AGENDA ITEM 4-B
STAFF REPORT
CITY OF ARVIN
TO: Honorable Mayor and City Council Members
FROM: Jeff Jones, City Manager
DATE: September 24, 2024
SUBJECT: Report, Discussion, and Potential Approval of Resolution No Adopting the Resolution of Necessity.
Recommendation:
Adopt the Resolution of Necessity (2/3 vote required).
Background:
In 2023, the City was ordered by the State Water Control Board to comply with new requirements related to its Wastewater Treatment Facility to comply with a Cease and Desist Order. In order to comply with these requirements, the City needs additional land to properly disperse the effluent from its Wastewater Treatment Facility.
The City, however, does not own sufficient land in the vicinity of the Wastewater Treatment Facility, and after analyzing the property surrounding the Treatment Facility, it was determined that the property located at the Southeast Corner of Rancho Dr. and Millux Rd., Arvin, California 93203: APN 446-010-04, is the best property to allow the City to comply with the State Water Control Board's requirements. While this Property is not within the territorial limits of the City of Arvin, California Code of Civil Procedure §1240.125 states, "Except as otherwise expressly provided by statute and subject to any limitations imposed by statute, a local public entity may acquire property by eminent domain outside its territorial limits for water, gas, or electric supply purposes or for airports, drainage or sewer purposes if it is authorized to acquire property by eminent domain for the purposes for which the property is to be acquired." A map showing the location of the property is attached as an exhibit to the proposed Resolution.
Staff has been in contact with the property owners. Additionally, an appraiser, retained by the City, assigned a fair market value to the property necessary to complete the Project. An offer from the City to acquire the property for the amount stated in the appraisal was made on July 23, 2024.
After receiving no response from the Property Owner, on August 19, 2024 the City sent a second letter to the Property Owner, reiterating the previous offer to Purchase the Property. Additionally, since sending the offer to acquire the property, the City has sought to negotiate the purchase of the property in good faith. On August 29, 2024, the City Attorney received a telephone call from the Property Owner. During this call, the Property Owner stated that the best and final counteroffer to the City's offer would be $3,750,000, or approximately $50,000 per acre. This best and final offer exceeds the appraised value of the property by $2,680,000. Thus, the Property Owner and the City are unable to agree to a purchase price for the Property. To comply with the State Water 39 4-B-1
Control Board's requirements, the City must consider the filing of an eminent domain action, which will allow the City to proceed with the project while the fair market value is determined by the Court.
After the notice to the Property owner concerning this public hearing had been mailed, the property owner's attorney contacted the City Attorney and informed the City Attorney that the property owner would be seeking its own property valuation. Additionally, the property owner's attorney claimed that there may be other properties that are more suitable for the City's project.
Before an eminent domain case can be filed, the City Council must adopt, by at least a 2/3 vote (4 of 5 council members), a "Resolution of Necessity." This resolution makes certain findings required by state law and authorizes the city attorney to begin the proceedings.
It must be emphasized that the price to be paid for the property is NOT the subject of this hearing.
This hearing has the sole purpose of determining whether the statutory findings can be made.
Statutory Findings:
The statutory findings required to be made, and the facts supporting the making of the findings, are as follows:
1. The project is planned and located in a manner that will be most compatible with the greatest public good and the least private injury.
Facts: Yes, this is the closest property, which would allow the City to comply with the new requirements related to effluent mandated by the State Water Control Board. There is another property that the City evaluated using for the Project. However, due to the proximity of that property to a private lake, the property at issue has a lower risk of causing an environmental hazard. This property is vacant and will require minimal work in order to allow the City to utilize it as intended. This Project is deemed important for the safety of the residents of Arvin and is necessary to allow the City to continued compliance with the State Water Board's Cease and Desist requirements.
2. The taking of the project is necessary for the proposed project.
Facts: Yes, as stated above, the City does not own sufficient land within the vicinity of its Wastewater Treatment Facility to allow it to comply with the State Water Control Board's requirements. Additionally, because this land is currently vacant, it will require minimal work to allow it to be utilized for the public's interest.
