DISCUSSION:
This action consists of authorizing the levy of special taxes in Community Facilities District 2005-1 to a newly annexed area for a mixed-use development known as Barrel Creek (Annexation No. 27).
This is a second reading of the proposed Ordinance and is required to formalize the annexation.
On September 8, 2026, the City Council held a public hearing on annexing the territory identified as Annexation No. 27 into the City’s Community Facilities District (CFD) 2005-1. After the close of the public hearing, the City Council adopted Resolution No. 2026-061. This annexation was authorized by Council on a 5-0 vote. A landowner election was then held, and the landowner(s) elected to authorize a special CFD tax and approved the annexation. The Draft Ordinance (Attachment 1) was subsequently introduced for first reading to authorize the levy of a CFD fee to all future property owners of Annexation No. 27 territory.
The Special Tax levied against residential units for Fiscal Year 2026-2027 is $883.67 per unit, which is subject to an annual escalator to pay for the service expansion needed to serve these additional residential units. The money collected can only be used to fund new public services authorized to be funded by the State Mello-Roos Act and identified within the Rate and Method of Apportionment and cannot be used to support existing services. Adoption of this Ordinance on second reading will complete the CFD process and allow for the issuance of residential building permits on the property.
09/22/2026 | Item D3 | Staff Report
FISCAL IMPACT:
Assessments for this annexation are estimated to be $53,020.20 annually, adjusted each year for inflation.

SUBJECT: Design Award for 2027 Measure F-14 Pavement Rehabilitation Project RECOMMENDATION:
Council award a professional services agreement to North Coast Engineering for $181,530 to provide design engineering and prepare bidding documents for the 2027 Measure F-14 Pavement Rehabilitation Project (City Proj. No. C2026R01).
DISCUSSION:
BACKGROUND
Sales Tax Measure F-14 was approved by voters in November 2014 to fund the repair, maintenance, and rehabilitation of City-maintained local roadways with a one-half cent sales tax over twelve years. A list of projects to be funded with Measure F-14 revenue is developed each budget cycle by employing the Critical Point Management technique with the City’s Pavement Management Program. The list of roadway segments below were selected by this process and included with the 2027 Measure F-14 Pavement Rehabilitation Project (2027 F-14 Project). A project map is also attached for reference.
Road Segments in 2027 Measure F-14 Pavement Rehabilitation Project Road Name Beginning Location Ending Location Length (ft) Area (sq ft) 2024 PCI Carrizo Rd El Camino Real Traffic Way 2,945 64,790 25

ANALYSIS
A Request for Proposals (RFP) was issued for the design phase of the 2027 F-14 Project in July 2026 with a work scope that includes topographic surveying, survey monument research, pavement engineering analysis, preparation of construction plans, specifications, cost estimates (PS&E), and providing engineering assistance during the bid process. Four proposals were received from Rick Engineering Company (RICK), North Coast Engineering (NCE), BKF Engineers (BKF), and Above Grade Engineering (AGE), all with local offices in San Luis Obispo County. All four are qualified consultants with experience on similar projects.
A technical selection committee independently reviewed and scored each proposal considering experience with similar projects, responsiveness to City needs, experience of key personnel, and other factors. While all proposals demonstrated the ability to complete the work, the selection committee identified North Coast Engineering as being the most qualified and providing the City with the best value to complete the work, and the City Engineer is recommending awarding a professional services agreement to NCE for the project.
NCE has a long and successful track record working with the City, including completing design work for previous F-14 projects. A detailed fee estimate worksheet was submitted with NCE’s proposal, and staff believes NCE’s fee is reasonable considering the extensive pavement testing, topographic surveying and intersection design that is needed. If awarded, NCE’s compensation will be based upon actual labor hours worked plus reimbursable expenses and subconsultant fees.
Design work is anticipated to take approximately seven months to complete. Staff anticipates a public bid around May 2027 with construction occurring in the June through November, 2027 timeframe.
FISCAL IMPACT:
Approving staff’s recommendations in this report will result in estimated expenditures of $181,530 from Sales Tax Measure F-14 Funds for the design phase of the 2027 F-14 Project. The adopted FY25-27 Budget includes $325,000 in budgeted funding for the project with a total project estimate of $4,275,000. The upcoming FY27-29 Budget is anticipated to include additional funding for the construction phase of the project.

SUBJECT: Design Award for North El Camino Real Pavement Rehabilitation Project, Phase 2
RECOMMENDATION:
Council award a professional services agreement to RICK Engineering for $209,746 to provide design engineering and prepare bidding documents for the North El Camino Real Pavement Rehabilitation Project, Phase 2 (City Proj. No. C2026R02).
