CITY COUNCIL STAFF REPORT – CONSENT AGENDA
TO: HONORABLE MAYOR AND CITY COUNCIL
FROM: GEORGE RODERICKS, CITY MANAGER
DATE: JULY 16, 2025
SUBJECT: AUTHORIZING THE EXECUTION OF A PUBLIC ART
DONATION AGREEMENT
RECOMMENDATION
It is recommended that the Council authorize the City Manager to accept a public art donation and execute a contract with Dan Friegang.
BACKGROUND
Dan Friegang reached out to Councilmember DeGolia regarding donating a painting to the Town. Councilmember DeGolia forwarded the request to the City Manager to bring back to the City Council for review and possible acceptance of a painting for the Town’s display. The painting is a Jane O'Neill watercolor and depicts trees and structures.
Dan Friegang wishes to attach certain conditions to the donation of the painting, including that the painting be permanently displayed for the public to see, that the Town not sell the painting, that a plaque be created and placed next to the painting, and that if the painting is not publicly displayed for a period of more than six (6) months, he has a right of first refusal to reclaim the painting. The painting is valued at approximately $500.
ANALYSIS
The City Attorney has drafted a Public Art Donation Agreement between the Town and Dan Friegang that accepts the donation of the painting. The agreement also attaches the conditions listed above.
