CITY COUNCIL STAFF REPORT – STUDY SESSION
TO: HONORABLE MAYOR AND CITY COUNCIL

FROM: ROBERT BARRON III, FINANCE DIRECTOR

ROBERT OVADIA, DIRECTOR OF PUBLIC WORKS
DATE: JUNE 3, 2026
SUBJECT: REVIEW OF THE FY 2026/27 TOWN BUDGET SPECIAL REVENUE,

INTERNAL SERVICE FUNDS AND ALL FUNDS CHANGES ONLY

CAPITAL IMPROVEMENT PROGRAM

RECOMMENDATION
Review and discuss Operating Budget FY 2026/27 provide feedback Special Revenue, Internal Service Funds and Capital Improvement Program (CIP).

BACKGROUND & EXECUTIVE SUMMARY
The June 3 Study Session is the 4th meeting of the Council to discuss the FY 2026/27 Town Budget.

Prior meetings focused on General Fund and Capital Improvement Program. This Report also includes discussion of Special Revenue Funds and Internal Service Funds, returns the entirety of the budget back to the City Council and incorporates any adjustments from the last review (inclusive of the CIP).

Summary of Changes Since Last Council Meeting
General Fund
For FY 26/27, General Fund revenues are projected at $26,161,563 and General Fund expenditures are projected at $23,370,663. This reflects a single year surplus of $2,790,900 before the addition below the line of ERAF and transfers in/out for CIP. There is a projected year-end positive fund balance in the General Fund of $11.702 million. This is a decrease of approximately $2.145m from previous General Operations budget review. There is an allocation placeholder of $4.090 million and $250k annual facility replacement to the CIP below the line and this amount contributes to the decrease in fund balance. This will be discussed further in more detail in the CIP section of this report. The new fund balance amount includes an Unallocated Fund Balance of $4.691 million.

Town Financial Outlook Planning Model

FY 2026/27 Special Revenue, Internal Service Funds & CIP June 3, 2026

Page 2 of 13 ends

During the May 6 Budget Study Session, the Council discussed the 5-Year Planning Model and identified capital project priorities and new projects. In short, after review of the CIP the Council removed the Selby Bicycle Lane Project but added 4 projects discussed later that netted to approximately the same fiscal amount. The Council directed staff to incorporate all of the changes and return on June 3 with an updated spreadsheet.

Based on Council feedback, the updated FY 2026/27 allocation to CIP is $4,090,000 and $250,000 for Facility Replacement in the Financial Planning Model. This allocation is a transfer out from the General Fund in the FY 2026/27 budget towards the Capital Improvement Fund for Town project priorities in the Drainage, Bike & Ped, Streets, and Park Master plans. The Transfer out of $4.340 million is now incorporated below the line within the General Fund Revenues & Expenditure Summary.

With the changes made, there is a net available ending fund balance (after set-asides) of $4,691,207 (line 46) in FY 2026/27 in the Financial Planning Model Departmental Budget Changes
There was a slight decrease in adjustments to Revenues in the amount of $65,000 in the General Fund for FY 2026/27. There was an overall increase in General Fund Department expenditures in the amount of $5,832. The expenditures increase was due to department operation. o Police Department had an increase of $5,832 due to previous discussion and approval of adding specialty pay of 2.5% for the Therapy Canine Handler. The Police Department’s therapy canine program was established in July 2024. The therapy dog Emmy and her handler provide comfort, emotional support, and positive engagement during police and community interaction. There were also minor funding adjustments for County of San Mateo annual maintenance and Animal Control contracts.

CAPITAL IMPROVEMENT FUND
Staff provided the 5-Year Fiscal Outlook Spreadsheet and project list for Council review. Based on Council feedback, the total allocation amount from the General Fund for FY2026/27 is $4,340,000. The City Council reviewed the various baseline, on-going, and potential projects identified for funding consideration. Based on Council feedback, the allocation amount from the General Fund for the FY2026/27 CIP is $4,090,000 and $250,000 for facility replacement.

Policy discussion by the Council resulted in confirmation of current priorities and continuation of on-going projects with the noted exception of the Selby Bicycle Lane Project. Below are the resultant updated changes to the CIP program:

Added CIP Projects FY 2026/27:
- Middlefield Road Pedestrian Improvements (Design): $300,000 - El Camino Real/Atherton Avenue Intersection Study (study only): $350,000 - Drainage Master Plan Update: $350,000

Page 5 of 98 ends

Page 3 of 13 ends

- HPP Asphalt Pathway Repairs (design and construction): $325,000 Staff noted that some of the projects or priorities have potential grant or non-general funds offsets.

These amounts reduced the General Fund contribution reflected in the final Unallocated balance of $4.090 million for CIP projects. There is a spreadsheet of baseline, ongoing, and new CIP projects attached. This spreadsheet includes the current status of each project.

The grant and offsets by Fiscal Year are as follows:

FY 2026/27
$300,000 from Library Funds
$1,000,000 – Alameda de las Pulgas Traffic and Safety Improvements (SMCTA – Awarded) $125,000 – El Camino Real/Selby Intersection Improvements (SMCTA – Awarded) FY 2027/28
$2,875,000 – El Camino Real/Selby Intersection and Drainage Improvements (SMCTA – Awarded)
$750,000 – Middlefield Road Pedestrian Improvements (SMCTA, C/CAG, or other - Potential) Without these funds, the General Fund would be required to make up the funding difference or the projects would not move forward. The Town continually reviews the 5-year Outlook that includes the above recommended updates and changes based on the Council's feedback on projects and priorities for General Fund allocation at tonight’s study session.