DISCUSSION:
BACKGROUND
The North El Camino Real Pavement Rehabilitation Project, Phase 2 (North ECR 2) will rehabilitate
0.55 miles of El Camino Real (ECR) between San Benito Road and Del Rio Road. This is the second phase of pavement rehabilitation for the northern stretch of ECR and picks up where the last project ended. The previous construction project (C2016R01) occurred in 2018 between San Anselmo Road and San Benito Road. Properties adjacent to North ECR 2 are primarily commercial, multifamily, mixed use, and undeveloped. There is also significant development in the project area that has recently occurred, is in progress, or properties that have development entitlements but have not started construction – including Emerald Ridge, Del Rio Ridge, Del Rio Ranch, and The Edge.
It is expected that there may be multiple different pavement treatment methods utilized on this project as there is significant variability in the existing conditions of the road. Existing pavement widths vary significantly and are a mix of finished frontage improvements with concrete curb, gutter, and sidewalk and no frontage improvements. The lane configurations are also inconsistent and this project plans to provide a standardized lane configuration comprised of one through lane in each direction, a two-way center left-turn lane, bike lanes, curb and gutter, and sidewalk. Onstreet parking will be provided where possible. Curb, gutter, and sidewalk improvements are not planned to be completed with this project for undeveloped parcel frontages and will be expected of the developer. However, pavement may be widened adjacent to these undeveloped parcels in order to accommodate the lane configuration.
The pavement condition varies throughout this segment due to frontage improvements being completed by several recent adjacent developments and resurfacing of a portion of the
09/22/26 | Item D5 | Staff Report
southbound lanes following a sewer main replacement. It is expected that the majority of the roadways will need to be reconstructed, but the design engineer will evaluate all of the existing conditions and recommend a comprehensive pavement rehabilitation solution that takes into account cost-effective treatments for sections of roadway that are currently in good condition.
ANALYSIS
A Request for Proposals (RFP) was issued for the design phase of the North ECR 2 project in July 2026 with a work scope that includes preliminary geotechnical testing, topographic surveying, survey monument research, pavement engineering analysis, preparation of construction plans, specifications, cost estimates (PS&E), and providing engineering assistance during the bid process. Three proposals were received from Rick Engineering Company (RICK), Wallace Group (WG), and 4Creeks Engineering (4CE), all with local offices in San Luis Obispo County. All three are qualified consultants with experience of similar projects.
A technical selection committee independently reviewed and scored each proposal considering experience with similar projects, responsiveness to City needs, experience of key personnel, and other factors. While all proposals demonstrated the ability to complete the work, the selection committee identified RICK as being the most qualified and providing the City with the best value to complete the work. The City Engineer is recommending awarding a professional services agreement to RICK for the project.
RICK has a successful track record with the City, including completing design work for a number of F-14 projects, as well as the recently completed Santa Lucia Road Rehabilitation Project between Portola Road and the Graves Creek Bridge near Llano Road. A detailed fee estimate worksheet was submitted with RICK’s proposal and reviewed by staff who believe RICK’s fee is reasonable considering the extensive pavement testing, topographic surveying and intersection design that is needed. If awarded, RICK’s compensation will be based upon actual labor hours worked plus reimbursable expenses and subconsultant fees.
Design work is expected to take approximately seven months to complete. Staff anticipate a public bid around May 2027 with construction occurring in the June through November 2027 timeframe.
FISCAL IMPACT:
Approving staff’s recommendation will result in estimated expenditure of $209,746 from the Road Repair and Accountability Act of 2017 Funds, also known as SB-1 Funds. The adopted FY25- 27 Budget includes $250,000 for the project design in FY 26/27 with an anticipated total project cost of $2,100,000. Funding for the remaining $1,850,000 in project costs is anticipated to be allocated as part of the development of the FY 27-29 Budget, and this project has been identified as a candidate for continued SB-1 funding.

advance of the 2026/2027 El Niño winter season, in accordance with the Public Contract Code.
Delays in repair work until competitive bids are obtained may result in negative impacts to public safety and flooding, and staff therefore believes that there is sufficient basis under the Public Contract Code to support the emergency procurement to repair the failed storm drain pipes. The Resolution also requires that Council review this emergency action at its next regularly scheduled meeting, and each regularly scheduled meeting thereafter until the repairs to the failed storm drain pipes and culverts are complete, to determine whether there is a need to continue the action pursuant to Public Contract Code Section 22050(c).
