQA regulations.

EXHIBIT E

CITY OF ARVIN

LIMITED ENGLISH PROFICIENCY (LEP) PLAN
Introduction
This Limited English Proficiency (LEP) Plan has been prepared to address the City of Arvin’s responsibilities as a recipient of federal financial assistance as they relate to the needs of individuals with limited English language skills. The Plan has been prepared in accordance with Title VI of the Civil Rights Act of 1964, Federal Transit Administration Circular 4702.1A dated May 13, 2007, which state that no person shall be subjected to discrimination on the basis of race, color, or national origin.

Executive Order 13166, titled Improving Access to services for Persons with Limited English Proficiency, indicates that differing treatment based upon a person’s inability to speak, read, write, or understand English is a type of national origin discrimination. It directs each federal agency to publish guidance for its respective recipients clarifying their obligation to ensure that such discrimination does not take place. This order applies to all State and local agencies which receive federal funds, including City departments receiving federal grant funds.

Background
The City of Arvin directly administers transit services. The Arvin City Council is the policymaking body for the transit system.

Transit services consist of a fixed route and demand response service. Transit generally operates from Monday to Friday.

The City of Arvin has developed this LEP Plan to help identify reasonable steps for providing language assistance to persons with limited English proficiency who wish to access services provided by the City. As defined by Executive Order 13166, LEP persons are those who do not speak English as their primary language and have limited ability to read, speak, write, or understand English.

This plan outlines how to identify a person who may need language assistance, the ways in which assistance may be provided, and how to notify LEP persons that assistance is available. In order to prepare this plan, the City of Arvin undertook the U.S. Department of Transportation four-factor LEP analysis which considers the following factors:

1. The number or proportion of LEP persons in the service area who may be served or are likely to encounter the transit activities or services.

2. The frequency with which LEP persons come in contact with transit activities or services.

3.D.3
Attachment: TITLE VI Program (003) (City of Arvin 2023 Transit Title VI Compliance Program)

3. The nature and importance of programs, activities, or services provided by the City to the LEP population.

4. The interpretation services available to City ArvinTrans passengers and overall cost to provide LEP assistance.

A summary of the results of ArvinTrans four-factor analysis is reflected in the following section.

Meaningful Access: Four-Factor Analysis

1. The number or proportion of LEP persons in the service area who may be served or are likely to encounter the City of Arvin’s transit activities, or services.

The 2020 United States Census reported that Arvin had a population of 19,498 The population density was 3,979 people per square mile. The racial makeup of Arvin was 61.4% White, .4% African American, .6% Native American, 1.1% Asian, 0% Pacific Islander, 23.4% from other races, and 13% from two or more races. Hispanic or Latino of any race were 95.7%.

Of its 19,568 total residents, the City has 87.8% that speak other languages than English. People of Spanish descent are the primary LEP persons likely to be involved with the City programs and transit services. For the City, California place, the American Community Survey of the U.S.

Census Bureau (2014-2018) shows that among the area’s population, 10% speak English as a first language or “very well” as a second language. For groups who speak English “less than very well", "not well" and/or "not at all", 95 % are Hispanic, and 5% percent of the City’s population is limited English speaking persons of varied descent.

2. The frequency with which LEP come in contact with ArvinTrans transit services.

ArvinTrans staff reviewed the frequency with which the Transit Manager and staff could have contact with LEP persons. To date, the City of Arvin has had 0 requests for interpreters and 0 requests for translated transit program documents. This is a result as all documentation being provided in English and Spanish. Should requests for interpretation come, the City will use certified translators on staff or the use of NextTalk to provide the interpretation.

Bus operators are in regular contact with LEP persons on ArvinTrans transit services of which the majority is Spanish. All transit information is available in alternative languages. City of Arvin staff have Spanish proficiency or access to Spanish speaking staff at all times as well as the use of NexTalk.

3. The nature and importance of programs, activities, or services provided by the ArvinTrans transit services to the LEP population.

4. The resources available to ArvinTrans and overall cost to provide LEP assistance.

3.D.3
Attachment: TITLE VI Program (003) (City of Arvin 2023 Transit Title VI Compliance Program) City of Arvin Transit Manager has access to a variety of services and resources that can help in outreaching and providing LEP assistance at low or no cost. Community and regionally based resources include:
• Arvin Senior Lunch Program
• Kern County Social Services Agencies
The above resources will be used on a regular basis or as needed to assist in identifying the needs of the City of Arvin LEP population. They will also serve as a means to widely disseminate bilingual transit service information and announcements and to notify the LEP population of planned workshops and outreach efforts.

