AGENDA REPORT
MEETING
DATE:

TO: Mayor and City Council
FROM: Greg Thompson, Community Development Director
PREPARED
BY:
Christina Thurman, Executive Assistant
SUBJECT: Authorizing submittal of grant application submittal to the California Energy Commission for Automated Permit Processing; and approving Budget Amendment establishing revenue and expense account; and authorizes the City Manager or designee, to execute any and all agreements and accept funds awarded through the California Automated Permit Processing Program (Community Development Director Thompson)
RECOMMENDED COUNCIL ACTION
Adopts Resolution No. 3373-23 approving the submittal of a grant application to the California Energy Commission for Automated Permit Processing (CalAPP); and Adopts Resolution No. 3372-23 approving Budget Amendment No. 12 amending Fiscal Year 2022-23 Budget to establish a revenue and expense account for CalAPP; and Authorizes the City Manager or designee, to serve as the City's authorized representative to execute all documents and accept all funds on behalf of the City.
I. BACKGROUND/ANALYSIS:
Senate Bill 379, the Solar Access Act, became law on September 16, 2022. The SAA requires cities with more than 5,000 residents, counties with more than 150,000 residents, and all cities within those counties, to implement instant online permitting for solar and solar + storage systems. The requirement will go into effect starting September 30, 2024, for cities under 50,000 residents. The bill would require the city to report to the Energy Commission when it is in compliance with specified requirements and would require the city to self-certify their compliance with the bill’s provisions when applying for specified funds from the Energy Commission.
SB 129, the Budget Act of 2021 allocated $19,000,000 to support a grant program (CalAPP) for California cities, counties, or cities and counties to establish online solar permitting. Funding through CalAPP is available to all incorporated cities, counties, or cities and counties to implement an online, automated permitting platform that verifies

code compliance and issues permits in real time for a solar energy system. CalAPP funding is intended to encourage cities and counties to further enhance permitting processes and accelerate processing and turnaround time, particularly regarding plan review.
Funding levels vary based on population size of the applicant’s jurisdiction, from a minimum of $40,000 to a maximum of $100,000 per awarded applicant. The City of Atwater would be awarded $40,000 as jurisdiction with a population less 50,000.
The National Renewable Energy Laboratory (NREL), a project within the U.S.
Department of Energy, has created a free-to-use program, SolarAPP+, to support local governments with residential solar and solar + storage system permitting. SolarAPP+ provides a web-based portal that streamlines and automates project plan review and produces code-compliant approvals to support building departments in quickly issuing permits for residential solar energy system installations. National data shows that local governments with instant online permitting for rooftop solar process 5-14x more volume than jurisdictions with traditional permit processing. The SolarAPP+ portal uses standardized compliance checks to catch typos and errors; returning corrections to the applicant instantly. Eligible “cookie-cutter” rooftop solar applications get approved permits to build instantly, while ineligible projects flow through a typical permitting review. While SolarAPP+ is “free-to-use”, CalAPP funding will be used for staff training and to off-set subscription costs for and the platform's integration with CloudPermit, the City's existing permitting software.
II. FISCAL IMPACTS:
The total amount awarded by CalAPP for a city our size is $40,000. Adoption of Resolution No. 3372-23, Budget Amendment No. 12 will establish a grant revenue account and increase expense appropriation in Special Departmetnal expense.
This item was reviewed by the Finance Department.

This item has been reviewed by the City Attorney.
IV. EXISTING POLICY:
This item is consistent with goal number one (1) and four (4) of the City's Strategic Plan:

SUBJECT: Approving First Amendment to the Professional Service Agreement to Willdan Financial Services of Temecula, California for a Sanitation Service Rate Study (Public Works Director Vinson)
RECOMMENDED COUNCIL ACTION
Approves First Amendment to Professional Service Agreement, in a form approved by the City Attorney, to Willdan Financial Services of Temecula, California to extend the term for a Sanitation Service Rate Study; and authorizes the City Manager to execute the First Amendment on behalf of the City.
I. BACKGROUND/ANALYSIS:
On April 26, 2021, Willdan Financial Services of Temecula, California was awarded a Professional Service Agreement for a Sanitation Service Rate Study to include the following services:
• Review current sanitation and related service costs, policies and procedures and regulatory requirements as they affect operations, capital projects, revenue program requirements, and rate structures.
• Review future growth of the City and any potential expansion of collection programs.
• Determine solid waste service charges and estimate future increases or applicable COLA's.
• Prepare a cost of service analysis that fairly and equitably allocates costs to customer classes while adequately funding revenue requirements including operations and maintenance, capital improvements, and debt service for a period of five (5) years.
The results of this rate study will provide the council with an idea of what the sanitation rates should cost and include new recommended rates to comply with state regulations on recycling. After the City Council receives their recommendations, council will vote, by separate action, on whether or not to move forward with the process of raising the rates.