3. The offer to purchase required by California Government Code Sec. 7267.2 was made to the owners of the property interests.
Facts: Yes, a written offer to acquire the property at the fair market value as determined by the appraiser was made on July 23, 2024. A follow-up offer letter was sent on August 19, 2024 after the property owner failed to respond to the initial offer.
4. The necessary notice of this hearing was given as required by Code of Civil Procedure Sec. 1245.235.
Facts: Yes, the notice was given by the City Clerk on August 29, 2024. 40 48-2
5. The City of Arvin has complied with all conditions and statutory requirements necessary to exercise the power of eminent domain.
Facts: Yes, as outlined in this staff report.
6. The City of Arvin has complied with all provisions of the California Environmental Quality Act for the project.
Facts: Yes, CEQA documents are prepared and will be submitted to the State Clearinghouse and the Kern County Clerk.
Land pay portion por the prop coy is ay propriated or a public 20, the out i ese are cessary unreasonably interfere with or impair the continuance of the public use as it then exists or can be reasonably expected to exist in the future.
Facts: No portion of the property is currently appropriated for a public purpose. The City proposes to use the property public purposes, including disbursement of effluent from the City's Wastewater Treatment facility.
Fiscal Impact:
Acquisition of this property is included in the costs of the Project budget.
Conclusion:
If the City Council wishes to proceed with the project, then this Resolution should be adopted.

The Real Property Located at the Southeast Corner of Rancho Dr. and Millux Rd., Arvin, California 93203: APN 446-010-04
Owner: Eduardo and Amalia Garcia
To the Owner or Owners of the Subject Property:
The City of Arvin is in the process of acquiring land in the vicinity of its Wastewater Treatment Facility to allow compliance with the California State Water Control Board's Requirements related to the City's Wastewater Treatment Facility and the effluent produced therefrom (the "Project"). The law provides procedures for public agencies to acquire private property for public use. It requires every agency which intends to condemn property to notify the owners of its intention to condemn. California Code of Civil Procedure (CCP) Section 1240.030 provides that the power of eminent domain may be exercised to acquire property for a proposed project if the following three conditions are established:
1. The public interest and necessity require the project.
2. The project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury.
3. The property sought to be acquired is necessary for the project.
Also, CCP Section 1245.230 requires that the offer required by Section 7267.2 of the Government Code has been made to the owner of record, unless the owner cannot be located with reasonable diligence. A written offer required by Section 7267.2 of the Government Code was sent to the address that was listed on the last equalized county assessment roll on or about September 15, 2023.
YOU ARE HEREBY NOTIFIED THAT THE CITY OF ARVIN, AT ITS MEETING TO BE HELD ON SEPTEMBER 24, 2024, AT 6:00 P.M., AT 200 CAMPUS DRIVE, ARVIN, CA 93203, WILL BE ASKED TO DECIDE IF THE ABOVE CONDITIONS HAVE BEEN MET AND, IF SO, TO ADOPT A RESOLUTION OF NECESSITY ("RESOLUTION" TO ACQUIRE THE SUBJECT PROPERTY BY EMINENT DOMAIN.
Questions regarding the amount of compensation to be paid or the value of the property to be acquired are not part of this proceeding and the City Council will not consider such in determining whether a Resolution should be adopted.
45 4B-7
If the City Council adopts the Resolution, the Resolution will authorize the City of Arvin to acquire the property by eminent domain. Within six months of the adoption of the Resolution, the City will prepare and file a complaint in the Kern County Superior Court commencing the eminent domain proceeding. All issues related to the compensation to be awarded for the acquisition of your property will be resolved in this court proceeding. A description of the required property is attached to this notice.
