RESOLUTION NO. 25-XX
A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF
ATHERTON AUTHORIZING EXECUTION OF DOCUMENTS IN THE
PARTICIPATION OF THE POOLED LIABILITY ASSURANCE NETWORK JOINT
POWERS AUTHORITY (PLAN JPA) WORKERS COMPENSATION PROGRAM _________________________________________
WHEREAS, Cities Group dissolution agreement requires that Cities Group cease all claims operations as of the transfer date on January 1, 2026. As a result all member agencies, including the Town of Atherton, must secure a new provider for Workers’ Compensation coverage effective January 1, 2026; and
WHEREAS, following review of available alternatives options for Workers Compensation program, staff recommend joining the PLAN JPA’s Workers’ Compensation Program; and
WHEREAS, PLAN JPA is an established joint powers insurance authority consisting of 28 member cities in the Bay Area. The Town of Atherton is already a member of the PLAN JPA for risk management and insurance pooling programs including general liability, property liability, auto liability, cyber security and employment liability; and WHEREAS, PLAN JPA Workers’ Compensation Program can accommodate the effective January 1, 2026 start date, which aligns with the Cities Group claims operations end date; and
WHEREAS, PLAN JPA Workers’ Compensation Program offers synergy for cost effective and comprehensive program solutions. Provides a premium that includes claims administration, excess insurance coverage, and safety consultation services; and WHEREAS, by participating in the PLAN JPA Workers’ Compensation Program, the Town can be under one insurance JPA umbrella that spreads risk across multiple agencies, stabilizing costs and protect against large unpredicted claims; and WHEREAS, the Town is already familiar PLAN JPA operations within the existing liability program that allows for a smooth transition, and consolidation of Town insurance programs under one JPA offers operational advantages with a more coordinated approach to risk management and prevention; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the Town of Atherton does hereby authorize and approve of the participation in the Pool Liability Assurance Network Join Powers Insurance Authority Workers’ Compensation Program.