Based on the four-factor analysis, the City of Arvin will develop its LEP Plan as outlined in the following section.

Identification of LEP Population
The City of Arvin has developed several possible ways to assist in identifying LEP populations within the City, including:

1. Examine records to see if requests for language assistance have been received in the past, either at meetings or over the phone, to determine whether language assistance might be needed at future events or meetings.

2. Have a staff person greet participants as they arrive to City sponsored transit events or other community events where ArvinTrans has a presence. By informally engaging participants in conversation, it is possible to gauge each attendee’s ability to speak and understand English.

3. Survey vehicle operators and other front-line staff, such as ArvinTrans bus operators, on their experience concerning any contacts with LEP persons.

4. Network with local social and human services organizations to assist in identifying LEP groups and individuals most in need of LEP assistance and to further facilitate dissemination of information about the ArvinTrans transit services.

Language Assistance Measures
There are plans for several language assistance options available to LEP persons, including both oral and written language services. There are also various ways in which transit staff can respond to LEP persons, whether in person, by telephone, or in writing. • Provide a bilingual transit representative at community events and public hearings. • Placement of statements in notices and publications that interpreter services are available for these meetings.

3.D.3
Attachment: TITLE VI Program (003) (City of Arvin 2023 Transit Title VI Compliance Program) • Survey bus operators, dispatchers, and other front-line staff on their experience concerning any contacts with LEP persons during the previous year. • Post City of Arvin Title VI Policy and LEP plan on the City’s website, www.Arvin.org. • When an interpreter is needed, for a language other than Spanish, in person or on the telephone, staff will attempt to access language assistance services from a professional translation service or qualified community volunteers.

Outreach Techniques
When staff prepares a document or schedules a meeting, for which the target audience is expected to include LEP individuals, documents, meeting notices, flyers, and agendas will be printed in an alternative language based on the known LEP population. Interpreters will be available as needed.

The City of Arvin currently uses a variety of outreach approaches, as described below.

Public Outreach Activities
The City of Arvin website posts transit information at www.Arvin.org. The City provides easy access to bilingual (English and Spanish) administrative staff and bus operators during operating hours to answer questions during their regular shift schedules for those LEP passengers who use the ArvinTrans transit services.

The City of Arvin reaches out to the community directly through meetings with agency and community staff and their clients, as needed. Information regarding the ArvinTranstransit services is disseminated at these meetings, including schedules and appropriate fliers. Transit information also is made available at a variety of locations throughout the community and on ArvinTrans buses.

Public Meetings
The City of Arvin conducts and participates in transit meetings that are open to the general public.

The City of Arvin collaborates with the KernCOG, and other agencies regarding public meetings relating to public transit services.

Participation in Community Activities
The City staff uses a number of public outreach techniques, including the following:

Public Meetings & Workshops

Any person or agency with internet access will be able to access and download the plan from the City of Arvin’s website. Alternatively, any person or agency may request a copy of the plan via telephone, fax, mail, or in person. LEP individuals may request copies of the plan in translation which the City of Arvin will provide, if feasible.

Questions or comments regarding the LEP Plan may be submitted to City of Arvin’s Transit Manager:
• City of Arvin, Attn: Transit Manager, 200 Campus Drive, Arvin, CA 95203, call to: 661- 854-3134 or email to: [email protected].

8. Minority Representation on Planning and Advisory Bodies.

The City of Arvin must describe efforts to encourage participation of minorities on committees, board, councils, or other bodies. The City of Arvin must provide a table of transit-related, nonelected planning boards, advisory councils or committees, or similar bodies, the membership of which is selected by the City of Arvin City Council and must indicate the racial breakdown of the membership of such committees or councils.

The City of Arvin does not have any transit advisory committees or non-elected committees.

9. Requirement to Develop System-Wide Standards and Policies.

FTA requires all fixed-route transit providers to develop quantitative service standards and policies for their fixed-route service. Individual public transportation providers may set standards that best reflect their local environment.

Since the City of Arvin operates a fixed route bus service, the exhibit on the next page will discuss system-wide standards and policies.

