TO: Mayor and City Council

PREPARED
BY:
Janell Martin, City Manager
SUBJECT: Authorizes the City Manager to Enter into a Memorandum of Understanding with Leo's Legacy for Collaboration on Planning, Funding, and Development of a Universal Design Playground (City Manager Martin)
RECOMMENDED COUNCIL ACTION
Adoption of Resolution No. 3656-26 authorizing the City Manager to enter into a Memorandum of Understanding with Leo's Legacy, in a form approved by the City Attorney, for Collaboration on Planning, Funding, and Development of a Universal Design Playground with Leo’s Legacy, to collaborate on pursuing grant and other funding opportunities for universal design features in a portion of the playground as part of the Osborn Park rehabilitation project.
I. BACKGROUND/ANALYSIS:
As part of the Osborn Park rehabilitation project, the City is exploring opportunities to incorporate universal design features into a portion of the playground to support safe, accessible, and inclusive recreation for children and families of all abilities. These features would be one component of the broader playground improvements. The proposed collaboration with Leo’s Legacy would support these efforts through funding research, community outreach, and recommendations on inclusive playground features.
Leo’s Legacy is a nonprofit organization with experience in fundraising, grant writing, and engagement with schools, healthcare providers, disability advocates, and families of children with disabilities. On July 7, 2026, its Board of Directors approved a resolution supporting collaboration with the City and authorizing its President to execute an MOU.
The proposed MOU establishes a three-year framework for Leo’s Legacy to assist the City in identifying grant and other funding opportunities, preparing draft applications and supporting materials, conducting community outreach, and providing recommendations on accessible playground design. Leo’s Legacy would provide these services as a donation, with no compensation or reimbursement from the City, and submit progress reports at least quarterly.

Agenda Report - Authorizes the City Manager to Enter into a Memorandum of Understanding with Leo's Legacy for Collaboration on Planning, Funding, and Development of a Universal Design Playground (City Manager Martin) Page 2
The City would retain ownership and control of City property and responsibility for final site selection, design, procurement, contractor selection, construction, and long-term maintenance. Leo’s Legacy could not bind the City to a grant application, funding source, or other commitment without prior written City approval. Applications and agreements that bind the City would require City approval and signature before submission or execution.
Funds intended for City use would be administered under City fiscal procedures. Any arrangement for Leo’s Legacy to accept or administer project funds would require a separate City-approved written agreement establishing financial controls and oversight.
Gifts, grants, or other funding that obligate City funds or create long-term commitments would require Council approval. Either party may terminate the MOU upon 30 days’ written notice.
II. FISCAL IMPACTS:
Approval of the MOU does not appropriate funds or create a commitment to pay Leo’s Legacy. Staff coordination and review would require City staff time. Future project costs, funding sources, matching requirements, and maintenance commitments would be evaluated as the proposal for these playground features is developed and brought to the City Council for approval as required.
III. LEGAL REVIEW:
This item has been reviewed by the City Attorney's office.
IV. EXISTING POLICY:
This item is consistent with goal number six (6) subsection one (1) and four (4) of the City’s 2026-2030 Strategic Plan: Maintain and refresh parks and facilities to provide quality experiences and evaluate the cost of services for recreational programs and explore opportunities for cost savings, program "sharing" and partnerships with nonprofit organizations.
V. ALTERNATIVES:
N/A
VI. INTERDEPARTMENTAL COORDINATION:
This item was coordinated with all the relevant departments.
VII. PUBLIC PARTICIPATION:
The public will have an opportunity to provide comments on this item prior to City Council action.
VIII. ENVIRONMENTAL REVIEW:
This item is not a "project" under the California Environmental Quality Act (CEQA) as

PREPARED

SUBJECT: Adoption of Ordinance CS 1084 Adding Chapter 10.53 (EBicycles) to Title 10 of the Atwater Municipal Code Relating to the Safe Operation of Electric Bicycles and Other Electric
Conveyances (Police Chief Novetzke)
RECOMMENDED COUNCIL ACTION
Waiving the Second Reading and Adopting Ordinance No. CS 1084 adding chapter
10.53 (E-Bicycles) to title 10 of the Atwater Municipal Code relating to the safe operation of electric bicycles and other electric conveyances.
I. BACKGROUND/ANALYSIS:
This is the second reading of the Ordinance. The first reading was completed at the Regular City Council meeting of September 28, 2026.
Background:
The City of Atwater has seen increased use of e-bikes and micromobility devices, mainly among the youth. While these offer convenience, the unsafe operation has raised significant public safety concerns throughout the city.
Current E-Bike and Micromobility Device Use in Atwater
The use of e-bikes and other micromobility devices has increased significantly throughout Atwater. These devices are commonly used for transportation, recreation, and travel to and from schools, parks, and commercial areas. Staff have observed increased ridership in residential neighborhoods, along major corridors, and near school campuses. Although e-bikes may provide mobility benefits, many riders, particularly juveniles, may not fully understand the traffic laws, equipment requirements, or safe riding practices for using e-bikes and similar devices. This creates safety concerns when riders operate in traffic lanes, fail to obey traffic signals, ride against traffic, carry passengers on single-rider devices, or operate at unsafe speeds.

