nd Reading & Adoption of Ordinance Amending Arvin Municipal Code §2.06.210 to Authorize the City Manager to Execute Certain Grant Documents.
CITY OF ARVIN
Staff Report
Meeting Date: February 10, 2026
TO: Arvin City Council
FROM: Christine Viterelli, Grants Manager
Jeff Jones, City Manager
SUBJECT: Approval of Second Reading and Adoption of An Ordinance of the City Council of the City of Arvin, California, Amending Arvin Municipal Code Chapter 2.06 to Add a New Section §2.06.210 Authorizing the City Manager to Execute Certain Grant Documents Without Prior Approval.
BACKGROUND:
The California Department of Housing and Community Development (HCD) has notified the City that it is changing its signatory rules to require that the City Manager sign grant applications, grant checks, and other such grant-related documents. The standard practice is to certify by resolution of the City Council to apply for a grant, and in the past, that resolution would then authorize the City Manager to endorse grant applications, amendments, warrants (funding checks), and other such documents needed to apply for, execute, and expeditiously implement the grant projects.
This standard procedure of seeking City Council approval to apply for a grant by resolution will remain unchanged and continue for future HCD grant applications. Effective in 2026, however, HCD is now requiring that all cities in California provide a copy of an ordinance authorizing the City Manager to execute grant documents, in addition to submitting the certified resolution. If an ordinance is not passed, then only the Mayor can sign the documents and endorse the warrants (checks) as they come into the finance department.
The City does not currently have this ordinance in place. Not having an existing ordinance authorizing the City Manager to execute grant documents creates a logistical nightmare during a short grant application window and may limit the ability to deposit checks from the funding agency to ensure adequate incoming cash flow. Additionally, there have been incidents in which HCD has requested quick revisions to HCD applications that require a signature, with very short turnaround times, in order to secure funding. For all the reasons stated above, city staff is now requesting and recommending that the City Council approve and pass this ordinance.
Introduction and first reading, read by title only, of the Ordinance was held during the Arvin City Council Meeting of January 27, 2026.
STAFF RECOMMENDATION:
Staff recommends the City Council consider adopting the Ordinance to be read by title only, waive second reading of the Ordinance, and approve the adoption of the Ordinance.
FINANCIAL IMPACT:
No fiscal impact.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARVIN,
CALIFORNIA, AMENDING ARVIN MUNICIPAL CODE CHAPTER 2.06
TO ADD A NEW SECTION §2.06.210 AUTHORIZING THE CITY
MANAGER TO EXECUTE CERTAIN GRANT DOCUMENTS WITHOUT
PRIOR CITY COUNCIL APPROVAL
WHEREAS, The City of Arvin Municipal Code (“AMC”) Chapter 2.06 (City Administrator/City Manager) created the office of the city manager in 1983, assigning the office responsibility for the efficient administration of all affairs of the city which are under his/her control;
WHEREAS, California Government Code generally requires the Mayor to execute all contracts on behalf of the City unless the City Council, by ordinance, gives signature authority to a city officer, which is generally the City Manager and/or Purchasing Officer. The City Council has not yet exercised this provision to delegate signature authority to a city officer; WHEREAS, the City Council desires to make updates to the City Manager’s powers and duties to allow the City Manager to sign grant applications, grant contracts and grant checks in order to avoid delay in receiving necessary funding;
WHEREAS, the City Council wishes to adopt this Ordinance to effectuate the increase in the City Manager’s signature authority to streamline the City’s grant application process, making City operations more cost-efficient, while maintaining prudent control and reporting mechanisms in the best interest of the City and its residents.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARVIN
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance by reference.
SECTION 2. Amendment. Section 2.06.210 (“Authorization of City Manager to execute certain agreements without prior council approval”) of Chapter 2.06 (“City Administrator/City Manager”) of Title 2 (“Administration and Personnel”) is hereby added to read as follows:
Section 2.06.210. Authorization of City Manager to execute certain agreements without prior council approval.

