Staff Report re Adoption and Second Reading of Ordinance Amending AMC Sections 2.06.090 and 2.060.100.

CITY OF ARVIN
Staff Report
Meeting Date: January 13, 2026
TO: Honorable Mayor, Mayor Pro Tem and Members of City Council FROM: Jeff Jones, City Manager
Stephanie Gutierrez, City Attorney
SUBJECT: Adoption and Second Reading of Ordinance Amending AMC Sections 2.06.090 and 2.060.100 Regarding Administrative Authority of the City Manager BACKGROUND:

On October 28, 2025, the City Council formally decided that the positions of City Manager and Finance Director will be held by two separate individuals going forward. Accordingly, staff determined that amendments to the Arvin Municipal Code (AMC) are necessary to ensure consistency with both Council direction and state law.

California Government Code
The authority and limitations governing the council-manager form of government are established by California Government Code Section 34851 et seq., which outlines the respective powers and responsibilities of the city council and the city manager. The city manager has the authority to appoint and remove the chief of police and other subordinate appointed officers and employees, except for the city attorney.

Amendment of Arvin Municipal Code Sections 2.06.090 and 2.06.100 Currently AMC Sections 2.06.090 and 2.06.100 expressly exclude the Finance Director position from the City Manager’s appointment and administrative authority. Based on the statutory framework provided by California Government Code Section 34856, the authority to appoint the Finance Director resides with the City Manager. The proposed ordinance, attached as Exhibit A, grants the City Manager the authority to direct and oversee all department heads, including the Finance Director, subject to adherence to all applicable personnel ordinances, rules, regulations, and state law.

STAFF RECOMMENDATION:

The City Council approve the second reading to be read by title only and adopt the Ordinance Amending AMC Sections 2.06.090 and 2.060.100 Regarding Administrative Authority of the City Manager.

ORDINANCE NO. _________

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARVIN
AMENDING SECTION 2.06.090 AND SECTION 2.06.100 OF THE ARVIN

MUNICIPAL CODE REGARDING ADMINISTRATIVE AUTHORITY OF
THE CITY MANAGER: EMPLOYEE OVERSIGHT AND

APPOINTMENT/REMOVAL
The City Council of the City of Arvin does ordain as follows:

SECTION 1: Findings. The City Council finds and declares as follows:

A. The authority and limitations governing the council-manager form of government are established by California Government Code Section 34851 et seq., which outlines the respective powers and responsibilities of the city council and the city manager.

B. Pursuant to Government Code Section 34856, the City Manager has the authority to appoint and remove the chief of police, finance director and other subordinate appointed officers and employees, except for the city attorney.

C. Currently, pursuant to Arvin Municipal Code Sections 2.06.090 and 2.06.100 the Finance Director position is expressly excluded from the City Manager’s appointment and administrative authority.

D. The City Council desires to amend Arvin Municipal Code Sections 2.06.090 and

2.06.100 to comply with Government Code Section 34856.

SECTION 2: Amendments. Arvin Municipal Code (“AMC”) Sections 2.06.090 and 2.06.100 are amended to read as follows:

2.06.090 – Authority over employees.

It shall be the duty of the city manager, and he/she shall have the authority to control, order and give direction to all heads of department, officers, subordinate officers and employees of the city under his jurisdiction through their department heads, except the city attorney, and as to the duties of the city clerk as imposed by the Government Code.

2.06.100 – Power of appointment and removal.

The city manager shall have the authority to appoint, remove, promote, and demote all officers and employees of the city, except the city attorney, in compliance with applicable personnel ordinances, rules, regulations and state law.

SECTION 3: Construction. This Ordinance must be broadly construed to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be

SECTION 4: Enforceability. Repeal of any provision of the Arvin Municipal Code does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before this Ordinance’s effective date. Any such repealed part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Ordinance.

SECTION 5: Electronic Signatures. This Ordinance may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.

SECTION 6: Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provision or application and, to this end, the provisions of this Ordinance are severable.

SECTION 7: Recordation; Validity of Previous Code Sections. If this entire Ordinance or its application is deemed invalid by a court of competent jurisdiction, any repeal or amendment of the AMC or other city ordinance by this Ordinance will be rendered void and cause such previous AMC provision or other city ordinance to remain in full force and effect for all purposes.

SECTION 8: Environmental Assessment. The City Council finds that this actions contemplated in this Ordinance do not require further review under the California Environmental Quality Act (Public Resources Code §§ 21000, et seq., “CEQA”) and the regulations promulgated thereunder (14 California Code of Regulations §§ 15000, et seq., the “CEQA Guidelines”) because, under CEQA Guidelines §§ 15060(c)(2) and 15378(b)(2), they do not result in direct or reasonably foreseeable indirect physical changes in the environment. In addition, this Ordinance further qualifies as a “general policy or procedure making” action under CEQA Guidelines § 15378(b)(5), as it solely governs the use, custody, and licensing of symbolic city property and intellectual property assets, without altering land use, zoning, or existing facilities.

