CITY OF ARVIN
Staff Report
Meeting Date: July 28, 2026
TO: Arvin City Council
FROM: Christine Viterelli, Grants Manager
Jeff Jones, City Manager
SUBJECT: A Resolution of the City Council of the City of Arvin Approving the Project List for the Fiscal Year 2026-2027 for the California State of Good Repair Program and Authorizing Related Actions
BACKGROUND:

The Road Repair and Accountability Act of 2017 (Senate Bill 1), signed into law on April 28, 2017, established several transportation funding programs intended to address statewide transportation infrastructure needs. Among these programs is the State of Good Repair (SGR) Program, which provides ongoing funding to eligible transit operators to maintain, rehabilitate, and improve public transit systems. The program is funded through revenues deposited into the State Transit Assistance (STA) Account and distributes approximately $105 million annually throughout California to support projects that improve transit safety, reliability, operational efficiency, and long-term system sustainability.

The SGR Program is administered by the California Department of Transportation (Caltrans) and provides grant funding for eligible transit capital, maintenance, rehabilitation, and operational improvement projects intended to keep transit systems in a state of good repair. Eligible uses include transit facility improvements, vehicle rehabilitation or replacement, equipment upgrades, transit technology improvements, and other investments that preserve and enhance public transportation infrastructure.

For Fiscal Year 2026-2027, the City of Arvin has been allocated $182,163 from PopulationBased SGR Program Account 99313 and $767 from Account 99314, for a total allocation of $182,930.

Staff recommends allocating the City’s Fiscal Year 2026-2027 State of Good Repair (SGR) funds to the City of Arvin Bus Microgrid Infrastructure Project, “Blue Skies for All,” to serve as a local match for project implementation. The project is designed to improve the resilience and sustainability of the City's transit operations through the installation of microgrid infrastructure and battery energy storage systems serving transit facilities.

The proposed investment will provide several long-term benefits to the City's transit program, including reduced electricity costs, increased energy reliability, and backup power capabilities

Use of SGR funds for this project is consistent with the program's objectives of improving transit infrastructure, increasing operational efficiency, and investing in long-term capital improvements that enhance the reliability and performance of public transportation services for the residents of Arvin. Staff therefore recommends approval of the proposed allocation of Fiscal Year 2026-2027 State of Good Repair funds to the City of Arvin Bus Microgrid Infrastructure Project, "Blue Skies for All." STAFF RECOMMENDATION:

Staff recommends that the City Council adopt a resolution approving the project list for Fiscal Year 2026-27 under the California State of Good Repair Program and authorizing related actions.

Staff Report re: A Public Hearing for the Close-Out of State-funded CDBG activities for the FY 22-CDBG- HA10029 Owner Occupied Housing Rehabilitation Program.

CITY OF ARVIN
Staff Report
Meeting Date: July 28, 2026
TO: Arvin City Council
FROM: Christine Viterelli, Grants Manager
Jeff Jones, City Manager
SUBJECT: A Public Hearing for the Close-Out of State-funded CDBG Activities for the FY 22- CDBG- HA-10029 Owner Occupied Housing Rehabilitation Program BACKGROUND:

The City of Arvin was awarded $500,000 in CDBG funding in June 2023 in response to the 2022 CDBG NOFA application. Program clearance was received on June 23, 2023, to begin accepting applications and providing services.

The Owner-Occupied Rehabilitation Program provided deferred, zero-interest, three-year forgivable loans to income-eligible owner-occupants (households at or below 80 percent of the Area Median Income) within the City of Arvin to complete emergency, minor, and substantial rehabilitation activities that addressed health and safety hazards, housing code deficiencies, and essential repairs, including roofing, plumbing, electrical, heating, ventilation, and air conditioning (HVAC), windows, and flooring.

The program was originally anticipated to assist five beneficiaries; however, only one owneroccupied rehabilitation loan was completed during the grant period. The reduction was due to limited eligible applicants, program demand, and projects that could not be completed within program requirements and funding limits. Reasonable efforts were made to identify and assist eligible households. Loans were provided as follows:

Loan # Amount Description of Project
1 $41,334.78 Owner-Occupied Rehabilitation Loan
TOTAL $41,334.78
Budget Total Expenses Disencumbered Funds
Total Admin (Homebuyer): $32,710.00 $29,694.34 $ 3,015.66 Total OOR Loans: $467,290.00__$83,082.53*______ $384,207.47__________ Total Award: $500,000 $112,776.87 $387,223.13

Staff Report re Arvin WWTP Lift Station Power Protection (New Generator) Project.

CITY OF ARVIN
Staff Report
Meeting Date: July 28, 2026
TO: Arvin City Council
FROM: Jeff Jones, City Manager & Sam Lux, City Engineer CC: Gerry Lemus, Rodrigo Vignau (Veolia)
SUBJECT: Arvin WWTP Lift Station Power Protection (New Generator) Project BACKGROUND:

As noted in the 2024-2026 WWTP Capital Improvement Plan that was submitted to the City in March of 2024 and March 2025 and included in the 2026-2028 WWTP Capital Improvement Plan submitted in March 2026, the Lift Station Power Protection Project will purchase a portable generator to protect the wastewater treatment plant process against rolling blackouts and power outages.

The plant location is subject to rolling blackouts and power outages, especially in periods of extreme weather. During these times, if the lift station were to go down without power, there are only 3 hours of well and sewer line storage under peak flow conditions before the lift station will overflow. In addition to the lift station overflowing, numerous Sewage Spill Overflow SSOs may occur around the city, which will be a violation of the Sewer System Management Plan (SSMP).

DISCUSSION:

To address current operational and environmental risks, we request to purchase a portable generator which is sized to power both lift station pumps running simultaneously to meet peak flows when required, and it will run the communications and alarms system Supervisory Control and Data Acquisition (SCADA) . The City has provided a temporary generator which is not sized to run both pumps simultaneously to meet peak flow demand. Additionally, the Generator is not at the lift station since it does not have a permit to operate. The benefit to purchasing a new Lift station Generator is that it will provide sewer overflow mitigation and added portable backup power for the treatment plant if/when needed.

Veolia reached out to three vendors to provide proposals for the portable generator and three proposals were received. Proposals were reviewed and Veolia recommends purchasing the Multiquip Whisperwatt Super Silent 125kVa Three Phase Generator. This generator sits on a trailer and is portable should it need to be moved temporarily to the wastewater treatment plant.

Of all three proposals received, the Multiquip Whisperwatt Generator will cause the least amount of noise when in use, to minimize disruption to the nearby community.

P&J Electric will provide support for new connections to the existing equipment to be compatible with the new generator upon arrival. (All quotes received are attached to this TA) The lead time on the generator order is 6-8 weeks from the date of purchase.

STAFF RECOMMENDATION:

Staff recommends that the City Council:

1. Approve the Task Authorization between the City of Arvin and Veolia Water West Operating Services, Inc.

2. Authorize the City Manager to execute the Task Authorization and any documents necessary to implement the Task Authorization and the Project, and to make non-substantive amendments consistent with Council’s direction.

FINANCIAL IMPACT:

The cost of the lift station project is included in the FY 26/27 Sanitation fund budget.

The City will need to obtain a San Joaquin Valley Air Pollution Control District (SJVAPCD) permit to operate Emergency/Low Use IC Engines for this generator. A copy of the permit application is included in the attachments and will need to be submitted once the generator is installed. The City will be required to submit the application and any associated fees at that time.

Veolia can help complete the application for the City, if needed.

The fees associated with this permit are as follows:

1. Application fee - $87 per emissions unit,

2. Processing fee - The current weighted labor rate is $113.00 per hour,

3. Annual PTO fee Rule 3020 Schedule 10 – Dependent on engine horsepower, 100-200 HP would be $143 per year.

Total fees $343.00 initially and $143.00 per year thereafter.

Total project cost for the Arvin WWTP Lift Station Power Protection (Generator) Project is $116,154.61.

EMISSIONS NOTE
 "California Air Resources Board (CARB) has approved alignment with the federal New Source Performance Standards (NSPS). Such alignment allows for emergency standby engines to be exempt from Tier 4 emissions standards; however, local air districts can require more stringent emissions control. The prospective buyer of the equipment quoted above is hereby notified the NSPS exemption does not apply to non-emergency standby engines (e.g. prime power applications such as peak shaving, parallel operation with the grid, or storm avoidance), or portable engines, even if used for emergency standby. Consult the local air district for permitting requirements and required emissions controls. Presently, South Coast Air Quality Management District (SCAQMD) Rule 1470 requires the use of a particulate filter if an engine is located within 100 meters of a school, and may require either a diesel particulate filter or an oxidation catalyst, depending upon engine size, if the installation is within 50 meters of a sensitive receptor. Particulate filters may also be required for Title V and major polluting facilities. For emissions requirements specific to the project for which this engine is being quoted, please contact SCAQMD at 909-396-2000. Unless otherwise listed above a DPF is not included in this proposal, please call for quotation if a DPF is required for this project.”  Caterpillar engines require a minimum of 30% load to prevent engine damage due to wet-stacking. Depending upon the permit and site specific conditions, SCAQMD emergency engine permits will only allow between 20 and 50 hours of runtime per year for non-emergency applications such as testing and exercising. Passive Diesel Particulate Filter systems depend on generator loading of a minimum of 50-60% to achieve minimum exhaust temperature threshold to keep soot regeneration and the filter backpressure within acceptable levels. If the engine will be operated consistently at low loads/low exhaust temperatures, the customer should make provisions to add load via facility operations or a load bank. Active Diesel Particulate Filter systems require no external load in order to regenerate. If listed above, Passive DPF option pricing, does not include a load bank or a load bank circuit breaker. If a load bank is needed for this project, please call for quotation.

TERMS AND CONDITIONS

1. Acceptance of Order.

This Quotation is for Buyer's information only and is not a valid offer to sell unless signed by an authorized representative of Seller in the place provided on the face of this Quotation. Prices, terms and conditions in an order from Buyer, which are inconsistent with the prices, terms and conditions of this Quotation, will be rejected by Seller, and are of no force and effect unless accepted in writing by Seller. Prices, delivery schedules and the scope of work on this Quotation are subject to change at Seller’s discretion.

