Staff Report to Approve Eng Report & Set Public Hearing for LLMD No. 2_June 10, 2025

CITY OF ARVIN
Staff Report
Meeting Date: June 10, 2025
TO: Arvin City Council
FROM: Samuel Lux, City Engineer
Jeff Jones, City Manager
SUBJECT: Consideration and Approval of A Resolution to Approve the Engineer’s Report for Landscaping and Lighting Maintenance District No. 2 and Consideration and Approval of A Resolution Declaring Its Intention to Levy and Collect Assessments Within Landscape and Lighting Maintenance District No. 2 Pursuant to the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code, and Appointing A Time and Place for Hearing Objections Thereto.

BACKGROUND:

At its May 27th 2025 meeting, the City Council adopted a resolution to initiate proceedings for an update to Landscaping and Lighting Maintenance District No. 2. The resolution authorized the preparation of an Engineer’s Report with assessments for the existing lots in the district. The Engineer’s Report has since been completed and filed with the City Clerk. It recommends the assessments take effect for Fiscal Year 2025-2026.

The next step in approving and processing a reassessment for existing parcels would be to adopt a resolution of intent that approves the Engineer’s Report and schedules a public hearing on the proposed assessments. Currently, there are no substantial changes to the limits of the district, and no annexations are proposed.

The resolution of intent included with this staff report, proposes the Council’s June 24th 2025 meeting for the public hearing. At the close of the hearing, the Council will likely be asked to adopt a third and final resolution that orders the revised assessments.

Should the City Council approve the provided resolution, the City Clerk shall then advertise the notice of public hearing as soon as possible in a local paper.

FINANCIAL IMPACT:

There is no fiscal impact with the recommended actions. There is a 3.4% fee increase for FY 2025-2026. The funds from the Maintenance District will be collected by the Kern County Assessor’s Office and disbursed to the City as a special assessment. When collected, these assessments will go into a fund that shall be used to pay for the maintenance and operation of the lighting, landscaping, walls, drainage, and administration of the district.

Attachment: 1.FY 26 - Workshop 1 (Budget Workshop - General Fund FY 2025-2026) Fiscal Year 24/25 update
Driven by the reallocation of $900,000 in America Rescue Plan Act Fund to general fund expenses, slightly increased sales tax revenue, and modest revenue increases related to inflation, the City is looking at closing FY 24/25 with a surplus of $700,000 for that fiscal year.

This is the sixth out of the past seven years that the City’s general fund has achieved a surplus for the year.

It is anticipated that the as of June 30, 2025 the City will have exceeded its emergency reserve target of 25 percent of one year’s general fund expense spending. Estimated reserve will be approximately $2,600,000.
25 percent of one year’s general fund expenses = $2,500,000

by the City’s reserves. City staff will continue to
explore grant opportunities to generate

CHALLENGES
City staff have not posed any challenges filling vacancies for SEIU and Non-Represented classifications. However, the recruitment and retention of qualified Police Officers continues to present challenges both statewide and nationally. Law enforcement agencies are experiencing reduced applicant pools due to various factors, including increased public scrutiny, competitive labor markets, more extensive background and psychological screening requirements, and evolving generational career preferences that place less emphasis on public safety careers.

These conditions have led many jurisdictions to struggle with persistent vacancies and staffing shortages.

Human Resources and Police Department staff have implemented proactive recruitment strategies to remain competitive in the law enforcement labor market, including academy sponsorships, lateral hiring opportunities, and targeted outreach. As a result, the City has been able to fill most positions in a timely manner, ensuring minimal disruption to public safety services and preserving strong community engagement.

Human Resources staff continuously monitor and evaluate the City's ability to fill vacancies in a timely and efficient manner. At this time, no changes to existing policies, procedures, or practices are necessary, as vacancy rates remain low, and recruitment efforts have been effective in meeting operational needs.

FISCAL IMPACT
There is no fiscal impact associated with this status update.

CEQA ANALYSIS
The action is not defined as a "project" per Section 15378(b)(5) of the CEQA Guidelines because the action is an organizational and administrative activity that will not result in direct or indirect physical changes to the environment and is not subject to CEQA.

Staff Report - Local Government Plan / PLHA Amendment Plan.

CITY OF ARVIN
Staff Report
Meeting Date: June 10, 2025
TO: Arvin City Council
FROM: Christine Viterelli, Grants Manager
Jeff Jones, City Manager
SUBJECT: A Public Hearing to Accept Public Comment and Consider Adoption of A Resolution of the City Council of the City of Arvin Accepting and Adopting the Local Government Plan and Authorizing the City Manager to Execute the Permanent Local Housing Allocation Program (PLHA) Amendment Plan, Streamline Application, and Standard Agreement if awarded.