ANALYSIS:
Since the last Council meeting, staff have been busy obtaining costs for the two Priority #1 locations on El Camino Real and preparing exhibits for Priority #2 and #3 locations. This work will be expected to take a month or two to complete and staff recommends that Council continue the actions under Resolution 2026-059. looking toward the horizon year of 2045. The complete General Plan and EIR can be found on the City’s General Plan website at www.atascadero2045.org.
DISCUSSION:
A city’s general plan is the primary document that establishes the context for how a city will develop and function into the future. It provides an integrated community vision and the general framework for all land use and zoning decisions within a community. It contains goals and policies that will shape future land use decisions, support economic development and job growth, foster healthy and resilient neighborhoods, protect and manage natural resources, ensure community safety, ensure adequate infrastructure and services are planned, and promote social and economic vibrancy. The 2045 General Plan frames the community vision for how Atascadero should grow and change over the coming years and decades. It is important for the document to reflect community priorities and values while shaping this future.
BACKGROUND
The City’s current General Plan was adopted in 2002 and provided a blueprint for development and growth with a horizon year of 2025. In 2021, the City began a five-phased approach to update the 2002 General Plan, initiating a comprehensive review and update to the plan, and identifying a vision, guiding principles, policies, and implementation framework with a horizon year of 2045.
This updated plan reflects the City’s approach to evolving demographics, economic factors, and environmental conditions in the context of a strong community vision.
The five phases of the project, as summarized below, included extensive community outreach and input, with each phase informing the final plan.
Phase 1, Scoping, included project process refinements and development of a community outreach strategy
Phase 2, Discovery, included development of the Existing Conditions Report, Vision and Guiding Principles, and a range of community engagement meetings and activities to hear early feedback on the City’s assets, challenges, and opportunities Phase 3, Exploring Alternatives, included the development of growth and policy alternatives for Atascadero’s future. This phase included the selection of a draft land use map, projected population and growth estimates, and general policy direction Phase 4, A Plan for Atascadero 2045, involved development of the draft 2045 General Plan document, the draft Environmental Impact Report, and Final outreach on the Draft 2045 General Plan
Phase 5, Celebrating our Future, involves preparation of a Final EIR, public hearings with both the Planning Commission and City Council, and final adoption of the 2045 General Plan with certification of the EIR by the City Council.
9/22/26 | Item G1 | Staff Report
This new General Plan requires the City to subsequently adopt a new zoning code and zoning map. The City commenced a comprehensive zoning code update in September 2024 to dovetail into the 2045 General Plan Update and minimize the gap between General Plan adoption and corresponding zoning code updates. A final draft of the Zoning Code will be reviewed by the Planning Commission on October 6th, with final action anticipated by the City Council on October 27th, with a second reading on November 10th. This would result in an effective date of the new zoning document on December 10, 2026.
ANALYSIS
The updated Draft 2045 General Plan replaces the term we currently use, “land use”, with the term “Placetype”. It includes policies that correspond to the goals and vision identified by the Council and community. The key policy framework focuses on:
• Supporting a mix of housing types
• Attracting new industries and higher wage jobs
• Improving mobility, access, and safety
• Addressing public infrastructure needs
• Ensuring fiscal sustainability
The General Plan is divided into chapters that integrate these key overarching policies and incorporate all required General Plan Elements per State law. All chapters are consistent to ensure that direction is comprehensive and clear. Guiding chapters of the plan include:
A. Chapter 3: Land Use and Community Form. This chapter fulfills State requirements for the Land Use Element. The chapter sets the stage for zoning and describes the purpose and characteristics of each Placetype (land use district). Policies are identified to preserve and foster community character when exploring opportunities for growth. This chapter outlines goals and policies for development citywide, including unique areas within Atascadero.
B. Chapter 4: Economic Development. This chapter provides policies to diversify the economic base and expand employment opportunities by attracting new businesses and supporting existing businesses. This chapter was emphasized by community members and City leaders as a key focus for the City with specifically defined policies and goals.
C. Chapter 5: Housing. This chapter is adopted separately under different State mandated adoption cyclesthat run for eight years. The former Housing Element will be incorporated into the 2045 General Plan. It was adopted in 2020 and is valid through 2028. The City will begin efforts to replace the current Housing Element in early 2027 and is currently seeking the assistance of a consultant to assist with that effort.
D. Chapter 6: Mobility. Fulfills State requirements for the Circulation Element and outlines policies to balance all modes of travel throughout Atascadero with an emphasis on multimodal transportation along major corridors, strategies to improve circulation at key
9/22/26 | Item G1 | Staff Report
intersections and freeway overpasses and identifying opportunities for expanded bicycle routes and pedestrian connections and trails.
