ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF
ATHERTON, STATE OF CALIFORNIA, AMENDING
CHAPTER 15.40 OF THE ATHERTON MUNICIPAL CODE
WHEREAS, the City Council has adopted various ordinances regulating construction within the Town as codified at Chapter 15.40 of the Atherton Municipal Code; and
WHEREAS, for ease of reference for contractors and property owners seeking to undertake construction within the Town, the Town annually publishes a schedule of days when certain construction and construction-related activities are prohibited in the Construction and Delivery Hours and Holidays (“Annual Schedule”); and WHEREAS, the City Council wishes to harmonize the provisions of the Atherton Municipal Code with the Annual Schedule posted on the Town’s website for 2026; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meeting of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
THE CITY COUNCIL OF THE TOWN OF ATHERTON DOES ORDAIN AS FOLLOWS:
SECTION 1: Amendment. Atherton Municipal Code section 15.40.110 Definitions, subsection C is hereby removed.
SECTION 2: Amendment. Atherton Municipal Code section 15.40.120 Time Limits, subsection B is hereby amended to read as follows:
B. Construction, pickup and delivery shall be prohibited on any property within the Town on Saturdays, Sundays, and the following Town established holidays: New Years’ Day, Martin Luther King Jr. Day, President’s Day, Memorial Day, Independence Day, Labor Day, Veteran’s Day, Thanksgiving, the day after Thanksgiving, and Christmas Day. If a listed holiday falls on a Saturday, the prohibition falls on the preceding Friday. If a listed holiday falls on a Sunday, the prohibition falls on the following Monday.
SECTION 3: Severability. If any section, subsection, subdivision, paragraph, clause or phrase in this Ordinance, or any part thereof, is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections or portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase of this Ordinance, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases may be declared 1919852.2 14537-009 O20XX-__ Page 2 of 2 Type adop
invalid or unconstitutional.
SECTION 4: Effective Date. This Ordinance shall become effective thirty (30) days following adoption.
