E. Should the Agreement be terminated pursuant to this Section, CITY may procure on its own terms services similar to those terminated.

F. By executing this document, CONSULTANT waives any and all claims for damages that might otherwise arise from CITY’s termination under this Section.

17. OWNERSHIP OF DOCUMENTS; EXCEPTIONS; WARRANTY. CONSULTANT may retain copies of such Documents as desired but will deliver all original materials to CITY upon CITY’s written notice. CITY agrees that use of CONSULTANT’s completed work product, for purposes other than identified in this Agreement, or use of incomplete work product, is at CITY’s own risk. Specifically, CONSULTANT understands and agrees that use of artificial intelligence (AI) tools including, without limitation, ChatGPT, Microsoft’s Bing Chat, Google’s Bard, and Meta’s LLaMA (Large Language Model Meta AI), in the performance of this Agreement does not constitute an original work, i.e., submitting Documents generated by such AI tools to CITY and representing it as CONSULTANT’s original work constitutes a material breach of this Agreement, constitutes a false claim, and may also violate applicable intellectual property right laws including, without limitation, United States Copyright Law. 19. INDEMNIFICATION.

A. CONSULTANT agrees to the following:
i. Indemnification for Professional Services. CONSULTANT will hold harmless and indemnify and at CITY’s request reimburse defense costs for CITY and all its officers, volunteers, employees and representatives from and against any and all suits, actions, or claims, of any character whatever, brought for, or on account of, any injuries or damages sustained by any person or property resulting or arising from any negligent or wrongful act, error or omission by CONSULTANT or any of CONSULTANT’s officers, agents, employees, or representatives, in the performance of this Agreement, except for such loss or damage arising from CITY’s sole negligence or willful misconduct.
ii. Indemnification for other Damages. CONSULTANT will indemnify and hold CITY harmless from and against any claim, action, damages, costs (including, without limitation, attorneys’ fees), injuries, or liability, arising out of this Agreement, or its performance, except for such loss or damage arising from CITY’s sole negligence or willful misconduct. Should CITY be named in any suit, or should any claim be brought against it by suit or otherwise, whether the same be groundless or not, arising out of this Agreement, or its performance, CONSULTANT will defend CITY (at CITY’s request and with counsel satisfactory to CITY) and will indemnify CITY for any judgment rendered against it or any sums paid out in settlement or otherwise.

B. For purposes of this section “CITY” includes CITY’s officers, officials, employees, agents, representatives, and certified volunteers.

C. It is expressly understood and agreed that the foregoing provisions will survive termination of this Agreement.

D. The requirements as to the types and limits of insurance coverage to be maintained by CONSULTANT as required by Section 23, and any approval of said insurance by CITY, are not intended to and will not in any manner limit or qualify the liabilities and obligations otherwise assumed by CONSULTANT pursuant to this Agreement, including, without limitation, to the provisions concerning indemnification.

20. ASSIGNABILITY. This Agreement is for CONSULTANT’s professional services.

CONSULTANT’s attempts to assign the benefits or burdens of this Agreement without CITY’s written approval are prohibited and will be null and void.

21. INDEPENDENT CONTRACTOR. CITY and CONSULTANT agree that CONSULTANT will act as an independent contractor and will have control of all work and the

manner in which is it performed. CONSULTANT will be free to contract for similar service to be performed for other employers while under contract with CITY. CONSULTANT is not an agent or employee of CITY and is not entitled to participate in any pension plan, insurance, bonus or similar benefits CITY provides for its employees. Any provision in this Agreement that may appear to give CITY the right to direct CONSULTANT as to the details of doing the work or to exercise a measure of control over the work means that CONSULTANT will follow the direction of the CITY as to end results of the work only.

22. AUDIT OF RECORDS. CONSULTANT will maintain full and accurate records with respect to all services and matters covered under this Agreement. CITY will have free access at all reasonable times to such records, and the right to examine and audit the same and to make transcript therefrom, and to inspect all program data, documents, proceedings and activities.

CONSULTANT will retain such financial and program service records for at least three (3) years after termination or final payment under this Agreement.

