CITY OF AVALON CITY COUNCIL
AGENDA ITEM: 3
MEETING DATE: February 7, 2023
ORIGINATING DEP: City Attorney CITY MANAGER: DMM
PREPARED BY: Scott Campbell, City Attorney
SUBJECT: Findings to Continue to Hold Remote Teleconference/Virtual City Council Meetings Pursuant to Assembly Bill 361
RECOMMENDED ACTION(S): Determine that the COVID-19 state of emergency proclaimed by the Governor still exists and has been considered by the City Council in deciding to continue to have teleconference meetings and that state or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19, and that as a result of the COVID-19 emergency, meeting in person would present imminent risks to the health or safety of attendees. Please note that the Governor has indicated that his emergency declaration will end on February 28, 2023.
REPORT SUMMARY: Traditionally, the Brown Act allows for teleconference or virtual meetings, provided that the physical locations of the legislative body's members joining by teleconference are posted on the agenda, that those locations are open to the public and that a quorum of the members is located within its jurisdiction. Newly enacted AB 361 provides an exception to these procedures in order to allow for fully virtual meetings during proclaimed emergencies, including the COVID-19 pandemic.
Since March of 2020 and the issuance of Governor Newsom's Executive Order N-29-20, which suspended portions of the Brown Act relating to teleconferencing, the City Council has had virtual meetings without having to post the location of the legislative body members attending virtually.
Most public agencies have been holding public meetings using virtual platforms since this time.
In June of 2021, Governor Newsom issued Executive Order N-08-21, which provided that the exceptions contained in EO N-29-20 would sunset on September 30, 2021.
On September 10, 2021, the Legislature adopted AB 361, which allows public agencies to hold fully virtual meetings under certain circumstances without the posting of the agenda from each location a legislative body member is attending. Governor Newsom signed the bill into law on September 16, 2021. Because it contained an urgency provision, it took immediate effect.
Specific Findings Required under AB 361
Under AB 361, the City Council can hold virtual meetings without providing notice of the City Council's teleconference location if the City Council makes the determination that there is a Governor-proclaimed state of emergency, which the City Council will consider in their determination, and one of two secondary criteria listed below exists:
65059.00000134520481.1
1. State or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19; or
2. The City Council determines that requiring a meeting in person would present an imminent risk to the health or safety of attendees.
COVID-19 continues to present an imminent threat to the health or safety of members of the public, and the Governor's declaration of a COVID-19 emergency still exists. Although vaccines are now widely available, many people in the State and County are still not fully vaccinated and remain susceptible to infection. The disease can still spread rapidly through person-to-person contact and those in close proximity. Further, more contagious variants of the disease are now present in the State and County, the most predominant of which is a new variant of the Omnicron variant. The County of Los Angeles recently re-instituted some mandates given the rise in cases and deaths nationally and public health officials have indicated that they may reinstitute certain mask requirements if cases continue to rise. The City's economy is dependent upon visitors to the island, the presence of which, increases the likelihood of transmission of the disease. Also, having members of the public attend council meetings at locations where council members are in attendance due to their desire to avoid exposure to COVID-19 poses an imminent risk to the health or safety of attendees.
Re-Authorization is Required Within 30 Days
The City Council made the findings listed above at its January 17, 2023 City Council meeting.
Consistent with the provisions of Government Code Section 54953(e), the findings must be made every 30 days "after teleconferencing for the first time" under AB 361. Thus, if the City Council desires to continue to meet remotely without having to post the location of each teleconference location, the City Council must again find that the COVID-19 emergency still exists and that one of the two following findings can be made: that state or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19, or, that a result of the COVID-19 emergency, meeting in person would present imminent risks to the health or safety of attendees. It is recommended that the City Council make these findings.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City Council will have to follow the Brown Act provisions that existed prior to the COVID-19 pandemic.
FOLLOW UP ACTION: That the City Council make the findings under AB 361 at its February 7, 2023 City Council meeting.