INTERNAL SERVICE FUND/SPECIAL REVENUE FUND
The Town maintains a variety of Special Revenue and Internal Service Funds that are “restricted funds” designated for a specific purpose. Revenue to Internal Service Funds comes from the various departmental operational budgets based on allocated charges to those departments. Special Revenue and Internal Service Funds include the Library Fund, Tennis Fund, COPS Grant fund, Equipment Replacement Fund, Workers’ Compensation Fund, General Liability Fund, and Employee Benefit Fund.

LIBRARY FUND

REVENUES
The Town is a member of the San Mateo County Library JPA system. The Library is funded through property taxes that are collected and allocated to library services. Under the JPA, jurisdictions are permitted to retain excess funds generated from the local property taxes as long as the basic library services are met. With the completion of the new Atherton Library and repayment of the construction advance, annual Library tax funds, minus amounts needed for yearly operation of the Library are retained by the Library JPA on a 50/50 basis. The County holds all excess funds.

The FY 2025/26 beginning fund balance for the Library Fund is $2,907,292. This includes the SMCL funds in the amount of $2,280,905 held in trust retained by the Library JPA. This balance is net of the repayment of the advancement of the SMCL JPA funds of $1,157,910.

Page 9 of 98 ends

FY 2026/27 Special Revenue, Internal Service Funds & CIP June 3, 2026

Page 7 of 13 ends

The estimated FY 2026/27 revenue for the Atherton Library JPA is $5.561 million and the SMCL operations is estimated at $4.06 million. The Town estimate for FY2026/27 is $1,160,550. After deducting the Library related activities, the remaining excess Library funds is $340,376. This amount will be evenly split between the JPA and the Town at approximately $170,188 each. These funds will be held in the San Mateo County Library Trust for the Town. The estimated fund balance for FY 2026/27 Library Trust funds is $2,610,293.

EXPENDITURES
The FY 2026/27 projected expenditures for the Library are $1,160,550 for operations, utilities, maintenance costs, use of town facilities, development of spaces and remaining expenditures for the Children’s Garden. There is an increase in utilities costs of $5,000 for electricity and $8,000 for water as rates and usage have increased. There is an increase in Contract Maintenance Services of $3,000 due to contractual adjustment increase. Facility repair and contract custodial services costs increased an additional $5,500. Maintenance costs for facility contracts for Library increased an additional $35,000 for systems maintenance on the facilities. These amounts are based on the building needs and operations largely related to challenges with the HVAC system. There is Building Maintenance manager allocation of $20,000 of Town personnel to oversee management of Library facility and systems. There is an allocation for Other Supplies and Materials of $210,000 for the use of Town facilities for Library programming, various Town programming, additional storage, and aesthetics needs around the Library outdoor spaces. These include the use of Town facilities at the Park for various Library programs, purchases of various items for the development of spaces such as refresh of tables, canopies, umbrellas, café benches and community room furniture for an estimate of $200,000. Building & Campus improvements also includes an allocation of $200,000 for the remaining construction expenses of the Children’s Garden. There is an allocation of $300,000 for the Library portion of the pedestrian improvements to Station Lane.

OTHER RESTRICTED FUNDS
The Town maintains a variety of Special Revenue and Internal Service funds that are “restricted funds” for specific purposes beyond basic capital improvement. Revenue to internal service funds are in the form of General Fund department charges based on allocations by department and uses.

EQUIPMENT REPLACEMENT FUND
The Equipment Replacement Fund is an internal depreciation fund for the replacement of large assets. The Fund is the Town’s set aside accumulation account to replace large equipment assets over time – such as computer equipment, software assets, vehicles, trailers, emergency equipment, etc. Annual depreciation-style departmental allocations to this Fund reduces the impact to the Town’s Operational year funding to replace the equipment. There continues to remain sufficient funds in the fund to accommodate emergency replacement needs as well as planned needs.

The FY 2027/26, departmental allocations (revenues) total $355,500 and the expenditures total $120,000. The largest allocation charge is $255,000 in the Police Department for FY 2026/27.

This allocaton reflects the purchase of two (2) vehicles each year as part of the department’s regular maintenance and replacement schedule ($210k) and for replacement of new equipment, including Automated External Defribillators (AED) and a new radar trailer. This year, the Department does not anticipate the purchase of patrol vehicles as part of its regular equipment replacement schedule.

The Town uses the State and Federal Multiple-Award Schedule pricing to purchase vehicles from the Equipment Replacement Fund.

In FY 2026/27 the Police Department will also purchase replacement Automated External Defribillators (AED) $35,000. There is an additional purchase of a new radar trailer $10,000. These supplemental items include the necessary replacement of equipent for safety operatons. There is a $45,000 allocation expense to the replacement fund in Police Department operations budget for the purchase of this new equipment. The Finance Department anticipates an upgrade to its financial software cloud based system. The upgrade and migration is $75,000. There is sufficient allocation build to this fund for upgrade of the software.

