CITY OF ARVIN
Agenda Report
Meeting Date: August 13, 2024
TO: Arvin City Council
FROM: Jeff Jones, City Manager
SUBJECT: A Resolution of the City Council of the City of Arvin to Approve the St.

Thomas Church Special Event Permit Application for their Annual Our Lady of Guadalupe Procession to be held on December 08, 2024, Authorize Closure of Streets and Waive City Costs Associated with this Event Subject to Execution of A Memorandum of Understanding between the City of Arvin and St.

Thomas Church.

RECOMMENDATION:

Staff recommends approval of the St. Thomas Church’s Special Event Permit Application due to Caltrans’ requirement for authorization from the City to approve an encroachment permit, which is necessary for the parade route on State Highway 223. Staff also recommends the City Council approve the Memorandum of Understanding and consider waiving costs associated with this event.

BACKGROUND:

Our Lady of Guadalupe Procession is scheduled for December 08, 2024. Set up will begin at 10:00 am. The procession will begin at 11:00am and conclude at 12:30pm. The procession will begin at the intersection of Campus Drive and Fourth St. The procession will travel south onto Bear Mountain Boulevard then head east and terminate at Saint Thomas Catholic Church, 350 E.

Bear Mountain Boulevard.

The Arvin Police Department will provide traffic control and will maintain safety for participants and spectators. Eastbound traffic on Bear Mountain Boulevard will be diverted south on Comanche from Bear Mountain Boulevard.

In the past, the City has provided an in-kind contribution of city staff time to support this event.

After reviewing the current budget, staff has determined there are sufficient funds to cover the cost of this year’s event.

The St. Thomas Church is required to provide a Certificate of Liability Insurance naming the City of Arvin, its officers, officials, employees, agents, and volunteers as additional insured and include commercial general liability coverage in the amount of $1,000,000 each occurrence.

ENVIRONMENTAL REVIEW:

Staff has conducted an assessment of this event as required by the California Environmental Quality Act (CEQA) and determined that it is categorically exempt under CEQA Guidelines section 15301(Existing Facilities) and 15323 (Normal Operations of Facilities for Public Gatherings) as there is a past history of using the existing road and sidewalk facilities for public gatherings such as parades, and the event will not involve expansion of use of these facilities beyond that currently existing. Further, none of the exceptions to the Categorical Exemptions under CEQA Guidelines section 15300.2 are applicable.

FINANCIAL IMPACT:

Estimated total cost for City staff time is $1,300.

Staff Report re replacing EV Charging Dispenser for Arvin Transit Buses.

CITY OF ARVIN
Staff Report
Meeting Date: August 13, 2024
TO: Arvin City Council
FROM: Hesham Elshazly, Transit Manager
Jeff Jones, City Manager / Finance Director
SUBJECT: A Resolution of the City Council of the City of Arvin Dispensing with the Public Bidding Requirements and Authorizing the City Manager to Execute the Quote from Borgwarner in the amount of $67,594.55 for the Replacement of An EV Charging Dispenser for the Arvin Transit Buses Based on the Single Vendor Exception.

BACKGROUND:

The Arvin Transit Department is in need of a new EV charging dispenser for the buses to replace one that no longer functions. The Transit Department has three charging dispensers. Of the three charging dispensers, one has failed, one works and the other works intermittently.

City staff obtained a quote from Borgwarner for the amount of $67,594.55 to replace the failed charging dispenser. This includes a PCS (Power Control System) upgrade kit, a Generation 3 EV charging dispenser including all cables and connectors, an HMI 7-inch touch display, connectivity, 5-year cellular data, a 5-year subscription & license, and a 5-year warranty; along with door fans, installation, shipping, and tax.

The current failed charging dispenser was purchased from Proterra in 2020. Proterra declared bankruptcy and no other vendors are available to replace the charging dispenser. Chapter

3.08.070 of the Arvin Municipal Code provides that the public bidding or open market procedure may be dispensed with when the commodity can be obtained from only one (1) vendor.

STAFF RECOMMENDATION:

Staff recommends approval of the Resolution dispensing with the public bidding requirements and authorizing the City Manager to execute the quote from Borgwarner in the amount of $67,597.55 for the replacement of an EV charging dispenser for the Arvin Transit buses based on the single vendor exception.

FINANCIAL IMPACT:

BORGWARNER IN THE AMOUNT OF $67,594.55 FOR THE

REPLACEMENT OF AN EV CHARGING DISPENSER FOR THE ARVIN
TRANSIT BUSES BASED ON THE SINGLE VENDOR EXCEPTION.

