The Proposition created Article XIIIB of the State Constitution placing limits on the amount of revenue that can be spent by all entities of government. Proposition 4 became effective for the 1980-81 fiscal year, but the formula for calculating the limit was based on the 1978-79 “base year” revenues.
The limit specifies the maximum appropriations that may be funded by proceeds of taxes. Adopted limits are to be adjusted each year by a “change factor” that is tied to growth indicators specified by the State. By applying the change factor to the prior year’s appropriation limit, a new limit is calculated for the next fiscal year. If a city receives more revenue than the appropriation limit, the revenue must be returned to the taxpayers through a tax reduction or refund.
Currently, the City is estimated to be at 63.5% of its Gann spending limit of $3,391,290 and a total appropriation limit of $2,151,901. This is only an estimate based on the proposed budget but indicates that the City is in a positive appropriation position and in compliance with the law.

CITY OF ARVIN
Staff Report
Meeting Date: June 23, 2026

FROM: Jeff Jones, City Manager
SUBJECT: STATUS OF VACANCIES, RECRUITMENT, AND RETENTION EFFORTS IN ACCORDANCE WITH ASSEMBLY BILL (AB) 2561 (CALIFORNIA
GOVERNMENT CODE SECTION 3502.3)
RECOMMENDATION

2. Receive and file the City’s Annual Position Vacancy Report, presented in compliance with Assembly Bill (AB) 2561 (Government Code § 3502.3).
BACKGROUND
Effective January 1, 2025, Assembly Bill 2561 amended the Meyers-Milias-Brown Act by adding Government Code § 3502.3. This legislation requires public agencies to present information regarding workforce vacancies and related recruitment and retention efforts at least once per fiscal year during a public hearing conducted prior to adoption of the agency’s final budget.
The statute further requires:
• Notification to recognized employee organizations and the opportunity for those organizations to present at the public hearing; and
• Identification of any policy, procedural, or operational factors that may contribute to hiring challenges.
This report satisfies the City’s annual reporting obligation under AB 2561 and presents current vacancy and workforce data.

The Human Resources Department ensures compliance, consistency, and fairness through the following practices:
• Tracking all authorized positions and vacancies and collaborating with departments to ensure critical vacancies are addressed in a timely and strategic manner. • Ensuring job announcements clearly outline duties, qualifications, salary, and application instructions.
• Promoting internal promotional opportunities when appropriate to support career development and retention.
• Advertising positions publicly with inclusive, non-discriminatory language to support an open and competitive recruitment process.
• Accepting and reviewing only complete applications received by the filing deadline.
• Screening applicants solely based on job-related qualifications and disqualifying ineligible candidates.

• Issuing a formal offer of employment once all conditions are satisfied, confirming job title, salary, start date, and official appointment details. • Documenting all recruitment efforts to demonstrate fairness, transparency, and compliance with EEO and legal requirements.
At this time, the City’s current financial position limits its ability to actively recruit for all vacant positions. Recruitment activity will expand as fiscal conditions improve.

Recruitment and Retention Challenges
City staff have not posed any challenges filling vacancies for SEIU and Non-Represented classifications. However, the recruitment and retention of qualified Police Officers continues to present challenges both statewide and nationally. Law enforcement agencies are experiencing reduced applicant pools due to various factors, including increased public scrutiny, competitive labor markets, more extensive background and psychological screening requirements, and evolving generational career preferences that place less emphasis on public safety careers. These conditions have led many jurisdictions to struggle with persistent vacancies and staffing shortages.
Human Resources and Police Department staff have implemented proactive recruitment strategies to remain competitive in the law enforcement labor market, including academy sponsorships, lateral hiring opportunities, and targeted outreach. As a result, the City has been able to fill most positions in a timely manner, ensuring minimal disruption to public safety services and preserving strong community engagement.
Human Resources staff continuously monitor and evaluate the City's ability to fill vacancies in a timely and efficient manner. However, the current financial position of the City is impacting the City’s ability to fill vacancies.
CONCLUSION
The City is in compliance with AB 2561 requirements and continues to monitor workforce vacancies, recruitment effectiveness, and retention trends. Staff will continue to evaluate recruitment strategies and adjust as needed, while balancing operational needs with current fiscal constraints.
FISCAL IMPACT