WORKERS’ COMPENSATION FUND
The Workers’ Compensation Fund accounts for the cost and expense of managing the Workers’ Compensation Program through the Town’s self-insurance risk pool. As the Council is aware, the Cities Group JPA entered a dissolution plan under which the Cities Group would cease providing claims administration and all other benefit services on behalf of the Member Agencies on or before December 31, 2025. The Town joined the PLAN JPA Workers Compensation program beginning January 1, 2026. We currently are with PLAN JPA for general liability and property insurance programs. The consolidation of these programs with the workers’ compensation program creates a more coordinated risk management program. This Fund includes costs related to risk management and prevention – safety training, educational materials, and accident prevention programs. As a member of a JPA, the Town contributes an annual assessment to the JPA based on all recognized and potential liabilities. These assessments or contribution rates are calculated annually based on claims history and any increases in loss recovery due to excessive claims losses.

As part of the workers’ compensation program, the Town maintains a Self-Insured Retention (SIR) amount of $10,000 per claim. Since joining on January 1, 2026, there was also a half year assessment cost of $208,294. PLAN JPA offers reliable premium with a low SIR range, and an 85% confidence level on costs. A higher confidence level provides a greater likelihood that actual costs will fall within the projected estimate. The confidence level can be reduced over time by the JPA Board and is evaluated regularly. Estimated costs for a full fiscal year in PLAN JPA are $416,588. The current year’s assessment is 1% of salary for all departments and the total amount is $74,053. For FY 2026/27 staff is increasing the assessment for the Police Department from 1% to 4%. This will increase the allocation from $113,482 to $187,460 for FY2026/27. There are adequate reserves in the Workers Compensation Fund to absorb the difference for the year. Staff will ramp up allocation charges in future years as we build history with our new JPA. The Town's exposure risk in the pool is significant due to liability related to having a Police Department.

The Town maintains an active Workers’ Compensation Risk Management Program. Due to the Town’s diligence in building up its Workers’ Compensation Fund over the years, there has been a

healthy fund balance for transition from the Cities Group to the new PLAN JPA as the Town transitions its current (11) open clams to the JPA and for maintaining claims.

The current year assessment is $208,294 for half a year and is projected to increase $417,000 in FY 2026/27.

GENERAL LIABILITY FUND
The General Liability Fund accounts for the insurance cost of general liability claims and property losses. The Town is part of an insurance pool administered by PLAN JPA. The activities within this Fund provide for expenses related to general liability insurance, employment practice insurance and self-insured retention claims. Total internal service charges from the General Fund for FY 2026/27 are estimated at $672,391. This is an increase of 6%. The total FY 2026/27 projected expenditures for this fund are $772,391. This includes the self-insurance retention expense of $100,000 that allows the payout of four (4) claims at $25,000 per claim. The Town does not anticipate expending retention expenses of four (4) claims in the fiscal year; however, the amount is a requirement established by PLAN JPA. Average retention claims are about two (2) per year.

EMPLOYEE BENEFITS FUND
The Employee Benefits Fund tracks expenditures across various departments for employment, unemployment, retirement, and healthcare benefits. The Fund also represents an audit compliant set aside for compensated absences (time earned) – vacation, sick leave, holiday, compensatory time, etc.). Revenue to the fund comes through charges allocated back to each departmental budget based on number and type of personnel within each department. Revenue to the Fund for FY 2026/27 is $552,396. Expenditures for FY 2026/27 are $441,512. The expenditure includes $81,512 for the Town contribution of the minimum retiree health PEMHCA amount to CalPERS.

These costs are included and charged to the respective departments based on retiree health and allocated to the Employee Benefits Fund. The PEHMCA costs are paid directly to CalPERS and are reimbursable from the Town’s OPEB Trust. The Town is no longer budgeting the “pay as you go” retiree health benefit contribution as an operation expense as the retiree benefits are now funded through the OPEB Trust. During the FY 2025/26 budget (June 2025) the Town elected to make an additional $3m ADP to CalPERS towards paying down the pension UAL for Town’s Public Safety plan. There was an allocation of $800K from the Employee Benefit Fund.

Within this fund is also the employee benefits charge of $282,987. This is a charge of 3% to 4% of the General Fund Operational Departments salary expense that is allocated for personal leave contributions of sick, vacation, and holiday pay. The Police Department allocation is 4% and all other departments 3%. The Town has a total compensated absences balance of $1,229,506.

Compensated absences represent accrued time-off, vacation, and holiday pay for all employees and are required to be recorded as a liability. These are amounts that would be liquidated or mature due to the termination of Town staff.

Included within this fund are also unemployment insurance charges if there are any future claims charged to the Town. This is a charge of 1% of Operational Departments salary expense Any claims would be paid out of this fund. The total budgeted charge is $77,386.

TENNIS FUND
The Tennis Fund projected revenues are $79,000. The majority of this revenue comes through the facility management servies contract with Player Capital. The contract provides yearly revenue of $50,000 to the Park. Keys are sold on an annual basis to any person (resident or non-resident) that wishes to use the Tennis courts. The standard key for residents is $110 and includes clay court key, and the non-resident key increased is $290.

