Staff Report Declare CNG Equipment as Surplus.
CITY OF ARVIN
Staff Report
Meeting Date: April 22, 2025
TO: Arvin City Council
FROM: Jeff Jones, City Manager
SUBJECT: A Resolution of the City Council of the City of Arvin (1) Declaring Central Natural Gas (CNG) Station Equipment as Surplus and (2) Directing the City Manager to Authorize Sale of the Equipment.
RECOMMENDATION
Staff recommends that the City Council adopt a resolution declaring the equipment listed below, titled as surplus items, as surplus and authorize its sale pursuant to the procedures set forth in Arvin Municipal Code section 3.08.110.
BACKGROUND
Arvin Municipal Code section 3.08.110 specifies that current department heads of the city shall submit reports showing surplus stock, materials, and equipment. When it is found by the City Council that such materials owned by the City are not needed for use by any city department, the Council may declare such materials as surplus and authorize the sale thereof and proceeds from any such sale shall be deposited into City treasury.
Removal of these items from the City’s public works yard would assist in providing additional space needed to store other items and with the general housekeeping and maintenance of the areas.
The following equipment is to be sold as surplus in their current operational condition:
• All CNG station equipment –
Compressed natural gas station and appurtenant facilities including one 75 scfm compressor, one single tower dyer without self-contained regeneration, two 12,000 SCF storage vessels, one-dual hose fast fill dispenser, one card access device and all power and control equipment. All required trenching, conduit, wiring, plumbing, hardware and signage.
The CNG station was installed starting in 2010 and was completed in 2012. The cost of the facility was $677,684.83 and was funded by a CMAQ grant by Cal Trans.
The facility was never used, mostly due to the City changing direction in 2016 to move to the use of electric buses instead of procuring buses which would be fueled by CNG.
If the City Council determines that these items are surplus and authorizes their sale, the Transportation Department intends to sell them at auction to the highest bidder.
FINANCIAL IMPACT
There will be a cost to dismantle the CNG Equipment. It is anticipated that the proceeds received from the sale of the asset will be equal to or exceed the amount of the dismantling costs.

RESOLUTION NO. _____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARVIN (1)
DECLARING CENTRAL NATURAL GAS (CNG) GAS STATION
EQUIPMENT AS SURPLUS AND (2) AUTHORIZING THE CITY
MANAGER TO PROCEED WITH THE SALE OF THE EQUIPMENT
WHEREAS, Arvin Municipal Code (AMC) Section 3.08.110 (Surplus property-Sale or other disposal) establishes a procedure to declare equipment surplus; and WHEREAS, AMC Section 3.08.110 (A) states that all department heads of the city shall submit to the city council at such times, and in such form as may be prescribed, reports showing stock, materials, equipment and any real property on hand not then in use in said department.
When a surplus of stock, materials, equipment, or real property exists in any department, the city council may transfer the same to any other department having a need for such stock or any portion thereof on approval of the city council or its designated official; and WHEREAS, AMC Section 3.08.110 (B) states, when it is found by the city council that stock, materials, equipment, or real property exists which is not needed for use by any city department, the city council may authorize the sale thereof, and the proceeds from any such sale or sales shall be deposited in the city treasury; and
WHEREAS, AMC Section 3.08.110 (C) states, upon the city council's finding and authorization of the sale of surplus stock, materials, equipment, or real property, the city manager may take whatever steps necessary to obtain the highest price in exchange for the sale of the surplus stock, materials, equipment, or real property. The determination of the highest price that will be most favorable to the city will be made by the city manager, within his/her sole discretion. The city manager may thereafter enter into and complete the sale of the surplus stock, materials, equipment, or real property on behalf of the city; and WHEREAS, the Compressed Natural Gas (CNG) station equipment is no longer in use and is surplus.
NOW, THEREFORE, the City Council of the City of Arvin, does hereby resolve as follows:
1. The above recitals are true and correct.
2. The City Council of the City of Arvin hereby declares the above-described equipment is surplus and authorizes its sale by the city manager.

Net Energy Metering (NEM 2.0)
• Reducing the economic value of going solar 50-75%

Environmental solutions for business, industry and communities Vision Statement
• Veolia’s vision for the City of Arvin’s wastewater treatment plant is to reduce electricity costs through solar renewable energy generation. • The proposed system will also reduce air pollution and lower the cities carbon footprint which will aid in meeting the Climate Action Plan requirements set forth in AB32 for cities, counties and special districts here in the State of California. • The proposed system will also fix the cost of electricity over the next 20+ years, hedging against the high utility escalation experienced over the last 40 years and forecasted due to undergrounding of PG&E transmission lines and the adoption of EV Vehicles in the State of California.

FINANCIAL PERFORMANCE
PPA versus CEC ECAA Loan
• Provides Return on Investment (ROI) = 317%-900%+
• Secures Federal Direct Payment from US Treasury
Will pay for 30-40% of eligible project costs.
• Financing at (1.0%) interest which is the lowest financed cost to the City of Arvin or any entity in this high interest rate environment.
• Veolia proposes to deduct the electricity costs out of O&M contract for the WWTP, and City of Arvin to realize $230,000 in today’s dollars of guaranteed energy
savings. Will be CPI adjusted higher when solar system
goes online.