SECTION 9: Publication. The City Clerk is directed to certify the passage and adoption of this Ordinance; cause it to be entered into the City of Arvin's book of original ordinances; make a note of the passage and adoption in the records of this meeting; and, within 15 days after the passage and adoption of this Ordinance, cause it to be published or posted in accordance with California law.

SECTION 10: Effective Date. This Ordinance will become effective 30 days after adoption. \ \ \

Staff Report Unmet Transit Needs Hearing 2026

CITY OF ARVIN
Staff Report
Meeting Date: January 13, 2026
TO: Arvin City Council
FROM: Jeff Jones, City Manager
SUBJECT: A PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION OF

THE CITY COUNCIL OF THE CITY OF ARVIN DECLARING THERE

ARE NO UNMET TRANSIT NEEDS THAT CAN BE REASONABLY MET

WITHIN THE CITY OF ARVIN

RECOMMENDATION
Staff recommends that the City Council consider all public comments and testimony presented during the hearing and approve the resolution declaring that there are no unmet transit needs that can reasonably be met.

BACKGROUND
The Transportation Development Act of 1971 (TDA), as amended, governs the allocation of funds from the Local Transportation Fund for eligible transportation uses. These funds are distributed by the Kern Council of Governments (KCOG), acting as the Regional Transportation Planning Agency.

To qualify for TDA funding, the City must conduct an annual review of transit needs and hold a public hearing to receive written and oral comments regarding unmet transit needs and whether those needs are reasonable to meet.

Although the TDA does not provide explicit definitions for “Unmet Transit Needs” or “Reasonable to Meet,” it states that the inability to fully meet a transit need due to limited resources shall not be the sole reason for determining that the need is not reasonable to meet.

The City of Arvin interprets an unmet need as a situation where an individual, regardless of age or physical condition, cannot transport themselves due to deficiencies in the existing transportation system. Requests for minor operational improvements and improvements already funded and scheduled for implementation in the upcoming fiscal year are excluded.

A transit need is considered reasonable to meet if it is safe to operate with adequate roadways for transit vehicles, does not duplicate existing transportation services, addresses an existing need rather than a future need, and meets ridership requirements necessary to satisfy farebox recovery ratios as required by law (Public Utilities Code §§ 99268.2, 99268.5; 21 CCR §§ 6633.2, 6633.5), with fares comparable to similar services.

Based on the above criteria, the City’s review did not identify unmet transit needs that can be reasonably met.

Atencion: City Clerk, City of Arvin, 200 Campus Drive, Arvin, CA 93203, [email protected].

CITY OF ARVIN
Staff Report
Meeting Date: January 13, 2026
TO: Arvin City Council
FROM: Cecilia Vela, City Clerk
Jeff Jones, City Manager / Finance Director
SUBJECT: Consideration and Approval of Appointment of Board of Trustee to the Kern Mosquito & Vector Control District (KMVCD) and Setting the Term of the Appointment.

BACKGROUND:

The Kern Mosquito & Vector Control District (KMVCD) Board is made up of eight (8) Trustees; four appointed by the Kern County Board of Supervisors, one each by City Councils of Bakersfield, Arvin, Shafter, and Wasco. The appointment of the current City of Arvin’s Trustee, Ms. Fatima Arrellano Gonzalez, expired on December 31, 2025. The City Council may consider to either, (1) appoint a qualified Arvin resident; or (2) appoint a member of the City Council to fill the City of Arvin’s Trustee seat for a term expiring on December 31, 2027 or December 31, 2029.

PRIMARY OBJECTIVE OF THE KMVCD BOARD:

The primary objective of the KMVCD is the progressive elimination of mosquito breeding places, the objective to be accomplished by an educational service on control measures, performing services of temporary relief control, establishing projects of source reduction, using abatement procedure methods when necessary, and by general policy of cooperation.

QUALIFICATIONS TO SERVE AS THE KMVCD BOARD TRUSTEE:

To be eligible to serve as the City of Arvin District Trustee of the KMVCD Board, the individual must be at least 18 years of age, and an elector and resident of the City of Arvin. The filing of a Statement of Economic Interest disclosing certain personal financial holdings is required upon appointment and annually thereafter is required (Government Code sections 81000-91014). Two hours of training in general ethics principles and ethics law upon appointment, and every two years thereafter is required. (Government Code 53235(b), 53235.1).

