Background Memo- Grants Financing Need
CITY OF ARVIN
Staff Report
Meeting Date: May 13, 2025
TO: Arvin City Council
FROM: Christine Viterelli, Grants Manager
Jeff Jones, City Manager / Finance Director
SUBJECT: BACKGROUND MEMORANDUM REGARDING THE CONSIDERATION
OF A FINANCING PROPOSAL FOR INFRASTRUCTURE GRANTS
Background
The City of Arvin has several infrastructure grants scheduled to be implemented in the 2025- 2026 fiscal year, which will exceed the City’s operating budget. As such, it is necessary to consider the possibility of accessing a loan to allow the City to construct multiple projects within a year. Several of these infrastructure projects, including the 3 Road projects funded by AB617, will be built within a 4–6-month construction timeline.
Grant # 1- Urban Greening – Grant Amount $ 794,947.
The Urban Greening Grant is an award from the California Natural Resources Agency (2018) to install a dual-purpose pedestrian and bicycle path across from Garden in the Sun (aka Las Palmas Park) in a pocket park area adjacent to Walnut Street and north of the planned 4th Street construction. The path will be treelined, including plantings, two bioswales, solar lighting, and irrigation for the trees and plants. An illustration of the concept plan is below.
Background Memo- Grants Financing Need
This project will benefit the community in an area that residents and schoolchildren are already traversing to access the Grow Academy, Arvin High School, and the new KCCD campus. The trees will provide shade, reduce air pollution, reduce the “heat island effect” during the summer months, and provide a safe location for walking and biking in the community. The grant must be completed by March 1, 2027, with a planned implementation date of late winter/early spring 2026.
Grant # 2- AB 617- 3 Road Projects – Grant Amount $ 5,882,630.
The AB 617 Grant is a 2025 San Joaquin Valley Air District award to rehabilitate three streets in Arvin, including road repaving and construction of sidewalks, curbs, gutters, and bike lanes.
Below is an illustration of the three concept plans.
Comanche Drive:
South A Street:
Background Memo- Grants Financing Need
South Derby Street:
These projects will benefit the community by providing safer, walkable, and bikeable streets, access to schools, parks, transit hubs, and businesses, and reducing air pollution by offering complete streets and alternative transportation options such as walking and biking.
Construction is planned to begin in early summer 2025, with an estimated timeline of six months. The project must be completed in 2026 and is generally expected to be completed within six months of construction.
Grant # 3- FTA 5339 (b) – Bus and Bus Facilities Grant-Grant Amount $ 2,922,550 This is an award from the California DOT (2021) as a nationally competitive grant subaward from the Federal Transit Authority to purchase two zero-emission buses and construct a renewable microgrid with a battery backup at the City’s Transit facilities. These projects will benefit the community by reducing air pollution by replacing diesel and gasoline buses with zero-emission electric buses, reducing Greenhouse gas emissions, and reducing its carbon footprint by building a renewable energy microgrid to power the buses. The current completion date is February 27, 2026. An illustration is shown below:
Background Memo- Grants Financing Need
Grant # 5- TIRCP/ZETPC Transit Grant- Grant Amount $ 2,552,861 This is an award from the California State Transit Authority (2024-2028) to expand operations, provide match funds for new buses, expand both the hours of operations to the Tejon Casino area, and expand staff operations. The fund will also fund periods of free rides for passengers.
This project benefits Arvin residents by offering zero-emission transportation and reducing air pollution. It plans to increase transit operating hours to the Tejon Casino, resulting in more jobs and economic development for residents. The grant completion is slated for the end of 2028, with final closeout in 2029.
Grant # 6- 2023 CDBG- Haven Drive Road Construction- Grant Amount $ 3,200,000 This is an award (2023 CDBG) from the California Department of Housing and Community Development (HCD). This project will rehabilitate Haven Drive, including sidewalks, curbs, gutters, and road paving, and install underground sewer connections from Meyer Street to Comanche Drive.
An illustration is shown below:
Background Memo- Grants Financing Need
Grant # 7- 2023 CDBG- Haven Drive Road Construction- Grant Amount $ 3,200,000 This is an award (2023 CDBG) from the California Department of Housing and Community Development (HCD). This project will rehabilitate Haven Drive, including sidewalks, curbs, gutters, and road paving, and install underground sewer connections from Meyer Street to Comanche Drive.