Agenda Report - Adoption of Ordinance CS 1084 Adding Chapter 10.53 (E-Bicycles) to Title 10 of the Atwater Municipal Code Relating to the Safe Operation of Electric Bicycles and Other Electric Conveyances (Police Chief Novetzke) Page 2
As described in the California Vehicle Code (CVC), Electric bicycles (e-bikes) are bicycles with fully operative pedals and electric motors of 750 watts or less. There are three (3) classes of e-bikes:
Class 1 - has a motor that assists only with human propulsion, which ceases to assist when a speed of 20 mph is reached. The motor is not capable of reaching speeds greater than 20mph.
Class 2 - may be powered solely by electric power that ceases to assist when a speed of 20 mph is reached.
Class 3 - has a motor that assists only with human propulsion, which ceases to assist when a speed of 28 mph is reached. It is equipped with a speedometer.
E-bikes must disengage when the brake is applied and use a switch or mechanism that, when released, causes motor function to stop.
A person riding an electric bicycle is subject to CVC Article 4 of Chapter 1 of Division 11, which includes:
Not a motor vehicle; therefore, no insurance, license, or registration is required.
Bicycle helmet required. (Under 18 years old.)
Class 3 electric bicycle operators are required to be 16 years of age or older and wear a bicycle helmet regardless of age.
Rider has all rights and is subject to all provisions applicable to the driver of a vehicle, such as safe vehicle operation, equipment requirements, and bicycle signals.
A micromobility device includes motorized scooters and is defined as a two-wheeled device with handlebars, a floorboard to stand on, and is powered by an electric motor, as well as motorized boards, which are wheeled devices with floorboards designed to be stood upon when riding and are powered by an electric propulsion system.
People riding these types of motorized devices are also subject to various sections of the California Vehicle Code, including:
• Use of helmets
• Proper operation requirements
• At least 16 years of age (for motorized boards)
• Maximum speed limit is 15 mph
Analysis:
Public Safety Concerns

riding against the flow of traffic, failing to yield to pedestrians, failing to obey traffic control devices, riding without a helmet, using handheld devices while riding, and performing dangerous stunts such as “wheelies” in areas where pedestrians or vehicles are present. The City’s primary concern is public safety, especially for juvenile riders, motorists, and pedestrians.
Education and Outreach
A comprehensive education campaign and awareness program led by the Atwater Police Department’s Traffic Division and Community Services Division, along with the partnership of the Atwater Elementary School District can raise awareness of the safe and proper operation of e-bikes and other micromobility devices. Safety presentations and outreach materials can be directed towards students, parents and caregivers, schools, and local retailers. The campaign would explain e-bike classifications, micromobility devices, helmet requirements, safe sidewalk use, pedestrian right-of-way, and consequences for unsafe riding.

SUBJECT: Approving a Purchase Agreement with Track Tech Inc. for the Rebuild of the Trash Separator at the Prison Sewer Lift Station (Public Works Director Vinson)
RECOMMENDED COUNCIL ACTION
Approving a Purchase Agreement (Purchase Order) to Track Tech Inc. for the rebuild of the trash separator at the Prison Sewer Lift Station, in an amount not to exceed $36,000.;and authorizes and directs the City Manager or designee to execute the Agreement (Purchase Order) on behalf of the City.
I. BACKGROUND/ANALYSIS:
There is a trash separator located before the pumps at the prison sewer lift station. This separator removes debris out of the sewage before reaching the pumps to prevent the pumps at the lift station from plugging as often. The separator has teeth on a conveyor that catches and brings the debris out of the trough and then dumps it into a dumpster.
The conveyor on the trash separator stopped working a few months ago, and during the time staff has been reaching out to get quotes for repair, the pumps have been plugging 2–3 times a day.
Staff reached out to four vendors for quotes to repair the trash separator. The first three contractors that showed up did not have enough experience in repairing the trash separators and wanted to replace the whole trash separator, which would be in the range of $350,000-$400,000. Staff reached out to Veolia, and Veolia referenced Track Tech Inc, whom they contract to repair all of their trash separators at all of their plants they operate on the West Coast. Trach Tech Inc, ensured they would be able to repair it, but would have to pull it out and take it back to their shop to diagnose everything fully.
Staff moved forward with a purchase agreement with Track Tech for $22,000 to pull the conveyor and the gear box out and reach back out to staff once they had a quote to repair the work.
Track Tech reached back out to staff and let them know that most of the parts of the separator are still in good working shape. The work needing to be done is to repair the

broken shaft that comes out of the gear box and connects to the conveyor, manufacture new stainless steel teeth for some teeth missing on the conveyor, new pivot bolts to hold the teeth, and to bring back and assemble everything would be an additional $36,000. With this repair, the trash separator should be in good working function for at least another 7–10 years.

SUBJECT: Waiver of Encroachment Permit and Inspection Fees for Merced County Road Improvements on Santa Fe Road (Community
Development Director Hanson Lan and Public Works Director Vinson)
RECOMMENDED COUNCIL ACTION
Motion to Approve the waiver of the encroachment permit and inspection fees for Merced County’s road improvement project on Santa Fe Road within the City of Atwater; or
Motion approve staff's recommendation as presented.
I. BACKGROUND/ANALYSIS:
Merced County is planning road improvements on Santa Fe Road, including work within the City of Atwater. Construction is anticipated to begin in late October, with work occurring during evening hours.
The County will need an encroachment permit for the work within City limits. Staff recommends waiving the permit and inspection fees to support collaboration between the City and County on this regional improvement project. The project provides an opportunity to coordinate improvements to a roadway serving both Atwater residents and the broader region.
The fee waiver would apply only to the encroachment permit and inspection fees. The County would remain responsible for meeting applicable permit conditions and coordinating construction activities with City staff.
II. FISCAL IMPACTS:
The City would forgo the encroachment permit fee of $329. The City would forgo the inspection fee of $137 per hour for City Staff.
