The City Council has a long-standing commitment to ensure that the Atwater Police Department has equipment necessary to safeguard the lives of the citizens of Atwater.

Effective January 1, 2022, Assembly Bill 481 (AB 481 or the Bill), codified in Government Code sections 7070 through 7075, requires a law enforcement agency (LEA) to obtain approval from the applicable governing body, via adoption of a “military equipment” use Policy (the Policy) by ordinance (the Ordinance), prior to the LEA funding, acquiring, or using military equipment.

As a result of the law, the Atwater Police Department is required by Government Code 7072 to submit a report to the City Council detailing the inventory, use and funding of military equipment governed by AB 481. This report is attached to the item as Exhibit "A". This public hearing satisfies a second requirement of a community engagement meeting to represent the report and take public input. CITY COUNCIL

AGENDA REPORT

MEETING
DATE:

February 26, 2024
TO: Mayor and City Council
FROM: Anna Nicholas, Finance Director

PREPARED
BY:

Anna Nicholas, Finance Director
SUBJECT: Approving Resolution No. 3445-24 which Adopts the Mid-Year Budget Revenue and Expenditure Adjustments for Fiscal Year 2023-24 (Finance Director Nicholas)

RECOMMENDED COUNCIL ACTION
Motion to adopt Resolution No. 3445-24 approving Budget Amendment No. 9 amending the Fiscal Year 2023-2024 Budget regarding revenue and expenditure adjustments based upon mid-year analysis; or
Motion to approve staff's recommendation as presented.

I. BACKGROUND/ANALYSIS:

The City Council adopted the Fiscal Year 2023-24 budget on June 12, 2023. Since the implementation of the adopted budget, the Finance Department, in collaboration with all departments, has performed a mid-year review of the operating budget, which includes an analysis of the estimated revenues and expenses for the current fiscal year. As a result of the analysis, staff recommends budgetary adjustments that are detailed in Exhibit “A” of this agenda item.

The mid-year review provides an opportunity to analyze revenues and expenses, and any changes that have occurred since the beginning of the fiscal year. The budget approved by City Council in June is developed based on available data at the time of compilation. At different intervals throughout the budgetary cycle (fiscal year), the City receives revised estimates for major revenue sources such as Sales Tax and Gas Tax.

Staff performs analytical reviews of other revenue sources. Additionally, the mid-year review is an opportunity for all municipal departments to review their respective department budgets against ongoing and future activity and plan for any budgetary needs that could potentially arise between mid-year and the end of the fiscal year.

At the time the Fiscal Year 2023-24 budget was adopted in June of 2023, the unaudited General Fund Balance was projected to be $9.5 million at 6/30/2024. The estimated unaudited General Fund balance will be projected at $9.4 million, with $5.6 million

designated to meet the 25% General Fund Reserve “set-aside” which is based on 25% of the estimated General Fund expenses for the fiscal year. This leaves an estimated undesignated fund balance of $3.8 million. After the approval of the proposed mid-year budget adjustments, the General Fund will still meet the target of 25% reserve based on estimated expenses as demonstrated in the table below:

Current Key Data Indicators and Other Notes:

Unemployment: As reported by the Employment Development Department of the State of California, Labor Market Information Division, the Merced County unemployment rate was 10.2 percent in December 2023, up from a revised 8.5 percent in November 2023.

This compares with an unadjusted unemployment rate of 5.1 percent for California and

3.5 percent for the nation during the same period.

Source: Unemployment Rate and Labor Force (ca.gov)
Economy and Consumer Price Index (CPI): Through a series of strategic interest rate increases, The Federal Reserve had the goal of curbing inflation and avoiding a recession. There has been some cooling in the overall inflation rate. The Feds are projected to systematically cut interest rates in 2024 which will be advantageous for consumer spending but will reduce the amount of interest earned though savings accounts and investments.

According to the Bureau of Labor Statistics (BLS), U.S. Department of Labor, the CPI increased for All Urban Consumers (CPI-U) by 0.3 percent in January on a seasonally adjusted basis, after rising 0.2 percent in December. Over the last 12 months, the all items index increased 3.1 percent before seasonal adjustment. (February 13, 2024).

In comparison, on February 14, 2023, the BLS had reported the last 12 months prior to that reporting date, the all items index increased 6.4 percent before seasonal adjustment. It appears the strategic rate hikes had the positive effect the Feds were attempting to achieve in bringing the inflation rate closer to the Feds overall target rate of 2 percent. Source: https://www.bls.gov/news.release/pdf/cpi.pdf State of California: In January 2024, Governor Newsom released the State budget proposal for FY 2024-25. In the Spring, the State Legislature holds hearings and takes

action to approve the State budget; Legislature must enact a balanced budget by June

15. The preliminary proposal projects a deficit of $38 million, while the Legislative Analyst’s Office (LAO) projects a $68 million deficit. The difference between the two is due to a higher level of optimism from the State in the ability to collect revenues. Unlike cities, the State has a variety of tools to address a budget problem (aka deficit):
spending reductions, revenue increases, cost shifts, reserve withdrawals, and reversions. The May Revision occurs when the Governor releases a revised budget proposal in May.