Safely Surrendered Baby Awareness Month
February 2026
Whereas, the Safely Surrendered Baby Law (SSB) was implemented on January 1, 2001, with the intent to prevent harm and possible death to newborns, and Governor Schwarzenegger signed legislation extending the SSB Law permanently as of January 1, 2006.
Whereas, the intent of the laws is to save the lives of newborn infants at risk of abandonment by encouraging parents or persons with lawful custody to safely surrender the infant within 72 hours of birth, with no questions asked; and
Whereas, since 2006, 105 babies have been safely surrendered in Kern County; and Whereas, in Arvin and throughout Kern County, a newborn baby can be safely surrendered into the hands of any hospital emergency room or Fire Station staff; and Whereas, the Safely Surrendered Baby Coalition, under the coordination of the Department of Human Services, works to educate Arvin Citizens and all Kern County residents about this important law. The coalition is made up of a small group of dedicated individuals representing a long list of agencies, non-profits, hospitals, and stakeholders, including First Five Kern, Kern County Fire Department, Bakersfield City Fire Department, Right to Life Kern County, Adventist Health Hospitals, Clinica Sierra Vista, and Kern Family Healthcare to name a few.
Now, therefore, on behalf of all the citizens of the City of Arvin, We, the City Council of the City of Arvin are honored to declare February 2026, as Safe Surrendered Baby Awareness Month in the City of Arvin and recognize the work being done by the Safely Surrendered Baby Coalition.

PROCLAIM FEBRUARY 2026 AS SAFE SURRENDER BABY
AWARENESS MONTH IN KERN COUNTY
The purpose of this letter is to ask the Arvin City Council to proclaim February 2026 as Safely Surrender Baby Awareness Month and to advise the community of planned events to highlight the importance of the Safely Surrendered Baby Law.
The Safely Surrendered Baby Law responds to the increasing number of newborn infant deaths due to abandonment in unsafe locations. First created in January 2001, the law’s intent is to save the lives of newborn infants at risk of abandonment by encouraging parents or persons with lawful custody to safely surrender the infant within 72 hours of birth, with no questions asked. Since 2006, Kern County has had 105 babies safely surrendered.
In Kern County, a newborn baby can be safely surrendered into the hands of any hospital emergency room or Fire Station staff. The Safely Surrendered Baby Coalition, under the coordination of the Department of Human Services, works to educate Kern County residents about this important law.
The coalition is led by the Department of Human Services, and includes a group of dedicated individuals representing a long list of agencies, non-profits, hospitals, and stakeholders, including First Five Kern, the Kern County Fire Department, Bakersfield City Fire Department, Bakersfield Pregnancy Center, Right to Life Kern County, Adventist Health Hospitals, Clinica Sierra Vista, Kern Family Healthcare, Koinonia Family Services, Kern County Public Health, and Ridgecrest Regional Hospital.
Our February Awareness Campaign will include, a Live Press Conference February 18, 2026 at Adventist Health Specialty located at 3001 Sillect Ave, Bakersfield CA 93308 beginning at 10:00am, over 15 presentations at collaborative agencies throughout Kern County and Public Services Announcements on social media, all in an effort to alert the community about the Safely Surrendered Baby Law as a much better option than abandoning a baby.
Therefore, IT IS RECOMMENDED that the City Council proclaim February 2026 as Safely Surrendered Baby Awareness Month, prepare a proclamation and make a presentation.
Sincerely,
Lito Morillo
Director

for Newborns* is a
law that allows you
to give up your baby.
Certainly we want women to get proper medical
care and counseling while they are pregnant, not
after giving birth. But at the same time, we want
parents to know that if they choose not to keep their
baby, they will not go to jail for abandonment if they
deliver the baby to safe hands in any emergency
room or Fire Station in Kern County.
Don’t abandon your baby.
You can safely surrender
your newborn baby (up to

