We have just reviewed item #1 of the City Council (With the Planning Commission) Study Session Staff Report for November 27, 2023. As we will not be able to attend this meeting, given it is during regular work hours, we wanted to make two observations that should lead to corrections to the information contained therein in the hopes that the discussion does not proceed mis-informed:
All records we have access to clearly indicate that the property at 23 Oakwood is 1.52 acres and not 1.62 acres. What information does the Town possess that indicates 23 Oakwood is 1.62 acres? All county records we can locate indicate 1.52 acres. While I know that Arata has stated that he believes his property is 1.62 acres, what has the Town done to independently verify this? We suggest the Town have the property surveyed as the unit counts based on acreage appear to be important. Until the property is independently verified at other than the county record of 1.52 acres, all discussion of the property should be referenced at 1.52 acres.
Regarding the Density Bonus Law Table 1 (on page 2,) it indicates that 23 Oakwood is “½ mile from Transit”. We have come to understand that a property that is located within ½ mile from a major transit stop has additional consideration under the law. The Staff Report’s identification of 23 Oakwood as within ½ mile of a major transit stop in Table 1 is erroneous and should be corrected so that the discussion is clear. Citing that 23 Oakwood is within a ½ mile of any of the three qualifiers as stated in California Code, Resources Code- PRC 21064.3 (see link and screen shot below) is incorrect. Oakwood is not within a ½ mile of an existing rapid bus or train station nor a Ferry terminal. Lastly, it is not within a ½ mile of the intersection of two or more major bus routes. The bus route on the ECR is a single route, not intersecting.
Thank you for your consideration of these points and please confirm the corrections ahead of discussion on 11/27/2023.
Also, as we will be absent for the meeting at 3 pm on 11/27/2023 we would like the entirety of our statement contained in this email to be read into the public comments for this meeting. Pease confirm this request will suffice to read this email into public comment for this meeting.
Thank you,
Tom Giorgi and Stephanie Sargent
