Task I.12. Section 106 (Cultural Resources and Historical Architecture) Analysis Section 106 and CEQA Surveys, Reporting, and Agency Coordination A permit from the Corps would require compliance with Section 106 of the National Historic Preservation Act (NHPA), which requires the lead federal agency (e.g., the United States Coast Guard [USCG]) to assess and consider the effects of its undertakings on historic properties, including those listed on or eligible for the National Register of Historic Places (NRHP). The California Environmental Quality Act (CEQA; Section 21084.1) requires a lead agency to determine whether a project could have a substantial adverse change in the significance of a historical resource or Tribal cultural resources (Section 21084.2). In accordance with Section 106 of the NHPA and CEQA, Tetra Tech will conduct a Phase I archaeological investigation (field survey, reporting, and agency coordination) to assess whether the project would have the potential to affect historic properties or historical resources. The archaeological investigation will include incorporating the record search (already completed), California Native American Heritage Commission (NAHC) Sacred Lands File search (completed), lead agency coordination and consultation support as appropriate (e.g., Town of Atherton, US Army Corps of Engineers, State Historic Preservation Office (SHPO), archaeological survey, and technical reporting, as described below.

Archaeological cultural resource management services will be overseen by our Principal Archaeologist, Jenna Farrell, MA, RPA (Registered Professional Archaeologist). As an RPA with more than 20 years of experience in California, Ms. Farrell meets the Secretary of Interior’s Professional Qualifications for Archaeology and is a permitted Principal Archaeologist on our Cultural Use Permit for the U.S. Bureau of Land Management (BLM) and throughout several counties in California. Ms. Farrell has extensive experience with Section 106 and CEQA.

For the purposes of this scope of work and cost, the project area is defined as 1.5 miles by 100 feet width (18 acres).

Background Research
Tetra Tech conducted an archival, literature and records review of the project site. This action is not part of the scope.

Native American Heritage Commission (NAHC) and Tribal Coordination Tetra Tech staff conducted a Sacred Lands File search for the project through the NAHC to identify any documented Tribal cultural resources within the project or surrounding areas. The NAHC responded that the project is within sacred land and recommended reaching out to the list of Tribes. The NAHC provided a list of interested Tribal representatives. Tetra Tech will assist in preparing Tribal coordination or Assembly Bill 52 project letters and participate in up to two (2) one-hour conference meetings with Tribal representatives. Tetra Tech will also assist in maintaining a list of contacted Tribes and any responses.

A pedestrian survey involves walking transects at set intervals based on State Historic Preservation Officer (SHPO) and lead agency requirements, and professional judgment of ground surface visibility in the field.

Transects for the survey are anticipated to be no more than 15 meters apart, the maximum transect interval suggested by SHPO. Digital photographs will be taken of the survey area. The field crew will inspect exposed ground surface for cultural materials, changes in soil color and texture, or other evidence of previous human occupation. Newly identified cultural resources will be documented to state standards on the appropriate State of California Department of Parks and Recreation (DPR) 523 Form. The site(s) will be photographed using digital cameras. All locational data will be recorded using Tablets/GPS receivers in Universal Transverse Mercator coordinates referenced to the North American Datum of 1983. Previously recorded cultural resource sites or potential cultural resources identified through the desktop study will be monitored for locational accuracy and updated to reflect any new observations, as appropriate. Newly completed DPR 523 forms will be submitted to the NWIC to obtain state resource numbers. The results of the pedestrian survey will be presented in a Phase I Technical Report.

Architectural Survey and Atherton Channel CRHR/NRHP Evaluation 5 TETRA TECH
Tetra Tech will conduct an architectural resource survey of the Atherton Channel (c. 1950s, historic era channel with features). The survey will be conducted by an architectural historian who meets the Secretary of Interior’s Professional Qualification Standards (36 CFR Part 611). The resource will be documented to state standards on the appropriate State of California Department of Parks and Recreation (DPR) 523 Form. The site(s) will be photographed using digital cameras.