• Secured Net Energy Metering (NEM) v2.0 Grandfathered PG&E Electric Meter: Veolia has invested in the design and development of the solar array and interconnection application to get the PG&E electric meter grandfathered on the NEM v2.0 program before the program closed on April 14th, 2023.
• Leverage of Tax Incentives and Cash Payments Funding: Veolia aids the client in identifying and applying for grants, rebates and incentives.
• Upgrade to Energy Efficient Equipment: Upgrade today and pay for it with future energy savings. No need for capital funds or additional funding, just re-directs funds already in the budget for utilities and O&M to these smart investments. • Perform Capital Improvements: Capital Budget Avoidance • Decrease Operating Costs (Utility and O&M): Veolia helps stabilize budgets from volatility in the energy marketplace and once the debt service is paid in full, all subsequent energy cost savings are realized, and operating budgets are permanently lowered.
• Hedge Against Historical High Utility Escalation Rates: PG&E has high electric escalation rates as illustrated by the data over the last 40 years. Veolia will help hedge against these inflationary pressures.

Staff Report re Critical Change Orders for the Solar Renewable Energy Generation Project at the Wastewater Treatment Plant.
CITY OF ARVIN
Staff Report
Meeting Date: April 22, 2025
TO: Arvin City Council
FROM: Jeff Jones, City Manager / Finance Director
SUBJECT: City Council Action Item to Approve Critical Change Orders for the Solar Renewable Energy Generation Project at the Wastewater Treatment Plant.
BACKGROUND:
At a regularly scheduled City Council meeting on November 28th, 2023, the City of Arvin City Council voted to contract with Veolia Sustainable Buildings USA West, Inc. (f/k/a Enovity, Inc.) (“Veolia”) aka (“Service Provider”) to install a solar renewable energy generating system at the City of Arvin wastewater treatment plant to take advantage of the Net Energy Metering (NEM) v2.0 program that offered the City of Arvin significant energy savings over the useful life of the system.
Certain costs were unknown at the time of contract execution and city controlled contingency dollars were set aside in the financial budgeting stage for these unknown costs.
At a regularly scheduled City Council meeting on March 11, 2025, the City of Arvin City Council voted to approve the Contract Amendment authorizing the City Manager to utilize the City controlled contingency budget. Change orders that were upcoming were presented to the City Council and details of each change order are attached to this staff report.
STAFF RECOMMENDATION:
Staff recommends that the City Council approve the following critical Change Orders with Veolia in order to maintain critical project milestones to meet the PG&E Net Energy Metering v2.0 requirements.
CHANGE ORDER #03: $108,883.54
The Kern County Fire Department (the applicable Authority Having Jurisdiction (AHJ)), has approved the solar design, provided that the North-South access road on the East side of the solar installation is reinforced to support a load of 75,000 lbs. The Kern County Fire Department has made this modified requirement for emergency access to the solar project area. To meet these requirements, Service Provider’s subcontractor proposed that the road be compacted to 95% with 6” AC grinding compacted over the surface of the roadway, which the Kern County Fire Department stated in a letter dated October 3, 2024 would be acceptable. This work will need to be completed on the North-South access roadway on the East side of the solar project area, East of the fence line. This roadway is outside of the solar project installation area, and this work was not contemplated in the Statement of Work (SOW). Service Provider has obtained estimates from subcontractors to perform grading, compacting, and sampling consistent with the proposal made to the Kern County Fire Department.

CHANGE ORDER #05: $96,986.25
To meet the flood zone requirements of FEMA (the applicable Authority Having Jurisdiction (AHJ)) for the City of Arvin Wastewater Treatment Plant solar project, 6,500 Cubic Yards of imported fill dirt was required to be transported to the project site. This fill dirt was used to get the site up to the same grade of the highest adjacent grade (HAG) so that the project was compliant with FEMA flood zone requirements in the project area. The FEMA flood zone requirements were noted by the City of Arvin’s engineer during the permitting and AHJ approval process. As noted in the Master Services Agreement (MSA) assumptions and exclusions section 5 C iv, these unknown modifications required by the AHJ in excess of the project scope are excluded, resulting in additional costs.
CHANGE ORDER #06: $58,903.17
PG&E service upgrades are outside of the Veolia SOW. The City of Arvin has elected to use the project contingency and Service Provider financing for this scope, per Amendment #1 to the MSA dated March 11th, 2025. This change order came in over $200,000 Under Budget. PG&E upgrade charges include costs for Rule 2, 21, and 16. Further details are set forth in the attached PG&E Rule 2, 21, and 16 contracts, and the Service Provider will manage this process with PG&E and pay PG&E, with reimbursement to be provided as set forth in the MSA and SOW, as amended.
Service Provider will finance PG&E service upgrade costs for the City of Arvin per the terms agreed in the MSA and SOW, as amended, to be repaid seven (7) days from the date of receipt by Client of Investment Tax Credit or within a period of five hundred and forty-seven (547) days from the invoice date of the first invoice designated for deferral.