2. Liability.

Seller's liability on any claim of any kind, including claims for negligence, or for any loss or damage arising out of or connected with the manufacture, sale, delivery, installation, resale or use of any products covered by or furnished under any order connected with this Quotation shall be limited to those claims arising solely from the acts of Seller and Seller shall in no way be liable for any special, indirect, incidental or consequential damages. The term “consequential damages” shall include, but not be limited to, loss of anticipated profits, business interruption, loss of use, revenue, reputation and data, costs incurred, including without limitation, for capital, fuel, power and loss or damage to property or equipment. Buyer expressly acknowledges and agrees that Seller has set its prices in reliance upon the limitations of liability and other terms and conditions specified herein, which allocate the risk between Seller and Buyer and form a basis of this bargain between the parties. Any claims against Seller for shortages in shipments shall be made in writing to Seller within fifteen (15) days of receipt of shipment by Buyer. Unless otherwise provided for in writing, Seller's responsibility for shipment ceases upon delivery to carrier, and any claims for shortage, delays or damage occurring thereafter shall be made direct to carrier by Buyer. Seller shall not be liable for any delays in delivery attributable to strikes, labor disputes, lockouts, accidents, fires, delays in manufacture or in transportation, delays in delivery of component materials, floods, severe weather, or Acts of God, embargoes, governmental actions, or any other cause beyond the reasonable control of Seller. Seller shall not indemnify nor be liable to Buyer, Buyer’s assigns, successors, purchasers, lessees or licensees, or to any person or entity for any claims, losses, expenses or judgments arising out of or resulting in any way from the product or integration of compatibility of the product with any other components, processes, facilities or equipment that does not comply with the equipment manufacturer(s)’s recommendations.

3. Shipments.

Unless otherwise specified, all risk of loss from the goods shall shift to Buyer at such time as the goods are delivered to a carrier for shipment to Buyer. Unless otherwise specified, shipment dates are approximate and all quoted prices exclude shipping costs. Shipment of goods under any order accepted by Seller shall be subject to the approval by Seller of Buyer’s financial condition at the time of shipment.

Whether or not terms of payment are specified elsewhere, Seller may, at its option, condition shipments under any order accepted by Seller upon receipt of satisfactory security or of cash prior to shipment. If, at Buyer’s request, shipment of goods under any order accepted by Seller is delayed more than thirty (30) days after the shipment date specified in the order, or the date the goods are ready for shipment, whichever is later, Seller will require immediate payment in full and/or assess additional charges for the expenses incident to such delay.

4. Termination.

In the absence of a written agreement between Buyer and Seller expressing different terms and conditions as to termination, any order accepted by Seller may be terminated prior to completion by Buyer only upon written notice to Seller and payment of Seller’s termination charges. If notice of termination is received by Seller after Seller has committed to buy the principal components for any order, termination charges shall include all direct and indirect costs incurred by Seller and the total profit anticipated by Seller. Additionally, Buyer’s instruction to Seller to stop work for thirty (30) days during the time specified for performance in any order may be construed by Seller as the equivalent of written notice of termination from Buyer and previous stipulations will be in effect.

5. Taxes.

Unless expressly stated, Seller's prices do not include sales, use, excise or similar taxes, which Seller may be required to pay in filling Buyer's order. The amount of any applicable tax shall be paid by Buyer as an additional charge unless specifically included in any order accepted by Seller, or in lieu thereof, Buyer shall provide Seller with a tax exemption certificate acceptable to the taxing authorities.

6. Patents.

Seller shall, at its own expense, defend and save Buyer harmless from the expenses and consequences of any suit or procedure brought against Buyer, based on a claim that the use or sale of goods specified in any order accepted by Seller constitutes an infringement of any United States letters of patent in existence on the date of any such order; provided Buyer promptly notifies Seller in writing of such claim and gives the necessary authorization, information and assistance for the defense of such a claim.

7. Changes.

Seller, and Seller's suppliers, may, at any time, without notice to Buyer, make changes (whether in design, materials, the addition of improvements, or otherwise) in any goods specified in any order accepted by Seller without incurring any obligation of any kind as a result thereof, but only to the extent that such change does not cause the goods specified to fail to meet Buyer's requirements. Buyer may, in its order, provide for changes in its requirements with provision for a corresponding equitable change in the price, if any; but in no instance shall Buyer make changes, which are substantially different from the scope of the original order accepted by Seller.

8. Export Sales.

In the event the goods and services specified in any order accepted by Seller are for export, the Buyer shall be responsible for securing export, import and other licenses or authorizations as may be required.

The conditions specified in this Section apply to all export transactions. This transaction is only for the sale of the equipment requested and detailed in this Quotation. Not included is any startup assistance, fieldtesting, training or any other services that might be required on site. Also not included is any installation, installation audits, sea trials (if applicable), or installation materials. To ensure proper application, installation, and warranty integrity, Buyer is encouraged to contact the applicable Caterpillar Dealer for these services. The costs of these services are not included in the sale price nor will Seller be responsible for any such related costs.

9. Permits for Equipment Design, Installation and Operation.

As a supplier of equipment, disclaims responsibility for any and all permits or licenses necessary to design, install and operate the equipment due to zoning, air quality, environmental, safety, building or construction codes or use permits pertaining to Buyer’s particular application of such equipment or any similar type of permit. Special attention should be given to the requirements of local air district rules and California Air Resources Board (CARB) regulations pertaining to permit requirements. Seller is quoting on equipment based on the specifications set forth in this Quotation. If additional equipment or engine modifications are required beyond the specifications, such as additional equipment required for compliance by a local air district or CARB, those items are not included and are the responsibility of Buyer. For example, South Coast AQMD (SCAQMD) Rule 1470 may require controls and limits on particulate matter, especially when the engine installation is within 100-meters from a school, or within 50 meters of a sensitive receptor (defined in Rule 1470). Ultra low sulfur fuel is required for particulate filters. CARB Diesel Fuel, or other CARB-approved alternative fuel, is also required for compression ignition (CI) engines operated in California. When indicated in the bill of materials, the proposed equipment may be SCAQMD pre-approved as Certified Equipment. This certification does not eliminate the permit process or responsibility of others to obtain a permit. Procurement of certified equipment assures permitability, reduces the permit processing fees and reduces the time necessary to obtain the permit through SCAQMD.

10. Start-up, Commissioning and Operating Requirements.

Equipment provided in this Quotation may require start-up and commissioning, including inspection(s), to ensure the equipment is installed in accordance with manufacturer(s)’s recommendations and specifications. If Seller has commissioned the equipment, Buyer agrees not to modify the design or components of the installation such that the modifications would violate any legal requirements of the installation, or would cause the installation to deviate from manufacturer(s)’s recommendations and specifications. Buyer acknowledges and agrees that, with respect to products sold to Buyer in connection with this Quotation, Buyer shall have the sole responsibility to ensure the products are properly installed, operated and maintained in accordance with the manufacturer(s)’s recommendations and specifications, and to determine and

Failure to install, operate and maintain the products in accordance with the manufacturer(s)’s recommendations and specifications will invalidate any applicable manufacturer’s warranty.

11. Additional material.

Only those items listed in this Quotation are included with any order. For example, unless specifically identified in this Quotation, the following items are not included with any purchased equipment: any exhaust or fuel piping, main fuel tank, fuel, duct work, special tools, insulation, wiring, cable, bus duct, concrete, anchor bolts, rigging or any material or labor incidental to the installation itself. Buyer specifically assumes responsibility for the provision of any such items if not specifically identified in the Quotation.

12. Hours of services.

When included, delivery, startup assistance, field testing, training or any other services required on site will be provided during the normal weekday working hours of 7:00 am to 4:30 pm. Delivery or services occurring at any other time, weekends or holidays is subject to premium charges.

13. Warranty.

The equipment manufacturer's warranty is the only warranty provided in connection with the equipment described in this Quotation. Buyer is responsible for operating and maintaining the equipment as specified by the manufacturer. The manufacturer’s warranties are exclusive and in lieu of all other warranties either oral or written, express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose. Seller is not a manufacturer and makes no warranty and shall not, under any circumstances, be liable for any indirect or special, incidental or consequential damages including but not limited to loss of production, loss of profit, loss of use or business interruption, or any other economic loss, whether arising from contract, tort, strict liability or any other theory of law. Buyer, Buyer’s assigns, successors, purchasers or any other person designated to operate the equipment as the end user, is responsible for operating the equipment in accordance with manufacturer(s)’s recommendations and specifications. Failure to perform all scheduled maintenance may result in damage to the equipment, and may be grounds to deny warranty coverage.

14. Terms.

Terms of payment are due upon receipt of invoice with no deductions of any kind for retentions, setoffs, discounts or other similar items. A finance charge of 1.5% per month (not to exceed the maximum allowed by law) will be charged on all past due invoices. When necessary Seller will file a California “Preliminary 20-day notice” pursuant to Section 3097 of the California Civil Code.

15. Cost additives.

A: Unit Cost.

Quotation prices are valid for 30 days only and are based on current market prices as of date of quotation. The Seller reserves the right to adjust the final invoice with a price escalation up to 6% due to 1) purchase orders being received after expiration of quotation, 2) fluctuations in raw materials market prices at time of order, 3) labor rate increases at time of scheduled field services, 4) delays in submittal approvals and/or release of equipment or 5) additional items or services provided that were not included as part of the original quotation. Since final invoicing can and may take place up to a year or more from original quotation date.

B: Delays.

If delivery is delayed by customer Buyer beyond original shipment date, purchase price is due 30 days after original shipment date and a storage and handling charge will be applied and is due each month until delivery. Finance charge of 1.5% per month (not to exceed the maximum allowed by law) is applicable on any amounts arising hereunder or in connection herewith that are not paid when due.

C: Start up.

If construction of the facility or other delays are experienced or expected, which prohibit the initial startup of the equipment beyond one year from delivery additional costs may be imposed including, but not be limited to, long term storage preparation, inspection charges, parts, service, etc.

16. Lead Times.

Lead times are based on manufactures estimated timetables. Project completion time may vary due to delays in receipt of purchase orders, submittal approval, release of equipment, manufactures unforeseen delays in production or holiday schedules. Project completion time frame cannot be guaranteed. Back orders will be processed as soon as available. Part number changes may be made to provide latest improved interchangeable items of equipment.

17. Governing Law and Venue.

The rights and obligations of the parties with respect to the transactions contemplated by this Quotation shall be governed in all respects by the laws of the State of California. The parties hereto irrevocably agree that the exclusive venue for any litigation arising in connection with the transactions specified in this Quotation shall be in the courts located in the County of Los Angeles, California.

18. Attorneys’ Fees and Costs.

In the event of any legal action, controversy, claim, or dispute between the parties involving the transactions contemplated by this Quotation, the prevailing party shall be entitled to recover from the other party reasonable expenses, attorneys’ fees, and costs.