E. Chapter 7: Recreation, Open Space, and Natural Resources. Fulfills State requirements for the Conservation and Open Space Elements, which focus on resource preservation, park space, and recreation resources.
F. Chapter 8: Public Services and infrastructure. Addresses topics required for the Safety and Circulation Elements, in addition to other utility related topics, including water supply, storage, and delivery, wastewater collection and treatment, flood control and stormwater management, solid waste management, energy, and telecommunications.
G. Chapter 9: Safety and Emergency Preparedness. Fulfills State requirements for the Safety and Noise Elements. This chapter establishes goals and policies regarding adequate emergency services and response systems, encompassing both preventative and proactive practices. It also outlines policies to enhance community protection from wildland fire hazards, noise, hazardous materials, adverse effects of climate change, and geological events.
POLICY AND IMPLEMENTATION FRAMEWORK
While Atascadero remains rooted in its foundational policies to maintain public safety and infrastructure, promote economic development, prioritize fiscal sustainability, and maintain its historic character and natural resources, the City must also accommodate and guide growth in a way that supports our community, strives to meet State goals, and identifies opportunities to enhance fiscal prosperity. The 2045 General Plan includes policies and action items for each of the chapters listed above. These policies guide future decisions and serve as a metric to gauge the City’s progress toward implementation of the General Plan. These policies are what the City uses to report progress to the State every year during our annual reports.
COMMUNITY OUTREACH AND PARTICIPATION
Community input was key to the General Plan Update. The City hosted a series of pop-up events, focus group meetings, and open houses in various locations to provide education opportunities and solicit community ideas on a preferred land use and growth alternative for the future of Atascadero. The community participated in an online mapping exercise that reenvisioned land uses throughout the City and provided guidance for the final land use map, becoming the basis for the General Plan. Multiple Council workshops were held to discuss specific details on the visions for new Placetypes, such as the mixed-use and innovation/flex districts. The City partnered with Atascadero High School to engage students in the process and encourage them to be part of community visioning for the future. More recently, the City has hosted “Coffee with a Planner” events to further our General Plan and Zoning Ordinance update outreach. Overall, the City hosted over 20 opportunities for in-person input.

An Environmental Impact Report (EIR) was prepared by SWCA for the 2045 General Plan and corresponding Zoning Code Update. The analyses evaluated the physical changes associated with
9/22/26 | Item G1 | Staff Report
assumed community buildout as well as the physical effects that may result from the establishment and implementation of the goals and policies of the plan.
The environmental analysis resulted in five (5) mitigation measures that are included in the final General Plan. The analysis identified potentially Significant and Unavoidable impacts to:
Air Quality
Greenhouse Gas Emissions; and
Transportation
As identified in the EIR, impacts that are “significant and unavoidable” cannot be resolved through mitigation. The City’s proposed General Plan self-mitigates and reduces many impacts with its focus on infill growth and improving the City’s jobs-housing balance while reducing vehicle miles travelled (VMT). Nonetheless, significant changes in the way air quality and GHG impacts are measured makes it infeasible to avoid significant impacts while accommodating growth in the community. It is important to understand that almost any growth or change that implements the State’s housing goals in any city in California would likely result in similar impacts since the thresholds for the impacts are very low and the State’s housing goals are substantial. In fact, the growth pattern and potential impacts associated with the new General Plan are far less significant than the previous General Plan. In reality, the addition of more housing units and more jobs in Atascadero will reduce environmental impacts from today’s current condition due to the potential of reduced vehicle dependency as our community becomes more complete.
The Draft EIR was posted for public review on April 20, 2026 for a 45 day review period, ending on June 4, 2026. Three public comments were received, all from other administrative agencies.
A draft of the final EIR has now been completed. Response to comments can be found in Attachment 1 as part of the Final EIR. Changes to the EIR were made, where appropriate, based on these comments.
MITIGATION MONITORING AND REPORTING PLAN
When a Lead Agency makes findings on significant environmental effects identified in an EIR, CEQA law requires that the agency must also adopt a “reporting or monitoring program for the changes to the project which it has adopted or made a condition of approval in order to mitigate or avoid significant effects on the environment”. The Mitigation Monitoring and Reporting Program (MMRP) is implemented to ensure that the Mitigation Measures and project revisions identified in the EIR are implemented.