Grant # 8- CDBG- Meyer Street- planned submission to 2025 CDBG- $3,200,000 This is a planned and pending resubmission to the California Department of Housing and Community Development (HCD). This project will rehabilitate Meyer Street, including sidewalks, curbs, gutters, and road paving.
Grant # 9- David Valadao Congressional Allocation- 4th Street Build-Out $ 1,250,000 In late 2024, the City of Arvin submitted a competitive congressional allocation request to David Valadao for infrastructure funding to construct the future 4th Street between Walnut Street and Campus Drive. This project supports the development of a 51-unit affordable housing project in collaboration with the Cesar Chavez Foundation and Kern Community College District. David Valadao selected this project for funding. Unfortunately, Congress did not fund any allocations in 2024. The City of Arvin was recently asked to resubmit the request for 2025 funding. That request has been submitted and will proceed with the Congressional process with Congressman David Valadao’s office.
An illustration is shown below:
Background Memo- Grants Financing Need
This project will cover fifty-five percent of the construction costs for installing a new street, sidewalks, curb gutter, transit stop with shelter, crosswalks, utility connections, access to new services, and affordable housing for Arvin residents. The City is already in the project's design and plan creation stage.
This project has additional committed funding of $ 900,000 for the utility connections and droplines on the street for sewer, water, and internet. HCD funded the REAP 2.0 MPO award to the Kern Council of Governments as a metropolitan planning organization. REAP 2.0 is a collaborative grant that the Kern Council of Governments competitively awarded as an MPO Allocation grant. Thirteen member agencies, including Arvin, competed for this funding for several months, which included public outreach and presentations. The total amount awarded on behalf of Arvin, KCCD (as fiscal agent), and the Cesar Chavez Foundation is $ 5,355,748. Approximately $ 4 million will go to the land purchase for the affordable housing project, pre-construction costs of the affordable housing development, and the City of Arvin, DHF, & KCCD will perform administrative tasks, project management, and outreach with the remaining $604,482. Unlike the other grants listed above, REAP 2.0 will not require the City to consider a loan for the REAP funds due to a pre-approved MOU between the City of Arvin and KCCD as its fiscal agent.
Grant# 10- State Water Boards Grant for Pond # 3 Repair- $ 4,992,209 This is a grant for the rehabilitation of Pond # 3, funded by the State Water Boards ( 2024), to repair a leak in the WWT facility pond. This repair is necessary to comply with the State Water Board recommendations. An illustration is shown below:
Background Memo- Grants Financing Need
This project's anticipated completion date is October 2025. The current grant completion deadline is March 1, 2026.
Other Upcoming Grant Applications
Affordable Housing Sustainable Communities (AHSC 2025 Round 9) The City of Arvin, in collaboration with the Cesar Chavez Foundation(CCF) and Kern Community College District (KCCD), is currently working on an application to the AHSC Program, which is funded by the Strategic Growth Council and overseen by the California Department of Housing and Community Development. The application is due on May 28, 2025.
The project funds affordable housing, infrastructure, workforce development, and the reduction of greenhouse gases.
The City intends to request approximately $ 1.9 million for sidewalks for the 4th Street build-out between Walnut and Campus Drive, extension of bike lanes along North Walnut Street, Alderete, and Packard Drive, sidewalk GAP fill in between 4th Street from Campus Drive to Hill Avenue, including ADA ramps, install sidewalk on South side of Nectarine Court between Walnut Drive and Campus Drive, bike lane improvements along Varsity Road, and additional funding for Urban Greening Phase I with a Phase II extension from Alderete to Nectarine Court. For the transit component of the grant, the City will also request approximately $ 2 million for new transit buses, expand transit operations, and install 10 new bus shelters. The total grant amount for this collaborative grant is roughly $20 million, which will contribute to the affordable housing construction, workforce development programs by KCCD, and infrastructure improvements. Funding is also requested to conduct outreach during the 2-year grant implementation period. Funding is anticipated to be awarded in December 2025 with full encumbrance of all funds required by December 2027.
STAFF RECOMMENDATION:
Staff recommends consideration and discussion of a loan.
FINANCIAL IMPACT:
The fiscal impact would be the cost of financing and interest above the amount of the grant funding. The grants do not fund loans or interest on loans. ///

Re: Resolution in Honor of May 2025 as Community Action Month in Kern County Dear City Clerk,
We are asking the Arvin City Council to declare May as Community Action Month in Arvin during one of the council sessions held next month.