WHEREAS, the City of Arvin is in need of one EV charging dispenser for the Arvin Transit buses; and
WHEREAS, Government Code section 54201 requires local agencies to adopt procedures of the acquisition of supplies and equipment; and WHEREAS, Chapter 3.08 of the Arvin Municipal Code sets forth rules and regulations regarding the purchase of equipment and supplies for city departments; and WHEREAS, Chapter 3.08 of the Arvin Municipal Code generally requires that purchases of supply and equipment in excess of thirty thousand dollars ($30,000.00) shall be subject to a formal public bidding process; and
WHEREAS, Chapter 3.08.070 of the Arvin Municipal Code provides that the public bidding requirement may be dispensed with when the service, material, or group of commodities can be obtained from only one vendor; and
WHEREAS, the cost to replace the failed charging dispenser will cost more than thirty thousand dollars and would normally require the City of Arvin to comply with the public bidding process; and
WHEREAS, the City Manager has represented that the EV charging dispenser can only be obtained from one vendor.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arvin as follow:

1. The above recitals are true and correct.

Staff Report – Veolia Task Authorization - Emergency Influent Wetwell Piping Repairs at WWTF.

CITY OF ARVIN
Staff Report
Meeting Date: August 13, 2024
TO: Arvin City Council
FROM: Gerry Lemus, Veolia Water
Jeff Jones, City Manager
SUBJECT: Approval of A Resolution of the City Council of the City of Arvin Authorizing the City Manager to Execute A Task Authorization between the City of Arvin and Veolia North America for the amount of $91,703.84 for Emergency Influent Wetwell Piping Repairs at the Arvin Wastewater Treatment Plant; and Authorizing Veolia to Proceed with the Project and to Act on Behalf of the City as Necessary to Complete the Project.

BACKGROUND:

Veolia informed the City that on June 18, 2024, one of the influent wetwell discharge pipes at the Wastewater Treatment Plant burst inside the wetwell. There are two influent pumps that discharge into the wetwell. The wetwell supports the split of the influent flow between the Oxidation Ditch and the Orbal and helps manage the collection system's level. Corrosion appears to be the reason for the problem due to the conditions inside the infrastructure, which create high concentrations of hydrogen sulfide gas (H2S). Records show that, as per the drawings dated September 15, 1998, this infrastructure and material inside the wetwell have been in place for approximately 24 years from the final construction date in 2000 with the plant upgrade. This issue raises several safety and operational concerns. The attached pictures show the deterioration and corrosion of the piping and the pump railing guides also show signs of corrosion.

To mitigate the impact on the wetwell with the burst discharge pipe, the associated pump is locked out and tagged out of service, making the second pump the only one in operation. If the second pump happens to fail during the time the first pump is out of service, running the first pump with a damaged discharge pipe will not be an option since the pipe has burst, which could result in additional damage to the concrete inside the wetwell, causing repairs to be more expensive.

This project is considered an emergency due to the criticality in which, if pump two fails leaving no pumps operational, that will require many long hours of monitoring the plant 24 hours to avoid sanitary sewer overflows (SSO's).

To perform this emergency replacement of the 6-inch discharge piping for both corroded discharge pipes and guiderails, the wetwell will have to be bypassed during the work. The Contractor will have to utilize a vactor truck to remove solids from the wetwell so they can pressure wash the inside using confined space safety methods and ventilation. The piping that needs to be replaced goes through the concrete, therefore the Contractor will cut and remove the existing rotted piping and guiderails and replace with new guiderails, 6-inch coated piping in the wetwell, flanges, gaskets, and bolts.

Veolia reached out to three contractors to solicit proposals for this work but have only received one response, as the other contractors are too busy to provide a proposal at this time. It will not be wise to continue waiting. Per the Veolia Operations contract Section 5.01 VWWOS Scope of Service (m) and Section 5.02 Sewage Collection System, Veolia has requested to move forward with repairs at this time.

Staff Report – Veolia Task Authorization - Emergency Influent Wetwell Piping Repairs at WWTF.

Veolia provided a Task Authorization for a total cost of $91,703.84 which includes a 5% contingency.

FINANCIAL IMPACT:
$91,703.84 from the sewer fund.

RECOMMENDATION:

Staff recommends that the Council request clarification from Veolia concerning their classification of this project as a “Capital Project” (Section 5.04 of the Agreement) versus “Corrective Maintenance, Repairs, and Replacement” (Section 5.01(f) of the Agreement). Staff further recommends the Council approve the Resolution authorizing the City Manager to Execute the Task Authorization between Veolia and the City of Arvin for the Amount of $91,703.84 for Emergency Influent Wetwell Piping Repairs at the Arvin Wastewater Treatment Plant if Council determines that the requested project is a Capital Project and not Corrective Maintenance, Repairs, and Replacement; and Authorize Veolia to proceed with the project and to act on behalf of the City as necessary to complete the project.

Veolia Operations will be handling the bypass of the wet well during the course of construction as detailed below:

1. The gate can be closed to isolate the wet well.

2. Veolia Operations has a pump and hoses to pump what is in the wet well.

3. Any solids in wet well will need to be removed with vactor truck and disposed of at the plant. (included in Contractor quote) Veolia Water West Operating Services, Inc. will provide the following services to provide and install a new generator at the City of Arvin Wastewater Treatement Plant.