Now that the City has received the RFP responses from haulers related to the Highway 59 landfill, the City may resume completing the sanitation rate study and then return to City Council with the findings. Since the term of the agreement has passed, this first amendment to the PSA is merely to extend the term of the contract until December 2023 to let the consultant finish the study. No additional costs are being requested at this time.

Included in the scope of the RFP were key issues facing the City and how the hauler would assist the city in complying with the state mandates and CalRecycle regulations governing management of recyclable materials and organic waste. Senate Bill 1383 (SB1383) mandates that all customers must actively participate in an organic waste diversion program to substantially reduce organic waste being sent to landfills.
Assembly Bill 341 (AB341) mandates that all commercial customers participate in a recyclable diversion program. Non-participation in organic waste or recyclable materials diversion programs will result in fines for the city and/or residents and businesses. The

new organic recycling program, included in the new franchise agreement, is a key aspect of meeting state regulatory compliance mandate and is not negotiable.
The purpose of this agenda item is just to seek Council direction regarding Solid Waste Collection Services and authorization to proceed with contract negotiations with MIdValley Disposal.
The City released an RFP for Collection Services on September 7, 2022. The following four haulers submitted proposals:
1. Gilton Solid Waste Management, Inc
2. Mid-Valley Disposal
3. Republic Services
4. Waste Management
An evaluation team made up of City Staff and HF&H Consultants evaluated the four proposals. From November 3, 2022 to December 5, 2023 the evaluation committee reviewed proposals. The four haulers were invited to interview in person on December 6 and 8, 2022. Following the interviews, follow-up questions were given to each hauler and responses were received by Jan 6, 2023. The haulers were scored based off of their proposals, interviews, and follow-up responses. Based on the proposals, interviews, and follow-up responses, the evaluation committee ranked Mid-Valley as the top-ranked company.
Mid-Valley Disposal is a Central Valley based solid waste company with modern stateof-the art recyclables and organics processing facilities located in Fresno and Kerman, respectively. They provide franchise services to 32 communities and have done service for 11 communities in the Central Valley. Mid-Valley Disposal operates its collection services using on-board tablets and multiple cameras to track and record collection stops, on-route conditions, driver performance, or vehicle breakdowns/hydraulic spills.
Information generated from collection vehicles, in real time, is directly linked to dedicated to service representatives. Customer service representatives also have electronic access to the customer service information in the event service problems or discrepancies occur, and the customer needs to be notified. This modern, integrated, and data-driven approach is what Mid-Valley Disposal has proposed to provide to the City.
Mid-Valley Disposal is committed to having a fully staffed customer service department locally, vehicle parking, and maintenance facility within the City and will provide outreach staff to work with customers participating in the required recycling and organic waste diversion programs. If Mid-Valley is selected by the City, the RFP requires that the new hauler must offer employment to all displaced workers from the incumbent hauler.
With their detailed proposal and during their interview, Mid-Valley Disposal demonstrated that they will take full responsibility for meeting all performance

requirements in the franchise agreement and will move toward and keep the City in compliance with CalRecycle regulations. Mid-Valley Disposal demonstrated that they have the staffing, management tools, technology, financial ability, and local knowledge to provide a high level of customer service and good value to the City's residents and businesses.
Additionally, Mid-Valley has the capacity to process the city's organic waste and recyclable materials if the Merced County Regional Waste Authority (MCRWA) is unable to process organics or recyclables. Mid-Valley also has the ability to accept organic waste from the city, while the Highway 59 Landfill facility is being built.