CITY OF AVALON CITY COUNCIL
4 MEETING DATE: February 7, 2023 AGENDA ITEM:
ORIGINATING DEP: Finance CITY MANAGER: DIM
PREPARED BY: Matthew Baker, Finance Director
SUBJECT: Fiscal Year 2022-2023 First Quarter Treasurer's Report / Fiscal Year 2022-2023 Second Quarter Treasurer's Report RECOMMENDED ACTION(S): Adopt a resolution accepting the FY22-23 First Quarter Treasurer's Report and the FY22-23 Second Quarter Treasurer's Report.
REPORT SUMMARY: State and Municipal Codes require the Treasurer to submit within 30 days following each fiscal quarter a report summarizing the City's cash and investment balances. Attached is the First and Second Quarter Treasurer's Report for FY22-23. The report was shared with the City Treasurer prior to presentation to City Council.
The purpose of the report is to inform, on a quarterly basis, the City's cash and investment balances, the investment types, yields, and market values, and to ensure that the City's investments are in compliance with the City's adopted Investment Policy. The report shows that all of the City's funds are in compliance with its investment policy. In general, operating cash is held in US Bank checking accounts and the excess cash is invested in California's Local Agency Investment Fund (LAIF) and various certificates of deposit (CDs). In accordance with Government Code sections 16429.1 and 53601 et seq., the City cannot invest more than 30% of its portfolio in CDs. CDs accounted for 19.7% of the portfolio for the quarter ended December 31, 2022.
The unrestricted cash balance for the second quarter of 2022-2023 totaled $20.82 million, an increase of $1.89 million from the first quarter of 2022-2023. The unrestricted cash balance includes cash for enterprise funds (e.g. Sewer, Saltwater, and Solid Waste) not available for general government functions. During the COVID-19 pandemic, the City's unrestricted cash balance fell to $5.62 million for the quarter ended September 30, 2020 as a result of the restrictions to non-essential travel and decreased tourism. The increase in unrestricted cash over the last two fiscal years is largely attributable to increased visitor-driven tax revenues, including transient occupancy taxes, as well as reduced expenditures compared to pre- pandemic operations.
During October 2022, the City opened a new account at US Bank (CIMC Improvement Fund) for the proceeds of the special tax approved by the voters of the City on November 3, 2020.
Section 10-2.609 of the Avalon Municipal Code states:
The proceeds of the special tax shall be deposited into an account created exclusively for that purpose and designated the "Catalina Island Medical Center Improvement Fund" and shall be held, separate and apart from other funds of the City. Funds deposited in such account shall be used for the exclusive purposes of financing the infrastructure replacement, and debt financing for a new facility, infrastructure necessary for the implementation of new programs of the Catalina Island Medical Center, or any component thereof, and for any financing costs or other Administrative Costs incurred by the Catalina Island Medical Center or the City on behalf of the Catalina Island Medical Center in connection therewith. For purposes of this article, "Administrative Costs" shall include only those costs incurred to impose and administer the special tax and shall not include administrative or operational costs of the Catalina Island Medical Center. Proceeds of the special tax may not be used for any other purposes except as provided for herein.
The restricted cash balance for the second quarter of 2022-2023 totaled $9.8 million, an increase of $473 thousand from the first quarter of 2022-2023. The increase is primarily attributable to the new CIMC Improvement Fund, with a balance of $371 thousand reflecting tax collections for activity through October 2022.

MEETING DATE: February 7, 2023
ORIGINATING DEP: Public Works CITY MANAGER: DuM
PREPARED BY: Jamie Hmielak - Maintenance Superintendent SUBJECT: Purchase of a Skid Steer for the Wastewater Treatment Plant RECOMMENDED ACTION(S): Authorize City Manager, or their designee, to procure a used skid steer that meets the required specification outlined by Staff, for a total not to exceed $66,500 per the City's purchasing policy.
REPORT SUMMARY: The existing skid steer at the wastewater treatment plant (WWTP) is currently 20 years old. It is poor condition, no longer reliable, and is undersized. These factors have led to decreased efficiency and productivity at the WWTP. After analysis of equipment options, Staff proposed a used skid steer that is larger in size to increase work efficiency. A used unit is preferred due its immediate availability, and the harsh operating environment that the equipment will experience at the plant.
inspected the skid steer and found it to be in good condition. Expected life of the used skid steer shall be no less than 10 years. Several quotes were obtained, which are listed below.