Rancho Drive and Sycamore Road (a portion of APN 189-340-53), including Adoption of a Categorical Exemption for the Project according to Section 15304 of the CEQA Guidelines
Staff Recommendation:
Staff recommends the City Council conduct a public hearing, receive public testimony, deliberate, and motion to:
1. Adopt a Resolution approving Site Development Permit (“SDP”) 2025-06 pertaining to the Sycamore truck parking lot, located at the southeast corner of N Rancho Drive and Sycamore Road (a portion of Kern County Assessor’s Parcel Number, “APN” 189-340- 53), including adoption of a Categorical Exemption for the project according to Section 15304 of the California Environmental Quality Act (“CEQA”) Guidelines Executive Summary:
Nazar Kooner (the “Applicant”) requests SDP 2025-06 pertaining to the operation of a commercial truck parking lot (the “Project”) located at the southeast corner of N Rancho Drive and Sycamore Road on a portion of Kern County Assessor’s Parcel Number (“APN”) 189-340-53 (the “Property”).
The Project would consist of a fenced, approximately 1-acre parking area for commercial trucks.
The site will also include lighting, landscaping, and a provision for an RV to serve as an office and security station. The site would provide commercial truck operators within the City a safe and secure place to store their truck while off duty.
The SDP would facilitate the development of the Project site. A Categorical Exemption, according to Section 15304 of the CEQA Guidelines, is recommended for the Project.

Staff Report re Sycamore Truck Parking (SDP 2025-06)
The Arvin Municipal Code (“AMC”) allows the City Council to approve, approve with conditions, or deny an application for a planning permit, including an SDP. A permit should be denied if the City Council cannot make the appropriate findings. Project design may be altered, and site improvements may be required to make the Project compatible with nearby uses.
Background:
Site Location
The Project Property is located within City limits. The site is located at the southeast corner of N Rancho Drive and Sycamore Road. The site is approximately 1 acre and is a portion of APN 189- 340-53 (approx. 13 acres total). The Property is currently vacant.
Project Proposal
The proposed Project includes an application for SDP 2025-06 to facilitate the operation of a commercial truck parking lot, as described above, to offer commercial truck operators within the City a safe and secure location to store their truck while off duty. The application proposes chainlink fencing, pole lighting, and landscaping along the project boundaries. The application also proposes a temporary provision for an RV on-site to serve as an office and on-site caretakers unit.
Setting and Surrounding Uses
As referenced below in Table 1, the Property is surrounded by vacant and/or agricultural land to the north, east, south, and west. The vacant land to the north has a General Plan Land Use designation of HI – Heavy Industrial and the land to the east, south, and west has a Land Use designation of LI – Light Industrial.
Direction
from site Existing Land Use General Plan Designation Zone District North Agricultural Heavy Industrial N/A
East Vacant/Agricultural Light Industrial M-2 – Light Manufacturing South Vacant Light Industrial M-2 – Light Manufacturing West Vacant Light Industrial M-2 – Light Manufacturing
General Plan Land Use Designation
The Property has an Arvin General Plan land use designation of LI – Light Industrial.
The Light Industrial General Plan use designation is established to provide for “low-intensity industrial use, with emphasis placed on minimal nuisance or pollution to other uses within the area and to adjacent districts. Permitted uses include warehousing and storage, research and development facilities, limited manufacturing and other uses that are compatible with nearby residential and commercial development.”
Zone District
The Project site is zoned M-2 – Light Manufacturing, consistent with the General Plan land use designation.