Community Action Partnership of Kern County (CAPK) is Kern County’s official anti-poverty agency. Our mission is to “provide and advocate for resources that will empower members of the communities we serve to be self-sufficient.” We are part of a nationwide network of more than 1,000 Community Action Agencies.
In May, CAPK will celebrate its service to communities in every corner of Kern County as part of National Community Action Month. We will be highlighting the impact that our 19 povertyfighting programs and more than 1,100 employees make each day in the lives of those facing hunger, economic insecurity, and loss. That celebration is even more important this year as we reflect on the merger of the California Veteran's Assistance Foundation (CVAF) to the menu of services the agency provides the community. This program will allow CAPK to service the Veteran community more holistically.
Thank you for your consideration of this request. Please contact Savannah Oates at [email protected] or (661)496-9035 to coordinate this recognition.
Sincerely,
Jeremy T. Tobais
Chief Executive Officer

WHEREAS, Community Action of Kern operates the Primeros Pasos Head Start location in Arvin tending to the children within the community and providing a Head Start to their education; and
NOW, THEREFORE, be it resolved, I, Mayor Olivia Calderón, and the members of the City Council of the City of Arvin, hereby proclaim May 2025 as Community Action Month in recognition of the hard work and dedication throughout the community.

Staff Report re: Approval of PWA to Energy Link Industrial Services, Inc. for Transit Parking Lot Improvements.
CITY OF ARVIN
Staff Report
Meeting Date: May 13, 2025
TO: Arvin City Council
FROM: Hesham Elshazly, City Transit Manager
Jeff Jones, City Manager / Finance Director
SUBJECT: Approval of the City Council of the City of Arvin Awarding a Public Works Agreement to Energy Link for the Construction of an Electric Vehicle Charger for Transit Parking Lot Improvements, Subject to Approval as to Form by the City Attorney.
BACKGROUND:
The City of Arvin Transit Division recently purchased two new electric buses to enhance service levels and improve ridership capabilities. The City was notified in November that the electric bus was in production, with an anticipated delivery date of June 1, 2025. The addition of these buses requires upgrades to the existing transit center charging infrastructure to accommodate the new vehicles. These improvements, include the installation of an electrical vehicle charger, which is estimated to exceed $30,000, necessitating a formal bidding process under normal circumstances.
The City of Arvin has an immediate need to install an additional electric vehicle charger within the City Hall parking lot to provide sufficient charging capacity for two new electric buses expected to arrive within the next 30 days. The City Engineer initiated an informal bidding process and requested quotes from three reputable contractors and received the following quote:
Energy Link Industrial Services, Inc. $ 45,988.37
The other two contractors contacted for quotes were unable to perform the work due to prior commitments or did not respond after several requests. Therefore, due to the urgency of the need and the reasonableness of the quote received, the City recommends moving forward with an award of a public works agreement to Energy Link Industrial Services, Inc.
1. Urgency of Timeline:
A formal bidding process typically requires several months, including preparation, advertisement, bid evaluation, and contract award. This timeline cannot be accommodated within the electric bus's delivery schedule. Delaying the improvements would risk the City's inability to park, charge, or integrate the new bus into its fleet upon delivery, rendering the investment temporarily unusable and impacting public transit services.
Additionally, these very costly electric buses are grant-funded, and the City must guard the security of the buses, assuring they are behind a secure and protected security gate.
Staff Report re: Approval of PWA to Energy Link Industrial Services, Inc. for Transit Parking Lot Improvements.
2. Operational Necessity:
The lack of proper infrastructure upon the bus's arrival would disrupt transit operations and contradict the City’s efforts to enhance ridership and service reliability. Without the necessary improvements, the City would face operational and financial inefficiencies, including potential costs for temporary storage or charging solutions.
3. Scope and Specialized Work:
The required work includes specific tasks such as concrete installation for foundations, electrical infrastructure, and installation of the charger. Engaging a qualified contractor directly ensures that these complex, interdependent tasks are completed promptly and correctly, minimizing the risk of delays or rework.
4. Mitigation of Risk:
Proceeding with the sole bid received from the bidding process reduces the risk of failing to meet the operational deadline. It ensures alignment between the contractor's schedule and the delivery timeline of the electric bus, safeguarding the City's transit capabilities and public service commitments.
Conclusion:
To address the time-sensitive nature of these improvements and ensure the City of Arvin can seamlessly integrate the new electric bus into its fleet, City staff recommend proceeding with the procurement of the project based on the quote received for the necessary transit center upgrades.