BACKGROUND:

On October 13, 2020, the City of Arvin previously authorized Resolution No. 2020-68, which authorized the City to apply for Permanent Local Housing Allocation Funds (PLHA). PLHA provides funding to local governments in California for housing-related projects and programs that assist in addressing the unmet housing needs of their local communities. in Arvin, the PLHA has been awarded for the purpose of providing loans to residents who desire to build Accessory Dwelling Units (ADUs).

This funding will be used to assist low-income households with Accessory Dwelling Unit (ADU) repairs to bring them into compliance with local codes and ordinances, to ensure tenant safety, and/or to assist with the cost of constructing a new ADU utilizing plans developed under the City's ADU Program that is currently in progress. Arvin residents who wish to apply for a garage conversion will also be eligible to participate in this program. However, they would have to submit their plans for a garage conversion, as garages are unique, and no standard template is available. The City has received approximately $ 689,013 in funding and estimates that the funding amounts will be in the $883,000 range for the entire PLHA program.

City Staff reached out to the Department of Housing and Community Development (HCD) to inquire if the prior plan could be amended to better support the community's needs by converting the plan from a 30 year, 0% interest loan to 5-year, 0% interest forgivable loans and to raise the low-income requirements so that more Arvin residents would be eligible to apply to the program.

HCD confirmed that this was acceptable to them.

The funding, provided through Senate Bill (SB) 2 (Chapter 364, Statutes of 2017), is intended to provide a permanent, ongoing source of financial support to local governments for housingrelated projects. The primary goal of SB 2 is to address unmet housing needs by supporting eligible housing and homelessness activities.

Staff Report - Local Government Plan / PLHA Amendment Plan.

The PLHA program requires the City to submit a streamlined application for the reserved funding each time a Notice of Funding Availability (NOFA) is released for a funding year, even though the funding amounts for previous years have been reserved for the City of Arvin’s PLHA ADU program.

PLAN:

The City of Arvin’s proposed five-year plan activity for year 5 funds is as follows:

Activity 2 – Streamline Application - Provide owner-occupied funding to assist eligible households with repairs to existing Accessory Dwelling Units (ADUs), bringing them into compliance with local building codes and ordinances to promote tenant safety. Additionally, funds may be used to support the construction of new ADUs, using pre-approved plans developed under the City’s ADU Program. Households with incomes up to 120% of the Area Median Income (AMI) may qualify for forgivable loans of up to $80,000. These loans carry zero percent interest and are fully forgivable after a five-year term, provided the borrower continues to occupy either the primary residence or the ADU as their primary residence throughout the forgiveness period.

Activity 2 – Amendment Plan 2020-2022
Increase in Loan Amount: The current maximum loan amount of $20,000, propose increasing the maximum loan amount to $80,000 per unit.

Adjustment to AMI Targeting: The current at or below 60% AMI propose increasing the eligible income threshold to at or below 120% AMI.

Loan Forgiveness Structure: Propose structuring the loan as forgivable after a five-year affordability period.

Note: Up to five percent (5%) of each annual allocation can be used to cover administrative costs associated with the administration of the plan. Staffing and overhead costs directly related to carrying out the eligible activities are “activity costs” not subject to the cap on “administrative cost.”
This resolution authorizes the City Manager to endorse the necessary forms and grant documents, including proposed amendments to the plan.

STAFF RECOMMENDATION:

Staff recommends approval of the resolution.

FINANCIAL IMPACT:

PLHA Funds are proposed to be available to the City for an Accessory Dwelling Unit program to be administered by Self-Help Enterprises. General Funds are not proposed to be utilized for administering the program.

Re: City of Arvin, A City with Growing Pains
Dear Foreperson:

The City of Arvin (“City”) received a copy of the Kern County Civil Grand Jury Report entitled “A City with Growing Pains,” dated February 10, 2025. Pursuant to the Grand Jury’s request for response, the Arvin City Council held a public meeting on June 10, 2025, and approved transmittal of this correspondence.

The City Council was asked to respond to Findings #1 through #14 and Recommendations #1 through #5 and #7 through #11. The City Council responds to the Grand Jury’s findings and recommendations as follows:

FINDINGS
F1. Many of the Arvin City employees have voiced concerns that other staff members are not doing the amount of work required for their respective positions, causing animosity in the workplace.

Response: The City Council disagrees with this finding due to insufficient information. However, the City Council acknowledges the importance of this finding.

Therefore, the City Manager has been directed to collect further information and analysis regarding this concern.

F2. Cohesiveness within the staff is often missing, demonstrated by employee allegiance – or lack thereof – to various members of the City Council, department heads, or fellow employees. This has resulted in the perception of two "teams" within the City staff working in different directions.

Response: The City Council disagrees with this finding due to insufficient information.