23. INSURANCE.

A. Before commencing performance under this Agreement, and at all other times this Agreement is effective, CONSULTANT will procure and maintain the following types of insurance with coverage limits complying, at a minimum, with the limits set forth below:

Type of Insurance Limits
Commercial general liability: $2,000,000
Professional Liability $1,000,000
Business automobile liability $1,000,000
Workers compensation Statutory requirement
B. Commercial general liability insurance will meet or exceed the requirements of the most recent ISO-CGL Form. The amount of insurance set forth above will be a combined single limit per occurrence for bodily injury, personal injury, and property damage for the policy coverage. Liability policies will be endorsed to name CITY, its officials, and employees as “additional insureds” under said insurance coverage and to state that such insurance will be deemed “primary” such that any other insurance that may be carried by CITY will be excess thereto. Such endorsement must be reflected on ISO Form No. CG 20 10 11 85 or 88, or equivalent. Such insurance will be on an “occurrence,” not a “claims made,” basis and will not be cancelable or subject to reduction except upon thirty (30) days prior written notice to CITY.

C. Professional liability coverage will be on an “occurrence basis” if such coverage is available, or on a “claims made” basis if not available. When coverage is provided on a “claims made basis,” CONSULTANT will continue to renew the insurance for a period of three (3) years after this Agreement expires or is terminated. Such insurance will have the same coverage and limits as the policy that was in effect during the term of this Agreement, and will cover CONSULTANT for all claims

made by CITY arising out of any errors or omissions of CONSULTANT, or its officers, employees or agents during the time this Agreement was in effect.

D. Automobile coverage will be written on ISO Business Auto Coverage Form CA 00 01 06 92, including symbol 1 (Any Auto).

E. CONSULTANT will furnish to CITY duly authenticated Certificates of Insurance evidencing maintenance of the insurance required under this Agreement and such other evidence of insurance or copies of policies as may be reasonably required by CITY from time to time. Insurance must be placed with insurers with a current A.M. Best Company Rating equivalent to at least a Rating of “A:VII.” F. Should CONSULTANT, for any reason, fail to obtain and maintain the insurance required by this Agreement, CITY may obtain such coverage at CONSULTANT’s expense and deduct the cost of such insurance from payments due to CONSULTANT under this Agreement or terminate pursuant to Section 16.

G. Self-Insured Retention/Deductibles. All policies required by this Agreement must allow CITY, as additional insured, to satisfy the self-insured retention (“SIR”) and deductible of the policy in lieu of CONSULTANT (as the named insured) should CONSULTANT fail to pay the SIR or deductible requirements. The amount of the SIR or deductible is subject to the approval of the Assistant City Attorney and the Finance Director. CONSULTANT understands and agrees that satisfaction of this requirement is an express condition precedent to the effectiveness of this Agreement. Failure by CONSULTANT as primary insured to pay its SIR or deductible constitutes a material breach of this Agreement. Should CITY pay the SIR or deductible on CITY’s behalf upon the CONSULTANT’S failure or refusal to do so in order to secure defense and indemnification as an additional insured under the policy, CITY may include such amounts as damages in any action against CONSULTANT for breach of this Agreement in addition to any other damages incurred by CITY due to the breach.

24. USE OF SUBCONTRACTORS. CONSULTANT must obtain CITY’s prior written approval to use any consultants while performing any portion of this Agreement. Such approval must approve of the proposed consultant and the terms of compensation.

25. INCIDENTAL TASKS. CONSULTANT will meet with CITY monthly to provide the status on the project, which will include a schedule update and a short narrative description of progress during the past month for each major task, a description of the work remaining and a description of the work to be done before the next schedule update.

THE RECRUITMENT PROCESS
Bob Murray & Associates’ recruiters are specialists in finding positive placements and providing security and fairness to candidates and clients while ensuring the integrity of the search process. Outlined below are the steps in our proven recruitment process, refined through our 34+ years of experience in executive recruiting.