EXHIBIT G
CITY OF ARVIN ArvinTrans

SYSTEM-WIDE STANDARDS AND POLICIES
In addition to the general reporting requirements, FTA Circular 4702.1B requires providers of fixed route public transportation to submit additional information specific to fixed route service.

3.D.3
Attachment: TITLE VI Program (003) (City of Arvin 2023 Transit Title VI Compliance Program) Since the City of Arvin does NOT operate fifty or more fixed route vehicles in peak service, it is subject only to the requirements for system-wide standards and policies.

Title 40 CFR Section 21.5(b)(2) specifies that a recipient shall not utilize criteria or methods of administration which have the effect of subjecting persons to discrimination because of their race, color, or national origin. In addition, Appendix C to 49 CFR part 21 establishes that no person or group of persons shall be discriminated against with regard to routing, scheduling, or quality of service on the basis of race, color, or national origin. Frequency of service, age and quality of vehicles assigned to routes, quality of stations serving different routes, and locations of routes may not be determined on the basis of race, color, or national origin.

City of Arvin has adopted the following service standards and policies in compliance with these regulations:

1. Vehicle Load
Measure: Provides service levels to prevent overcrowding and standees.

The City of Arvin system‐wide goal is to have an average maximum load factor for local service not to exceed 1.25, as measured by a ratio of total passengersto seats on board the vehicles. This equates to a maximum of approximately five (5) standees on a 21-foot vehicle.

The City works to ensure passengers are not left behind due to overcrowding or overloads.

Overcrowding is particularly monitored on routes monthly. The City provides bus service using 40 foot buses to minimize overcrowding and ensure passengers wait no longer than 15 minutes for the next local bus during peak periods.

Buses in City fleet currently used have seating capacities of:

Length Make Model Seats

26.3 Glaval Ford 16
35ft Proterra Catalyst 35 27
35ft Proterra Catalyst 35 27
35ft Proterra Catalyst 35 27

39.1 Glaval F Liner 38

39.1 Glaval F Liner 38

2. Vehicle Headway
Measure: Provides adequate service frequency based on the corridor of operation and ridership demand.

The City system‐wide goal is to provide service every 15 minutes during the peak, 30 minutes during times between Arvin and Lamont, 30 minutes during times between Arvin and Tejon, and 45 minutes during times between Arvin and Bakersfield, as demand warrants. Services in rural areas of the City is deployed as demand warrants. The vehicle headway standard is designed to

3.D.3
Attachment: TITLE VI Program (003) (City of Arvin 2023 Transit Title VI Compliance Program) ensure that passengers have equitable wait times for transit vehicles. Vehicle headways are measured as the amount of time between the departure of two subsequent buses along the same route or service corridor. The peak period is defined as Monday through Friday between 7:00a.m. and 10:00a.m. and 2:00 p.m. to 4:00 p.m.

3. On-time Performance
Measure: Provides accessible and reliable transit services to Arvin To ensure reliable services, the city aimsto have a 99% on‐time performance target at majorstops and transfer hubs and a 99% on‐time performance target at minor timepoint stops for fixed route operations. In addition, the City standard is less than 0% of fixed‐route trips missed or removed from the daily schedule. For dial-a-ride services, the standard for on‐time performance is at least 99% of all dial-a-ride trips arriving within the 5minute (15) pick‐up window.

4. Service Availability
Measure: Provides accessible and reliable transit services to Arvin The city’s goal is to provide transit service to major origins and activity centers within Arvin and in Bakersfield. This goal includes providing transit within ½ mile of 100% of all Arvin residents by census block, 50% of major employers and other large trip generators, and 50% of large multifamily housing developments as well as ensuring that 40% and 100% of middle and high schools are within 2 mile and 5 miles, respectively, of transit service.

Service Policies

1. Distribution of Transit Amenities
The transit amenities policy is designed to provide the framework for the distribution of bus stop amenities equitably throughout the system. When resources allow for improvements at multiple stop locations, the City will prioritize resources based on passenger activity and transfer opportunities. The city will also recognize the amount of observed boarding versus alighting activity when citing amenities such as shelters, benches, and real‐time information screens.