Every year the Town resurfaces and maintains courts as needed. The tennis court resurfacing treatment includes crack filling and taping, followed by a new surface coating and striping. This is done on approximately every 3-5 years on a cyclical basis on each of the five (5) non-clay tennis courts. During the fiscal year the Town restriped the pickleball court to four courts on one tennis court, allowing for multiple games. We continue to monitor reservations and use of this court for pickleball.

The FY 2026/27 budget includes the purchase of tennis keys by residents and non-residents providing annual revenue of approximately $25,000. Each January, new tennis keys go on sale for the new court locks that get installed in February.

For FY 2026/27, the Town anticipates expenditures of $51,000. This includes $13,000 for contract maintenance services for MCE, general court maintenance and facility repairs needs of $35,000 and $3,000 for building security court gates upkeep.

COPS - CITIZEN’S OPTION FOR PUBLIC SAFETY
The COPS Office was created as a result of the Violent Crime Control and Law Enforcement Act of 1994. As a component of the Department of Justice, the mission of the COPS Office is to advance community policing in jurisdictions of all sizes across the nation. Community policing focuses on crime and social disorder through the delivery of police services that includes aspects of traditional law enforcement, as well as prevention, problem-solving, community engagement, and partnerships. In FY 1996/97, the California State Legislature created the Citizen’s Option for Public Safety (COPS) Program. Funds have been available through the State of California to local entities in the form of Citizen’s Option for Public Safety (COPS) Grant. The Town in recent years has seen an increase in funding and recently received approximately $194,000 from the grant. We project to receive $200,000 in grant funds for FY 2026/27. These funds must be used for front-line law enforcement only. The Town anticipates receipt of this funding on an annual basis and funds are used for sworn personnel salary related expenditures.

Capital Improvement Program
Fiscal Years 2026/27 through 2030/31
3 I. INTRODUCTION
About the Capital Improvement Program
The Town of Atherton’s Five-Year Capital Improvement Program (CIP) summarizes anticipated resources and their estimated uses for major infrastructure and other capital construction, improvement, and maintenance projects.

The CIP is a five-year planning tool that identifies anticipated capital improvements and their funding sources from fiscal years 2026/27 through 2030/31. The CIP does not appropriate funds, but rather, it functions as a budgeting and planning tool which supports appropriationsthat are made through adoption of the annual budget. The CIP is updated annually to reflect the latest community priorities, infrastructure master plans, completed projects, updated project cost estimates and available revenue sources.

Master Plans
The City Council commissioned several Master Plans and studies, starting in FY 2012-13, to become well informed on the status of the Town’s infrastructure needs. These master plans, evaluations and studies are for the following Town-owned infrastructure:
• Bicycle and Pedestrian Master Plan
• Holbrook-Palmer Park Master Plan
• Civic Center Master Plan
• Storm Drainage Master Plan
• Pavement Management Program Update
• Neighborhood Traffic Management Action Plan
• Local Roadway Safety Plan
• Street Light Inventory
Several oftheseMaster Planswill be updated overthe nextfew years. The CIP incorporates the recommendations from these Plans, and associated updates, along with other input including resident requests, and Council prioritiesto identify and describe capital projects that will be of long-term benefit to the residents. As such, the programs and projects enclosed in this CIP are dedicated to enhancing accessibility, safety, and the built environment throughout the Town by targeting various transportation, drainage, park, and facilities improvements.

Attachment 4

Page 59 of 98 ends

Capital Improvement Program
Fiscal Years 2026/27 through 2030/31
4 The CIP projects were selected based on the following factors:
• Implementation of the Town’s General Plan Guidelines
• Council and Community direction
• Implementation of accepted and approved Master Plan recommendations • Implementation of Facilities’ planning and priorities • Maintenance needs of roadways and safety of roadway users • Ability to improve transportation deficiencies
• Drainage facilities improvement needs
The five-year CIP identifies the highest priority capital needsthat can be addressed within the available and forecasted revenue. These capital needs are matched to their eligible funding consisting of the previous year’s fund balances and five-year revenue projections identified by the Finance department.

CIP Document Organization
The CIP is organized to serve two primary purposes. First, it describesfunding sources and discusses their sources and uses. Next, it provides a description of the planned transportation, drainage, park, and facility capital improvements developed through an examination of the Town’s capital needs.

As such this CIP is organized into three parts.

I. Introduction: This provides an overview of the purposes of the Capital Improvement Program.

II. Detail of Funding Sources and Revenues: This section describes the anticipated funding and revenue sources supporting the projects and programs contained in this CIP.

III. CIP Project List and Budgeting Schedule: Thissection provides a detailed overview of the projects and budgeting of project expenditures in relation to available forecasted funding over the next five years.

6 II. FUNDING DESCRIPTIONS
The Town ’s Capital Projects contained in this CIP are financed through a variety of funding and revenue sources. These funding sources may include:
 General Fund
 Gas Tax
 Atherton Channel Fund
 Atherton Library Fund
 Atherton Library Fund
 Measure A
 Measure M
 Measure W
General Fund (Capital Improvement)
The General Fund provides funding for the Town’s general programs and day-today operations. This includes Town management, administration, parks and recreation operations, public works operations, law enforcement, trash hauling, special operational programs, planning, and general Town services.