STEP 1 DEVELOP THE CANDIDATE PROFILE
Our understanding of the City of Arvin’s needs will be key to a successful search. Yasmin Beers, Stacey Stevenson, Stephanie Dietz, Adele Fresé, or Jeff Mori will meet virtually with the City of Arvin and key stakeholders to learn as much as possible about the ideal candidate for the City Manager position. Key stakeholders often include:
• Council/Board Members – up to five virtual one-on-one meetings with the Recruiter
• Internal Stakeholders (e.g. Department Heads) – up to two virtual group meetings with the Recruiter
• External Stakeholders (e.g. Chamber of Commerce, Community Groups) – one virtual one-on-one or group meetings with the Recruiter Internal and External Stakeholders

We find that many of our clients value a recruitment process that opens the opportunity for employees, community members, business leaders, and organization representatives to provide input regarding the ideal candidate. Our recruiters are skilled in virtually facilitating group staff meetings, forums for the business community, and/or town hall meetings that provide for equitable involvement from a variety of constituencies.

If the City of Arvin desires, we will work with the City of Arvin to create a customized virtual community and/or staff input process. Please note: Virtual facilitation of stakeholder meetings is included in the professional fee. On-site Recruiter facilitation is available for an additional fee – please refer to “Costs and Guarantee” on page 7 for pricing information.

Online Stakeholder Surveys

Sometimes clients are seeking input from a wider range of stakeholders—such as community members, business leaders, and organization representatives—online surveys are ideal to solicit input regarding qualities of the ideal candidate. Our experienced recruiters excel at crafting targeted, thoughtful, open-ended questions and can design a customized survey, providing a link for easy sharing on your website.

After closing, your dedicated Recruitment Coordinator will send you the survey

5.F.2
Attachment: PSA - Bob Murray and Assoc for City Manager Exec Recruitment_022426 (PSA - GVP Ventures, Inc. DBA Bob Murray & Associates Bob Murray & Associates Proposal for the City of Arvin Page 5 response data for your review and analysis. Online Surveys are available at an additional nominal cost under Optional Services (please refer to page 8).

We want to become familiar with the values and culture of the organization, as well as to understand the current and future issues, challenges, and opportunities in the City of Arvin.

Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori will review and help define the City’s wish-list regarding the ideal candidate’s personality, management style, knowledge, skills, and abilities and will work with the City to identify expectations regarding education and experience. The City of Arvin and Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori will discuss compensation, benefits, and other key information necessary to ensure that outstanding candidates are attracted to this opportunity. The profile we develop together at this stage will drive subsequent recruitment efforts.

STEP 2 DESIGN/DISTRIBUTE BROCHURE AND ADVERTISEMENTS
Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori and your dedicated Recruitment Coordinator will use the candidate profile developed with the City of Arvin to create a professional recruitment brochure, with the assistance of our professional graphic designer. The four-page, full-color brochure will describe the community, organization, position, ideal candidate, and compensation and will include pictures provided by the City of Arvin that you feel best represent your organization and your community.

Upon your approval, Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori will send the brochure by email (and postal mail if desired) to a targeted audience, personally inviting potential candidates to apply for the City Manager position. We will also place the recruitment brochure on our website, which attracts over 11,000 unique hits weekly and is a trusted resource for candidates seeking executive and professional positions. Two sample brochures are included in this proposal package for your reference.

Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori will also design an effective advertising campaign appropriate for the City Manager recruitment. Our broadest outreach comes through our active social media involvement on LinkedIn as well as our monthly newsletter where upcoming and current positions are featured. Sources such as Western City Magazine, PublicCEO, and the Careers in Government website will be used to reach an extensive local government audience, while position-specific postings will be chosen to attract candidates who have built their careers in and are committed to the City Management field.

5.F.2
Attachment: PSA - Bob Murray and Assoc for City Manager Exec Recruitment_022426 (PSA - GVP Ventures, Inc. DBA Bob Murray & Associates Bob Murray & Associates Proposal for the City of Arvin Page 6 Suggested City Manager-specific advertising sources for the City of Arvin’s search include:

International City/County Management Association
Arvin Management Foundation
League of California Cities
Engaging Local Government Leaders Job Board
League of Women in Government
Bob Murray & Associates does not typically place ads with job aggregators or general job posting sites such as CareerBuilder, Monster, or Indeed, as we have found that the broad reach of these sites does not necessarily lead to quality candidates for executive and professional positions.

