Subject: Request for Amendment to Agreement Approved December 20, 2023 Upper Atherton Channel Relining Project - Project Management Services Dear Robert:
This letter serves as a request to amend Capital Program Management Inc. (CPM) Agreement approved December 20, 2023 to provide Project Management Services to the Town of Atherton ("Town") for Upper Atherton Channel Relining project, including design consultant selection through an RFP process, environmental review and permit coordination, consultant project management and oversight, and assistance with FEMA reimbursement for eligible activities.
The amendment would add an estimated completion date of February 28, 2026 and increase the estimated fee budget from Sixty-Six Thousand Dollars ($66,000) to One Hundred Twenty-One Thousand Dollars ($121,000), an increase of Fifty-Five Thousand Dollars ($55,000). It would also provide an updated Schedule of Hourly Rates showing no rate increase through the end of the contract. We recommend the following:
REVISE Paragraph 2.A. within TERM OF CONTRACT, as follows:
A. The services of Consultant, as outlined in Exhibit "B" attached, are to commence upon full execution of this Contract and shall be undertaken and completed by the estimated completion date of February REVISE Paragraph 3.A. within TERM OF CONTRACT, as follows:
A. The Consultant shall be paid monthly for the actual fees and costs of services, but in no event shall total compensation exceed One Hundred Twenty-One Thousand Dollars ($121,000) without City's prior written approval. Consultant's fees shall be as specified in the Schedule of Fees, which is attached hereto an incorporated herein as Exhibit C.
REPLACE EXHIBIT "B" Project Schedule, with the attached.
REPLACE Schedule of Rates for Personnel Costs within EXHIBIT B with the attached updated Schedule as EXHIBIT "D".
CPM has valued our working relationship with the Town and we are delighted to continue our services.