19. Additional Conditions.

Buyer shall furnish to Seller, at no cost, suitable working space, storage space, adequate heat, telephone, light, ventilation, regulated electric power and outlets for testing purposes (if applicable). The facilities shall be within a reasonable distance from where any applicable services are to be provided. Seller and its representatives shall have full and free access to the equipment in order to provide any applicable services. Buyer shall provide the means to shut-off and secure electric power to the equipment and provide safe working conditions. Buyer shall not require Seller or its employees, as a condition to site access or otherwise, to further agree or enter into any agreement, which waives, releases, indemnifies or otherwise limits or expands any rights or obligation whatsoever. Any such agreements shall be null and void. Seller is under no obligation to remove or dispose of parts or equipment unless specifically agreed upon in Seller’s scope of work. Seller-removed parts become the property of Seller. Seller must not perform any electrical power switching unless specifically requested by Buyer, under the supervision of Buyer, and subject to procedures jointly agreed to in advance. Notwithstanding Buyer’s request, Seller may refuse to perform power switching, if in the opinion of Seller, such action would be unsafe. IN THE EVENT THAT SELLER PERFORMS POWER SWITCHING, TO THE FULLEST EXTENT PERMITTED BY LAW, BUYER SHALL INDEMNIFY, DEFEND, AND HOLD SELLER HARMLESS FROM ANY AND ALL LIABILITY, ACTIONS, SUITS, CLAIMS, DEMANDS, DAMAGES, COSTS, AND EXPENSES (“LOSSES”) ARISING OUT OF OR IN ANY WAY CONNECTED WITH OR RESULTING FROM SELLER’S PERFORMANCE OF POWER SWITCHING, REGARDLESS OF WHETHER THE LOSSES RESULT FROM SELLER’S NEGLIGENCE (WHETHER ACTION OR PASSIVE, AND WHETHER SOLE, JOINT, OR CONCURRENT), AND EVEN THOUGH CAUSED IN WHOLE OR IN PART BY A PRE-EXISTING DEFECT, STRICT LIABILITY, OR OTHER LEGAL FAULT OF SELLER. THIS INDEMNITY SHALL APPLY TO ANY ACTS OR OMISSIONS OR NEGLIGENT CONDUCT, WHETHER ACTIVE OR PASSIVE, ON THE PART OF EITHER SELLER OR BUYER. If OSHA or any other federal, state or local government, trade association, or contractual regulations or standards require a “safety person” to be on site during the performance of services, or in the event of a trade union jurisdictional dispute where trade union represented personnel are required to assist or stand by during the performance of services by Seller, Buyer shall be responsible for providing for and paying for any charge or wages for such person(s), as applicable. Buyer shall immediately inform Seller, in writing, at the time of order placement and thereafter, of any unsafe or hazardous substance or condition at the site, including, but not limited to, the presence of asbestos or asbestos-containing materials, and shall provide Seller with any applicable Material Data Safety Sheets regarding the same. Any losses, costs, damages, claims and expenses incurred by Seller as a result of Buyer’s failure to advise Seller shall be borne by Buyer. Seller, in its sole discretion and without cost or penalty, reserves the right to cancel its performance under this Agreement or any order immediately upon written notice to Buyer following Seller's discovery of unsafe or hazardous site substance or condition or any other circumstance altering Seller performance of Services. Buyer shall appoint a representative familiar with the site and the nature of the Services to be performed by Seller to be accessible at all times that Seller personnel are at the site. Seller shall not be liable for any expenses incurred by Buyer in removing, replacing or refurbishing any Buyer equipment or any part of Buyer’s building structure that restricts Seller's access. Buyer's personnel shall cooperate with and provide all necessary assistance to Seller. Seller shall not be liable or responsible for any work performed by Buyer.

Staff Report re Adoption of City Council Policies and Procedures Manual

CITY OF ARVIN
Staff Report
Meeting Date: July 28, 2026
TO: Arvin City Council
FROM: Stephanie Gutierrez, City Attorney
Jeff Jones, City Manager
SUBJECT: Resolution Adopting the City Council Policies and Procedures Manual BACKGROUND:

The City of Arvin has historically maintained formal procedural rules to guide the conduct of City Council meetings and governance practices. The City Council most recently adopted and amended its Procedural Rules for the Conduct of City Council Meetings through Resolution No. 2017-21 on March 21, 2017 (Attachment B). That action consolidated prior rules into a single resolution and built upon earlier updates, including revisions adopted in 2016 to address Grand Jury recommendations related to communications with City staff and enforcement provisions for violations of Council policies.

Since that time, the City’s procedural framework has remained largely unchanged and has focused primarily on meeting rules, order of business, and basic governance procedures. Over time, however, best practices in municipal governance, as well as evolving legal requirements and organizational needs, have highlighted the benefit of a more comprehensive and modernized policy document.

The proposed City Council Policies and Procedures Manual (“Manual”) expands upon the City’s prior procedural rules by providing a more detailed and structured framework addressing not only meeting procedures, but also Council roles and responsibilities, the council-manager form of government, ethics and conflicts of interest, communications, interactions with staff, and expectations for Council conduct. The Manual is intended to document accepted practices, clarify expectations, and promote transparency, consistency, and efficiency in City governance.

Adoption of the Manual will replace the City’s prior procedural rules framework with a comprehensive, updated governance document that reflects current law, best practices, and the City Council’s commitment to effective and accountable municipal leadership.

ANALYSIS
The proposed Manual is a comprehensive document organized into multiple chapters addressing key municipal areas, including:
• Council authority and responsibilities
• Mayor and Councilmember roles

Staff Report re Adoption of City Council Policies and Procedures Manual • Council-manager relationship
• Meeting procedures and parliamentary rules
• Ethics, conflicts of interest, and conduct
• Communication protocols and media relations
• Interactions with staff
• Boards, commissions, and committees
• Enforcement mechanisms, including censure and due process The proposed Manual is intended to serve as a living document that guides the City Council’s operations while remaining adaptable to future needs. It is designed to be reviewed periodically, at least every two years, to ensure it reflects updates in state law, best practices, and City policy.

The Manual also establishes the City Clerk as the official custodian responsible for maintaining the document and ensuring it is accessible to the public, reinforcing transparency and accountability.

STAFF RECOMMENDATION:

Adopt a Resolution of the City Council of the City of Arvin approving and adopting the City Council Policies and Procedures Manual.

FINANCIAL IMPACT:

There is no direct fiscal impact associated with adoption of the Manual. Implementation will be carried out using existing staff resources.

Pursuant to California Government Code Section 36813, the City Council of the City of Arvin hereby establishes the Policies and Procedures Manual herein. The Policies and Procedures Manual will take effect upon adoption by the City Council and will remain in effect until such time as it is amended or repealed in accordance with the provisions contained herein.

In addition to the Policies and Procedures Manual, this document includes supplementary information intended to assist the City Council, City staff, and the general public.

1.1 INTRODUCTION
This City Council Policies and Procedures Manual (“Manual”) has been prepared to document accepted practices and clarify expectations. The Manual is intended to assist Councilmembers in carrying out their roles, as well as provide useful information to prospective Councilmembers and other interested residents. Through agreement of the City Council to adhere to these practices, the effective administration of City Council affairs is greatly enhanced. While attempting to not be overly restrictive, procedures are established so that expectations and practices can be clearly articulated to guide Councilmembers in their actions.

The City Clerk shall be responsible for the maintenance of the Manual and ensuring its availability to the public. It is anticipated that this Manual will be reviewed at least every two (2) years, in order to reflect changes in law or City Council policy or procedure.

1.2 CITY COUNCIL ORIENTATION
Members of the City Council should have an understanding of the full range of services, facilities, and programs provided by the City. As new members join the City Council, the City Manager will coordinate an orientation to provide an opportunity for new Councilmembers to meet key staff. As part of this orientation, the City Attorney shall conduct training(s) to familiarize Councilmembers with applicable laws and legal responsibilities. This Manual shall be included in the orientation, along with a packet of additional materials to support and enhance the onboarding process.

Failure to observe any of the listed rules or procedures does not serve as an independent source to challenge any decision or action of the City Council.

This Manual provides a summary of important aspects of City Council activities. However, it cannot incorporate all material and information necessary to undertake the business of a City Council in California. Many other laws, policies, plans and documents exist that bind the City Council to certain practices and courses of action. Some of the most notable documents are:

CALIFORNIA CONSTITUTION AND CODES
The California Constitution and Codes contain many requirements for the operation of city government. Many of these requirements are also replicated within the Arvin Municipal Code to ensure there is broad awareness of such requirements. Arvin is a general law city, which means it is organized in accordance with provisions of the California Government Code.

ARVIN MUNICIPAL CODE
The Arvin Municipal Code contains local laws and regulations adopted by ordinance. It contains a variety of laws including, but not limited to, planning and zoning standards, election laws, local tax standards, and park and open space regulations. The Arvin Municipal Code is available on the City’s website or from the City Clerk.

GENERAL PLAN
Arvin’s General Plan is comprised of a number of elements, such as land use, transportation, open space, mobility and housing, in accordance with state requirements. The General Plan also provides a policy framework for various matters that fall within these areas. The General Plan is also available on the City’s website or from the City Clerk.

6.B.3

2.1 GENERAL POWERS AND RESPONSIBILITIES
The City of Arvin is governed by a City Council made up of four (4) Councilmembers and a directly elected Mayor. The City Council serves "at large," representing the entire community, rather than a particular district. The Mayor and the City Council are elected to four (4) year overlapping terms.

There are no limits to the number of terms they may serve.

2.2 MAYOR AND CITY COUNCIL GENERALLY
The powers of a city council in California to establish policy are broad. City Council may undertake any action related to City affairs other than those prohibited or preempted by state or federal law.

Specifically, the City Council shall have the power, in the name of the City of Arvin, to do and perform all acts and things appropriate to a municipal corporation and the general welfare of its inhabitants which are not specifically prohibited by the California Constitution and/or California law generally.

The Arvin City Council acts as a body. Although the Mayor has additional ceremonial and administrative responsibilities, no Councilmember possesses authority beyond that of any other member. In the establishment of policy and in all voting matters, each Councilmember holds equal authority. Except where otherwise required by law, a majority vote of the City Council is sufficient to establish policy and make decisions on behalf of the City.

A decision of the majority will bind the City Council to a course of action. It is staff’s responsibility to ensure that the policy of the City Council is implemented. Actions by staff to implement a decision of the City Council do not reflect any bias against Councilmembers who held a minority view on that issue.