However, the City Council acknowledges the importance this finding and intends to work with the City Manager to determine what steps may be necessary to ensure an efficient, safe and professional working environment for all City staff.

F3. The unattractiveness of closed businesses discourages other businesses from locating in the downtown area.

Response: The City agrees with this finding. While downtown redevelopment does not happen overnight, the City Council plans to work with City staff and the community to prepare a long-term vision for the revitalization of the City’s downtown area that can be achieved incrementally.

F4. Repairing the streets in the downtown area of Arvin is a critical piece in the overall economic revitalization of the City, by aiding in the attraction of businesses to that part of town.

Response: The City agrees with this finding. In the economic context, sustainability is enhanced by attracting and retaining businesses that offer needed goods and services, as well as sufficient job opportunities for residents. In order to attract those businesses to the downtown area, the streets should be repaired.

F5. The lack of scrutiny of billings from the Outside Law Group has resulted in payment of invoices that are billed in excess of the contracted amounts.

Response: The City Council disagrees with this finding due to insufficient information.

However, the City Council acknowledges the importance of this finding and, as recommended, intends to hire an expert to audit Outside Law Group’s invoices. Once complete, this audit will provide the City with conclusive answers as to overpayments and/or underpayments to Outside Law Group.

F6. The contract with Outside Law Group describes the agreement as an appointment of an “interim City Attorney” (See Attachment A, ¶2.0 of the contract with Outside Law Group). The contract, dated May 25, 2021, is still in use, and no apparent effort has been made to either find a new qualified attorney or to update the contract with the Outside Law Group.

Response: The City Council agrees with this finding. As a result, a Request for Proposal for City Attorney services was issued. Following review of all proposals received, multiple municipal law firms were interviewed for the position of City Attorney. On April 14, 2025, the City entered into a Legal Services Agreement with Burke, Williams & Sorensen, LLP for City Attorney services. Burke provides an experienced team of municipal law practitioners supported by topic area experts suitable to support the full range of services provided by the City.

F7. Adjusting the contractual fees to be charged/paid with the 5% annual increase required under the contract in ¶3.1 results in the following hourly fee schedule:

Basic Services
Attorneys $260.46
Paralegals and Law Clerks $115.76
Special Legal Services
Partner/Of Counsel $341.50
Associate $260.46
Paralegals and Law Clerks $115.76
Third Party
Partner/Of Counsel $405.17
Associate $318.34
Paralegals and Law Clerks $144.70
Other Specialists
Partner/Of Counsel $318.34 to $520.93
Associates $248.89 to $318.34
Response: The City Council agrees with this finding. The rates outlined above are correct when including the annual rate increase. However, Outside Law Group did not increase their rates as permitted by the agreement when they represented the City as City Attorney.

F8. The City does not have a written contract in effect with the outside contractor working for the Planning Department. This could lead to excessive billing.

Response: The City Council partially agrees with this finding. Any third-party contractor working for the City without an agreement in place could lead to excessive billing. However, the City entered into a contract with Precision Engineering Inc. for on call planning services on September 24, 2024. The City Council acknowledges this finding and has ensured all third party contractors currently working for the Planning Department have a written contract in effect with the City.

F9. The Police Department’s emphasis on Community Policing has brought the crime statistics down considerably in the past two and a half years, contributing to Arvin becoming a more welcoming community.

Response: The City Council agrees with this finding.

F10. The City Council failed in its duty to either appoint a replacement for the Council vacancy, or to call for a Special Election.

Response: The City Council partially agrees with this finding. At the time of the Grand Jury Report’s publication, the City had not appointed a replacement for the Council vacancy or called a Special Election. However, on April 8, 2025, the City Council approved a Resolution calling for an All-Mail Ballot Special Municipal Election on Tuesday, August 26, 2025. The nomination period for this office began on May 05, 2025, and closed on May 30, 2025.

F11. The decision to cease the publishing of City Council Minutes has left the residents of Arvin without an easy way to determine what actions were taken by the City Council except what they may learn from the press or word of mouth.

Response: The City Council agrees with this finding. The City posts minutes on the City website once staff has received City Council approval. Minutes can be found at https://www.arvin.org/AgendaCenter.

F12. The deviation from the customary agenda format resulted in having the old council vote on matters before the new council had been seated. This prevented the new council’s opportunity to vote on matters that otherwise would have been before them.

Response: The City Council partially agrees with this finding. While the City has in the past customarily seated new members of City Council at the beginning of the first meeting following an election, it is not required by law.

F13. There is an inherent conflict with the City Manager also filling the roles of Finance Director and Community Development Director.

Response: The City Council partially agrees with this finding. As described in the response to Recommendation 10, the City recognizes the functional benefits of separating some of the City Manager’s responsibilities as a Finance Director, and assigning those responsibilities to a different person. That structure will allow the City Manager to provide management and oversight to the person performing the Finance Director responsibilities.