The law provides you with an opportunity to appear before the City Council and raise questions concerning the three conditions referred to in CCP 1240.030, as cited above. You are entitled to appear and object to the adoption of the Resolution. If you intend to appear, please provide a written request to appear before the City Council. Failure to file a written request to appear and be heard within 15 days after the notice was mailed will result in waiver of the right to appear and be heard. Please include with any written request to appear a statement indicating which of the three conditions listed in the first paragraph above you contend have not been met. By designating which of the conditions form the basis of your challenge and explaining why you believe they have not been met, you will enable the City Council to conduct a full and expeditious review of the project's effect on your property. If you request an appearance and review, you will be notified of the time and date for participation in that review. Staff will conduct the review on behalf of the City Council and ask for your participation. Reasons why the project is exempt: The land acquisition meets the exemption criteria pursuant to California Environmental Quality Act (CEQA) Guidelines, Chapter 18.04 CEQA Implementation and Environmental Clearance and Resolution No. 2022-08 CEQA Implementation Guidelines. Pursuant to Title 14 of the California Code of Regulations, Sections 15061 (b) (2) and (b)(3), that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a project which has the potential for causing a significant effect on the environment. This project and the associated project approvals are exempt from review under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15061(b)(2) and (3) because it can be seen with certainty that there is no possibility that it will have a significant effect on the environment, as the proposed project is merely a transfer of ownership with no other changes to the land or use. In addition, the project is exempt pursuant to Section 15325, Class 25 (Transfers of Ownership of Interest in Land to Preserve Existing Natural Conditions and Historical Resources), subsection (b)- as the acquisition will allow the continued agricultural use of the area. The project is also not located next to any scenic highway or resources, nor is located on a hazardous waste site which is included on any list compiled pursuant to Section 65962.5 of the Government Code. Finally, there are no structures on the site that could qualify as historical resources. The project will not have a significant adverse impact on a historic resource.
The Notice of Exemption is to be filed with Kern County Clerk in accordance with the City of Arvin's Guideline for the implementation of CEQA and with the State of California - CEQA Submit. For all the foregoing, including evidence in the administrative record, the City Planner recommends the City of Arvin adopts a Class 3 Categorical Exemption under CEQA Guidelines section 15301- Existing Facilities and 15061(b)(1) and (bl(3).

APPROACH TO SERVICES PROVIDED
This section describes the general tasks and deliverables that would be provided for on-call planning services. PCE will provide a strong emphasis on the management of multiple projects and competing priorities while maintaining quality, meeting schedules, and staying within budget.
PCE understands that the City of Arvin is seeking assistance from qualified Planning firms to provide on- call current planning services to support the City's Community Development Department to provide timely responses to planning inquiries and application submittals. PCE also understands that the City desires a firm with a range of expertise and experience because experience level is dependent on project type and project types will vary. PCE also understands that on-call services will include answering phone calls and emails, providing zoning and land use information to developers, and processing various types of planning applications (both ministerial and discretionary). We understand that processing applications will include preparing all necessary documentation for such applications and being available to present at public hearings.
PCE has staff ranging from entry-level to Senior Planners. PCE's Division Manager has experience managing a Current Planning Division in a city of over half a million and thus has the experience needed to delegate and respond to emails and inquiries as needed.
APPROACH TO PROCESSING PLANNING/DEVELOPMENT APPLICATIONS PCE staff has experience processing various types of planning entitlement applications from zone clearances to plan amendments and tract maps for large-scale development projects. PCE has a strong understanding of the planning process including understanding how to implement complex development codes and general plans at the project level. PCE will follow the protocols outlined by the agency to make sure projects are processed consistently and accurately. Our experience working directly on entitlements and supervising the process puts us a step ahead of most firms.
PCE's approach to processing planning applications is grounded in our perspective that project management is ultimately about managing expectations through project mobilization, delivery, and closeout, always keeping the end users) in mind. With that in mind, every project will be approached as follows:
• Task 1. Reconnaissance/Background Research: PCE will review the City's planning application submittal requirements and development review processes in addition to the zoning code, land use plans, and other relevant regulations.
• Task 2. Coordination Meeting: PCE will facilitate a coordination meeting with City staff to ensure that we have a clear understanding of the City's processes and procedures for reviewing and managing development applications and ensure we are utilizing all standard and current forms and documents when processing applications. The end goal is to make sure work products are consistent with those produced internally.
• Task 3. Project Review: After having a clear understanding of the process, when PCE is assigned an individual development project, we will devise a simple implementation strategy that includes a project understanding, key dates, and deliverables.
