CITY COUNCIL STAFF REPORT – CONSENT AGENDA
TO: HONORABLE MAYOR AND CITY COUNCIL
FROM: GEORGE RODERICKS, CITY MANAGER
DATE: SEPTEMBER 18, 2024
SUBJECT: INFORMATIONAL – CAL CITIES 2024 RESOLUTIONS PACKET

RECOMMENDATION
It is recommended that the Council receive and file the Cal Cities 2024 Resolutions Packet; and, if there are specific comments related to the Voting Delegate’s support or opposition to the Resolutions to so advise.

BACKGROUND
Each year, members of the City Council traditionally attend the League of California Cities Annual Conference. At the General Assembly meeting of the conferance, the Council selected Voting Delegate has an opportunity to vote on any Cal Cities Resolutions presented. Attached is the Cal Cities 2024 Resolutions Packet.

ANALYSIS
The Cal Cities 2024 Resolutions Packet includes one resolution for consideration at the General Assembly. The Resolution is presented by the City of Glendora and is “a Resolution of the General Assembly of California Cities calling for the California Legislature to enact laws that ensure that “What Applies to One Applies to All” in the Fair and Equal Treatment of all Governmental Officials at al levels in the State of California.” The Resolution references numerous legislative measures that apply to local jurisdictions but apply in limited measure to the State. These include the Brown Act, exemptions under CEQA, the Political Reform Act, and others.

The Resolution resolves to the following policy:
”The California State Legislature shall not enact, and the Governor shall not sign into law, any law or regulation that applies solely to elected officials of California cities and counties, unless such law or regulation also applies equally to members of the California State Assembly and Senate.

This prohibition shall not apply to laws or regulations affecting the inherent powers of the legislative branch under the California Constitution.”
The Resolution is echoed by several letters of support and a Cal Cities Staff Analysis.