Reaching Diverse Candidates
Bob Murray & Associates, a woman- and minority-owned business, is proud of its commitment to attracting and placing diverse candidates. Nearly 50% of our last 100 placements were women; Hispanic placements 25%; African American placements 13%; Asian placements 21%; and Native American placements at 1%. Not only do we place advertisements with websites designed to attract minority and female candidates, but our President, Valerie Phillips, is a member herself of many diversity-focused organizations including the Local Government Hispanic Network, the League of Women in Government, the Professional Women’s Network, Mexican Professionals, and Women Leading Government. She networks frequently with fellow members to gain insight into which potential candidates are leaders in their field.

Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori will seek to reach candidates in communities and organizations with demographic profiles and populations served like that of the City of Arvin, to maximize the potential for individuals from a wide variety of backgrounds, cultures, and life experiences to be considered for the City Manager position.

STEP 3 RECRUIT CANDIDATES
The strongest candidates are often those who are successful and content in their current positions and need to be sold on a new opportunity. Our extensive network of contacts, developed through over 2,100 successful placements, is a primary source for identifying and obtaining referrals for these candidates. Our in-house database of 40,000 current and former executive and professional candidates is a valuable resource that can only be built over time—time that we have invested into perfecting our process for finding the right candidates for our clients. Our aggressive outreach efforts are focused on phone calls to personally invite potential applicants, answer questions, and allay any reservations, and these efforts are essential to the success of the City Manager recruitment.

5.F.2

Following the closing date for the recruitment, Ms. Beers, Ms Stevenson, Ms. Dietz, Ms.

Fresé, or Mr. Mori will screen all resumes we have received, using the criteria established in the candidate profile as a basis upon which to narrow the field of candidates. Internal candidates receive sensitive consideration, and Ms. Beers, Ms Stevenson, Ms. Dietz, Ms.

Fresé, or Mr. Mori will discuss with the City of Arvin how the City wishes to proceed with these candidates.

STEP 5 CONDUCT PRELIMINARY INTERVIEWS
Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori will personally interview the top 10 to 15 candidates from the resume screening, with the goal of determining which candidates have the greatest potential to succeed in your organization. To reduce travel-related expenses to our clients and increase efficiency in the search process, these interviews are typically conducted via Zoom, Teams, or other convenient videoconferencing applications.

STEP 6 SEARCH PUBLIC RECORDS
Under the direction of Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori, your dedicated Recruitment Coordinator will conduct a review of published print and online articles for each recommended candidate. Sources include Lexis-Nexis™, Google, social media, and our contacts in the field. This will alert Ms. Beers, Ms Stevenson, Ms.

Dietz, Ms. Fresé, or Mr. Mori to any further detailed inquiries we may need to make before our recommendations are finalized.

STEP 7 MAKE RECOMMENDATIONS
Based on our findings during the preliminary interview process, Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori will meet with the City of Arvin virtually or on site to share the complete applicant list and recommend a limited number of candidates for your further consideration. Ms. Beers, Ms Stevenson, Ms. Dietz, Ms.

Fresé, or Mr. Mori will make specific recommendations and will help facilitate discussions regarding the candidate pool, but the final determination of interviewees will be up to you.

We typically recommend 6-8 candidates that we feel best match your expectations and prepare a detailed report on each candidate. This virtual “Recommended Finalist” eBook is provided to each member of the decision-making body and includes:

Candidate list with Recommended Finalists identified in Group 1 and Group 2 (primary and secondary recommendations), as well as Internal candidates

Complete cover letter and resume for each Recommended Finalist candidate List of Other Applicants (those who did not meet minimum qualifications or were otherwise unsuitable, based on our screening process)
Bob Murray & Associates maintains all search records for a period of seven (7) years following each recruitment, and we are happy to forward cover letters and resumes for each applicant by postal mail or email as soon as the recruitment closes to new applications.

STEP 8 FACILITATE PANEL INTERVIEWS
Our years of experience will be invaluable as we help you develop an interview process that objectively assesses the qualifications of each candidate. We will work with the City of Arvin to craft and implement an interview approach that fits your needs. This may include panel and/or individual interviews by the City of Arvin; key stakeholders, community/employee interview panels; writing and presentation samples; meet-andgreets; or other specialized process elements Ms. Beers, Ms Stevenson, Ms. Dietz, Ms.

Fresé, or Mr. Mori helps the City of Arvin to design.

Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori will be present on-site during the panel interviews to facilitate as necessary during the process and to guide discussion to consensus regarding final candidates. Bound interview books will be provided for each interview panel member containing:

Recruitment brochure with candidate profile
Interview schedule
Suggested interview questions
Experience summary, cover letter, resume, and rating form for each candidate
Ranking forms for use during the panel interview process We will work closely with your staff to coordinate and schedule interviews. Our goal is to ensure that each candidate has a positive experience, as the way the entire process is conducted will influence the final candidates’ perception of your organization.

STEP 9 CONDUCT BACKGROUND AND REFERENCE CHECKS
Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori and your Recruitment Coordinator will conduct detailed reference checks for up to two (2) final candidates.

To gain an accurate and honest appraisal of the candidates’ strengths and weaknesses, we will talk candidly with people who have direct knowledge of their work and management style. In addition to gaining a 360-degree view of candidates from the

Your Recruitment Coordinator will work with the two (2) final candidates and our professional backgrounding firm, HireRight, to conduct credit, civil litigation, and motor vehicle record checks and verify candidates’ degrees.

STEP 10 ASSIST IN NEGOTIATIONS
We recognize the critical importance of successful negotiations and can serve as your representative during this process. Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori know what other organizations have done to put deals together with great candidates and what the current market is like for City Manager positions in organizations like the City of Arvin’s. Your Recruiter will be available to advise you regarding current approaches to difficult issues, such as housing and relocation. We will represent your interests and advise the chosen candidate and you regarding salary, benefits, and employment agreements, with the goal of putting together a deal that results in the appointment of your chosen candidate. With our proven experience and vested interest in a positive outcome, we can turn a very difficult aspect of the recruitment into one that is straightforward and agreeable for all parties involved.

COMPLETE ADMINISTRATIVE ASSISTANCE
We receive many unsolicited testimonials each year from clients and candidates alike noting our prompt, considerate, accurate, and professional service during the search process. Throughout the recruitment, in time intervals that suit the City of Arvin, we will provide you with updates on the status of the search and attend to all administrative details on your behalf.

Candidates receive immediate acknowledgement of their applications, as well as personal phone calls and/or emails (as appropriate) advising them of their status at each critical point in the recruitment. Candidates who receive preliminary or final interviews and are not chosen to move forward in the interview process will receive personal calls from Ms. Beers, Ms Stevenson, Ms. Dietz, Ms. Fresé, or Mr. Mori on behalf of the City of Arvin.

It is our internal company standard that all inquiries from clients and candidates receive a response within the same business day whenever possible, and certainly within 24 hours if the inquiry is received during the work week. Ms. Beers, Ms Stevenson, Ms.

Dietz, Ms. Fresé, or Mr. Mori will be available to the City of Arvin by office phone, cell phone, and email at any time to ensure a smooth and stress-free recruitment process.

Staff Report re Second Amendment to the City Manager Employment Agreement

CITY OF ARVIN
Staff Report
Meeting Date: February 24, 2026
TO: Honorable Mayor, Mayor Pro Tem and Members of City Council FROM: Stephanie Gutierrez, City Attorney
SUBJECT: Second Amendment to the City Manager Employment Agreement BACKGROUND:

Jeff Jones has served the City in various executive capacities, beginning as Finance Director in 2017. He subsequently assumed the role of Interim City Manager in 2021 while continuing to oversee Finance. In March 2022, the City Council approved an agreement formally appointing him to serve concurrently as City Manager and Finance Director.

On October 31, 2025, the City Council determined that the City Manager and Finance Director roles should be separated. At that meeting, the Council appointed Mr. Jones as City Manager exclusively and directed staff to update his employment agreement accordingly. The First Amendment to his agreement was approved on November 17, 2025 to reflect this change.

The City Council now wishes to extend the term of the existing employment agreement to ensure leadership stability while the City proceeds with an executive recruitment process for the position of City Manager.

ANALYSIS:

The proposed Second Amendment updates Section 5 (Term) of Agreement No. 2022-02 to extend Mr. Jones’s appointment as City Manager through July 22, 2026. No other substantive changes are proposed. All other terms and conditions of the existing employment agreement remain in full force and effect.

This extension provides continuity of executive leadership during the recruitment and transition period, ensuring uninterrupted management of City operations and ongoing initiatives.