This approach is essential to maintaining uninterrupted transit services, maximizing the utility of the new bus, and upholding the City’s commitment to improved public transportation.
STAFF RECOMMENDATION:
Staff recommends approval of the project award to Energy Link Industrial Services, Inc. Upon approval a public works agreement will be provided to the contractor in a format approved by the City Attorney.
FINANCIAL IMPACT:
The cost of these improvements is $45,988.37, as estimated on the quote from Energy Link Industrial Services, Inc. This cost is eligible for reimbursement on the company's annual TDA transit fund claim.

Staff Report re Navarro Annexation Application Initiation
CITY OF ARVIN
Staff Report
Meeting Date: May 13, 2025
TO: Arvin City Council
FROM: Bonique Emerson, AICP, Consultant Planner
Jeff Jones, City Manager/Finance Director
SUBJECT: Initiation of the Navarro Annexation Application (APN 189-280-04 – 16000 S.
Comanche Drive)
Staff Recommendation:
Staff recommends that the City Council:
1. Adopt a Resolution of the City Council initiating the annexation process for APN 189- 280-04, and allow connection to City sewer while the annexation is in process.
Background:
The Applicant (Navarro Family Trust) previously filed Conditional Use Permit Case No. 36, Map No. 144 with Kern County pertaining to the development of a 6.72-acre property for a farm machinery and equipment repair facility located at 16000 S. Comanche Drive, north of the northwest corner of Comanche Drive and Bear Mountain Boulevard. A vicinity map is provided below. The subject site is within the City of Arvin’s Sphere of Influence but outside of City limits.
The applicant initially intended to develop the property in the County.
On May 9, 2019, the Kern County Planning Commission conducted a public hearing for the project. At the Public Hearing, the City of Arvin raised the issue of potential environmental concerns related to the engineered septic system. The City indicated that the proposed septic system may pose health and safety issues to the surrounding housing population and contaminate nearby surface and groundwater. The City of Arvin requested the Applicant to connect to the City’s system in order to decrease the health and safety issues. At that time, the Applicant agreed to annexation of the parcel into the City of Arvin to connect to the City’s sewer system.
On August 16, 2023, the Kern County Local Agency Formation Commission (LAFCo) adopted Resolution No. 23-05 approving the request to extend sewer services to the Applicant’s property located outside of the City’s current boundaries. The Commission determined the extension to be in the public interest, acknowledged the absence of alternative service providers, and accepted a Notice of Exemption under CEQA. The approval is contingent upon the City of Arvin’s agreement to pursue annexation, execute a memorandum of understanding, and fulfill associated conditions, including indemnification of the Commission by the applicant. A Vicinity Map and Land Use and Zoning Maps are provided below for reference.
Staff Report re Navarro Annexation Application Initiation
Staff Report re Navarro Annexation Application Initiation
Staff Report re Navarro Annexation Application Initiation
Staff Report re Navarro Annexation Application Initiation Project Description:
Navarro Family Trust (Applicant) requests the initiation of an Annexation into the City of Arvin to facilitate a future project that will include a General Plan Amendment, Pre-Zone, Site Development Permit (or City adoption of County Conditional Use Permit No. 36, Map No. 144).
The Subject site is one parcel totaling 6.72 acres, located on 16000 S. Comanche Rd, in the City of Arvin (APN 189-280-04). The Project would facilitate the development of farm machinery and equipment repair facilities.
• General Plan Amendment (GPA) would change the land use designation of the parcel from 8.4 – Mineral and Petroleum to GC – General Commercial. • Pre-Zone would change the zoning of the parcel from A – Exclusive Agricultural to C-2 – Commercial, once annexed.
• Site Development Permit would facilitate the proposed development of the site (farm machinery and equipment repair facilities (tire shop)).
Analysis:
Council Initiation of Annexation Application
The City Council is requested to take procedural action and intent to allow Staff to begin the formal processing of the annexation application. The approval of this initiation does not constitute the approval of the annexation application or the associated entitlements (General Plan Amendment (GPA), Pre-Zone, and Site Development Permit). The approval of this initiation would allow Staff to begin preparing the required application materials and submit a formal annexation application to Kern County LAFCo.