However, the City disagrees that it is feasible to create a separate role for a Community Development Director at this time.

F14. The City of Arvin should be commended for its forward thinking in the management of its Transit Department and the conversion of its bus fleet to all electric.

Response: The City Council agrees with this finding.

RECOMMENDATIONS
R1. The Grand Jury recommends that by May 1, 2025, a written contract with a contractor for the City’s Planning Department be completed and signed by all parties. (Finding #8)
Response: This recommendation has been implemented. A written agreement is in place with Precision Engineering, Inc. for all on-call planning services. The City does not have any other third party contractor working for the City’s Planning Department at this time.

R2. The Grand Jury recommends that by March 14, 2025, Arvin comply with California Elections Codes §§1000 and 1405 by filing notice of intent to hold a special election to fill the vacant City Council seat. (Finding #10)
Response: This recommendation has been implemented. The notice of intent was published on April 30, 2025. A copy of the notice can be found at https://arvin.org/DocumentCenter/View/1170/Notice-of-Election---Special-Municipal-Electionof-August-26-2025 R3. The Grand Jury recommends that a Special Election be held on November 4, 2025, to bring the City into compliance with law, California Code, Elections Code – ELEC §1000 to fill the vacant City Council Seat. (Finding #12)
Response: This recommendation will be implemented at a Special Election on August 26, 2025. At the time of publication, the City had not appointed a replacement for the Council vacancy or called a Special Election. However, on April 8, 2025, the City Council approved a Resolution calling for an All-Mail Ballot Special Municipal Election. Due to the population of the City, Kern County informed the City of the ability to hold an All-Mail Ballot Special Election on Tuesday, August 26, 2025. City Council believes it is appropriate to fill the vacancy as soon as possible. This All-Mail Ballot Special Election allows for a new member to join City Council in September, 2025 instead of December, 2025.

R4. The Grand Jury recommends that by July 1, 2025, the City assemble a working group made up of representatives from City Departments of Community Development, Economic Development, Parks & Recreation, Police, Transportation, and the City Council to work with similar groups of persons or groups, such as business groups, service clubs, and property owners interested in the revitalization of Arvin’s downtown area to develop an actionable plan to attract commerce, residents and others in the area. (Findings #3 and #4) Response: This recommendation will be implemented by July 1, 2025. To clarify, the City does not have Community Development, Economic Development or Parks & Recreation departments.

R5. The Grand Jury recommends that all Outside Law Group invoices from the commencement of the contract (May 26, 2021) to date be adjusted to include the retainer,

adjust the fees per the contract and reduce the number of hours charged accordingly by June 30, 2025. (Findings #6 and #7)
Response: This recommendation will be implemented. Following an audit conducted by an independent third party, the City will request adjustments of Outside Law Group invoices.

R7. The Grand Jury recommends that by July 1, 2025, the City Council secure a City Attorney by a valid contract or direct employment. (Finding #6) Response: This recommendation has been implemented. See response to Finding #6 above.

R8. The Grand Jury recommends that by August 1, 2025, the City, through its Human Resources Department, provide mandatory specialized training for the Mayor, City Council and all City employees regarding confidentiality, workplace decorum and team building. (Findings #1 and #2)
Response: This recommendation will be implemented. The City is currently in the process of retaining a human resource firm that specializes in assisting local government agencies and will act as the City’s Human Resources Manager. A request for proposal was published on May 20, 2025. Following the retention of a Human Resources Manager, mandatory specialized training will be provided for the City Council and City employees as recommended.

R9. By July 1, 2025, the City Council should codify an agenda format to be followed at the first meeting following the certification of an election, special election or appointment.

This format should place the swearing in of new members (including the Mayor) first on the agenda followed by Public Comments. (Finding #12)
Response: This recommendation will be implemented. While this is not required by law, the City Council agrees that a codified agenda format following the certification of an election, special election or appointment will set a clear procedure moving forward.

R10. By July 1, 2025, an Assistant City Manager should be hired to relieve the conflicts created for the City Manager by filling the multiple roles of City Manager, Finance Director, and Community Development Manager. (Finding #13)
Response: A portion of this recommendation will be implemented; however, a portion of this recommendation will not be implemented because it is not reasonable. The City Council desires to separate the role of City Manager and Finance Director; however, City Council does not believe an Assistant City Manager position is feasible at this time. Additionally, the City does not have a Community Development Department and therefore the role of Community Development Manager does not exist.

4907-3012-7940 v2
R11. By July 1, 2025, the Grand Jury recommends that City Council Meeting Minutes be posted on the City’s website promptly after they are approved by the City Council.

Response: This recommendation has been implemented. Please see Finding # 11.
