Staff Report – Second Amendment to PSA with DPSI

CITY OF ARVIN
Staff Report
Meeting Date: April 8, 2025
TO: Arvin City Council
FROM: Jeff Jones, City Manager
SUBJECT: Consideration and Approval of a Second Amendment to the Professional Consultant Services Agreement between the City of Arvin and DPSI Engineers, Inc. for On-Call Engineering Services in the Amount of $907,800.00 for the (1) Design and Construction Management of Three AB617 Road Projects located on Derby, South A Street and Commanche Road.

BACKGROUND:

The City of Arvin had a significant need for On-Call Engineering services based on current grant funding already awarded, pending grants, and planned future infrastructure projects. To meet the anticipated obligations and deadlines for existing and planned projects, the City needed to expand its ability to grow its engineering capacity and technical expertise to be responsive to its current and future needs for engineering support.

The City of Arvin published a Request for Qualifications for On-Call Engineering services on Planet Bids on April 18, 2024. The prepared scope of work was broad and included representation on behalf of the City in all needed engineering capacities. Three RFQ responses were received on May 7, 2024. The City interviewed all three firms and reviewed the responses for qualifications, ability to perform locally and in a hybrid environment, and experience and expertise in implementing State and Federal grant projects.

Staff determined that it would be appropriate to award an agreement to Diversified Project Services, Inc. (“DPSI”), a local firm in Bakersfield that could operate remotely and in Arvin and had the most experience and qualifications in completing federally funded infrastructure projects.

On or about July 15, 2024, the City Council approved an Agreement with DPSI for On-Call Engineering Services. On or about December 12th, 2024, the City amended that agreement to include two additional projects. These projects are related to (1) the design and construction of 4th Street between Campus Drive and Walnut Drive, and (2) the project to pave and reconstruct Meyer Street from Bear Mountain Boulevard to Sycamore Drive. Thus, City Staff previously prepared an amendment to the Agreement with DPSI to include these two projects within the Scope of Work to be provided by DPSI, which the City Council approved.

Since entering that Agreement, the City has determined that the Agreement with DPSI should be amended again to include three additional projects funded by the California Air Resources Board (CARB) and administered by the San Joaquin Valley Air Pollution District (SJVAPCD). These projects are related to (1) the design and construction management of three upcoming AB617 road projects slated to begin over the summer of 2025 along Derby/Tejon, South

Staff Report – Second Amendment to PSA with DPSI
A Street, and Commanche Road. Thus, City Staff has prepared a second amendment to the Agreement with DPSI to include these three projects within the Scope of Work provided by DPSI.

STAFF RECOMMENDATION:

Staff recommends that this item be approved and the contract with DPSI be amended as mentioned above.

FINANCIAL IMPACT:

The proposed second amendment totals $907,800. This amendment would increase the total cost of the Agreement with DPSI from $470,900 to $1,378,700.

The funding will be reimbursable as pre-development engineering, design, and construction management costs designated on the City of Arvin’s grant contract with the San Joaquin Valley Air Pollution Control District list of projects for AB617 Road Projects previously approved by the City Council. The total amount of the AB617 Road funding project that was previously approved and under contract with the air district for the three AB617 road projects is $ 5,882,630.

ALTERNATIVE TO CONSIDER
DPSI has the knowledge and ability to start projects quickly based on its relationship with the city.

The original RFP process showed that DPSI’s billing rates were comparable to those of other responsive bidders. Should the City decide not to approve the amendments and instead go out to bid on the open market, the City's projects will be severely delayed due to the RFP process.

Additional costs would be incurred during the learning process, as another vendor will incur costs while being brought up to speed on the projects and City processes. Currently, staff does not recommend that the AB617 projects go out for a separate RFP since the underlying original contract was procured correctly, and DPSI has been functioning as Arvin’s City engineer. DPSI has been participating in the AB617 process and meetings and assisted the City in the preparation of the road projects and estimating for these projects.

 Construction costs are based on available estimates and may require updates as the design is finalized.
 Construction management costs are estimated based on grant quantities and the assumption that the project will be constructed over 144 working days.  Additional testing and re-staking services required beyond the initial estimate will be billed separately.
 Any changes to scope or schedule will be communicated to the City in advance for approval.  Any additional studies and reports (i.e. traffic, air quality, biological, archaeological, cultural) are the responsibility of the client. If required, DPSI can coordinate obtaining consultant proposals on a time and materials basis with prior written authorization from client.  City review periods are assumed to be two (2) weeks per design phase. Delays beyond this timeframe may impact the project schedule.
 Cost estimates are based on historical bid data and engineering judgment but do not guarantee actual bid prices.
 Any design changes that significantly alter the scope of work or change the location of site features as shown in the original site plan will require additional time and budget will be handled under an Additional Services Agreement.
 It is assumed that the client will provide all applicable environmental clearances required for the project. Any studies or reports required for clearances are the responsibility of the client.

Staff Report Unmet Transit Needs Hearing 2025

CITY OF ARVIN
Staff Report
Meeting Date: April 08, 2025
TO: Arvin City Council
FROM: Jeff Jones, City Manager / Finance Director
SUBJECT: A PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION OF

THE CITY COUNCIL OF THE CITY OF ARVIN DECLARING THERE

ARE NO UNMET TRANSIT NEEDS THAT CAN BE REASONABLY MET

WITHIN THE CITY OF ARVIN
ISSUE
To consider public comments and establish a finding for unmet needs which are reasonable to meet in the public transportation system.

MOTION
Move to approve the resolution establishing the unmet and reasonable to meet transit needs finding.

RECOMMENDATION
Staff recommends that the City Council consider all public comments and City Council testimony during the public hearing and approve the resolution establishing the unmet and reasonable to meet transit needs finding.

BACKGROUND
The Transportation Development Act of 1971 (TDA), as amended, provides for the disbursement of funds from the Local Transportation Fund for various eligible transportation uses. The funds are distributed by the Kern Council of Governments (KCOG), in its capacity as the Regional Transportation Planning Agency. An eligible claimant wishing to receive TDA funding through KCOG must conduct an annual review of the transit needs of the individuals and groups in the community. A public hearing must be conducted to receive written and oral comments regarding any “unmet transit needs” and whether these are “reasonable to meet”.

An unmet need exist if an individual of any age or physical condition is unable to transport himself or herself due to deficiencies in the existing transportation system. Excluded are: 1) those request for minor operational improvements, and 2) those improvements funded and scheduled for implementation, in the following fiscal year.

An unmet need is “reasonable to meet” if it is (1) safe to operate and has adequate roadways for transit vehicles, (2) not a duplication of an existing transportation service, (3) a response to an existing need, not a future need, and (4) has the ridership to meet the legally required farebox requirements (Pub. Util. Code §§ 99268.2, 99268.5 and 21 CCR §§ 6633.2, 6633.5 with fares close to fares of similar service).
