Item No. 6
Town of Atherton
CITY COUNCIL STAFF REPORT – REGULAR AGENDA
TO: HONORABLE MAYOR AND CITY COUNCIL
GEORGE RODERICKS, CITY MANAGER
FROM: ROBERT OVADIA, PUBLIC WORKS DIRECTOR
RADHA HAYAGREEV, CONSULTING SENIOR PLANNER
DATE: MARCH 20, 2024
SUBJECT: APPROVE A SUBDIVISION IMPROVEMENT AGREEMENT AND FINAL PARCEL MAP FOR PARCEL MAP NO. TOA 24-01 FOR
THE THREE-LOT SUBDIVISION AT 170-178 ATHERTON
AVENUE (APN 070-070-110 AND 070-070-280)
RECOMMENDATION
It is recommended that the Council approve the Subdivision Improvements Agreement and Final Parcel Map for the three-lot subdivision at 170-178 Atherton Avenue (APN 070-070-110 and 070- 070-280).
BACKGROUND
On December 20, 2023, the City Council conditionally approved the Tentative Map for the threelot subdivision and approved the CEQA Notice of Exemption for the proposed subdivision at 170- 178 Atherton Avenue (APN 070-070-110 and 070-070-280). The conditions of approval included the construction of public improvements along Atherton Avenue. Section 16.20.07 of the Atherton Municipal Code requires that the subdivider execute and file an agreement between himself and the Town, specifying that they shall complete all improvement work to the satisfaction of the city engineer within one year from City Council approval.
Following Council approval of the Tentative Parcel Map, the CEQA Notice of Exemption for the subdivision was filed with the County of San Mateo and California Office of Planning and Research on January 30, 2023.
ANALYSIS
The Final Parcel Map has been reviewed by the Town’s Surveyor for technical correctness and the City Engineer for conformance with the approved Tentative Parcel Map. The Subdivision Improvement Agreement requires the subdivider to complete the public improvements as required by the conditions of approval for the Tentative Parcel Map. As part of this agreement, the sub- Final Parcel Map TOA 24-01, 170-178 Atherton Avenue

divider is required to provide various securities up to the amount of the estimated cost of public improvements, (currently estimated to be a total of $300,000.00). None of these improvements have been finally designed, completed and accepted at this time. Traditionally, the applicant is required to complete the public improvements within twelve months of Map approval, in accordance with the Atherton Municipal Code via a Subdivision Improvement Agreement.
The subdivider has requested an extension in the completion date of the public improvements such that they be better correlated to the construction window of the proposed construction on lots 1 and 2. Such deferral would minimize potential damage to improvements associated with construction and would allow for street resurfacing following the heavy equipment activities at the site. The Subdivision Agreement requires completion of the public improvements by June 1, 2026.
This timeline would also coincide with Town-planned updates to the Town’s Bicycle and Pedestrian Master Plan which may better define the extent of any required improvements.
The subdivider has posted a cash security deposit pending the approval of bonds and other securitization required by the Subdivision Improvement Agreement.
FISCAL IMPACT
There is no fiscal impact associated with this action. All required fees are collected by the Town for performing Planning and Engineering review and analysis for the subdivision.
GOAL ALIGNMENT
This Report and its contents are in alignment with the following Council Policy Goals:
• Goal Area A – Maintain Fiscal Responsibility
• Goal Area B – Preserve Small Town Character and Quality of Life • Goal Area F – Be Forward-Thinking, Well-Managed, and Well-Planned
POLICY FOCUS
The subdivision complies with the Town’s Housing Element and housing policy. The Council’s policy focus should be on consistency with the approved tentative map and compliance with the conditions of approval.