When accounting for General Fund use, the fund description on the individual project pages are listed as Capital Improvement. Each year, the Budget allocates funds from the General Fund to the Capital Improvement Fund. The intent is to budget annually a certain amount from the General Fund to address Town priorities. The Capital Improvement Fund also recognizes current and anticipated grant allocations and expenditures.

Measure A
Measure A is a voter approved half-cent sales tax for countywide transportation projects and programs. In 2009, county voters overwhelmingly approved a reauthorization of Measure A through 2033.

The purpose of these funds are to maintain localstreets and roads, repair potholes and sidewalks, develop alternative transportation options such as bicycling and pedestrian programs, and to develop and implement traffic operations and safety projects.

Measure A dollars are distributed on a formula allocation based on population and the number of road-miles. The Town receives approximately $370,000 annually through Measure A.

7 Measure M
Approved by voters in November 2010, the Congestion Management Agency for San Mateo County levies a $10 registration fee on vehiclesregistered in San Mateo County. This Measure is set to expire in 2035.

These funds help to maintain neighborhood streets, fix potholes, provide transportation options, improve traffic circulation, reduce congestion, reduce water pollution from oil and gas runoff, and provide safe routes to schools.

Approximately 50% of Measure M revenues fund Countywide Transportation Programs, and the other 50% is formula-allocated to local agencies. The Town receives approximately $75,000 per year from Measure M.

Measure W
Approved by voters in November 2018, Measure W is a half-cent sales tax on qualified retail transactions for use on transportation improvements and maintain affordable transit. This Measure is set to expire in 30 years (2048).

The distribution of funds are shaped by the San Mateo County Congestion Relief Plan. The Plan includes the five (5) following investment categories:
• Countywide Highway Congestion Improvements
• Local safety, pothole and congestion relief improvements • Bicycle and pedestrian improvements
• Regional Transit Connections
• County public transportation improvements.

Ten percent (10%) of the annual revenue is allocated to the County of San Mateo and the cites of the County for transportation investments using a distribution formula that is based 50% on population and 50% on road miles (adjusted annually). The Town’s allocation of the Measure W funds is approximately 1.74% of the City/County distribution, which is projected to be approximately $145,000.

The Town may use Measure W funds for street paving and pothole repair, bicycle/pedestrian safety projects, promoting alternative modes of transportation, planning and implementing traffic and safety projects including Attachment 4

8 signal coordination, and implementing advanced technologies and communications of the roadway system.

Gas Tax
The Town receives a formula allocation of funds based upon population and lane miles. In FY 2026-27 the Town will receive approximately $216,000 in regular Gas Tax revenues. This amount is augmented with additional revenues from the Road Repair and Accountability Act of 2017 (SB 1). Effective November 1, 2017, the gasoline excise tax was increased to 12 cents per gallon and the excise tax on diesel was increased 20 cents per gallon. SB 1 also increased the vehicle registration tax effective January 1, 2018, and an additional vehicle registration tax will be applied to zero emission vehicles effective July 1, 2020. As a result, the total Gas Tax allocations to the Town is expected to be approximately $190,000 in FY 2026/27.

With the proposed funding through the Capital Improvements Program, the Town will be able to achieve the Maintenance of Effort requirements to continue to receive SB1 funds. A portion of these funds are used to cover overhead and management of maintenance activities.

Atherton Channel Fund
Fees collected by the Town to finance drainage and related improvements/repairs and environmental monitoring for those portions of the Channel for which the Town is responsible.

Atherton Library Fund
In 1999 the San Mateo County Library Joint Powers Authority (JPA) wasformed to assist in governing library funds accumulated through Proposition 13 in 1978, which sets aside a proportion of assessed property values to fund California libraries. Under the JPA, jurisdictions retain a portion of the excess funds generated from the jurisdiction’s property taxes once basic library services are met. The Atherton Library Fund is an accumulation of revenue in excess of annual operating costs.

Project Name: Road Maintenance Program - #56003
Project Description: This is an annual program
combining patching, sealing and overlays to maintain
roads in a cost-effective manner. Every two
years, an engineering survey of pavement condition is
performed by independent assessors, who determine
a pavement condition index (PCI) and recommend
specific maintenance strategies for each road. Staff
analyzes the data, conducts physical inspections, and
recommends an annual program to cost-effectively maintain roads. The funds proposed for this program include the allocation of SB-1, Gas Tax, Measures A, M and W, and Capital Improvement Funds in the amount of $1,455,000 for FY 2026/27.

Funds associated with the Roadway Maintenance and Rehabilitation Account (RMRA) approved through SB-1 in 2017 are subject to maintenance of effort requirements which is supported by the proposed Capital Improvement funds in the current and future years.