Required Actions: General Plan Amendment and Pre-Zoning Prior to the submission of the annexation application to LAFCo, a GPA and Pre-Zone of APN 189-280-04 shall be approved by City Council. Pursuant to Government Code § 56375(a)(7), LAFCo commission requires, as a condition to annexation, that the City approve the General Plan Amendment and Pre-Zone prior to consideration of the annexation. Following the approval of recommendations by the Planning Commission, the City Council will need to take action to adopt a resolution approving the GPA and Pre-Zone of the Subject site. Staff anticipates that these items will come before City Council in approximately 90 days, depending on the level of environmental review required (CEQA).
Environmental Review
The annexation of APN 189-280-04 is subject to CEQA (California Environmental Quality Act).
Staff will prepare the required CEQA document during the review of the GPA, pre-zone and site development permit. Staff has the option to prepare a Notice of Exemption pursuant to CEQA Guidelines, or a negative declaration. This will be determined by staff as the details of the project are analyzed.
Conclusion:
Staff recommends that the City Council authorize City staff to proceed with the preparation and submission of a formal annexation application for 16000 S. Comanche Drive (APN 189-280-04).
This will allow the City staff to proceed with processing the related applications. Future approval
Staff Report re Navarro Annexation Application Initiation of the annexation and associated entitlements will occur through separate, noticed public hearings before Planning Commission and City Council.

RESOLUTION NO. ___________
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARVIN
INITIATING THE ANNEXATION PROCESS FOR 16000 S. COMANCHE, ARVIN (APN 189-280-04).
WHEREAS, the Navarro Family Trust (Applicant) has requested to initiate annexation proceedings for the property located at 16000 S. Comanche Drive, (APN 189-280-04), consisting of approximately 6.72 acres; and
WHEREAS, the subject property is located outside City of Arvin limits, and under the jurisdiction of Kern County, but within the City of Arvin’s adopted Sphere of Influence; and WHEREAS, the Applicant filed a Conditional Use Permit No. 36, Map No.144 in Kern County proposing to permit the proposed use of farm machinery and equipment repair facility. At the public hearing, the City of Arvin requested the Applicant to connect to the City’s sewer system; and
WHEREAS, on August 16, 2023, the Kern County Local Agency Formation Commission (LAFCo) adopted Resolution No. 23-05 conditionally approving the extension of City sewer services to the property, contingent upon the City of Arvin’s agreement to pursue annexation and related actions; and
WHEREAS, the initiation of annexation proceedings is a procedural step that allows City staff to begin preparing the necessary application materials and coordinate with LAFCo for formal consideration, and does not constitute approval of the annexation or associated entitlements; and WHEREAS, the City Council finds it to be in the public interest to initiate the annexation process in order to facilitate the orderly extension of municipal services and support appropriate land use planning consistent with the City’s General Plan.
NOW, THEREFORE, BE IT RESOLVED THAT: The City Council of the City of Arvin does hereby authorize City staff to proceed with the preparation and submission of a formal annexation application to the Kern County Local Agency Formation Commission (LAFCo), including the preparation of required applications such as the General Plan Amendment, PreZoning, Site Development Permit and Environmental Review under CEQA for APN 189-280-04.
The Council also does hereby authorize connection to City sewer while the annexation is in process if the applicant pursues development of the approved Conditional Use Permit in the County in the meantime.

Oscar,
Thank you for your call this morning. Kern LAFCo staff was visited by Mr. and Ms. Navarro and Mayor Trujillo today. We were asked to provide the city with options in regard to the Navarro’s property located on S. Comanche Dr. (APN 189-280-04).
The Mayor and the Navarro’s understand that the property requires annexation into the city so they can receive city services. The annexation process requires 3-6 months prior to authorization.
To expedite the process of providing sewer services, the City can submit an application to LAFCo to extend services to the property while the annexation application is being processed. The Extension of Services application must be returned to LAFCo prior to May 17, 2023, to be reviewed and placed on the June 21, 2023, agenda for approval by the Commission. This will allow the City to begin the process of connection to the city’s sewer system.
The Mayor and the Navarro’s would like to pursue both applications. I have attached the application for the Extension of Services and will follow up with the Annexation application (files are too large to send together). The applications are electronic and once filled out can be submitted via email.
Please review and let me know if you have any questions.