2.3 CITY COUNCIL-MANAGER FORM OF GOVERNMENT AND ROLE

OF THE CITY MANAGER
The City Council-City Manager form of government is practiced in Arvin (hereinafter, “councilmanager form of government”). In California, the most common structure of city government is the council-manager system. Established by statute, the council-manager form of government is used in both general law and charter cities throughout the state. (Government Code § 34851 et seq.). Unlike in “strong mayor” cities where the mayor holds executive authority, a council-manager form of government assigns the role of chief executive to the City Manager, who is responsible for administering the full range of municipal operations. In council-manager cities, elected officials such

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 8 as the council and mayor are primarily responsible for setting policy, while the city manager is responsible for implementation, though managers often share responsibility for policy development.

The employment relationship between the City Council and the City Manager honors the fact that the City Manager is the chief executive officer of the City who works for five (5) independently elected officials. Collaborative leadership between City Council and the City Manager fosters transparency, accountability, and strategic decision-making.

Councilmembers should avoid situations that can result in City staff being directed by one or two members of the Council. Regular communication between the City Council and the City Manager is important in managing collaborative discourse. All dealings with the City Manager, whether in public or private, should respect the authority of the City Manager in administrative matters.

As in any professional relationship, it is important that the City Manager keep the City Council informed. The City Manager respects and is sensitive to the political responsibility of the City Council and acknowledges that the final responsibility for establishing the policy direction of the City is held by the City Council.

The City Manager’s power and authority include, but is not limited to:

A. Review and approval all agenda documents before preparing the agenda for regular or special meetings of the City Council.

B. Direct the work of all City departments, except those that are directly appointed by or report directly to the City Council (i.e. the City Attorney’s Office).

C. Recommend to the City Council adoption of measures that the City Manager may deem necessary for the health, safety or welfare of the community.

D. Consolidate or combine offices, positions, departments or units under the City Manager’s purview.

E. Conduct research in administrative practices to bring about greater efficiency in City government.

F. Provide management and leadership training to City departments.

2.4 ROLES AND RESPONSIBILITIES – MAYOR, MAYOR PRO TEM

AND COUNCILMEMBERS

2.4.1 MAYOR
A. Serves as the presiding officer of the City Council, preserving strict order and decorum at all meetings of the City Council.

B. Announces decisions of the City Council and rules on all questions of order, subject to review

D. Is recognized as the ceremonial spokesperson for the City and relays information as approved by a majority of the City Council.

E. Selects a substitute for City representation if the Mayor Pro Tem is unavailable to attend in the Mayor’s absence.

F. May call for special meetings in accordance with Section 6.15 of this Manual.

G. Signs required documents on behalf of the City pursuant to state law.

H. Presents proclamations at City Council meetings.

I. Is entitled to vote on all matters but does not have veto power.

2.4.2 MAYOR PRO TEM
A. Serves as the presiding officer when the Mayor is absent.

B. Performs the duties of the Mayor in the Mayor’s absence or at the request of the Mayor.

C. Represents the City at ceremonial functions at the request of the Mayor.

2.4.3 COUNCILMEMBERS
Including the Mayor and the Mayor Pro Tem, all members of City Council are expected to:

A. Participate in City Council meetings and in other public forums while demonstrating respect, consideration and courtesy to others.

B. Serve as a model of leadership and civility to the community.

C. Inspire public confidence in government.

D. Demonstrate honesty and integrity in every action and statement.

E. Be familiar with this Manual.

F. Prepare in advance for City Council meetings and be familiar with issues on the agenda.

G. Advise the City Clerk as soon as possible of an impending absence.

H. Seek authorization from the City Council if any request of staff requires more than two (2) hours of staff time to complete. This provision does not apply to City Council questions related to agenda reports.

I. Be respectful of other people’s time, stay focused and act efficiently during public meetings.

J. Commit to spending time each year outside of regular City Council meetings to work with the City Manager on setting goals and priorities for City government and to work on issues that may be inhibiting the maximal achievement of City goals.

K. Complete all required training in a timely manner, including state mandated AB 1234 Ethics Training and legally mandated harassment training.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 10 L. File in a timely manner all required Fair Political Practices Commission documentation, including but not limited to the annual Statement of Economic Interests.

2.5 APPOINTMENT OF CITY MANAGER AND CITY ATTORNEY
The City Council appoints two (2) positions within the City organization: the City Manager and the City Attorney. Both positions serve at the will of the City Council. The City Manager is an employee of the City and has an employment agreement that specifies certain terms of employment including an annual evaluation by the City Council. The City Manager is responsible for all other personnel appointments within the City.

The City Attorney has such duties as prescribed by the general laws of the state and regulations of the City.

2.6 CONCURRENT ROLES; CONCURRENT MEETINGS
City Councilmembers also serve as members of the following entities:

SUCCESSOR AGENCY TO THE ARVIN COMMUNITY REDEVELOPMENT AGENCY

ARVIN HOUSING AUTHORITY

ARVIN PUBLIC FINANCING AUTHORITY
Since the Councilmembers are also members of these legislative bodies, the City Council may concurrently convene meetings of the City Council and such legislative bodies that include all Councilmembers, or for which Councilmembers constitute a quorum. (Government Code Section 54952.3).

2.7 FINANCIAL MATTERS

2.7.1 COUNCIL COMPENSATION
State law and the Arvin Municipal Code provide modest compensation to members of the City Council. State law limits an increase in City Council salaries to 5% per year, effective only following the next election after adoption. (Government Code Section 36516).

2.7.2 TRAVEL BUDGET AND EXPENSE REIMBURSEMENT
It is the policy of the City Council to reimburse Councilmembers for actual and necessary expenses incurred in the performance of their official duties, subject to budgetary limitations and applicable

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 11 laws, policies, standards, and procedures established by the City Council. Reimbursable expenses are limited to those which would be deductible business expenses under IRS regulations. An expense will not be reimbursable if it is paid for or reimbursed by another entity or person. Subject to the foregoing, actual and necessary expenses will be reimbursed to any Councilmember if they arise from or are incurred in connection with the following type of occurrence:

A. Attending educational seminars or seminars designed to improve officials’ skill and/or information levels;
B. Participating in regional, state and national organizations whose activities affect the City’s interests;
C. Attending City events and City sponsored functions;
D. Where expenses are incurred after being approved by the City Council in advance of their incurrence; and
E. Expenses that would otherwise be allowable under this Manual when pre-approved by the City Council, but are incurred unexpectedly under emergent circumstances while on City business, and for which prior City Council approval cannot be obtained due to those circumstances.

Quarterly itemized reports of expenses incurred by Councilmembers will be prepared by the Finance Director and provided to the City Council by the City Manager.

All travel arrangements, except usage of a personal vehicle, shall be made by the City Manager’s Office at the most economical fare available consistent with the available travel time of the individual making the trip. Government and group rates must be used for lodging and transportation when available.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 12 CHAPTER 3

3.1 COMMUNICATIONS
An important role of each Councilmember is communication with the public to assess community opinions and to communicate information about the City. Because the City Council performs as a body – that is, acting based on the will of the majority as opposed to individuals – it is important that general guidelines be understood when speaking for the City Council. It is equally important to inform the public when members are speaking in a personal capacity and not on behalf of the City Council.

3.2 WRITTEN CORRESPONDENCE
The City Manager is authorized to receive and take administrative action on all correspondence directed to the City Council. Generally, correspondence relating to a specific City Council agenda item shall be distributed with the agenda report. Correspondence received after the publication of agenda packets is to be compiled and distributed to the City Council prior to the City Council meeting. The City Manager is also authorized to respond to correspondence submitted to the full City Council on non-agenda items or direct a staff member to respond to the extent possible.

After the City Council has taken a position on an issue, official correspondence should reflect this position. While Councilmembers who may disagree with a position are free to prepare individual correspondence on such issues, City letterhead and staff support should not be utilized.

3.3 SPEAKING ON BEHALF OF THE CITY OF ARVIN
Similar to written correspondence, when Councilmembers are requested to speak to groups or asked about the City Council’s position on an issue, the response should reflect the position of the City Council as a whole. A member may clarify their vote on a matter by stating, for example, “While I voted against X, the City Council voted in support of it.” When representing the City at meetings or other venues, it is important that those in attendance gain an understanding of the City Council’s position rather than that of an individual member.

When dealing with members of the media, the Mayor should represent the position and interest of the City Council. The Mayor may delegate this responsibility to the Mayor Pro Tem. In the event the Mayor Pro Tem is unavailable, the Mayor may delegate this responsibility to any Councilmember.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 13 3.4 SPEAKING AS AN INDIVIDUAL
On occasion, Councilmembers may wish to transmit correspondence on an issue upon which the City Council has yet to take a position or about an issue for which the City Council has no position. In these circumstances, members should clearly indicate in their communications that they are not speaking for the City Council as a whole, but for themselves as one member of the Council. As discussed above, in spoken conversations, Councilmembers should clarify when they are speaking as an individual and not on behalf of the City Council.

Example: “I am speaking only as an individual member of the City Council and not on behalf of the City Council as a whole.”

3.5 COUNCIL CONDUCT WITH THE MEDIA
Councilmembers are frequently contacted by the media for quotes and background information. The following are guidelines for communication with the media:

3.5.1 MAYOR IS THE OFFICIAL SPOKESPERSON FOR CITY COUNCIL

ON CITY POLICY
Because the Mayor is the designated representative on the City Council to present and speak on the official City position, Councilmembers must be clear about whether comments represent the official City position or their own personal viewpoint.

3.5.2 ON THE RECORD
It should be assumed that you are always “on the record.” Most members of the media represent the highest levels of journalistic integrity and ethics and can be trusted to keep their word. However, one bad experience could be devastating.

3.5.3 CHOOSE WORDS CAREFULLY AND CAUTIOUSLY
Comments taken out of context can cause problems. Therefore, be cautious about the use of humor, sarcasm, or word play.

3.6 CORRESPONDENCE FROM COUNCILMEMBERS
Councilmembers are sometimes requested to provide letters to residents, businesses, or other public agencies that convey the position of the City Council on policy matters. These letters are usually drafted by City staff or Council, placed on City letterhead, and signed by either the Mayor or City

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 14 Manager. Individual members of the Council may prepare letters to respond to constituents in response to inquiries or to provide requested information. Staff may also aid in the preparation of such correspondence at the direction of the City Manager. Councilmembers must place copies of any correspondence sent by an individual member on file with the City Clerk.

