NOTICE IS HEREBY GIVEN, pursuant to Atherton Municipal Code § 8.20.020, that conditions described on Attachment A are in violation of Atherton Municipal Code. The existence of property in a condition constituting a nuisance as defined in this code is injurious to the public health, safety, and welfare of the residents of this town. Such conditions contribute substantially and increasingly to the necessity for excessive expenditures for protection against hazards, diminution of property values, and the preservation of the public health and safety constitute a nuisance under Atherton Municipal Code § 8.20.020.
REQUIRED CORRECTIVE ACTION(s): Secure all appropriate permits and to physically commence, within ten (10) days from the date of service of the notice, and to complete within thirty (30) days from such date, the abatement of the described conditions/violations in Attachment A. The disposal of all materials involved in the public nuisance shall be carried forth in a legal manner.
PENALTY: Pursuant to Atherton Municipal Code § 1.20.050, each infraction shall be punishable by (1) a fine not exceeding one hundred dollars for a first violation; (2) a fine not exceeding two hundred dollars for a second violation of the same ordinance within one year; (3) a fine not exceeding five hundred dollars for each additional violation of the same ordinance within one year.
ADMINISTRATIVE AND ABATEMENT COSTS: Pursuant to Atherton Municipal Code § 1.21.110, at its discretion, the Town may pursue any and all legal and equitable remedies to collect unpaid fines imposed pursuant to this chapter. It is intended that persons causing, maintaining, or permitting the violation, and not the taxpayers, bear the financial burden of the Town’s code enforcement efforts. Remedies available to the town to collect unpaid fines and costs include the following without limitation: 1. Referring the delinquent account to a collection agency; 2. Authorizing a lien to be recorded on the property; and/or 3. Authorizing a special assessment upon the property. The town shall be entitled to recover all costs related to enforcing any violations that are recoverable under Government Code Sections 38771 et seq. and 54988 or any other local, state, or federal law. Such collection costs shall be in addition to any penalties, interest, and/or late charges imposed upon the unpaid fine.
EXTENSION: Pursuant to Atherton Municipal Code § 8.20.080 a responsible person has the right to request an extension of time, in writing, to the Code Enforcement Unit, within ten (10) days of the service of this notice. An extension request will be considered if it is determined that such an extension of time will not create or perpetuate a situation imminently dangerous to life or property.
APPEAL: Pursuant to Atherton Municipal Code § 8.20.090 any person aggrieved by the action of the city manager or his/her designee is issuing a notice and order pursuant to the provisions of this chapter may appeal to the city council within ten (10) days of service of the notice and order. If no appeal is filed within ten (10) days of service of the notice, the action of the city manager or his/her designee shall be final.

It shall be the responsibility of owners,
tenants and occupants of property to
discover the existence of dead or
dangerous trees located on such
property. Any owner, tenant or occupant
of property in the town on which
property there is a tree which appears to
be dead, is liable to fall, is dangerous or
is an obstruction to public travel shall
report in writing the existence of such
hazard to the superintendent of streets
and shall, within ten days after
observation thereof, at his own expense,
cut down and remove such tree. (Ord.
329 § 7 (part), 1974; Ord. 297 § 1, 1970)
The dangerous tree has been confirmed by the
Public Works Director to be on the easement
adjactement to your property. As the property
owner, this easement and the trees on it are
your responsibility. Questions regarding