The Arvin City Council may either, (1) appoint a qualified resident of Arvin; or (2) appoint a member of the City Council to serve as the KMVCD Board of Trustee.

The Trustee must be available to attend meetings at the KMVCD office in Bakersfield every 2nd Wednesday of the month at 11:30am in Bakersfield. The term of the trustee may be set for either two or four years at the discretion of the City Council. Therefore, the term is scheduled to expire on December 31, 2027 or December 31, 2029.

RECOMMENDATION:

Staff recommends that the City Council either, (1) appoint a qualified Arvin resident; or (2) appoint a member of the City Council to serve as the KMVCD Board Trustee and set the term of the appointment.

FINANCIAL IMPACT:

None

CITY OF ARVIN
Staff Report
Meeting Date: January 13, 2026
TO: Arvin City Council
FROM: Dennis Clark, Acting Finance Director
SUBJECT: A RESOLUTION OF THE BOARD OF DIRECTORS OF THE

SUCCESSOR AGENCY TO THE DISSOLVED ARVIN COMMUNITY

REDEVELOPMENT AGENCY, APPROVING AND ADOPTING A RECOGNIZED OBLIGATION PAYMENT SCHEDULE COVERING THE PERIOD OF JULY 1, 2026 THROUGH JUNE 30, 2027, PURSUANT TO HEALTH AND SAFETY CODE SECTION 34177(l) AND (o).

BACKGROUND:

As part of the RDA wind down process, each successor agency is responsible for drafting a Recognized Obligations Payment Schedule (ROPS) delineating the enforceable obligations of the former RDA and their source of payment every year. ROPS are subject to the approval of the local oversight board.

In the past, the ROPS were presented every six months. The State of California has changed the reporting period to be an annual report. In compliance with this requirement, Staff has prepared ROPS 26-27 for the Period July 01, 2026 to June 30, 2027 which is due to the Department of Finance (DOF) by February 1, 2026. Attached is the ROPS that Staff is recommending for submittal. This list includes all obligations that have been identified and the amounts requested for payment in this cycle. Items are listed under the RPTTF column for Admin or Non Admin obligations. “RPTTF” stands for Redevelopment Property Tax Trust Fund. These are the revenues collected through property taxes. These funds must be used first to meet debt obligations and any remaining obligations may be funded with the RPTTF. The Successor Agency currently has $5,230,000 in bond debt which will be paid off in full by 2039.

The rows highlighted in red on the “Obligation Payment Schedule” are items that have been denied in previous ROPS requests, specifically for loans that the City of Arvin provided to the former City of Arvin Redevelopment Authority between 1998 and 2012. The City and the Successor Agency verified the loans in 2012, however they remain open due to the Department of Finance needing additional documentation in order to approve the items and reimburse the City. Staff has kept them on the ROPS schedule in order to keep them active and give the City an opportunity to revisit these requests in future submissions. The main item identified for payment during this cycle will be the funds to meet bond obligations for a principal and interest payment in March and September. In addition to the bond principal and interest payments, a modest amount for general maintenance expenditures for the properties currently owned by the Successor Agency is included on the ROPS schedule. The allowable amount for Administrative Costs is estimated to be $185,000 and will be included on this schedule. This amount is below the ‘minimum amount’ of $250,000 which is authorized per ROPS guidelines and State law.

7.A.1
Attachment: ROPS 26.27 SR (Approval of ROPS 26/27)
Staff has determined that $185,000 is sufficient to support all administrative costs of the Successor Agency. Administrative costs include staff time, appraisals of property owned by the Successor Agency, City Attorney expense, and other consultant costs.

In prior years, and most recently in 2014, the total available RPTTF through property taxes was less than the amounts being requested on the ROPS. Should this situation happen during FY 26- 27, the obligations that cannot be funded in this cycle will be carried over into the next ROPS cycle, and the City will be asked to provide a short-term loan to the Successor Agency to cover the shortfall. Based on current projections of property tax incremental revenue due to the Successor Agency for the period of July 1, 2025 to June 30, 2026 this situation is highly unlikely to happen.

Once the ROPS is approved by the Successor Agency, it will be submitted to the Kern County Oversight Board for approval and then to the DOF, Kern County Auditor Controller and the State Controller’s Office for review and approval.

RECOMMENDATION:

Staff recommends that the Successor Agency Board approve the ROPS 26-27 for the period of July 01, 2026, to June 30, 2027 and authorize staff to submit this also to the Kern County Oversight Board for approval.

FISCAL IMPACT:

None. There is cost recovery for staff time which City staff spends on Successor Agency business. Such cost recovery is paid via an administrative allowance that the City requests on the ROPS.