3.7 LETTERS OF RECOMMENDATION
If Councilmembers are asked to prepare letters of recommendation for students and others seeking appointments it is appropriate for Council to use City letterhead and their Council titles. Letters of recommendation should also indicate that the member does not speak for the City Council as a whole, but for themselves as one member of the Council. No review by the entire Council is needed, but copies of these letters must be placed on file with the City Clerk.

3.8 USE OF CITY SEAL/LOGO
City Councilmembers may only utilize the City seal and/or logo, shown below, for official business of the City. It will be a violation of this Manual for any Councilmember to make or use the seal or logo of the City or any cut, facsimile or reproduction thereof, in a manner which could be mistaken for the official business of the City, City Council, officers or departments.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 15 CHAPTER 4

4.1 INTERACTIONS WITH CITY STAFF
City Council should work through the City Manager or their designee to contact and/or work with staff. City staff will make every effort to respond in a timely manner to all requests made by individual Councilmembers for information or assistance. In the event a Councilmember’s request requires in depth analysis or more than two (2) hours of staff time, it will require City Council approval. Nothing in this Section shall be construed to limit the City Council’s authority to direct the City Manager through official action taken at a City Council meeting.

4.2 ACCESS TO INFORMATION
Staff shall cooperate fully and communicate candidly with both individual Councilmembers and the City Council in providing requested information, as authorized by law. The City Manager or appropriate staff will inform the City Council when a critical or unusual event occurs about which the public would be concerned. There are limited restrictions when information cannot be provided.

Draft documents (e.g., staff reports in progress, administrative draft EIRs, etc.) under review are not available for release until complete and after review by City Manager and the appropriate Department Head. In addition, there are legal restrictions on the City’s ability to release certain personnel information even to members of the City Council.

To assist the City Manager in their ability to monitor the flow of information, requests for information should be submitted in writing. To ensure proper responsiveness, all questions and requests for information are to go to the City Manager.

4.3 DISSEMINATION OF INFORMATION
In cases where a staff response to an individual Councilmember's request involves written materials, the City Manager shall provide copies of those materials to all Councilmembers.

4.4 RESTRICTION OF POLITICAL INVOLVEMENT BY STAFF
Local governments are non-partisan entities. As reflected within the principles of the councilmanager form of government, staff formulation and recommendations should remain consistent with City Council policy and should not be influenced by political factors.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 16 CHAPTER 5

5.1 CONFLICTS OF INTEREST
State laws are in place to prevent an action by a Councilmember that would constitute a conflict of interest. The purpose of such laws and regulations is to ensure that all actions are taken in the public interest. Whenever a Councilmember believes a potential for conflict of interest exists, he/she is encouraged to consult with the City Attorney. Staff may also request an opinion from the City Attorney or the California Fair Political Practices Commission (“FPPC”) regarding a Councilmember’s potential conflict. Laws that regulate conflicts are very complicated. Violations may result in significant penalties including criminal prosecution or the inability to serve in public office.

There are two primary laws that govern conflicts of interest for public officials in California: (1) the Political Reform Act, and (2) California Government Code Section 1090, et seq. In general terms, the Political Reform Act prohibits a public official from having a financial interest in a decision before the official. Government Code Section 1090, et seq. relates to government contracting law and prohibits a public official from having an interest in government contracts.

5.2 CITY ATTORNEY ADVICE
The City Attorney has an affirmative duty to protect the City and City Council from conflicts of interest wherever possible. It is critical to note that while the City Attorney can render advice on an interpretation of state laws and regulations on conflict matters, such advice is solely an interpretation of the law. The only entity that can provide binding interpretations and immunity on such matters is the California Fair Political Practices Commission (FPPC). Members or the full City Council may also solicit opinions on such matters directly from the FPPC, however, such opinions often take time to develop and may not readily respond to urgent matters. It is important to note that the City Attorney does not represent individual members of City Council, but the City Council as a whole.

5.3 CONFLICT OF INTEREST FORMS
Annual disclosure statements are required of all Councilmembers, designated commissioners and senior staff, which indicate potential conflicts of interest including sources of income, real property interests and receipt of loans and gifts.

5.4 HARASSMENT AND WORKPLACE STANDARDS
State law prohibits, and the City has policies and procedures which prohibit discrimination and harassment.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 17 5.5 LIABILITY
The City offers a variety of services and may occasionally find itself subject to legal actions through lawsuits. The City must always approach its responsibilities in a manner that reduces risk to all involved, however, with such a wide variety of high-profile services all risk cannot be eliminated.

It is important to note that violations of certain laws and regulations by individual members of the City Council may result in that Councilmember being personally liable for damages which would not be covered by the City. Examples include, but are not limited to, discrimination, harassment or fraud.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 18 CHAPTER 6

6.1 CITY COUNCIL MEETINGS
All regular and special meetings of the City Council are open to the public. Closed sessions may be held for purposes permitted by law, from which the public may be excluded.

6.2 RULES OF PARLIAMENTARY PROCEDURE
The City Council has adopted Rosenberg’s Rules of Order, Revised 2011, as its rules of parliamentary procedure.

The City Attorney shall be designated as the parliamentarian for City Council proceedings and shall advise the presiding officer on rules of order, meeting procedure, and the proper conduct of business. In the absence of the City Attorney, the City Clerk shall serve as parliamentarian. A parliamentarian serves in an advisory capacity only. Consistent with Rosenberg’s Rules of Order, the presiding officer retains the authority to determine and rule on proper parliamentary procedure.

6.3 SEATING ARRANGEMENT FOR CITY COUNCIL
The Mayor shall be seated in the center of the dais and the Mayor Pro Tem shall always be seated immediately next to the left of the Mayor.

6.4 DUTIES OF PRESIDING OFFICER
The Mayor shall act as the presiding officer at all meetings of the City Council and shall preserve strict order and decorum. In the absence of the Mayor, the Mayor Pro Tem shall serve as the presiding officer. In the absence of both the Mayor and the Mayor Pro Tem, the Council shall select, by majority vote of the members present, a Councilmember to serve as presiding officer for the meeting or until the Mayor or Mayor Pro Tem is present. The presiding officer shall state each question coming before the City Council and shall restate each question immediately prior to calling for the vote. The Mayor, Mayor Pro Tem, or other Councilmember serving as presiding officer shall be eligible to vote on all questions and shall direct the order of participation of Councilmembers.

6.5 QUORUM
Three (3) Councilmembers shall constitute a quorum for the transaction of business. A majority of the quorum shall be sufficient to pass any action taken by the City Council except on such matters which, by law, require a greater majority.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 19 If a majority of Councilmembers are absent from any meeting the City Clerk may declare the meeting adjourned to a stated time and place and shall prepare a written notice of the adjournment and conspicuously post it at the entrance to the Council Chambers.

6.6 RECOGNITION TO SPEAK
Every Councilmember desiring to speak shall address the Mayor, and upon recognition by the Mayor, shall confine their remarks to the question or item under debate.

6.6.1 INTERRUPTIONS
A Councilmember, once recognized, shall not be interrupted while speaking unless a motion to raise a point or order is raised by another Councilmember, or unless the Councilmember speaking chooses to yield to questions from another Councilmember.

6.6.2 CHALLENGED WHILE SPEAKING
A Councilmember, challenged while speaking, shall cease speaking until the point of order is determined. The Councilmember shall be permitted to proceed if ruled to be in order. Conversely, the Councilmember shall remain silent or alter any remarks to comply with Rosenberg’s Rules of Order if found not to be in order.

6.6.3 PUBLIC HEARINGS; EX PARTE COMMUNICATIONS
Councilmembers should not speak to the merits of an issue, other than to ask questions, until the public hearing has been closed. If the agenda item is an appeal of other than a legislative matter, Councilmembers should acknowledge and state the substance of any prior discussion of the item with any person (other than personal consultants not having an interest in the matter) at the beginning of the hearing.

6.7 ABSENCES
The purpose of this section is to establish clear procedures for granting permission for Councilmember absences in order to ensure compliance with Government Code Section 36513 and maintain continuity of governance. This policy is intended to define when an absence is considered “with permission” for purposes of that statute.

Councilmembers are expected to attend all regular meetings of the City Council unless an absence is excused. A Councilmember who anticipates being absent from a regular City Council meeting shall, when practicable, notify the City Clerk prior to the meeting and request that the absence be excused.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 20 An absence shall be deemed “with permission” under Government Code Section 36513 only if one of the following occurs:

A. Council Action. The City Council by vote in open session, grants permission for the absence.

The following categories of absences may be excused:
• Illness or Medical Leave.
• Family emergencies.
• Personal or family matter.
• Attendance at other official city, regional, state or intergovernmental meetings. • Military service or legally required appearances.

B. Council Recess or Canceled Meeting. The absence occurs during a period in which the City Council has formally recessed, cancelled or otherwise does not conduct a regular meeting.

C. Other Absences Excused by Council Discretion. The City Council reserves the discretion to excuse other circumstances, including but not limited to, natural disasters or emergencies, travel disruptions or other situations the Council finds reasonable.

Sample motion: “I move that the City Council find and determine that Councilmember [Name]'s absence from the regular City Council meeting held on [Date] is an absence with permission pursuant to Government Code Section 36513 and Section 6.7 of the City Council Manual.” All excused absences must be clearly noted in the official City Council minutes. The City Clerk will maintain records sufficient to demonstrate whether absences are with or without permission for purposes of Government Code Section 36513.

An absence that is not approved in accordance with this Manual shall be considered an absence without permission under Government Code Section 36513. Nothing herein alters or limits the operation of state law governing vacancies in office.

If a Councilmember is absent without permission from all regular City Council meetings for 60 days consecutively from the last regular meeting they attended, their office becomes vacant and shall be filled as any other vacancy pursuant to Government Code Section 36513.

6.8 COUNCILMEMBER OBLIGATION AFTER ABSENCE
When a Councilmember is absent from an earlier meeting at which a matter was discussed, it shall be the duty of that Councilmember to become acquainted with the issues discussed by reading the documents presented and when possible, listening to or viewing the taped recording of the meeting missed.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 21 6.9 DEADLINE FOR NEW BUSINESS
Generally, no new item of business will be discussed or considered after 11:00 p.m., unless approved by the City Council.

6.10 BUSINESS ITEMS OUT OF ORDER
The Mayor or staff may modify the order of the agenda upon approval of a majority of the City Council.

6.11 DEVELOPMENT OF AGENDA
The City Manager is responsible for preparing the City Council’s meeting agenda. Items may also be placed on an agenda for City Council consideration in the following ways:

A. by direction of the City Attorney in consultation with the City Manager; B. by direction of a majority of Councilmembers; or
C. under any processes set forth by statute or ordinance.