SUBJECT: Approving Budget Amendment No. 13 regarding Sewer Enterprise Fund to purchase APN 0156-060-013 and 0156-060-014 from Global International Equities, Inc (Public Works Director Vinson)
RECOMMENDED COUNCIL ACTION
Motion to adopt Resolution No. 3375-23 authorizing the Sewer Enterprise Fund to purchase real property located at 255 E Bellevue Rd, Atwater, CA 95301, more particularly described as Assessor’s Parcel No’s. 156-060-013 and 156-060-014, from Global International Equities, Inc, Michael Tims, President, for the Lower Shaffer Storm Drain Project 22-07 in the amount of Six Hundred Thousand Dollars ($600,000), and approve the expenditure of any additional and related closing costs expenses; and authorize and direct the City Manager to execute a Purchase and Sale Agreement, in a form approved by the City Attorney, and all documents related to the purchase of the property on behalf of the City; or
Motion to approve staff's recommendation.
I. BACKGROUND/ANALYSIS:
On December 10, 2022, heavy rains flooded the area known as Lower Shaffer. Both stationary pumps and a portable pump located at the Centennial Storm Station were operating, but could not discharge water fast enough to prevent flooding in the area.
Following the flooding, City Council and staff were determined to find a solution to prevent the flooding of Lower Shaffer during heavy rains. After consulting with engineers, it was recommended that constructing a storm basin/pump station that could hold the water, as well as discharge the water into a canal, would be the most effective solution to prevent flooding.
City staff began looking at properties near the area of Lower Shaffer for the construction of the basin. It became clear there were two choices about where the basin could be built. The basin could be built inside of Osborn Park, but this would require the loss of baseball fields and recreational space, or the swim club property and the property adjacent to the north. Due to the need for recreational space in the city, staff is

recommending acquiring the former swim club property and adjacent parcel for the purpose of constructing a basin for stormwater runoff. The proposed acquisition consists of a full acquisition of the property for the City to construct a new storm basin for lower shaffer drainage area project 22-07. The property has good access with direct access to Bellevue Rd. The property is rectangular in shape.
The two parcels of land are approximately 2.7 acres. The property is zoned General Commercial District (C-G) and it is currently unimproved and vacant. There are no site improvements within the acquisitions area.
II. FISCAL IMPACTS:
Upon approval of Budget Amendment No. 13, there will be sufficient funds available in the Fiscal Year Budget 22/23 to cover the purchase and closing costs of the property.
This project account will also be used for the future storm drainage improvements.
This item has been reviewed by the Finance Department.
III. LEGAL REVIEW:
This item has been reviewed by the City Attorney's Office.
IV. EXISTING POLICY:
This item is consistent with goal numbers one (1) and two (2) of the City's Strategic Plan: to ensure the City's continued financial stability and to improve public safety, respectively.
V. ALTERNATIVES:
Not required for all staff reports but should be included in most reports where the Council should be considering options, or discussion of options already investigated.
If there are Policy options for consideration, the discussion should be specific and detailed.
VI. INTERDEPARTMENTAL COORDINATION:
N/A
VII. PUBLIC PARTICIPATION:
The public will have an opportunity to provide comments on this item prior to City Council action.
VIII. ENVIRONMENTAL REVIEW:
The City finds that the proposed action is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15004(b)(2)(a), as the City is proposing to enter into a land acquisition agreement which

would require CEQA review, prior to any future use of the land and, alternatively, is exempt from CEQA review pursuant to CEQA section 15061(b)(3), where it can be seen with certainty that there is no possibility that the purchase may have a significant effect on the environment.

SUBJECT: Approving Budget Amendment regarding Revenue and Expenditure Adjustments based on Mid-Year Analysis (City Manager Waterman and Finance Director Youmara)
RECOMMENDED COUNCIL ACTION
Motion to adopt Resolution No. 3376-23 approving Budget Amendment No. 14 amending the Fiscal Year 2022-2023 Budget regarding revenue and expenditure adjustments based upon mid-year analysis;or
Motion to approve staff's recommendation as presented.
I. BACKGROUND/ANALYSIS:
The City Council adopted the Fiscal Year 2022-2023 Budget on June 27, 2022. An analysis of revenues and expenditures through December 31, 2022 has been completed. Based upon that review, several budget adjustments are recommended.
Over the past several years, the City of Atwater has taken positive steps to address and correct the City's General Fund and two of the enterprise funds which had operated in a deficit position for many years. In Fiscal Year 2021-2022, all interfund loans have been paid off. The result of these efforts by the City Council has created a positive fund balance in the General Fund and the enterprise funds for the fourth consecutive fiscal year. This is a tremendous accomplishment made possible through their prudent fiscal decision-making.
The unaudited General Fund Balance at June 30, 2022 is projected to be $12.4 million.
Utilizing the Council's current reserve target goal of 25% of the approved General Fund appropriations to be placed in a General Fund Reserve, the Reserve would be $4.4 million, based upon the Fiscal Year 2022-2023 General Fund expenditure appropriations prior to the Mid-Year budget amendments. The remaining balance, after setting aside 25% target reserve, would be about $8.0 million of unallocated General Fund Balance.