application proposes chain-link fencing, pole lighting, and landscaping along the project boundaries. The application also proposes a temporary provision for an RV on-site to serve as an office and on-site caretaker’s unit. The proposed Site Plan is shown in Attachment C to this report.
Pursuant to AMC Chapter 17.60, an SDP is required to ensure “that certain types of proposed developments will serve to achieve a group of facilities which will be well related one to another, and which, taken together, will result in a well-composed design, and to meet the city ordinances”.
SDPs are required for the following types of development:
• Mobile home parks, travel trailer parks, airports and commercial, industrial, public, and quasi-public building complexes. Multi-family residential development within the R-2, R3, and R-4 Zone District(s) that are not in compliance with Chapter 17.72 Multiple Family Residential Design Review;
• Use of any commercial or industrial structure vacant for more than ninety (90) days. For structures subject to Chapter 17.68 (Commercial - Bear Mountain Central Business District Standards), existing structures vacant for more than sixty (60) days, except that if unusual hardship is shown the City Planner may extend that time by up to an additional one hundred and eighty (180) days;
• Change of use from an existing use to a heretofore new use at that location; • New development, not listed under Chapter 17.05 Uses Permitted Subject to Administrative Approval; or
• Expansion of existing structures, not listed under Chapter 17.05 Uses Permitted Subject to Administrative Approval.
SDPs are subject to review and approval by either the City Planner or the City Council. Pursuant to AMC Section 17.60.040(C)(2), the City Council is responsible for reviewing and approving SDPs that include:
• New development of one thousand and one (1,001) square feet or more; • Expansion of existing structures by more than fifty (50) percent; • Change of use of existing structures where site improvements are required; • Mobile home parks, travel trailer parks, airports and building complexes encompassing more than one (1) acre;
• All other development requiring a SDP not listed in Subsection C.1 Development Standards (AMC 17.30 / 17.70)
The development standards below apply within the applicable AMC Chapter 17.30 M-2 – Light Manufacturing district, together with such standards specified in Chapter 17.70 Site Development Standards, apply to all land and structures within the M-2 zone district. After each required standard below, there is an analysis of the Project’s compliance.
Height Limitation (AMC 17.30.030)
The maximum height for buildings in the M-2 zone shall be six (6) stories and not to exceed seventy-five (75) feet. The proposed Project does not propose construction of any buildings; therefore, this section does not apply.
Yards (AMC 17.30.040, .050, .060)
The required front yard in the M-2 district is forty (40) feet, except that along any secondary highway, as designated by the city's highway plan a minimum setback of forty-five (45) feet from the centerline of the highway shall be required, and along any major highway, as designated by

the city's highway plan, a minimum setback of fifty-five (55) feet from the centerline of the highway shall be required. Setback from the centerline of Bear Mountain Boulevard (State Route 223) shall be seventy-two (72) feet. There are no buildings proposed to be constructed; therefore, this section does not apply.
There are no side or rear yard requirements, except where the M-2 district abuts a street or residential district, in which case the required side and rear yard requirements shall be twenty (20) feet. The Project does not abut a street or residential zone; therefore, there is no side or rear yard requirements. As a result, the Project complies with this section.
Area Requirements (AMC 17.30.070)
The minimum site area shall be six thousand (6,000) square feet. The Project proposes a 1-acre truck parking facility. Therefore, the minimum site area is met.
Landscape Standards (AMC 17.70.010(A))
A minimum of ten percent (10%) of the developed area shall be landscaped. The Project as proposed includes minimal landscaping along the project boundary. Pursuant to AMC
17.70.010(M), the City Planner has waived the 10% requirement due to the unusual circumstances pertaining to this project. Notably, that the Project site is located outside of the urban core, is surrounded by vacant land, and that strict enforcement of this requirement would not provide a public benefit.
Removal of Obstructions (AMC 17.70.010(B))
Obstructions within street rights-of-way shall be removed. There are no obstructions present within the right-of-way along the Project’s frontage to Sycamore Road. The Project has been conditioned to maintain the 55’ right-of-way clear of any obstructions now and in the future.
Curb, Gutter and Sidewalk (AMC 17.70.010(C))
Curb, gutter, and sidewalk shall be constructed as required by the subdivision ordinance when required as part of street improvements. Sycamore Road is partially improved per County standards. Pursuant to AMC 17.70.010(M), the City Planner has waived the requirement to improve the Project’s frontage along Sycamore Road due to unusual circumstances. The limited length (only approximately sixty (60) feet) and required scope (improvement of full 55’ collector width) would make installation of these improvements for this project impractical.
Drive Areas (AMC 17.70.010(D))
All access drives, parking areas, and vehicle maneuvering areas shall be surfaced with a minimum of two inches (2”) of asphalt, concrete, or paving material of higher quality. The Project will be conditioned to comply with this requirement.
Utility Services (AMC 17.70.010(E))
All new on-site utility services shall be placed underground. The Project will be conditioned to require all new utility service connections be underground.
Water Drainage (AMC 17.70.010(F))
Prior to the issuance of any grading or building permits, a plan for the disposal of drainage waters originating on site and from adjacent road rights of way shall be approved by the department of planning and building, if required. Easements or grant deed shall be given to the city for drainage

