ENVIRONMENTAL REVIEW:
The City Staff have prepared a Notice of Exemption for the Title 17 Zoning code additions, amendments, and deletions. The City Council on July 9, 2024, accepted the Planning Commission’s recommendations to find and determine that the proposed ordinance amendments are exempt from the California Environmental Quality Act ("CEQA") and find that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines Section 15300.2 apply to this Ordinance. Stated reasoning: The additions, amendments, and deletions to Title 17 Zoning can be seen with certainty that there is no possibility that it will have a significant effect on the environment, as the proposed ordinance merely amends the existing Arvin Municipal Code which establish new and amended ordinances for the permitting and regulation of certain uses within the city. All environmental impacts of which will be assessed on a use-specific basis. (CEQA Guidelines § 15061(b)(3)). The code amendments: are not located next to any scenic highway or resources; nor located on a hazardous waste site which is included on any list compiled pursuant to Section 65962.5 of the Government Code; the code amendments do not include physical development; the code amendments do not affect any site that could qualify as historical resources; no structures are to be demolished due to the adoption of the code amendments; nor would the code amendments have a significant adverse impact on a historic resource.
AUTHORIZATION BY CITY COUNCIL:
On September 19, 2017, the City Council adopted Resolution No. 2017-92 which authorized the City Manager to bring forward various code amendments; whenever the public necessity, convenience, general welfare, or good practices justify such action. The City Manager is recommending that the Planning Commission and City Council add and amend various chapters of the Arvin Municipal Code Title.

TO: Arvin City Council
FROM: Pedro Barraza, Public Works Supervisor
Jeff Jones, City Manager
SUBJECT: Consideration and Approval of A Resolution of the City Council of the City of Arvin Recognizing the Competitive Bidding Process of California Turf Equipment and Supply Inc., Dispensing with the Public Bidding Requirement; and Authorizing the City Manager to Approve the Purchase of Two (2) Exmark Lawnmowers for an amount of $50,984.50 for the Public Works Department.
BACKGROUND:
The Public Works Department is in need of additional lawnmowers to keep up with maintaining the parks and City facility lawn areas. The department currently has the following four riding lawnmowers: A 2019 John Deere 1600 Turbo Series III Commercial Wide Area Mower with 2- Post Folding ROPS; A 2022 John Deere X380 48-inch Accel Deep Mower Deck; and was recently approved for the purchase of one (1) new Kio Lawnmower and declared two (2) 2011 Grasshopper riding lawnmowers as surplus. The two grasshopper mowers were not reliable as they continuously break down and often needed to be repaired.
The City wishes to purchase two (2) additional lawnmowers. Staff has obtained a quote from California Turf Equipment and Supply Inc. for purchase of two (2) Exmark lawnmowers for the total price of $50,984.50.
Section 3.08.070 (B) (5) of the Arvin Municipal Code (AMC) states that Bidding or open market procedure may be dispensed with only when:
“Competitive bidding or proposal procedures, substantially similar to the competitive bidding or proposal procedures in this code, have already been utilized either by a federal, state, county, city or special district government agency, or by a legitimate cooperative purchasing agency; and, that the supplies, equipment, materials or public works project provided to the city are at the same or better price, terms and conditions, as was obtained through such prior competitive bidding or proposal procedures” California Turf Equipment and Supply Inc. conducted a competitive bidding process under the Omnia Partners Cooperative Contract #20469 similar to the competitive bidding process required by Arvin Municipal Code Section 3.08.070, which resulted in the purchase of lawnmowers at the same or better prices as offered to the City of Arvin.