MEETING DATE: February 7, 2023
ORIGINATING DEP: Harbor CITY MANAGER: AMM
PREPARED BY: Orne Carstarphen Harbor Master
SUBJECT: Harbor Patrol Boat Volvo D3 Engine replacement RECOMMENDED ACTION(S): Authorize the City Manager to approve an expenditure for purchase of a new Volvo D3-200A Engine package for Patrol Boat 1 per the City of Avalon's purchasing policy.
REPORT SUMMARY: Patrol Boat 1 is part of a fleet of seven (7) boats necessary to carry out the day-to-day operations of the City of Avalon Harbor Department. Patrol Boat 1 is equipped with a Volvo D3 engine which currently has 7,800 operating hours on it. The engine is due for replacement. Replacement of the engine is best done in the off season and will insure efficiency and reliability as we enter the summer season.
Per the City's purchasing policy, three quotes have been obtained from the fowling vendors.
Marine Diesel Services $ 55,605.98
Harry's Marine Service $ 44,204.75
Outdrive Exchange $43,577.00
Though Outdrive Exchange provided a quote for less than the other vendors, the quote does not include language referring to warranty or other guarantee of work completed. Additionally, the Outdrive Exchange quote does not include duel propellers as part of overall quote for repower.
Staff recommends authorizing the City Manager to select Harry's Marine Service as the vendor for this engine repower project.
GOAL ALIGNMENT: Fleet management.
FISCAL IMPACTS: The purchases of D3 engine package was anticipated in the adopted Fiscal Year 2022-23 Budget for Patrol Boat Repair and Maintenance, 10470-6689.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: Harbor Department Personnel will not have necessary equipment for its day-to-day operations.
FOLLOW UP ACTION: Implement City Council direction.

CITY OF AVALON CITY COUNCIL
MEETING DATE: February 7, 2023 AGENDA ITEM:
ORIGINATING DEP: Finance CITY MANAGER: Дни
PREPARED BY: Matthew Baker, Finance Director
SUBJECT: FY23 Mid-Year Financial Results and Proposed Budget Amendments
RECOMMENDED ACTION(S): (1) Receive the report of the Mid-Year Financial Results for FY22-23; and (2) Authorize the proposed budget amendments as outlined in Exhibit A to this report.
BACKGROUND: On June 21, 2022, City Council adopted the City's annual operating and capital budget for the fiscal year ending June 30, 2023 (FY23). The adopted budget reflects estimated General Fund revenues and transfers-in totaling $14,558, 169, which were comprised of operating revenues totaling $12,053,316 and grants and transfers totaling $2,504,853.
General Fund appropriations totaled $15,795,581, with recurring operating expenditures totaling $11,244,312, non-recurring operating expenditures totaling $339,960, capital outlays totaling $3,746,307 and transfers to other funds totaling $465,000. Recurring revenues exceed recurring expenditures with reserves to be utilized to fund one-time capital outlays. The adopted budget for the Harbor Fund includes fund revenues totaling $15,681,657, comprised of $8,254,270 in operating revenues and $7,427,387 in grants and other non-operating revenues. Harbor Fund appropriations total $16,846,657 with $7,117,638 in operating expenditures and $9,729,019 in capital outlays. Similar to the General Fund, recurring revenues exceed recurring expenditures, with reserves utilized to fund significant capital outlays. Sewer, Saltwater, and Solid Waste Funds were budgeted to align with the cost of service study adopted by City Council on June 1, 2021.
REPORT SUMMARY: The unaudited revenue and expenditure figures for activity through December 31 have been compiled to provide a comparative update to the adopted budget. Due to the timing of when certain revenues are received or when funds are expended (e.g. visitor- driven revenues peak during first quarter, insurance premiums paid during first half of year), amounts may be greater or less than 50% of the budgeted amounts as of December 31st. In general, the report includes comparisons to the prior two fiscal years, which were both impacted by pandemic-related restrictions and may not reflect comparable activity for the current fiscal year (FY23). Fund descriptions focus on operating revenues and expenditures, with capital outlays and grant revenues discussed separately in this report.
As part of the mid-year budget process, Management reviewed expenditures to identify accounts where expenditures exceeded or are on pace to exceed budgeted amounts. Proposed amendments to the budget are requested in the report and outlined in Exhibit A. Under the City's 1 Budget and Fiscal Policies adopted with the FY23 Budget, Management has the authority to make budget adjustments within departments and expenditure categories under certain prescribed amounts provided no additional funds are expended. See Exhibit B for a list of budget adjustments made as part of this mid-year review.
General Fund Operations
FY23 operating revenues total $7,395,297 as of December 31st (61.3% of budgeted) compared to $6,855,252 (42.0% of actual) in FY22 and $4,812,071 (42.5% of actual) in FY21. FY23 operating expenditures, total $5,197,398 at mid-year (44.9% of budgeted) compared to $4,166,487 (51.1% of actual) in FY22 and $3,876,746 (44.2% of actual) in FY21. See below for a comparison to prior mid-year activity by major revenue source and department. Net operating revenue is before capital outlays and transfers to other funds.