PRECISION 6
EVIL ENGINEERING. IN
77 54-26
PCE will complete the following tasks on each individual project. Our timelines will be dependent on the individual project but will range from 3-16 weeks:
• Task a: Outline Project Requirements (i.e., deliverables, key deadlines, budget, etc.). • Task b: Assess the capability (e.g. skill levels, experience) and capacity (e.g. resources) of the PCE project team. PCE will assign project accordingly.
• Task c: Confirm deliverables and key dates with City. • Task d: Route Project and Coordinate Project comments from other departments and agencies. • Task e: Review Project in accordance with City standards (design review, site plan review, zoning ordinance compliance, general plan compliance, etc.). Conduct site visit if needed. • Task f: Coordinate CEQA document and required technical studies with consultant or prepare the document in-house.
• Task g: Revise documents as needed based on staff review and input. • Task h: Prepare staff reports, resolutions, presentations, and attend public hearings, as needed.
APPROACH TO GENERAL INQUIRIES
Our approach to responding to general inquiries is to have either our Division Manager or most Senior Planner review the inquiry and delegate or respond to the inquiry, depending on the level of expertise needed. PCE will swiftly respond to phone calls and emails.
Timeline: PCE will respond to simple inquiries within 24 hours (excluding weekends) of receiving call or email. For more complex inquiries, PCE will provide an initial response within 24 hours indicating that the inquiry has been received and that a response will be provided within 5 business days.
APPROACH TO ENVIRONMENTAL ASSESSMENT AND DOCUMENTATION (CEQA) Task 1. Review Project Information
Upon receiving receipt of Task Order for a CEQA and/or NEPA project, PCE will review the provided project information and prepare a Scope of Work, Schedule, and Budget estimate for the project. PCE will also prepare a Preliminary Environmental Review (PER) memo (as needed) to identify and recommend impact areas that would need technical studies from sub-consultants. PCE will identify the level of CEQA review. The following tasks are most relevant for an Initial Study/Negative Declaration/Mitigation Negative Declaration. If an exemption is more appropriate, a simplified approach will be taken.
Task 2. Kick-Off Meeting.(1).
After agreeing with the City on a scope of work, PCE will coordinate a kick-off meeting with City staff to refine the scope of work, confirm timeline, and identify technical studies to be performed. For the kick-off meeting, PCE will prepare a detailed Work Program. During the meeting, PCE and City staff will review and discuss the approach, deliverables, and timelines. PCE will finalize the work program based on the discussions at the kick-off meeting. The work program will include a budget, tasks and subtasks, revised schedule, and deliverables. This meeting will ensure that the direction PCE takes is based on clear City input and consideration of PCE's research and recommendations.

Task 3. Administrative Draft
PCE will prepare an Administrative Draft in conformance with CEQA or NEPA and any relevant case law.
PCE will utilize any established templates, specifications, background information, or setting language provided by the City. The NEPA Administrative Draft will be compliant to established templates and contents as required by the Lead Agency. This usually includes project description, purpose and need, alternatives, environmental impact analysis, determination, and mitigation measures as required. The CEQA Administrative Draft will include the following at a minimum:
• Introduction - Regulatory Information and Document Format • Project Description - Project Title, Lead Agency, Contacts, Location and Coordinates, Land Use and Zoning, Project Description, Setting, Required Approval from Other Agencies, Tribal Consultation • Environmental Determination (ND/ MND)
• Impact Analysis (per CEQA Guidelines Appendix G: Aesthetics, Agriculture, etc.) • Mitigation Monitoring and Reporting Program - Mitigation Measure(s), Responsible Party for Implementation, Responsible Party for Monitoring, Timeframe for Implementation, Confirmation of Implementation
• Technical Appendices - technical studies, including air quality/greenhouse gas emission study, biological assessment, traffic study, cultural resources study, noise study, and infrastructure study as necessary;
• Cover Page, Table of Contents, List of Tables and Figures As part of drafting the environmental document, PCE will do the following:
• Utilize the applicant's project description and project drawings to prepare a more detailed project description/operational statement for the IS.