In November, streets are identified based on their PCI index. Staff also conducts visual assessments and identifies other street rehabilitation priorities. Special attention is paid to roadside drainage systems to ensure that the edges of the pavement do not create situations that could be hazardous to pedestrians or impede drainage. • Two-inch grind and overlay (on various streets throughout Town) • Maintenance Dig-outs (on various streets throughout Town) • Cape Seal/Slurry Seal (on various streets throughout Town) Attachment 4

CITY COUNCIL STAFF REPORT – STUDY SESSION
TO: HONORABLE MAYOR AND CITY COUNCIL
FROM: FRED LUSTENBERGER, BUILDING OFFICIAL

LISA-MARIE DALEY, CERTIFIED CODE ENFORCEMENT

OFFICER
DATE: JUNE 3, 2026
SUBJECT: DISCUSSION AND DIRECTION REGARDING WAYS TO BETTER

MANAGE THE CUMULATIVE IMPACT OF MULTIPLE

SIMULTANEOUS CONSTRUCTION PROJECTS OCCURRING

WITHIN THE TOWN

RECOMMENDATION
Staff recommend that the City Counsel discuss and provide feedback and direction on ways to better manage and mitigate the various negative impacts resultant from ongoing and projected major construction projects within the town.

BACKGROUND
Historically, the Town has taken a limited approach in the way it regulates and manages full-site development and similarly sized construction projects compared to many neighboring jurisdictions. It has few, if any, amendments to its adopted state building codes, does not have a formalized design review process for new or large-scope renovation projects and, aside from its code enforcement operations and after-hours construction regulation, generally adopts a reactive, rather than proactive, approach to the enforcement of its regulations. The intent is to balance the interests of property owners wanting to develop or renovate their properties in the manner of their choosing with those who are most likely to be impacted by such projects.

The Town, however, does have Chapter 15.40 of the Atherton Municipal Code, which applies to all building construction (including, but not limited to, all additions, alterations, modifications, repairs and improvements) that requires a building permit, and landscaping related to such building construction. It addresses several diverse construction related concerns such as parking and traffic control, operational and delivery hours, project time limits, noise, screening, and dirt, debris, and litter control. Per Section 15.40.100 Site Regulations-Impacts-Purpose, The purpose of this chapter is to protect the peace, health and safety of the citizens of the town and to secure those persons on a regular basis, including weekends and holidays, a reasonable degree of relief from traffic congestion, dirt, litter and air pollution resulting from construction activities and the delivery of construction supplies and materials as defined below. (Ord. 514 § 1, 2000)

In recent years, staff experience in fielding complaints covered by the regulations contained in Chapter 15.40 strongly indicates that construction vehicle parking and traffic congestion, noise and dust generated by construction activities, and communication failures are the most problematic areas of concern for both residents living near large scale construction sites as well as for motorists and cyclists within the Town.

ANALYSIS
As is the case with all the other communities on the peninsula, Atherton is almost fully developed, leaving in-fill development projects as the predominant type of new or full-renovation construction activity, which, unlike development in major subdivisions in other areas, can, and most likely will, severely impact nearby existing residences and community infrastructure. Because, as mentioned above, the primary construction related impacts and concerns facing the Town and its residents are parking and traffic congestion, noise and dust generation, and often communication failures between contractors and neighbors, these areas will be the primary focus of this report.

Parking and traffic congestion are the dominant complaints. At most of the larger scale construction sites, parking for service trucks and worker vehicles is at a premium, leaving parking on the side of adjacent streets the primary option for construction workers, which can present several problems, including parked vehicles encroaching on private properties or in the vehicular way, blocking access to fire hydrants, reducing minimum street and cul-de-sac turnaround widths, affecting visibility at blind intersections, etc. And many of these parked vehicles do trigger the need for Code Enforcement actions, where staff have described situations where they must spend hours identifying which vehicles belong to which of several concurrent construction sites, writing citations at $500 per vehicle but with little deterrent effect. Contractors frequently rotate subcontractors who themselves bring additional subcontractors or vendors, making vehicle identification and accountability extremely challenging.

Typical full-site development projects in the Town often involve new homes sized between 10,000 and 25,000 square feet and with most having one or more accessory structures and associated landscape improvements. Within a typical three-year period, there may be 50 to 100 of these projects ongoing along with many smaller alteration and repair projects such as reroofing, remodeling, electrical and HVAC upgrades, solar PV installations, etc. Combined, the total estimated number of workers needed to provide these services easily exceeds the Town’s total resident population, which can and often does result in significant traffic congestion, particularly at rush hours, and heavy wear and tear of the Town’s roadways.

Noise is a significant and recurring complaint, particularly from projects running near or beyond permitted hours. The Atherton Municipal Code, Section 8.16.050, specifically exempts construction activities from the noise regulations contained in Section 8.16.030 provided they are performed pursuant to the terms and provisions of Chapter 15.40, or between 8AM and 5PM, Monday through Friday, excluding most Town observed holidays. However, many residents understandably report that the loud and near constant noise generated from nearby construction sites year-after-year significantly degrades their quality of life. Dust generated from certain construction activities such as grading, landscaping or other earthwork, demolition, and reroofing is also reported by residents but is difficult to verify at the time of the inspection, making

enforcement challenging. Further, neither Chapter 15 of the AMC nor the state building codes specifically address dust generation from construction sites, which limits staff’s ability to regulate and control.

Communication failures between contractors and neighbors are a root cause of many complaints.

Residents often endure conditions for six to eight months before calling to complain, by which point problems are at their worst and early intervention opportunities are lost. Over time, Building and Code Enforcement staff have observed that certain contractors who have much experience working within the Town appear to generate far fewer neighbor complaints than others regardless of where their projects are located, suggesting they may be conducting outreach efforts with their neighbors or taking other proactive steps.