In situations where the City has the authority and available resources to site new amenities at multiple bus stops, amenities will be programmed for placement at those stops based on a ranked score. Amenities may include, but are not limited to, shelters, seating, trash receptacles, and transit information displays. Rankings are based on total scores assigned to each candidate stop and are based on weighted factors, including passenger boardings, transfer opportunities, and access to major activity nodes. While the City will use rankings to program the installation of amenities, external factors (e.g., site limitations, regulations of local jurisdictions, etc.) may dictate that amenities be installed out of order or not at all. The maintenance and replacement of existing amenities will not be subject to ranked scoring.

2. Vehicle Assignment

3.D.3
Attachment: TITLE VI Program (003) (City of Arvin 2023 Transit Title VI Compliance Program) The vehicle assignment policy is designed to provide the framework for the distribution of buses in an equitable fashion throughout the system. All vehicles used in transit service will be ADA accessible and accommodate at least two wheelchairs and two bicycles. Vehicle size and capacity will be assigned based on demand and passenger load factors.

RE: Audit Services Contract Extension – Fiscal Year Ended June 30, 2023 Dear Mr. Jones:

I would like to take this opportunity to thank you for the confidence and support the City of Arvin (the “City”) has provided to us over the past years and present this letter for your consideration regarding extending The Pun Group, LLP’s contract with the City.

We have developed an understanding of the City’s operations that has aided us in providing quality Audit Services. With that knowledge, we have been able to expand our audit efforts and provide observations that have assisted the City’s staff. We have also demonstrated our ability to respond to requests of the City and our ability to deliver quality services. It is our understanding the City of Arvin has been satisfied with our efforts.

We would like to propose an extension of our Audit Services contract to include the Fiscal Year Ended June 30, 2023. The objective of our audits is to issue an opinion regarding the fairness of the presentation of the City’s financial statements in accordance with generally accepted accounting principles. The proposed total all-inclusive maximum price breakdown is presented as follows:
(1) Single Audit fee includes up to one (1) major program. Fees for auditing additional major programs will be $4,000 each. The number of programs determined to be “major” will be based on OMB Uniform Guidance. The Engagement Team will discuss this with the City’s Management before starting Single Audit work. (2) Supplemental reports, audits, or agreed-upon procedures must be added in a written agreement prior to commencing audit work. The Firm and the City will discuss and approve the scope and associated costs of these tasks.

If the City agrees with the foregoing, please sign the copy of this letter in the space provided and return it to us.

We would very much like to continue our relationship with the City of Arvin and stand ready to provide the level of service and commitment to which the City has become accustomed. If you have any questions, please feel free to call me at (949) 777-8801.

CITY OF ARVIN
Agenda Report
Meeting Date: September 12, 2023
TO: Arvin City Council
FROM: Jeff Jones, City Manager
SUBJECT: A Resolution of the City Council of the City of Arvin to Approve the St.

Thomas Church.

RECOMMENDATION:

Staff recommends approval of the St. Thomas Church’s Special Event Permit Application due to Caltrans’ requirement for authorization from the City to approve an encroachment permit, which is necessary for the parade route on State Highway 223. Staff also recommends the City Council approve the Memorandum of Understanding and consider waiving costs associated with this event.

BACKGROUND:

Our Lady of Guadalupe Procession is scheduled for December 10, 2023. Set up will begin at 10:00 am. The procession will begin at 11:00am and conclude at 12:30pm. Bear Mountain Boulevard.

The Arvin Police Department will provide traffic control and will maintain safety for participants and spectators. Eastbound traffic on Bear Mountain Boulevard will be diverted south on Comanche from Bear Mountain Boulevard.

In the past, the City has provided an in-kind contribution of city staff time to support this event.

After reviewing the current budget, staff has determined there are sufficient funds to cover the cost of this year’s event.

The St. Thomas Church is required to provide a Certificate of Liability Insurance naming the City of Arvin, its officers, officials, employees, agents, and volunteers as additional insured and include commercial general liability coverage in the amount of $1,000,000 each occurrence.

ENVIRONMENTAL REVIEW:

Staff has conducted an assessment of this event as required by the California Environmental Quality Act (CEQA) and determined that it is categorically exempt under CEQA Guidelines section 15301(Existing Facilities) and 15323 (Normal Operations of Facilities for Public Gatherings) as there is a past history of using the existing road and sidewalk facilities for public

CITY OF ARVIN
Staff Report
Meeting Date: September 12th, 2023
TO: Arvin City Council
FROM: Alex Ghazalpour, Chief of Police
Jeff Jones, City Manager
SUBJECT: Police Department Sunridge Systems Software Addition of IRIMS BACKGROUND:

As part of our ongoing commitment to optimizing our resources and equipping our personnel with much needed tools, we are planning to update our current CAD dispatching software and introduce the Incident Records and Information Management System (IRIMS).