Staff Report re Fee Waiver for Rezone
CITY OF ARVIN
Staff Report
Meeting Date: May 13, 2025
TO: Arvin City Council
FROM: Isaiah Medina, Consultant Planner
Bonique Emerson, AICP, Consultant Planner
Jeffrey Jones, City Manager/Finance Director
SUBJECT: Consideration of Waiver of Any and All Fees Associated with a General Plan Amendment, Zone Change Amendment, and Lot Merger for APN 191-181-23 Staff Recommendation:
Staff recommends the City Council:
1. Approve a Resolution of the City Council of the City of Arvin, waiving any and all fees associated with a General Plan Amendment and Zone Change Amendment for City owned property to upzone property in compliance with SB330 and SB8 (State Law) resulting from the proposed removal of residential density resulting from the proposed rezoning of APN 191-181-23.
2. Consider a Resolution of the City Council of the City of Arvin waiving any and all fees associated with the General Plan Amendment and Zone Change Amendment for the property identified by the Kern County Assessor as APN 191-181-23; and
3. Consider a Resolution of the City Council of the City of Arvin waiving any and all fees associated with the Lot Merger of the three (3) lots identified by Kern County Assessor as APN 191-181-23.
Executive Summary:
The Property Owner (PO) purchased the Subject Property in 2024 in hopes of constructing a new location for their existing business as well as additional office space for other uses. According to the PO, the seller indicated the property was zoned for commercial uses. The PO subsequently visited the Arvin Planning Office to confirm the zoning and determine the feasibility of relocating the business to the site. At that time, the PO was informed by Planning staff that the parcel was zoned Residential. The PO was then told by Planning staff that due to its location and prior use, that the rezoning would likely not be an issue and that the property had strong potential for commercial designation. Based on this guidance, the PO proceeded with the purchase.
The PO submitted a rezoning application and was informed of the steps and associated fees, including an estimated 90-day waiting period for grading the site, which was required to proceed.
The PO then submitted a check in the amount of $8,743.00 to initiate the process. The PO later learned that the Zoning Change Amendment would not be a simple process and there were other Zoning Changes.. The major issue that the PO was unaware of that makes this rezone and general plan more complex is that SB330 and SB8 (§66300(b)(1)(A)) prohibits a jurisdiction from downsizing property for housing unless the jurisdiction “concurrently” up-zones other property to increase enough permitted density and makes sure there is no net loss in residential capacity citywide. This required upzoning has to be done at the same Council hearing as the requested
Staff Report re Fee Waiver for Rezone
downzoning of property. Most cities require applicants of downzoning of residential property to find property to upzone and pay associated costs of that related rezoning application.
It should be noted that staff turnover resulted in a number of projects being left in progress, including this one. In January of 2025, the PO scheduled a meeting with the City Manager to discuss the Project and the issues they had faced. The PO indicated that their check had been returned for the requested fees mentioned above, but that they were interested in restarting the process and getting the Subject Property zoned for commercial uses. The PO was informed that the fees they had previously been informed of had been provided in error and that the true cost of the application was approximately double what had been previously quoted.
Considering the errors in process and information provided by former City Staff, the PO is requesting that the City waive any and all fees associated with rezoning the City owned property that will be upzoned to comply with State law. In addition, the PO is requesting that the City waive any and all fees associated with rezoning the subject property to support his existing business.
Finally, the PO is also requesting the City waive any and all fees associated with the merger of the three (3) lots which comprise the Subject Property to allow for easier future development.
Background:
In 2014, the City initiated Rezones of over 300 parcels city-wide to ensure zoning is consistent with the designations on the General Plan’s “Proposed Land Use Map” – which was adopted in 2012. While the City had already completed a number of zone changes related to the General Plan update, there were still a number of parcels within the City with zoning designations which were inconsistent with the underlying land use designation. Additionally, in some cases, the General Plan Land Use designation did not match well with the existing uses and zoning on particular parcels. In those cases, the General Plan Land Use designation was amended to better fit existing zoning. Included in this effort was the Subject Property, which is located at the northeast corner of Hill Street and Tucker Street and identified by the Kern County Assessor as Assessor Parcel Number 191-181-23.
Parcels that were proposed for similar changes were grouped together into individual “cases”. The Subject Property was included in “Case 22”, which included 35 parcels. All of the parcels are located on the north side of Tucker Street, from Derby Road on the east to west of Hill Street on the west (Figure 1). Prior to this effort, the General Plan land use designation for the Subject Property was General Commercial and the zoning designation was R-3 (Limited Multiple Family Residential). Most of the parcels were/are occupied by residential uses, though there was a Funeral Home located at the northwest corner of Hill and Tucker (now demolished). Due to the residential uses of the parcels in this case, the decision was made to amend the General Plan land use designation to “High Density Residential”, which was consistent with the existing R-3 zoning designation at the time. In July of 2023, the City of Arvin adopted Resolution 2023-44 which updated the Land Use Element of the General Plan, including amendments to allowable densities.