STAFF RECOMMENDATION:

Staff recommends that the City Council approve the Second Amendment to Agreement No. 2022‑02, extending the term of the City Manager’s Employment Agreement through July 22, 2026, and authorize the Mayor to execute the amendment.

Staff Report re Council Discussion Re Competitive Procurement for Effluent Disposal and Farming Services.

CITY OF ARVIN
Staff Report
Meeting Date: February 24, 2026
TO: Honorable Mayor, Mayor Pro Tem and Members of City Council FROM: Jeff Jones, City Manager
Stephanie Gutierrez, City Attorney
SUBJECT: Council Discussion Regarding Competitive Procurement for Effluent Disposal and Farming Services
BACKGROUND:

The City of Arvin owns and operates a Wastewater Treatment Plant that produces 1.2 to 1.5 million gallons of treated effluent water per day. Compliance with Waste Discharge Requirements Order No. 5‑00‑093 requires the City to apply treated effluent to land and maintain appropriate crop absorption capacity.

Following the termination of the Agricultural Lease Agreement with Apothio, LLC on July 2, 2025, the Public Works Department temporarily managed the effluent application but could not sustain this responsibility long-term. Staff therefore identified the need for an experienced agricultural operator to manage effluent irrigation consistent with the WDRs.

To avoid noncompliance with state requirements, City staff contacted two qualified entities and ultimately entered into a six-month Temporary Effluent Water Agreement with Zam Farming LLC, later extended via the First Amendment (Agreement No. 2025-34) through September 30, 2026.

Under the Agreements, Zam Farming LLC:
• Receives up to 4 million gallons per day of treated effluent; • Applies the effluent to farmland and approved crops;
• Uses City-owned property leased at $1 per farmable acre (approx. 208 acres); and • Has no treatment responsibilities for the effluent itself.

The existing agreement provides needed regulatory compliance but was originally intended as a temporary measure while the City considered longer-term options.

ANALYSIS:

The original staff report anticipated that staff would prepare a formal Request for Proposals (RFP) during the temporary effluent management agreement period to secure a long-term qualified agricultural operator. With the First Amendment now extending the existing arrangement with Zam Farming LLC through September 30, 2026, the City has a sufficient

Staff Report re Council Discussion Re Competitive Procurement for Effluent Disposal and Farming Services. window of time to conduct an RFP process if the City Council chooses to pursue one. Issuing an RFP at this stage would allow the City to evaluate other qualified operators beyond Zam Farming LLC and potentially obtain more favorable or innovative approaches to effluent management, crop planning, or use of City-owned agricultural land.

At the same time, the City Council may determine that issuing an RFP is unnecessary because Zam Farming LLC is already providing effluent management services that meet regulatory requirements, and maintaining continuity is advantageous given the complexity of wastewater dispersal. The procurement process would also require substantial staff time and resources, and the City currently lacks sufficient eligible land to discharge all of its wastewater, whereas Zam Farming has enough acreage to accommodate it.

If the City Council were to decide against issuing an RFP, the City would continue to rely on a temporary agreement that was not originally designed as a long-term procurement method. If the City Council directs staff to proceed with an RFP, the process would likely span four to six months, including drafting the solicitation, advertising, evaluating proposals, conducting interviews, and returning to the Council for contract award—an approach that still fits comfortably within the current agreement’s term. The decision before the Council is therefore primarily one of policy direction: whether to pursue competitive procurement for a long-term effluent and farming services partner or continue under the current extended arrangement with Zam Farming LLC while maintaining operational stability.

STAFF RECOMMENDATION:

This is a discussion item only. Staff requests direction from City Council on whether to:

1. Direct staff to prepare and issue a formal Request for Proposals for a qualified farmer/operator to manage the City’s treated effluent water and farm the associated City owned agricultural acreage; or

2. Continue with the existing effluent management arrangement with Zam Farming LLC and amend the temporary effluent agreement with a permanent agreement; or

3. Provide alternative direction to staff.

FINANCIAL IMPACT:

The existing agreement provides a nominal lease revenue of $208 for the term based on $1 per farmable acre. An RFP may produce proposals with different financial models (lease revenue, shared crop revenue, or cost-sharing models). Staff time required for procurement will impact the City Attorney’s Office and Public Works.