Proposed Budget Amendments
Based upon additional financial information made available after the adoption of the budget this past June, adjustments to revenue and expenditure projections in the City's General Fund and several other funds are recommended at this time. A listing of the proposed budget adjustments for fiscal year 2022-2023 can be found in Exhibit "A".
General Fund - Revenue
Staff proposes adjustments to the following revenue accounts in the General Fund; • Increases to Sales & Use Tax, Business License Tax, Property Tax in Lieu Vehicle License Fee, and Property Tax Current Secured due to higher than anticipated revenue received through 12/31/22.
• Increase in Admin Fee revenue due to an increase in General Fund NonDepartmental expense that is allocated. • Net increase in CDD revenue accounts due to volume of activity through 12/31/22 and adjusting revenue to more accurately reflect what is expected to be received during FY 2022-2023.
• Increase in Cannabis related fees to recoup costs due to transitioning to the new Cannabis Regulatory Permit process.
• Decrease various recreation program revenues more accurately reflect what was received and adjusting programs to fit the need. Such as Coed Volleyball will take place instead of having a Men’s and Women’s Volleyball.
General Fund - Expense
Staff proposes adjustments to the following expense accounts in the General Fund; • Increase expense appropriation to all Worker’s Compensation and Risk Management Charges due to the 2022 Central San Joaquin Valley Risk Authority (CSJVRMA) Retrospective Adjustments. Overall, Workers Compensation increased by $130,014 and Risk Management Charges increased by $48,447. • Increase Professional Service Expense in City Administration due to the City of Atwater General Election invoice coming in higher than estimated. • Increase Non-Departmental Memberships & Subscription expense due to LAFCO membership invoice coming in larger than estimated. • Establish budget in Electronic Payment Processing Expense for the Police Department credit card terminal fees that was inadvertently omitted from the budget.
• Increase Community Services Department's Plan Check Fees expense account due to increase in activity and plan check contract service costs. • Increase in Cannabis Professional Service expense due to increase in monitoring and compliance contract service costs.
• Decrease various recreation program expense accounts as programs won't occur this fiscal year.
• Increase transfer out to Maintenance Districts to match the amount in the adopted Engineer's Report for fiscal year 2022-2023.
Agenda Report - Page 3

SUBJECT: Adopting Resolution No. 3377-23 opposing Initiative No. 21- 0042A1, the Taxpayer Protection and Government Accountability Act
RECOMMENDED COUNCIL ACTION
Motion to adopt Resolution No. 3377-22 opposing Initiative No. 21-0042A1, the Taxpayer Protection and Government Accountability Act.
I. BACKGROUND/ANALYSIS:
The Taxpayer Protection and Government Accountability Act would amend the California Constitution with provisions that limit voters’ authority and input, adopt new and stricter rules for raising taxes and fees, and may make it more difficult to impose fines and penalties for violation of state and local laws. The measure puts billions of local government tax and fee revenues at risk statewide with related core public service impacts. The measure would have significant negative impacts on City of Atwater operations and core service delivery. The proposed constitutional initiative is sponsored by the California Business Roundtable.

• Except for licensing and other regulatory fees, fees and charges may not exceed the “actual cost” of providing the product or service for which the fee is charged. “Actual cost” is the “minimum amount necessary.” The burden to prove the fee or charge does not exceed “actual cost” is changed to “clear and convincing” evidence. • Requires fees and charges paid for the use of local and state government property and the amount paid to purchase or rent government property to be “reasonable.” These fees and charges are currently allowed to be market-based. Whether the amount is “reasonable” (introducing a new legal standard aiming to force below market fee and charge amounts) must be proved by “clear and convincing evidence.” The standard may significantly reduce the amount large companies (e.g., oil, utilities, gas, railroads, garbage/refuse, cable, and other corporations) will pay for the use of local public property.
• Prohibits fees on new development based on vehicle miles traveled.