The agenda shall contain a brief general description of each item of business to be transacted or discussed, including items to be discussed in closed session. (Government Code Sections 54954.2, 54954.5).

6.12 DOCUMENT PREPARATION AND APPROVAL FOR AN
AGENDA
A. Ordinances. No ordinance shall be prepared for presentation to the City Council unless ordered by a majority vote of the City Council, prepared by the City Attorney on their own initiative, or recommended by the City Manager and developed with the City Attorney’s assistance. (Government Code Section 36936).

B. City Attorney Approval as to Form. All ordinances, resolutions, and contracts shall be approved as to form by the City Attorney, or their attorney designee, before being placed on the agenda. If the City Manager finds it necessary or expedient to place a contract on a City Council agenda for authority to execute it, but the contract is not yet in final form or has not been signed by the other parties, the City Council shall condition its authorization to execute the contract on the final contract being in substantially the same form as the one presented for the City Council’s consideration with such changes as may directed by the City Council, and upon the City Attorney’s approval of the final contract as to form. If the contract is

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 22 substantially changed or is not approved as to form by the City Attorney, then the contract must be placed on a subsequent agenda for the City Council’s consideration.

C. Ordinance Introduction and Adoption. The City Council hereby establishes and directs that reading the title of a proposed ordinance will be considered to constitute a full reading of the ordinance, unless a majority of the City Council present asks for a full reading. (Government Code Section 36934).

D. Majority Vote Required. An affirmative vote of at least three (3) members of the City Council shall be necessary to adopt an ordinance, a resolution, and to approve a contract for the expenditure of funds, except as may be required by law. An urgency (emergency) ordinance must be adopted by at least four (4) members of the City Council. (Government Code Sections 36936, 54954.2, 54956.5).

E. Ordinance Preservation. Following adoption of an ordinance, the City Clerk will assign a number to the ordinance, publish a summary, and/or post the full text as required by law. The ordinance shall be filed and preserved in the City Clerk’s Office.

F. Consent Calendar, Public Hearing, or Matters for Consideration. Ordinances not requiring a public hearing may be presented to the City Council for introduction as a action item and adoption on the consent calendar. The City Attorney shall determine the placement of an ordinance on a City Council agenda.

6.13 AGENDA FORMAT FOR REGULAR MEETINGS
The business of the City Council shall be taken up for consideration and disposition in the following order:

1. Call to Order
Mayor (or presiding officer) shall call the meeting to order.

2. Roll Call

6. City Council Comments Regarding Public Comment on Non-Agenda Items Following the public comment period on non‑agenda items, City Councilmembers may make brief comments or provide general direction consistent with the Ralph M. Brown Act. This item is limited to acknowledgment of comments received, clarification, or requests for staff follow‑up, and does not permit extended discussion, deliberation, or action on matters not appearing on the posted agenda.

7. Consent Calendar

At least two City Council members must request that a proclamation item be placed on the agenda. Proclamations will be considered for approval on the Consent Calendar by the City Council, with the presentation following immediately thereafter, unless otherwise pulled for earlier consideration of the presiding officer or a majority of the City Council. If a majority of the Council votes in favor of the proclamation, it shall be deemed to be a proclamation of the City Council of the City of Arvin.

B. Consent Calendar. Routine items that are not controversial in nature and do not require a public hearing may be placed on the consent calendar at the City Manager’s discretion. All items may be approved by one motion and one vote. Any Councilmember or member of the public or their representative may request any item be withdrawn from the consent calendar for separate consideration in its regular order of business.

C. Minutes. The minutes of a City Council meeting shall be “action minutes” which include the motions made, actions taken, and a brief summary of public comments.

A Councilmember may request, through the Mayor, the privilege of having an abstract of a Councilmember’s statement on any subject under consideration by the City Council entered into the minutes. If the City Council consents, the statement shall be entered. If a Councilmember voted in the minority, however, that Councilmember has the right to an abstract of such dissent entered into the minutes which explains an affirmative vote on a ministerial or other routine action on an underlying project or other matter as to which the Councilmember voted in the minority. An “abstract” is defined here as “a statement summarizing the important points of a given text.” The Councilmember requesting an abstract shall succinctly summarize their position to be entered into the minutes. Comments on items included on the agenda shall be reserved until the Council considers those items. However, under the provisions of the Brown Act, the City Council is prohibited from discussing, deliberating on, or taking action on any item that does not appear on the posted agenda. This prohibition includes collective discussion, the use of intermediaries, or serial communications conducted outside a properly noticed meeting. Accordingly, matters raised during “Public Comment on Non-Agenda Items” are limited to brief responses or clarification and to a determination of whether the issue should be placed on a future agenda for discussion, action, or report. Any

The requesting Councilmember shall provide the City Manager, with a copy to the City Clerk, a brief description of the proposed item sufficient to inform the City Council and the public of its subject matter. Requests for future agenda items shall be submitted no later than five (5) business days before the next City Council meeting.

6.15 SPECIAL MEETINGS
Special meetings may be called by the Mayor, the City Manager, the City Attorney, or by a majority of Councilmembers. The call and notice for a special meeting must specify the items to be considered and the date, time, and location for the meeting. (Government Code Sections 36807, 54956(a)).

Special meetings may only be called for matters that cannot be reasonably deferred until the next regular meeting. Special meetings shall not be used for items that can adequately be addressed at a regularly scheduled meeting. A matter typically qualifies when waiting until the next regular meeting would result in harm, legal non-compliance, or loss of opportunity.

6.16 SPECIAL MEETING STUDY SESSIONS/WORKSHOPS
The City Council may meet informally in special meetings designated as workshops that are called by the Mayor, the City Manager, or by a majority of Councilmembers. Study Sessions are special meetings intended for: training purposes such as ethics training, sexual harassment prevention and education, and specific technical subjects such as land use, team building, and to receive briefings and background information and hold general discussions on major issues before City Council action is required. Special meeting workshops are also intended for the City Council to work with staff to develop administrative items such as the budget, for the City Council to receive public input on matters of community wide concern, and for similar activities.

Study Sessions are open to the public and are meetings for purposes of the Brown Act. The City Council may provide direction, but unlike other special meetings, the City Council may not take final action at a Study Session. (Government Code Section 54956).

6.17 CLOSED SESSION
Closed sessions may only be held as authorized by state law and shall be held in accordance with the provisions of the Brown Act. A Councilmember may move to adjourn the closed session and reconvene the City Council in open session. The motion requires a second and approval by a majority vote. Upon being properly seconded, the Mayor must immediately call the motion for a vote.

The City Attorney or City Manager may call and notice closed session meetings as special meetings. (Government Code Sections 54954.5, 54956.5, 54956.7-54957.1, 54962).

After meeting in closed session, the City Council shall reconvene in open session, and the presiding officer or City Attorney shall make a public report of any reportable action taken in the closed session and the related vote tabulation. (Government Code Sections 54957.1, 54957.7).

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 27 6.18 CITY COUNCIL COMMITTEES
A majority of City Council may form ad hoc City Council subcommittees that do not have final decision-making authority. The City Council may also form standing City Council subcommittees.

Ad hoc City Council subcommittees comprised solely of less than a quorum of the City Council and that are limited to both a defined task and a duration are not subject to the Brown Act and are not required to follow these rules of procedure. (Government Code Section 54952(b)).

City Council standing subcommittees comprised of less than a quorum of the City Council and that have continuing subject matter jurisdiction or a fixed meeting schedule established by the City Council, shall comply with the Brown Act and follow these rules of procedure. (Government Code Section 54952(b)).

6.19 ADDRESSING THE CITY COUNCIL

6.19.1 SPEAKER CARD AND SPEAKER TIME
A person desiring to address the City Council is encouraged to complete a speaker card. Depending upon the extent of the agenda and the number of persons desiring to speak on an issue, the Mayor may limit the time for individual comments. When deemed necessary, the Mayor may extend speaker time unless a majority of the City Council objects. The following time limits apply unless modified by a majority of the City Council:
• Verbal Comment/Communications
Individual speaker – 2 minutes
Individual speaker (Translator) – 4 minutes
Spokesperson for Group of People – 15 minutes

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 28 Council, speakers who fill out a speaker card shall be called to address the Council before those who do not fill our speaker cards.

Once called, the person shall step up to the microphone and may state their name, the subject they wish to address, and state whom they are representing if they are representing an organization or other person(s). All public comments shall be addressed to the Council as a whole and not any individual member. No question shall be asked of City staff without permission of the presiding officer.

No person, other than the person having the floor, shall be permitted to provide public comment without the permission of the presiding officer. All comments shall be provided to the City Council through the presiding officer, and no question shall be asked of a Councilmember except through the presiding officer.

6.19.3 SPOKESPERSON FOR GROUP OF PERSONS
In order to expedite matters and to avoid repetitious presentations, whenever any group of persons wishes to address the Council on the same subject matter, it shall be proper for the presiding officer to request that a spokesperson be chosen by the group to address the Council and, in case additional matters are to be presented by another member of said group, to limit the number of such persons addressing the Council, subject to the right of all members of the public to speak on any item on the agenda pursuant to the Ralph M. Brown Act. Total minutes of public comment shall not exceed 15 minutes.

6.19.4 QUESTIONS AND COMMENTS FROM THE PUBLIC
Questions and comments from the public shall be limited to the subject under consideration. Public comment provided pursuant to the Ralph M. Brown Act is not a question and answer session.

Members of the public are afforded the opportunity to address the City Council on matters within the Council’s jurisdiction. Councilmembers may listen and make brief comments but should not engage in dialogue or respond to questions during the public comment period.

6.19.5 ADDRESSING THE CITY COUNCIL AFTER A MOTION IS MADE No person in the audience may address the City Council after a motion is made, without first securing permission to do so. Upon recognition by the presiding officer and permission being granted by a majority of the City Council, the person so recognized shall confine him or herself to the item under discussion.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 29 6.20 CONTINUED AGENDA ITEMS
It is City Council practice and policy that matters scheduled on an agenda will be heard at the meeting scheduled. When unforeseen circumstances mandate a request for continuance of an agenda item by an applicant, appellant, or other interested parties, the request must be made to the City Council at the outset of the consideration of the item. In addition, any person intending to make a request for a continuance shall inform the City Clerk, verbally or in writing, as soon as possible prior to the meeting that such a request for continuance will be made. The City Clerk shall inform the Mayor. The City Council will consider the request for continuance prior to discussing the substance or merits of the agenda item. The interested parties may speak to the issue of a continuance without forfeiting the right to speak later to the merits of the issue if a majority of the Council so rules. Comments may be presented by persons not able to attend the meeting for which the item is finally scheduled if the City Council agrees to continue the item.