Staff tools currently in place:

Construction Operations Parking Plan (COP): Every project technically requires a COP under the Atherton Municipal Code (AMC). They are cumbersome to complete. Therefore, staff applies an internal threshold to determine which projects require one. Reroofing permits, for example, are over the counter and do not trigger a COP. When COP enforcement was strengthened in 2022, code enforcement complaints dropped by 67%. The COP is currently being revised.

Alternate Parking Plans: Contractors frequently submit these, sometimes required by staff prior to COP approval, particularly for cul-de-sac projects. Neighbor sign-off is required when alternate parking would affect their frontage. The alternate parking agreement includes a condition that the easement be restored to at least its prior condition before final sign-off.

Administrative Citations: Available under the Administrative Citation ordinance for violations capable of repetition. However, their deterrent value in Atherton is limited because project costs are so high that fines are treated as a minor cost of doing business.

Stop Work Orders: Available under AMC 15.40.230(D) and the state’s building codes, which authorize the Building Official to stop work whenever work is being done contrary to the provisions of that chapter or the Building Code. However, the codes require specific criteria to be met, and parking violations alone may not clearly meet that threshold under current code language. Under the current AMC administrative citation policy, stop work orders have proven to be a more effective lever because it directly impacts project timelines and profitability.

Required Signage: Per the AMC, each site must post a yellow town-issued sign with dispatch number and construction hours, as well as a contractor sign with business name, project address, and contact number. A field review found that many sites are not in compliance with this requirement.

Page 4 of 9 ends

Construction (completion) Time Limits: Although these regulations do not directly address the concerns identified in this report, they do augment the Town’s existing compliance tools and could also strengthen the effects of any proposed compliance approaches by providing a heightened sense of urgency to contractors to comply promptly with any corrective orders to avoid any unnecessary project delays, which could result in substantial fines per the AMC.

Discussion points and proposed options:

Designated On-site Point of Contact: The recently adopted 2025 California Building Code has new provisions for the owner’s responsibility for fire protection, which, among other requirements, requires projects to name and identify a site safety director who becomes the primary point-of - contact for that site. The site safety director is responsible and accountable for ensuring that the site complies with all safety measure components specified in the Building Code. Although new to Atherton, this requirement could be integrated into the COP requirement whereas a condition of permit issuance, the contractor must identify the named point of contact with a direct cell phone number, not a business main line. If the contact changes, an updated name and number must be provided promptly. The point of contact’s name and number would be prominently posted on-site in a format visible to neighbors. If that number goes unanswered when called by staff, a stop-work order could be issued for the remainder of the day. This would serve as a foundational, low-cost improvement that would bridge the communication gap between the site and the Town and give neighbors a usable resource.

Enhanced Fine Schedule: The California construction-specific fine schedule starts at $130 per diem and escalates steeply for continued non-compliance to $700, $1,300, and $2,500 per infraction, which is more robust than the AMC fine schedule of $100/$200/$500 currently in place.

Adopting this would require a code change and, although staff believe that stop-work orders would still be a stronger deterrent for larger contractors, an enhanced fine schedule could have more bite for smaller operators.

Stop Work as a Cumulative Enforcement Tool: This would require amending the AMC to allow a stop-work order to be triggered by cumulative citation issuance, such as three consecutive violations, rather than requiring a single discrete safety event. Under a proposed model, the stopwork order would remain in place until the contractor comes to City Hall, meets with Code Enforcement and the Building Department, and demonstrates a corrective plan. A potential escalation would require appearance before a Council Subcommittee or individual member and staff subcommittee for repeat or serious violators. The Council Subcommittee level meeting could be open and noticed to neighbors and could be a significant deterrent and opportunity for neighbors to air concerns.

Neighbor Notification: This proposal would require contractors to provide pre-construction notice to adjacent neighbors and all properties on the same cul-de-sac, introducing the project, the anticipated timeline, and the point of contact. Periodic updates by the contractor, either quarterly or tied to construction milestones, could also be required as part of this process and, potentially, coordinated with the arborist report mailing schedule. However, as noted by staff, language and cultural barriers with some contractor groups could present some practical challenges.

As mentioned earlier, a few large, well-regarded contractors proactively conduct neighbor outreach, offer services such as power washing to address dust concerns, and as a result generate far fewer complaints
Conflict Between Parking Codes: It should be noted that there is conflict between the AMC (which allows parking in front of a property), the California Vehicle Code (which allows parking within 18 inches of the edge of the pavement), and fire code requirements (which require a minimum 20-foot clear width for apparatus access). And that, from a practical perspective, in Atherton’s street environment, full legal compliance with all three simultaneously is effectively impossible; however, staff agree that the most defensible approach is to prioritize fire code compliance and suggested that if on-street parking reduces the clear width below 20 feet, contractors should be required to arrange off-site parking with shuttle access to the site. This approach has historical precedent: prior to City Hall construction, workers were shuttled from the City Hall parking lot. A similar requirement could be incorporated into the COP conditions.

However, it should be noted that the Town cannot formally approve off-site parking in neighboring jurisdictions, though staff sometimes informally accommodate it.