3.F.3
Attachment: KCDHS Brochure SSB_021026 (Proclamation - Feb 2026 Safely Surrendered Baby How does it work?
A distressed parent who is unable or unwilling to care
for an infant can legally, confidentially and safely
surrender their baby within 3 days of birth. All that
is required is that the baby be brought to any fire
station or emergency room. If there are additional
places, they will be listed on this brochure. A bracelet will be placed on the baby for identification. A
matching bracelet will be given to the parent. The
bracelet will help connect the parent to the baby if
the parent wants the baby back.
Does the parent have to call before bringing
in the baby?
No. A parent can bring in a baby anytime, 24 hours a
day, 7 days a week.
Can only a parent bring in the baby?
In most cases, a parent will bring in the baby. The
law allows another person to bring in the baby if they
have lawful custody.
Does a parent have to tell anything to the people
accepting the baby?
No. Nothing is required. However, hospital personnel
will give the parent a medical information
questionnaire that is designed to gather family
medical history. This could be very useful in caring for the child but it is up to the parent to complete it.
What happens to the baby?
The baby will be examined and given medical
treatment, if needed. Then the baby will be placed in
a foster or pre-adoptive home.
What happens to the parent?
Once the parent(s) has safely turned over the baby,
they are free to go.
What if a parent wants the baby back?
The parent(s) may take the bracelet back to the
hospital. Under the SSB Law, a parent has at least 14
days to claim his or her infant. Hospital personnel will provide information about the baby.
Why does California have this law?
The purpose of the Safely Surrendered Baby Law is to
protect babies from being hurt or killed because they
were abandoned.
You may have heard tragic stories of babies left
in dumpsters or public toilets. The persons who
committed these acts may have been under severe
emotional distress. The mothers may have hidden
their pregnancies, fearful of what would happen if
their families found out. Because they were afraid
and had nowhere to turn for help, they abandoned
their infants.
Abandoning a baby puts the child in extreme
danger. It is also illegal. Too often, it results in the baby’s death. Because of the Safely Surrendered
Baby Law, this tragedy doesn’t ever have to happen
in California again.
Is there another choice?
Yes. Adoption is always a choice and should be
considered first. Whenever parents have decided
that they are unable to care for a baby, whatever
the reason, adoption is by far the best choice.
Adoption protects the rights of all involved, including the baby. In fact, parents may be able to assist in
selecting the adoptive parents and may be allowed
to have contact with the baby after the adoption.
It’s important for women to seek help while they are
pregnant, not after giving birth.
A Safely Surrendered Baby in California
At 8:30 a.m. on Thursday, July 25, 2002,
a healthy newborn baby was brought to St.
Bernardine Medical Center in San Bernardino
under the provisions of the California Safely
Surrendered Baby Law.
This baby was another child protected under
California’s Safely Surrendered Baby Law. As
the law states, the baby’s mother did not have
to identify herself. When the baby was brought
to the emergency room, he was examined by a
pediatrician and was healthy and doing fine.
He was placed in a foster home for short-term
care while the adoption process was started.
Every baby deserves a
chance for a healthy
life. If you or someone
you know is considering
giving up a newborn,
learn about your options.
What is the
Safely Surrendered
Baby Law?
Under this law, a person
may surrender their baby
confidentially without fear
of arrest or prosecution for
abandonment.