The MMRP for the 2045 General Plan and Zoning Code Update includes the five identified mitigation measures. All identified mitigation measures required policies or action items to be added to the General Plan. The final 2045 General Plan has been edited to incorporate these measures, and all mitigation has been satisfied. The MMRP is included as Attachment 1, Exhibit A. The following is a summary of the identified mitigation measures:
9/22/26 | Item G1 | Staff Report
Paleontological Resources
Mitigation Measure GEO-9. Because new development projects may have the potential to damage paleontological resources, specific mitigation was identified to require a paleontological study for new larger scale developments in certain identified locations. A policy has been included in the 2045 General Plan and amendments have been made to the corresponding Zoning Code Update to satisfy this mitigation measure.
Wastewater Collection System
Mitigation Measure USS-3-1. Because timing of development over the envisioned 20 years cannot be known a mitigation measure is included to require analysis of individual projects as they are proposed to ensure adequate capacity in the collection system. An action item has been included in the 2045 General Plan to satisfy this mitigation measure.
Greenhouse Gas Emissions
Mitigation Measure GHG 1-1. The City’s Climate Action Plan is out of date and no longer valid based on revised State thresholds. A mitigation measure is included to update the Climate Action Plan. A policy has been added to the 2045 General Plan to accommodate this measure.
Mitigation Measure GHG 1-2. Until the City’s Climate Action Plan is updated, a mitigation measure was included that requires the City to incorporate transit-oriented features into development projects. These features include sidewalks and walkways that connect housing units to transit corridors. A policy has been included in the 2045 General Plan and amendments have been made with the Zoning Code Update to satisfy this mitigation measure.
Mitigation Measure GHG 1-3. To reduce impacts to greenhouse gas emissions, the City is required to incorporate a policy into the General Plan affirming participation in SLOCOG’s Sustainable Communities Strategy/Regional Blueprint Planning effort. This policy has been included in the 2045 General Plan.
STATEMENT OF OVERRIDING CONSIDERATIONS
CEQA requires that the Lead Agency (City of Atascadero) balance the economic, legal, social, technological, or other benefits, including region-wide or statewide environmental benefits, of a project against its unavoidable environmental impacts when determining whether to approve the project. If the specific benefits of a project outweigh the unavoidable adverse environmental impacts, the impacts may be considered “acceptable.”
For the impacts determined to be significant and unavoidable with implementation of the 2045 General Plan and Zoning Code Update the City Council will need to adopt a Statement of Overriding Considerations that provides the facts and reasoning related to the specific benefits of the project that outweigh the significant unavoidable impacts.
It is important to note that the 2045 General Plan assumes a level of growth that is likely to exceed the actual level of growth our City will realistically experience based on current State and regional
9/22/26 | Item G1 | Staff Report
trends. This assumption resulted in a conservative evaluation of environmental impacts to provide flexibility in plan implementation and growth scenarios into the future. In addition, the 2045 General Plan includes numerous policies and land-use changes that reduce impacts to air quality, greenhouse gas emissions, and vehicle miles traveled as compared to the 2002 General Plan.
FINDINGS OF FACT
In order to certify an EIR, the City must make one or more of the following findings for each of the significant effects accompanied by facts to support the findings.
1. Changes or alterations have been required in, or incorporated into, the project to mitigate or avoid the significant effects on the environment.
2. Those changes or alterations are within the responsibility and jurisdiction of another public agency and have been, or can and should be, adopted by that other agency.
3. Specific economic, legal, social, technological, or other considerations, including considerations for the provision of employment opportunities for highly trained workers, make infeasible the mitigation measures or alternatives identifies in the environmental impact report
These findings are in addition to the statement of overriding considerations for any effect that is found to be significant or unavoidable. The stated findings for approval of the General Plan and Zoning Code Update EIR can be found in Attachment 1, Exhibit A.
CONCLUSION
The Atascadero 2045 General Plan provides a framework for decision makers and the community for the next 20 years and beyond. The Plan strives to identify policies and actions aimed at achieving the City’s overall goals and vision. The Plan was developed in collaboration with members of the community, interested parties, partner agencies, staff, and decision makers. The Plan culminates a multi-year process and establishes a vision for the next 20 years rooted in community, economic prosperity, quality public service, responsible growth, and consideration of our natural environment.
NEXT STEPS
This hearing is the final hearing for the 2045 General Plan. The land use policies of the General Plan will be implemented by the Zoning Code Update, which is scheduled for Planning Commission action on October 6th and City Council action on October 27th.
Once the General Plan is adopted, the Plan will be converted to a web-based digital format allowing goals, policies, and actions to be linked and cross-linked providing for greater searchability and ensuring clear integration of all elements for future implementation actions.
This will enhance staff and the public’s experience and use of the General Plan and make the living document more accessible to all.