This amendment resulted in the Subject Property now having a General Plan land use designation of Medium Density Residential, consistent with the existing R-3 zoning designation.
Staff Report re Fee Waiver for Rezone
Figure 1: Case 22, 35 total parcels on the north side of Tucker Street from Derby to Hill St The PO purchased the Subject Property in hopes of developing a future location for their existing business. During the purchasing proceedings, the PO was initially under the impression that the property was zoned for commercial uses. The PO then was told that the property was actually zoned R-3, Limited Multiple Family Dwellings. The PO then inquired with former City Staff in the Planning Division as to the process of changing the zoning back to a commercial designation.
The PO was told by former City Staff that rezoning the property would not be difficult due to the commercial nature of the surrounding area. With these assurances, the PO completed the purchase and acquired the property in early January 2024.
Following the purchase, The PO again inquired about rezoning the Subject Property and was provided with a rezone application by former Staff within the Planning Division, which was completed and submitted, along with a check for the fees associated with the application.
Approximately three (3) weeks later, the PO requested information on the status of the application and former Staff provided an update to the PO that the rezone could not continue until future residential developments were completed and that there were other properties ahead in the rezone queue. The PO continued to follow up with former Staff and was told each time that the other rezones in the queue need to be completed before the Subject Property. Staff turnover resulted in a number of projects being left in limbo, including this one. At some point, the check submitted with the application was returned to the PO.
In January of 2025, the PO reached out to the City Manager and had a follow up discussion.
Following this meeting, the PO provided further information detailing how they were initially led to believe that the Subject Property was zoned as Commercial. Information from the Kern County Assessor’s Office and the Title Company that facilitated the escrow both indicated that the Subject Property held a commercial designation (Exhibit A). However, it is important to note that the City of Arvin is the official holder of Zoning for property within its jurisdiction. It is unclear how the PO was provided with incorrect information. The zoning of the Subject Property at the time of purchase was, and is currently, R-3, Limited Multiple Family Dwelling.
Request for Rezone Fee Waiver
The PO has requested to reinitiate the process to return the Subject Property to a commercial land use and zoning designation. The PO has stated that incorrect information, both from outside entities and former City staff, led them to purchase the Subject Property and had they been fully informed how difficult the rezone process would be, they would not have purchased the Subject Property. Therefore, the PO has requested that the City waive any fees associated with completing the rezone of the Subject Property to a commercial designation. This would require both a General
Staff Report re Fee Waiver for Rezone
Plan Amendment to change the General Plan Land Use designation from Medium Density Residential to General Commercial and a Zone Change Amendment to change the zoning designation from R-3 to C-2. The approximate costs of this action are discussed below.
Request for Lot Line Merger Fee Waiver
The PO has also requested the City waive any fees associated with the merger of the three (3) lots, identified by APN 191-181-23, into a single lot. Currently, Assessor’s Parcel Number 191-181-23 is comprised of Lots 11, 12, and 13 of Tract 1175 with each lot being approximately 50 feet wide by 120 feet deep. Each lot is treated as separate property with its own building restrictions (e.g., setbacks) that can potentially restrict future development as building over lot lines is generally not allowed. Therefore, the PO is interested in merging the three (3) lots into a single parcel. The approximate costs associated with this action are discussed below.
Fiscal Impact:
The City of Arvin Municipal Code (AMC) Chapter 3.32 establishes a City policy of recovering the full costs reasonably borne of providing City services, referred to as Cost Recovery.
Additionally, the City of Arvin adopted Resolution 2018-45, on June 19, 2018, which adopted a schedule of fees and charges for City services and activities relating to its Police Department, Animal Control Services, City Facility Rentals, Transit, Building Services, City Engineering Services, and City Planning Services. The Master Fee Schedule breaks a service or activity into two categories, a Flat Fee and Cost Recovery Deposit.
Pursuant to the AMC and current City policy, an application for a General Plan Amendment and a Rezone would be subject to the following Cost Recovery Deposits and Flat Fees. It should be noted that the amount would be double ($29,045 - $33,225), given that two (2) separate rezone and GPAs are required because of state law (one for the Subject Property and one for the Cityowned upzone site).