6.21 PUBLIC HEARING CLOSED
Once a hearing is closed it is inappropriate for the public to speak except to answer an inquiry of a Councilmember addressed through the Mayor. However, a public hearing may be re-opened by the Mayor, subject to approval by a majority of City Council, to hear new information.

6.22 CANCELLATION OF MEETING
If the City Council considers and then decides to cancel a future regularly scheduled or special meeting it should take such action at the earliest prior meeting possible. If the action to cancel a meeting is taken more than one regular meeting prior to the date of the canceled meeting, the fact of any such cancellation shall also appear as a resolution on the consent calendar for the meeting immediately preceding the canceled meeting date.

6.B.3

7.1 BOARDS, COMMISSIONS AND COMMITTEES

7.1.1 DEFINITIONS
A. Boards, Commissions and Committees. The City Council shall establish by ordinance all boards and commissions which shall advise the City Council and perform such other functions and duties as prescribed by City Council. Unless otherwise directed, ad hoc committees shall be established by resolution.

B. City Representatives. City Councilmembers and City residents may be appointed to serve on county, regional or multipurpose agencies, committees and commissions to represent the City.

C. Standing Committee. Standing Committees of the City Council shall have either (1) a continuing subject matter jurisdiction or (2) a meeting schedule fixed by ordinance, resolution or formal action of the City Council.

7.1.2 APPLICATION AND APPOINTMENT PROCESS
The members shall be appointed by the Mayor with the approval of the majority City Council, in accordance with the following procedure:

A. Vacancy, Announcement, Interview and Applicant Pool. The City Clerk shall maintain records of membership status of boards, commissions and committees. The Clerk shall notify the Mayor of each vacancy.

When a vacancy occurs, the Mayor shall announce the vacancy at a Council meeting and invite the public to apply for the position(s). When the Mayor determines that sufficient applications have been received, staff shall agendize an informational item at the next meeting announcing (1) the final date for receipt of applications, (2) the date of the Council meeting at which the City Council will receive all of the applications and make its decision whether to interview applicants, and (3) the date of the Council meeting for making the appointment if no interviews are held. The final date for receiving applications shall be at least one week following the announcement.

At the meeting scheduled for the Council to consider interviews, the City Clerk shall provide a copy of all applications received to the City Council. If, at that meeting, Council decides to hold interviews, it shall then determine the interview process, including which applicants will be interviewed and schedule the interviews. After the interview process is complete, the Mayor shall schedule the meeting for making the appointment with the City Clerk.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 31 B. Application Required. D. Publishing Names of Appointees. The name of the intended appointee shall be included on the agenda for the meeting at which the appointment will be made.

E. All Applications Provided to All Councilmembers. The City Clerk shall include in the City Council’s agenda packet for the Council meeting at which the Mayor’s appointment is scheduled, all current applications filed for appointment to the board, commission or committee. F. Nomination and Approval of Appointment. The Mayor shall place in nomination the name of the person intended to be appointed from among the persons in the final applicant pool. No second to the nomination shall be made, but debate is allowed. The Council may, by a majority vote, open the discussion to include any or all applicants in the applicant pool. It is out of order for any Councilmember to place in nomination any other person other than the person placed in nomination by the Mayor. Upon approval of the nomination by the City Council, the Mayor’s appointment is confirmed and approved.

G. Procedure in Event the Mayor’s Nomination Not Approved. If the Mayor’s intended appointment is not approved, the Mayor shall at the same or subsequent meeting place in nomination another person’s name from the pool. The process continues until an appointment by the Mayor is approved, in accordance with the procedure set forth in this document.

H. Applications: Current List. A current list of applicants is established each year. Applications may be submitted to the City Clerk at any time between January 1 and December 31. These applications may be considered for various vacancies throughout the year; however, on December 31, any remaining applications of these persons not appointed will be void. In order to be considered in the following year, new applications will need to be submitted starting January 1.

I. Resident Appointments. Any appointment of any person, except a Councilmember, as a member or liaison of a County, regional, multi-purpose agency, or other outside agency shall be accomplished in the same manner as appointments to boards, commissions and committees.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 32 J. Councilmember Appointment. The Mayor shall nominate a Councilmember as a member of a County, regional, multi-public agency, or other outside agency, at the time the matter is considered at the City Council meeting.

K. Removal of Member of Board or Commission or Committee or City Representative. Any member of a board, commission or committee and any City representative or liaison to an outside agency, may be removed by a vote of not less than four (4) Councilmembers, initiated by any member of City Council. Any proposed removal shall be scheduled at a regular Council meeting, with the name of the person proposed to be removed printed on the agenda.

L. Waiver of Requirements. If compliance with any of the requirements set forth in this Section 7 would substantially interfere with the conduct of important City business, the City Council may waive one or more such requirements upon the affirmative vote of four-fifths (4/5) of the City Council.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 33 CHAPTER 8

8.1 CITY COUNCIL EXPECTATIONS

8.1.1 FOLLOWING MEETING RULES OF PROCEDURE
This Manual expresses both statutory requirements and standards of conduct expected for Councilmembers. Councilmembers are responsible for adhering to these rules of procedure.

If a Councilmember violates this Manual, another Councilmember should respectfully point out the issue. If the behavior continues, the matter may be raised privately with the Mayor. If the Mayor is the Councilmember involved, the concern should be raised with the Mayor Pro Tem instead. If after consultation with the Mayor or the Mayor Pro Tem the Councilmember’s behavior continues to violate this Manual, the alleged violation(s) can be brought up to the City Council at a public meeting.

8.1.2 LIMITED USE OF ELECTRONIC DEVICES OR OTHER FORMS

FOR PRIVATE COMMUNICATIONS DURING MEETINGS
Councilmembers should not utilize electronic devices or other forms for private communications during a meeting to communicate among themselves, the public, or anyone else during a City Council meeting on substantive matters related to City business (except for the City Attorney). This restriction on the use of electronic devices and other forms for private communications preserves compliance with the Brown Act and due process.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 34 CHAPTER 9

9.1 FAILURE TO OBSERVE POLICIES AND PROCEDURES
Failure to observe any of the listed procedures does not serve as an independent source of challenge to any action of the City Council, nor does it serve as evidence of improper conduct in any challenge to any action by an individual Councilmember or by the City Council as a whole.

9.2 CENSURE OF COUNCILMEMBERS
Censure is the most severe form of action. Censure is a formal statement of the Council officially reprimanding one of its members and may be combined with other actions, including, but not limited to, loss of committee assignments, suspension of City-sponsored attendance at conferences, meetings, workshops, seminars and similar gatherings, or removal of other privileges deemed appropriate by Council. Censure should be used for cases in which the Council determines, based on review of the findings of an investigation, the policy violation is a serious offense.

A decision to censure requires Council to adopt a Resolution and make findings regarding policy violations at a public meeting. Prior to the adoption of the Resolution, the named Councilmember will be provided sufficient notice and the opportunity to provide a written or verbal response to the complaint. After the named Councilmember provides a written or verbal response to the complaint, if any, the majority of the Council may vote not to adopt the Resolution but may decide to issue a lower action against the named Councilmember.

To protect the overriding principle of freedom of speech, the Council will not impose censure on any of its members for the exercise of their First Amendment rights, no matter how distasteful the expression was to the Council and the City. However, nothing herein may be construed to prohibit the Council from collectively condemning and expressing their strong disapproval of such remarks.

9.3 DUE PROCESS
In all instances, the City Council shall ensure that all due process requirements are met. The City Attorney may recommend variations to procedures to ensure due process.

9.4 DE-ESCALATION/INFORMAL RESOLUTION
In addition to the actions above, the Council is encouraged to take steps to de-escalate behavior that could lead to a complaint before a complaint is filed and consider addressing the complaint informally, if appropriate, in an effort to bring the named Councilmember into compliance with this Manual.

6.B.3
Attachment: City Council Polices and Procedures Manual 2026_072826 (City Council Policies and Procedures Manual) 35 9.5 VIOLATIONS OF LAW
Any violations of applicable laws as referred to in this Manual, which include, but are not limited to, violations of the United States and California Constitutions, United States and California codes, regulations, interpretive administrative findings and relevant case law, may be reported to the appropriate governing agencies.

CITY OF ARVIN
Staff Report
Meeting Date: July 28, 2026
TO: Arvin City Council
FROM: Jeff Jones, City Manager
SUBJECT: BUDGET ADJUSTMENT No. 2627-01
BACKGROUND:

On June 23, 2026, the City Council adopted the Fiscal Year 2026-27 Budget and directed staff to develop a budget amendment that would restore two Police Officer positions that had been identified for elimination as part of the adopted budget. During budget deliberations, Councilmembers expressed a desire to preserve public safety staffing to the greatest extent possible and directed staff to identify alternative expenditure reductions or other cost-saving measures elsewhere in the budget.

During discussion of the Fiscal Year 2026-27 Budget, Councilmembers indicated that maintaining public safety services was a priority and requested that staff explore other options to achieve the necessary budget savings before reducing sworn police staffing levels. The Council subsequently approved the budget with direction to return with a budget amendment restoring the two Police Officer positions and identifying alternative expenditure reductions sufficient to offset the cost of those positions.

Additionally, Council expressed concern regarding projected revenues and the City's continued use of General Fund reserves to balance operations. Staff was directed to review and revise revenue projections where appropriate and return with more conservative estimates.

DISCUSSION:

Consistent with Council direction, staff evaluated a variety of expenditure reduction options and operational adjustments to offset the cost of restoring the two Police Officer positions.

The annual cost of restoring the two Police Officer positions is estimated at approximately $250,000. During the June 23, 2026 budget hearing, staff estimated the required offset could range between approximately $300,000 and $320,000 depending on the final mix of reductions and related budget adjustments.

The City Manager recommends implementing the following expenditure reductions:

Description Amount
Do not fill vacant Community Services Officer position ($96,000) Eliminate proposed market adjustment for Police Chief recruitment ($40,000)

6.C.1
Attachment: Staff Report Budget Adjustment 2627-01_072826 (Budget Amendments for Fiscal Year 2026-2027) Description Amount
Eliminate proposed market adjustment for Finance Director recruitment ($40,000) Discontinue temporary help support at City Hall ($54,000) Discontinue non-mandated flood insurance coverage at Adobe Complex ($12,000) Reduce City Council conference and travel budget by 50% ($3,500) Eliminate Police Department community event expenses ($6,500) Reduce other community event budgets by 50% ($7,000)
Reduce employee education reimbursement budget ($7,000) Reduce outside consultant expenditures ($30,000)
Total Reductions ($296,000)
In addition to the expenditure reductions identified above, staff is proposing to revise Measure L revenue projections to better reflect current economic conditions and recent revenue performance. This adjustment is intended to provide a more conservative and realistic estimate of available revenues and to address concerns raised by the City Council regarding the City's longterm financial outlook and reserve levels.