The upgrade to our IRIMS dispatching software is a strategic move aimed at improving the coordination and communication of our officers in the field. The new software version brings enhanced features such as real-time tracking, seamless integration with mapping and navigation tools, and improved data visualization. This means that our dispatchers will be able to accurately pinpoint the location of incidents and allocate resources more effectively, leading to quicker response times and ultimately, safer communities.

This system has been carefully designed to streamline the process of capturing and managing incidentrelated data. IRIMS will allow our officers to research information directly from the field, ensuring that critical details are accurately recorded in real time. This information will then seamlessly integrate with our central database, enabling more efficient data analysis and informed decision-making. By enabling our personnel to access and share crucial information seamlessly, we are fostering a safer environment for both our officers and the communities we serve.

Sunridge Systems is our current vendor that handles our Computer Aided Dispatch and Record Management Systems. This program is an add on to the current systems we have in place.

I am confident that these enhancements will have a positive impact on our field operations and contribute to our ongoing mission to ensure the safety and security of our community.

STAFF RECOMMENDATION:

Staff is recommending that the City Council authorize and approve the police department to purchase and implement the IRIMS Law Enforcement Software.

FINANCIAL IMPACT:

The cost of this project is $14,450.00. The ongoing yearly cost will be $1650.00, which is included in the first-year cost. The funding source for this software update and cost will come from the Edward J. Byrne Grant.

The Transportation Development Act (TDA) is a funding source for the development and support of maintaining our public transit needs that exist in California. TDA provides two major sources of funding. Local Transportation Fund and State Transit Assistance Fund. TDA Funds are distributed to KernCOG who oversees the administration and distribution of the funds to the various city and county agencies for transit operations. Excess TDA monies not used for transit, after going through an unmet transit needs process, are then available for street maintenance purposes. This resolution authorizes reimbursement for excess TDA monies not used for transit.

FISCAL IMPACT:

This is actual revenue item in the full amount of $1,625,838in fiscal year 2022-2023 and is being reimbursed in fiscal year 2023-2024. No impact to the City's general fund.

CITY OF ARVIN
Staff Report
Meeting Date: September 12th, 2023
TO: Arvin City Council
FROM: Alex Ghazalpour, Chief of Police
Jeff Jones, City Manager
SUBJECT: Police Department Air Conditioning Replacement Project BACKGROUND:

The current air conditioning units, which have served us diligently for a number of years, have unfortunately reached a state of consistent breakdown and unreliability. This ongoing challenge has not only led to discomfort for our officers and staff but has also hindered our ability to maintain an optimal working environment.

Over the past several years, the frequency of air conditioning unit failures and the need for repairs have escalated to an alarming level. These units, having exceeded their expected lifespan, are no longer able to maintain a consistent and suitable indoor climate, leaving staff vulnerable to uncomfortable working conditions during extreme weather. The persistent breakdowns have not only disrupted our daily operations but have also incurred significant maintenance costs.

To address this urgent issue, we engaged Holders Air Conditioning and Heating Incorporated, Bakersfield to conduct a comprehensive walk-through of our facility and provide a project description for the replacement of the aging air conditioning units. Their assessment confirmed that the current units are well beyond their serviceable life, contributing to the frequent breakdowns and increasing repair demands. The proposed solution involves the installation of modern, energy-efficient units that not only guarantee a consistent and comfortable indoor environment but also offer long-term cost savings through reduced energy consumption and lower maintenance requirements.

Holders Air Conditioning and Heating Incorporated's proposal outlines a meticulous plan for the replacement process, ensuring minimal disruption to our daily operations. Their team of experienced professionals will handle the installation with precision and efficiency, aiming to have the new units up and running in the shortest time possible.

Given the critical nature of our operations and the well-being of our personnel, I strongly recommend that we move forward with the replacement of the old air conditioning units as outlined in Holders Air Conditioning and Heating Incorporated's project description.

A detailed description of the project is included in the estimate as an attachment.