Conditional Use/Design Review as a Slowdown Tool: Another potential approach would be to reclassify large single-family residential projects from permitted use to conditional use, which would trigger CEQA review (a costly expense); but it would allow additional conditions to be imposed. This would be a significant policy shift from Atherton’s traditional permissive development environment and one that carries political and legal complexity. Staff considers this to be a “nuclear option” and not a practical solution at this time for the Town.

Safety Zone Concept: Following a study of the Town, this approach would identify areas particularly those with narrow streets, poor intersection geometry, or limited pedestrian infrastructure, where cumulative impact of multiple concurrent construction projects creates disproportionate safety impacts. Projects in designated zones would be subject to escalating requirements depending on how many concurrent projects are underway (e.g., one project triggers requirements A; two projects trigger A and B; three projects trigger A, B, C, and D). This concept is acknowledged by staff to be legally and logistically complex, requiring substantial study and raise concerns about property value disparities between zones, with hillside areas being the most defensible locations due to wildfire egress concerns.

CONCLUSION
This report provides an overview of the Town’s approach to how it regulates larger-scale construction projects and addresses the three most common code enforcement complaints related to these activities. It identifies current enforcement tools available to Town staff and presents some proposed alternatives for further discussion and consideration.

Guidelines for Construction, Operations and Parking Plans (C.O.P.) The following guidelines have been adopted by City Council Resolution incompliance with Chapter 15.40 of the Atherton Municipal Code requiring the submittal of a Construction Operation and Parking Plan.

Prior to acceptance of plans for building plan check, the applicant for a building permit shall submit a Construction Operation and Parking Plan (COP Plan) for review and approval by the Building Official. The Plan shall be made a part of the public file. At a minimum, the Construction Operation and Parking Plan shall contain the elements listed below:

Parking Area for Construction Personnel. All construction parking shall be located on-site or within the public right-of-way, only in front of the construction site and on the same side of the street as the construction site. The COP Plan shall provide a sufficient area to accommodate the number of construction personnel anticipated to be working on the project. The construction parking area shall be located outside of any tree protection fencing area. The construction parking area shall be rocked, with a rocked access drive. All construction personnel shall park in the construction parking area when at the jobsite. The City Manager or City Manager‘s designee may provide written permission for construction personnel parking in the public right-of-way only during such times as finish landscaping or other similar circumstance prevent use of the on-site construction parking area and further provided that the parking is located and conducted in a safe manner and affords a minimum disruption to the neighbors and neighborhood.

2. No Parking Signs. At the discretion of the Police Chief or Police Chiefs designee, to protect health and safety, or in the event the contractor fails to properly implement the COP plan, the City Manager or City Manager's designee may require the contractor to post signs on and along streets at 100 foot intervals for a distance of 500 feet on both sides of the street from the construction project notifying that parking is prohibited except for residents and their guests as authorized by the California Vehicle Code Section 22507. The contractor shall pay for the cost of the signs.

3. Construction Trailer. If a construction trailer is proposed, it shall be located completely on the private property at least 10 feet from any side or rear property line, at least 20 feet from the front property line for properties located in the RI-B zone and at least 40 feet from the front property line for properties located in the RI-A zone.

4. Debris Box is required. Any debris box used in conjunction with the construction shall be placed completely on private property (not in the right-of-way). The debris box shall be accessible from a paved or rocked access road.

5. Deliveries and Truck Traffic. A temporary construction driveway shall be installed

consisting of base rock or alternate material approved by the Building Official, beginning at the edge of pavement and extending a minimum of 100 feet into the property in order to reduce dust and mud tracking. Signs, delineators and flag personnel shall be available on-site, if necessary. If an existing paved driveway is maintained during construction, temporary access will not be required. The applicant may propose, or the Building Official may require temporary construction fencing to restrict additional access points.

6. Sanitary Facilities. The temporary sanitary facilities shall be placed out of the views of neighboring properties as much as possible. The facilities shall be accessed from a paved or rocked road or driveway. The sanitary facilities shall not be located in the public right-of-way and shall be located at least 10 feet from any side or rear property line, at least 20 feet from the front property line for properties located in the RI-B zone and at least 40 feet from the front property line for properties located in the RI-A zone.

7. Clean-up Area. When on-site cleaning of equipment is required for concrete forms and trucks, paint brushes, plastering tools and other similar equipment, a cleanup area shall be specified on the COP plan and posted with a sign. This area shall trot be located beneath any tree canopy or in any proposed planting area. Runoff from the clean-up area shall be contained and the waste material disposed of using "Best Management Practices" acceptable to the Regional Water Quality Control Board.

8. Construction Materials Storage An area shall be designated on-site for the storage of construction materials. The storage area shall not be located within the drip lines of any trees.

9. Notes to be Included on Construction Operation and Parking Plans. The following notes shall be included on all Construction Operation and Parking Plans:
a. Construction, deliveries and servicing of any item (i.e., debris box, sanitary sewer facilities, etc.) on the site shall only be permitted Monday through Friday, 8:00 AM to 5:00 PM.
b. No work of-any nature, including but not limited to hauling or heavy equipment shall be permitted on Saturdays, Sundays or Holidays.