Staff Report re Discussion of AMC Chapter 5.24 Yard Sales
CITY OF ARVIN
Staff Report
Meeting Date: February 10, 2026
TO: Arvin City Council
FROM: Isaiah Medina, Consultant Planner
Jeff Jones, City Manager
SUBJECT: Discussion and Direction – Chapter 5.24 YARD SALES BACKGROUND:
Residents have reported that some properties within the City are conducting yard sales almost every day or every weekend, effectively operating ongoing retail activity in residential neighborhoods. Under the current Arvin Municipal Code, a “yard sale” is permitted only with a City-issued permit, with a fee of $10 per permit; no more than two yard sales may occur at a location within any consecutive 12 months; each permit authorizes up to three consecutive calendar days; permissible hours are 7:00 a.m. to 9:00 p.m.; and the City Manager may issue additional permits to churches and recognized civic, social, and nonprofit organizations. The permit must be posted and available for inspection, and items for sale must be accessible to law enforcement and safety officials.
While the code sets an annual cap and duration per event, residents report that certain locations appear to rotate sales among household members or affiliated parties or otherwise hold sales so frequently that they create traffic, noise, clutter, and neighborhood impacts similar to ongoing commercial use. Current provisions do not explicitly address minimum spacing between yard sale events or aggregation across occupants at the same address and have not been amended since 1982.
EVALUATION OF CURRENT ORDINANCE AND POTENTIAL ACTIONS:
Staff has identified several key areas for Council discussion and evaluation:
Clarification of Definitions
1. Yard Sale Definition. Retain the current definition but clarify that the annual limit applies per street address (parcel), regardless of the occupant or organizing party, to prevent evasion of the regulation by rotating permittees.
2. Location Clarity. Specify that duplexes and ADUs share the same cap when accessed from the same street address.
5.A.1
Attachment: Staff Report_Chapter 5.24 YARD SALES Discussion (Discussion Re AMC Chapter 5.24 Yard Sales.)
Staff Report re Discussion of AMC Chapter 5.24 Yard Sales Frequency Controls
1. Intervals. Maintain annual cap of 2 but add a minimum spacing interval (e.g., 90 days) between permitted yard sales at the same address.
2. Event Duration. Keep the maximum of 3 consecutive calendar days per permit; consider limiting a single address to one weekend day per yard sale event if weekday activity is less impactful.
3. Seasonal Moratorium. Optionally restrict to certain weekends (e.g., spring/fall community sale weekends) to concentrate enforcement and communication.
Exemptions
Retain exemptions for churches and civic/social/nonprofit organizations but require:
• Registration of the organization’s status;
• Site plan for parking and traffic management when applicable; and • Limits on frequency for the same address (e.g., not more than 4 times annually unless at a designated institutional site).
Legal Considerations
Amendments should be content neutral, reasonable time/place/manner regulations for residential areas. The City Attorney’s Office will review draft language to ensure consistency with existing business licensing provisions and to maintain exemptions for recognized nonprofits while preventing misuse.
OPTIONS:
• Maintain status quo and focus on education and targeted enforcement. • Implement a pilot program establishing community sale weekends for six months, then evaluate.
• Adopt comprehensive amendments (definitions, spacing, fees, enforcement, operating standards). If directed, staff will (1) draft ordinance amendments consistent with Council direction, (2) return to Council within 60 days with a first reading, and (3) launch updated online permitting and outreach materials consistent with the new regulations.
STAFF RECOMMENDATION:
Provide direction to staff on potential amendments to the Municipal Code to address concerns about recurring or near continuous yard sales at certain properties.
FINANCIAL IMPACT:
Minimal to moderate. Enhanced enforcement may require additional code compliance hours, offset by citations.

Chapter 5.24 YARD SALES
Sections:
5.24.010 Yard sale defined.
"Yard sale," for the purpose of this chapter, means any event to which members of the public may come and purchase identifiable or tangible personal property; provided, however, it does not mean any such event which constitutes a sales activity, wholesale or retail, by any business which has a current business license issued by the city.
(Ord. 177 (part), 1982).
5.24.020 Permit—Required.
It is unlawful for any person, corporation, partnership, joint venture, association or any other form of organization to organize, conduct, establish or operate a yard sale in the city without first obtaining a permit to do so from the city manager or his authorized representative for a fee of ten dollars ($10.00) per permit. (Ord. 231 (part), 1988: Ord. 177 (part), 1982).
5.24.030 Permit—Conditions.
The city manager or his authorized representative shall issue a yard sale permit to an applicant if he finds all of the following conditions exist as to the application:
A. The operation or conduct of the requested event will not be contrary to the public peace, health, safety and welfare of the city;
B. The applicant has submitted satisfactory evidence that adequate and safe parking accommodations will be provided for the yard sale; and
C. The location at which the proposed yard sale is to be held is a location where not more than two (2) yard sales have been conducted within the last consecutive twelve (12) months immediately preceding the date of filing the pending application.
(Ord. 177 (part), 1982).
5.24.040 Hours of sale—Designated.
Any yard sale permit issued hereunder shall be for a period not exceeding three (3) consecutive calendar days. A permittee granted a permit under this chapter shall not conduct a yard sale for a period of time in excess of three (3) consecutive calendar days, and at no time before seven (7) a.m. or after nine (9) p.m. (Ord. 177 (part), 1982).
5.24.050 Hours of sale—Exemptions.
The city manager may issue yard sale permits in excess of that limit listed in the preceding section to:

Staff Report re Discussion of AMC Chapter 12.16 Parking and Keeping of Trucks Within City Limits
CITY OF ARVIN
Staff Report
Meeting Date: February 10, 2026
TO: Arvin City Council
FROM: Isaiah Medina, Consultant Planner
Jeff Jones, City Manager
SUBJECT: Discussion and Direction – Chapter 12.16 PARKING AND KEEPING OF
TRUCKS WITHIN CITY LIMITS
BACKGROUND:
Arvin Municipal Code Chapter 12.16 (“Truck Ordinance”) establishes regulations for the parking, keeping, and routing of trucks with a gross vehicle weight over 10,000 pounds. The ordinance was originally adopted in the 1990s, when surrounding land uses and street networks differed significantly from current conditions.
Under existing the existing ordinance:
• Trucks may not be parked within 100 of an intersection. • Trailers and semi-trailers may be parked only in the Arvin Industrial Park or specific segments of South Derby Street when unattached.
• Trucks carrying flammable materials are prohibited in residential districts. • Trucks are prohibited from being kept or parked in new subdivisions approved by City Council, with signage required prior to subdivision acceptance. • Designated truck routes are limited to specified segments of Comanche Drive, Sycamore Road, Derby Street, Bear Mountain Blvd (Highway 223), Kovacevich Street, Stockton Avenue, and Schipper Street.
These standards were designed for the street network and development patterns existing at the time.
The primary concern raised by residents is that the truck parking locations authorized in the current ordinance were established before several nearby residential neighborhoods were built.
As a result:
• Trucks are legally parking on streets that were once buffered from homes but are now directly adjacent or near newly developed residential areas. • This creates noise, safety, and visual impacts for new homeowners, despite trucks technically complying with the ordinance.

Staff Report re Discussion of AMC Chapter 12.16 Parking and Keeping of Trucks Within City Limits • The concern is not necessarily with the truck operators, but with the outdated nature of the designated streets, which have not been reevaluated since the ordinance’s latest amendment in 1997.
Residents report issues such as idling, limited line‑of‑sight, early‑morning truck movements, and overall incompatibility with residential character.
AREAS FOR COUNCIL CONSIDERATION AND DISCUSSION:
Review and Update Designated Truck Parking Streets
1. Identify streets where truck parking is currently permitted but now conflict with nearby residential areas.
2. Consider removing or relocating these permitted areas.
Establishment of Truck Parking Buffers
1. Set minimum separation distances between truck parking areas and homes (e.g., 300–500 feet).
2. Evaluate impacts on safety, noise, nighttime lighting and air quality.
Expansion or Relocation of Industrial Parking Zones
1. Assess alternative sites for off street or designated on street truck parking in industrial areas.
2. Explore potential public private partnerships for truck parking facilities.
Enforcement and Communication
1. Improve signage clarifying prohibited areas.
2. Increase code enforcement presence and outreach to truck operators.
Legal Considerations
As the Council considers potential updates to the truck parking regulations, it is important to do so within the broader framework of state law. The City maintains substantial authority to modify permitted truck parking locations, establish appropriate buffer requirements, and revise designated truck routes to reflect current neighborhood conditions, provided these changes remain content neutral, reasonable, and consistent with applicable state procedures. Should the Council direct staff to prepare amendments, staff will work closely with the City Attorney’s Office to ensure full compliance with state law.
OPTIONS:
• Maintain status quo and focus on targeted enforcement under current rules. • Modify truck parking locations and replace with more suitable industrial area locations. • Create expanded buffer requirements by prohibiting truck parking within a specified

This could include clearer definitions, updated truck routes, new penalties, and structured parking solutions.
STAFF RECOMMENDATION:
Staff recommends that the City Council provide direction on whether to initiate amendments to Arvin Municipal Code Chapter 12.16 regulating the parking and keeping of trucks within City limits, specifically to address truck parking near recently developed residential neighborhoods.
FINANCIAL IMPACT:
Minor to moderate. Financial impacts will depend on the direction provided by the Council.