purposes or access thereto, as necessary. The Project will be conditioned to require approval of a grading and drainage plan prior to issuance of a grading permit.
Fire Department Approval (AMC 17.70.010(G))
Fire flows, fire protection facilities, and accessways and safety setbacks shall be as required and approved by the fire department. The Project will be conditioned to require approval by the Kern County Fire Department Office of the Fire Marshall prior to issuance of building permits.
Exterior Lighting (AMC 17.70.010(I))
Exterior lighting shall be arranged or shielded in such a manner as to contain the direct illumination on the site and avoid glare in nearby residential areas. Exterior lighting shall be powered by passive energy; for example, solar powered. All buildings must have a lighted address panel placed at approved locations for ease of identification. The Project will be conditioned to ensure all exterior lighting is compliant.
Signs (AMC 17.70.010(O)).
Signs shall be approved by the planning and building divisions prior to installation. The Project does not include any proposed signage. Any future signs that wish to be installed on the Project site shall be approved by the City Planner and obtain any necessary permits.
Fugitive Dust (AMC 17.70.010(P)).
During all on site grading and construction activities, adequate measures shall be implemented to control fugitive dust. The proposed Project will be conditioned to implement Best Management Practices (BMPs) to control fugitive dust resulting from onsite grading and construction activities.
Other Department Comments
The Project was reviewed by various other City Departments and affected outside agencies. The responses and recommendations have been incorporated in the recommended conditions of approval included in this report.
Conclusion
The proposed Project is consistent with the Arvin General Plan and Zoning Ordinance.
Additionally, as conditioned, there is no evidence that suggests approval of the proposed Project will be detrimental to the public health, safety, and welfare of those residing or working nearby.
To ensure continued compatibility of the site with surrounding uses, conditions of approval have been incorporated.
Environmental Review:
The environmental impacts of the Project have been analyzed in accordance with CEQA. Staff recommend that the City Council find and determine that a Class 4 Categorical Exemption (Minor Alterations to Land) set forth in CEQA Guidelines Section 15304 applies to the Project.
Public Hearing Notice:
Public hearing notices were posted in three public places within the City of Arvin: 1) Arvin City Hall, 2) Arvin Police Department, and 3) Community Development Building, posted on the City of Arvin’s website (www.arvin.org), and mailed to property within 300 feet of the site on June 23, 2026. As of the date of this report, the City has not received any written comment or verbal inquiries regarding this Project.

This Project is subject to a variety of discretionary conditions of approval. These include conditions based on adopted City plans and policies; those determined through Site Development Permit review and environmental assessment essential to mitigate adverse effects on the environment including the health, safety, and welfare of the community; and recommended conditions for development that are not essential to health, safety, and welfare, but would, on the whole, enhance the Project and its relationship to the neighborhood and environment.

All discretionary conditions of approval for SDP 2025-03 will ultimately be deemed mandatory unless appealed by the applicant to the City Council within 15 calendar days after the decision by the Planning Commission. In the event you wish to appeal the Planning Commission’s decision or discretionary conditions of approval for this entitlement, you may do so by filing a written appeal with the City Clerk. The appeal shall state the grounds for the appeal and wherein the Commission failed to conform to the requirements of the zoning ordinance. This should include identification of the decision or action appealed (including its identification number) and specific reasons why you believe the decision or action appealed should not be upheld, and the identity of the appellant.