Taxes :
• Taxes and fees adopted after Jan. 1, 2022, that do not comply with the new rules, are void unless reenacted .
• Invalidates Upland decision that allows a majority of local voters to pass special taxes. The measure specifies that taxes proposed by the initiative are subject to the same rules as taxes placed on the ballot by a city council. • Expressly prohibits local advisory measures which allow local voters to express a preference for how local general tax dollars should be spent. • Requires voter approval to expand existing taxes (e.g., Utility, Transient Occupancy) to new territory (e.g., annexations) or to expand the tax base (e.g., new utility service) • New taxes can only be imposed for a specific time period. • City charters may not be amended to include a tax or fee. • All state taxes require majority voter approval.
Fines and Penalties :
• May require voter approval of fines, penalties, and levies for corporations and property owners that violate state and local laws unless a new, undefined adjudicatory process is used to impose the fines and penalties.
On Jan. 4, 2022, the California Business Roundtable filed the “Taxpayer Protection and Government Accountability Act” or AG# 21-0042A1. On Feb. 1, 2023, the measure qualified for the November 2024 ballot.
The League of California Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly opposes this initiative.
Local government revenue-raising authority is currently substantially restricted by state statute and constitutional provisions, including the voter approved provisions of Proposition 13 of 1978, Proposition 218 of 1996, and Proposition 26 of 2010. The Taxpayer Protection and Government Accountability Act adds and expands restrictions on voters and local government tax and fee authority.
Fees and Taxes
Local governments levy a variety of fees and other charges to provide core public services.
Major examples of affected fees and charges are:
• Nuisance abatement charges, such as for weed, rubbish, and general nuisance abatement to fund community safety, code enforcement, and neighborhood cleanup programs.
• Commercial franchise fees.
• Emergency response fees, such as in connection with DUI. • Advanced Life Support (ALS) transport charges.
• Document processing and duplication fees.
• Transit fees, tolls, parking fees, and public airport and harbor use fees. • Facility use charges, fees for parks and recreation services, garbage disposal tipping fees.
Virtually every city, county, and special district must regularly (e.g., annually) adopt

increases to fee rates and charges and revise rate schedules to accommodate new users and activities. Most of these would be subject to new, vague and obscure standards and limitations under threat of legal challenge. Based on the current volume of fees and charges imposed by local agencies, including council-adopted increases to simply accommodate inflation, Cal Cities estimates the amount of local government fee and charge revenue at risk is approximately $2 billion per year including those adopted since Jan. 1, 2022. Over ten years, $20 billion of local government fee and charge revenues will be at heightened legal peril.
Hundreds of local tax measures were approved in 2022 that likely do not comply with the provisions of the initiative. Nearly $2 billion of annual revenues from these voterapproved measures will cease a year after the effective date of the measure, reducing the local public services funded by these measures, unless the tax is re-submitted for voter approval.
Reductions on local government tax revenues have impacts on core services and infrastructure including fire and emergency response, law enforcement, streets and roads, drinking water, sewer sanitation, parks, libraries, public schools, affordable housing, homelessness prevention, and mental health services.
Fines and Penalties
Under existing law, cities are required to provide due process before imposing a penalty or fine for violation of its municipal code:
1. A local agency must adopt administrative procedures that govern imposing fines and penalties, including providing a reasonable period of time for a person responsible for a continuing violation to correct or remedy the violation [Gov't Code 53069.4].
2. Notice must be given to the violating party before imposing the penalty; and give the party an opportunity to be heard and present any facts or arguments [Merco Construction Engineers v. Los Angeles Unified School District (1969) 274 CA 2d 154, 166].
3. The fine may not be "excessive" [U.S. Constitution amendments VIII and XIV].
The initiative converts administratively-imposed fines and penalties into taxes unless a new, undefined, and ambiguous “adjudicatory due process” is followed. This provision may put at risk authority to impose fines and penalties for violations of state and local law.
II. FISCAL IMPACTS:
The Taxpayer Protection and Government Accountability Act will take billions of dollars away from local government services statewide.

RESOLUTION NO. 3377-23
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ATWATER TO OPPOSE INITIATIVE
21-0042A1
WHEREAS, an association representing California’s wealthiest corporations and developers is spending millions to push a deceptive proposition aimed for the November 2024 statewide ballot; and
WHEREAS, the measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and infrastructure, and would limit voter input by prohibiting local advisory measures where voters provide direction on how they want their local tax dollars spent; and WHEREAS, the measure creates new constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including local infrastructure and our environment; and
WHEREAS, the measure may make it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and WHEREAS, the measure puts billions of dollars currently dedicated to local services at risk and could force cuts to fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, and more; and
THEREFORE, BE IT RESOLVED that the City of Atwater opposes Initiative 21-0042A1; BE IT FURTHER RESOLVED that the City of Atwater will join the No on Initiative 21-0042A1 coalition, a growing coalition of public safety, education, labor, local government, and infrastructure groups throughout the state.
The foregoing resolution is hereby adopted this 27th day of February 2023.