• Establish thresholds of significance and analyze the project in relation to these thresholds for all impact sections identified in the 2024 (or any updated) CEQA Guidelines, Appendix G and/or as identified by the Lead Agency.
• Analyze and determine the significance of project impacts for each area of potential impact. (Adverse) Impacts that are found to be less than significant will be described, and impacts found to be potentially significant (if any) will be described and mitigation measures that will bring impacts below the significance thresholds, will be identified.
• Identify and evaluate further permitting needs, which will be listed in the Project Description.
Task 4. Public Review Draft
Following City review, PCE will revise the Administrative Draft for public review. PCE will provide the City with a Screencheck Draft before finalizing the document. After City reviews and accepts, PCE will finalize the Public Review Draft for public circulation, review, and comment. PCE will complete all required materials for submittal to the State Clearinghouse (e.g., Notice of Completion and Summary Form) as well as Public Noticing (e.g., Notice of Intent, Legal Blurb). In the case that the Public Review Draft shall be submitted to the OPR, PCE will prepare and electronically submit the required materials including the Notice of Completion (NOC) and Summary Form. PCE will track comments received during the public review period and prepare a response to comments for inclusion/incorporation in the final environmental document.

Task 1.5. Notice of Determination/ FONSI
For CEQA projects, PCE will prepare a Notice of Determination (NOD) to be filed with the City Clerk and State Clearinghouse within five (5) days of approval. For NEPA projects, PCE will prepare a FONSI and send to the commenting/affected units of federal, state, and local government and to the State Clearinghouse in compliance with Executive Order 12372. PCE will be responsible for filing of the determination documents.
Task 1.6. Attend Public Hearings
PCE will prepare presentation slides as needed. PCE staff will be available to attend public hearings for adoption, present, and answer questions, as necessary. PCE expects to attend public hearings in- person.
Timeline:
• "Tier 1" CEQA/NEPA Documents (Categorical Exemptions/Exclusions): administrative drafts can typically be completed within 4 weeks from receiving application materials including site plan and operational statement. PCE prepares more robust exemption documents that range from 8-12 pages.
PCE also consults with responsible agencies/divisions as required or appropriate (e.g., air district, water purveyor, school district). Lastly, as available, PCE will incorporate project comments and draft conditions of approval.
• "Tier 2" CEQA/NEPA Documents (Mitigated Negative Declarations/Negative Declarations/Environmental Assessments): administrative drafts can typically be completed within 6 weeks from receiving application materials including site plan and operational statement, project comments and draft conditions of approval, and all technical studies and analysis completed for the project. For NEPA documents, the timeline may be shortened or lengthened based on required consultation processes.
• "Tier 3" CEQA/NEPA Documents (EIRs/EISs): for CEQA, administrative drafts can typically be completed within 6 months from the notice to proceed with the entire EIR process taking approximately 12 months (or more for more complex projects). For NEPA, the entire process would occur within 24 months.

FOR FILLING THE VACANCY ON THE CITY COUNCIL AND DIRECTION
TO STAFF REGARDING THE SAME
RECOMMENDATION:
Staff recommends the City Council discuss initial options regarding how to fill the vacancy on the City Council and provide recommendations to Staff regarding the same BACKGROUND:
Under State law the City Council is required to fill a vacancy on the City Council either by appointing another Councilmember or holding a special election. There are various options for appointment. Staff is requesting direction from the Council as to how to proceed.
By way of background, Councilmember Murillo was elected to office in 2022, and has approximately two years remaining in his term of office as a Councilmember. Councilmember Murillo vacated his seat pursuant to Government Code section 36513 on September 7, 2024, in November 2026. This staff report outlines the Council's options and seeks direction from the City Council regarding how to proceed with filling the vacancy.
Options for Filling Vacancies
Government Code Section 36512 establishes the means by which a City Council vacancy nay be filled. The City does not have an ordinance requiring a certain method for filling a vacancy Consequently, under Section 36512(b), the City Council has the discretion to either (i) fill the vacancy by appointment or (ii) call for a special election.
The City Council must make this decision - to either fill the vacancy by appointment or call for a special election - within 60 days after the vacancy is created.