Staff will continue monitoring revenues, expenditures, and reserve balances throughout Fiscal Year 2026-27 and will return to the City Council with additional budget amendments as needed.

FISCAL IMPACT:

The proposed budget adjustment restores two Police Officer positions at an estimated cost of approximately $250,000.

The recommended expenditure reductions total approximately $296,000, resulting in a net General Fund savings of approximately $46,000.

In addition, Measure L revenue projections are proposed to be reduced by $642,000 based on updated revenue assumptions and collection trends. The revised revenue estimate is intended to provide a more conservative budget projection and reduce the risk of future operating deficits.

The proposed amendments are intended to implement City Council direction while minimizing impacts to public safety services and reducing reliance on General Fund reserves.

RECOMMENDATION:

Approve Budget Adjustment No. 2627-01 amending the Fiscal Year 2026-27 budget to restore two Police Officer positions and implement expenditure reductions and other budget modifications necessary to offset the associated costs.

Bids shall be obtained from prospective suppliers when the amount involved is fifteen thousand ($15,000.00) dollars or less, unless, (1) at the city's discretion, bidding has been dispensed with in accordance with Section 3.08.070 of this chapter; (2) the amount involved is less than three thousand dollars ($3,000.00) and the city council has determined more than one (1) bid to be impractical; or (3) the purchase is to be made through the petty cash procedures. All bids must be in writing.

E. Petty Cash. Purchases of a minor nature may be made through petty cash procedures prescribed by the city council. Bidding shall not be required for petty cash purchases. As used herein, a "minor nature" shall mean purchases of one hundred ($100.00) dollars or less. (Ord 138 §10, 1978).
(Ord. No. 413, § 2, 2-18-2014; Ord. No. 429, § 7, 7-5-2016; Ord. No. 440, § 3, 2-7-2017)

3.08.090 Formal contract procedure—Purchases over thirty thousand dollars.

Except as otherwise provided in this chapter, purchases of incidental services supplies and equipment of an estimated value greater than thirty thousand ($30,000.00) dollars shall be by written order or contract with the lowest responsible bidder pursuant to the procedure prescribed in this section.

A. Notice Inviting Bids. Notices inviting bids shall include a general description of the articles to be purchased, shall state where bid blanks and specification may be secured, and the time and place for opening bids.

1. Published Notice. Notices inviting bids shall be published at least five (5) days before the date of opening of the bid. Notice shall be published at least once in a newspaper of general circulation, printed and published in the city, or if there is none, it shall be posted in at least three public places in the city that have been designated by ordinance as the places for posting public notices.

2. Bidder's List. Sealed bids shall be solicited from responsible prospective suppliers whose names are on a bidder's list maintained by the city, or from responsible prospective suppliers who have made written request that their names be added thereto.

3. Bulletin Board. The city council, by its designated official, shall also advertise pending purchases by a notice posted on a public bulletin board in the City Hall.

B. Bidder's Security. When deemed necessary by the city council, bidder's security may be prescribed in the public notices inviting bids. Bidders shall be entitled to return of bid security; provided, however, that a successful bidder shall forfeit his bid security upon his refusal or failure to execute the contract within ten (10) days after notice of award of contract has been mailed, unless in the latter event the city is solely responsible for the delay in executing the contract. The city council may, on refusal or failure of the successful bidder to execute the contract, award it to the next lowest responsible bidder.

If the city council awards the contract to the next lowest bidder, the amount of the lowest bidder's security shall be applied by the city to the contract price differential between the lowest bid and the second lowest bid, and the surplus, if any, shall be returned to the lowest bidder. If the city council rejects all bids presented and readvertises, the amount of the lowest bidder's security may be used to offset the cost of receiving new bids and the surplus, if any, shall be returned to the lowest bidder.

C. Bid Opening Procedure. Sealed bids shall be submitted to the city clerk and shall be identified as "bids" on the envelope. Bids shall be opened in public at the time and place stated in the public notices. A tabulation of all bids received shall be open for public inspection during regular business hours for a period of not less than thirty (30) calendar days after the bid opening.

D. Rejection of Bids. In its discretion, the city council may reject any and all bids presented and readvertise for bids pursuant to the procedure hereinabove prescribed in this section.

E. Award of Contracts. Except as otherwise provided herein, orders or contracts shall be awarded by the city council to the lowest responsible bidder. Notwithstanding any other provision in this section, if no bids are received, orders or contracts may be awarded by the city council in its discretion without complying with any further bidding requirements of this section.

F. Tie bids. If two or more bids received are for the same total amount or unit price, quality and service being equal, and if the public interest will not permit the delay of readvertising for bids, the city council may, in its discretion, accept the one it chooses.

G. Performance Bonds. The city council may require a performance bond before entering a contract, in such amount as it shall find reasonably necessary to protect the best interest of the city. When required, the form and amount of the bond will be described in the notice inviting bids. (Ord. 138 §9, 1978).

B. Process for Contracts With a Total Value Not to Exceed Fifteen Thousand Dollars ($15,000.00). The city manager is authorized to contract for all professional services required by the city, for which an appropriation has been made in the current budget, without implementing the formal request for proposal process set forth in subsection B, provided the contract involves an expenditure of city moneys of less than or equal to fifteen thousand dollars ($15,000.00) and the total proposed expenditure of city moneys under the contract and any amendments thereto will not exceed fifteen thousand dollars ($15,000.00). procuring professional services pursuant to the authority provided in this subsection the city manager shall use his best efforts to obtain the best value for the city based upon (1) qualifications of the firm; (2) The firm's experience with similar projects; (3) the firm's capacity to provide the professional services consistent with the city's timelines for performance and (4) the total overall cost to the city unless excluded by state or federal law. In addition, to the extent that its provisions apply to the particular type of service to be procured, the city manager shall fully comply with the requirements of Government Code, section 4526, as may be amended, which shall take precedence over any conflicting provisions in this section. The contract procuring the professional services shall be approved as to form by the city attorney prior to execution by the city manager. The city clerk shall retain the original contract. The finance department shall encumber the amount against the budget.

C. Process for Contracts With a Total Value in Excess of Fifteen Thousand Dollars ($15,000.00).

1. Upon approval of the city manager, the department head of the department requesting professional services shall prepare a request for proposal (RFP), and request for qualifications which shall then be sent to the appropriate professional service firms. The RFP shall include a description of the project and a scope of work to be performed. As a rule, proposals from a minimum of three (3) prospective firms shall be solicited. To solicit proposals, at a minimum the city shall post the RFP on its website, publich notice of the RFP at least once in a newspaper of general circulation and shall use its best efforts to identify other means of communicating the existence of the RFP to persons and firms who may be qualified to provide the services sought.

2. The department shall review all proposals received. The general selection criteria for determining which firm is to be selected include:
a. Firm qualifications;
b. The firm's experience with similar projects;
c. Schedule of completion;
d. Price, unless excluded by state or federal law.

To the extent that the provisions of Government Code, section 4526, as may be amended, apply to the particular type of service to be procured the selection process shall comply with its requirements which shall take precedence over any conflicting provisions in this section.

3. Based on the results of the initial screening process, the top firms may be invited to present their qualifications. Based upon their qualifications and presentations, the city shall rank order the firms. The city may negotiate the price, terms and conditions of the project with the top firm. The city also reserves the right to negotiate with another top-ranked firm if an agreement cannot be reached with the number one ranked firm.

4. Once the firm is selected, the contract shall be forwarded to the city attorney for review.

5. A staff report with recommendations shall be presented to the city manager.

6. The city manager is authorized to exercise his/her discretion to award the contract based upon the selection criteria set forth in subsection (B)(2) and staff's recommendation for professional services required by the city, for which an appropriation has been made in the current budget, provided the contract involves an expenditure of city moneys greater than fifteen thousand dollars ($15,000.00) and less than or equal to thirty thousand dollars ($30,000.00) and the total proposed expenditure of city moneys under the contract and any amendments thereto will not exceed thirty thousand dollars ($30,000.00).

7. The city manager shall submit to the city council for its consideration at a regular meeting or special meeting, unless not permitted by law, any contracts for professional services that involves an

expenditure of city moneys greater than thirty thousand dollars ($30,000.00) or when the total proposed expenditure of city moneys under the contract and any amendments thereto will exceed thirty thousand dollars ($30,000.00).

8. The contract procuring the professional services shall be approved as to form by the city attorney prior to execution by the city. The city clerk shall retain the original contract. The finance department shall encumber the amount against the budget.

D. If no proposals are received in response to the RFP after solicitation as required by this section, then this may serve as a presumption that no competitive advantage may be served by further solicitation of bids as it would either be impossible or not in the public interest. Upon such a determination by the city manager, or the city council for contracts in excess of thirty thousand dollars ($30,000), no further solicitation of bids is required by this section.

3.08.100 Inspection and testing of supplies and equipment.

The city council, or the city officer it designates, shall inspect supplies and equipment delivered to determine their conformance with the specifications set forth in the order. The city council shall have authority to require chemical and physical tests of samples submitted with bids and samples of deliveries which are necessary to determine their quality and conformance with specifications. (Ord. 138 §11, 1978).

3.08.110 Surplus property—Sale or other disposal.

A. All department heads of the city shall submit to the city council at such times, and in such form as may be prescribed, reports showing stock, materials, equipment and any real property on hand not then in use in said department. When a surplus of stock, materials, equipment, or real property exists in any department, the city council may transfer the same to any other department having a need for such stock or any portion thereof on approval of the city council or its designated official.

B. When it is found by the city council that stock, materials, equipment, or real property exists which is not needed for use by any city department, the city council may authorize the sale thereof, and the proceeds from any such sale or sales shall be deposited in the city treasury.

C. Upon the city council's finding and authorization of the sale of surplus stock, materials, equipment, or real property, the city manager may take whatever steps necessary to obtain the highest price in exchange for the sale of the surplus stock, materials, equipment, or real property. The determination of the highest price that will be most favorable to the city will be made by the city manager, within his/her sole discretion. The city manager may thereafter enter into and complete the sale of the surplus stock, materials, equipment, or real property on behalf of the city.
(Ord. 138 §12, 1978).