Transient occupancy tax is the largest revenue source in the General Fund and accounts for
47.3% of budgeted operating revenues in FY23. The adopted budget estimated TOT revenues to be approximately 5% higher than pre-COVID activity. Although TOT during the prior fiscal year significantly exceeded pre-COVID levels, a conservative estimate was used during the development of the budget to account for the possibility that the prior year's increases in revenues were attributable to pent-up demand after pandemic related restrictions on non- essential travel were lifted and revenues returning to pre-pandemic averages in the current fiscal year. However, the City has continued to experience strong growth in TOT and is currently on track to exceed budget estimates by approximately $1.5 million, before required allocations to the Chamber. See below for a breakdown comparing budget estimates to collections for hotel and vacation rentals, combined

The City's sales tax revenues during the peak visitor season (July through September) totaled $559,967. This reflects a 31.0% increase in taxable sales activity from the summer of 2021 and 83.5% increase compared to the pandemic-impacted summer of 2020. Property tax revenues are primarily received during the second half of the fiscal year with the first residual and pass-through property tax remittance received in January 2023 totaling $330,537 (68.3% of budgeted). Other revenues include the 0.5% sales tax pass through to the Catalina Island Medical Center totaling $337,883 and the Measure H collections for the construction of the new medical center totaling $206,007 based on collections through December 31st.
General Fund Expenditures
4 FY22 YTD includes TOT revenues through December 31, 2022 with additional November revenues collected during the month of January.
3 General Fund operating expenditures include salaries, benefits, maintenance and operating costs, as well as certain contract services, for the majority of City departments, including Planning, Recreation, Fire, and Public Works. Through December 31st, operating expenditures are up $1,030,911 or 24.7% compared to the prior fiscal year. Approximately half of the increase is attributable to increased unfunded accrued pension liability (UAL) payments (+187,218), increased Insurance Fund allocations (+$160,345), and increased hospital sales tax pass through expenditures (+$136,676). The City incurred significant litigation-related expenditures during the first half of the fiscal year. In addition, the City elected to pay the entire UAL due at the beginning of the year rather than through monthly payments as done in the prior year. Below is a breakdown of activity by department:

4 In response to the COVID-19 pandemic, the City implemented a variety of cost saving measures, including layoffs and hiring freezes. In particular, Public Works was reduced from 21.9 full-time equivalents (FTEs) in the FY20 Budget to 15.0 FTEs in the current budget. Staff is requesting two additional full-time Maintenance Worker positions to be added to the current year budget for a total cost of $72,818 for the remainder of the current year. The recurring costs for these two additional positions would total approximately $160 thousand annually in future budgets. Please see Exhibit A for a breakdown of cost by account.
The City significantly reduced training and travel expenditures over the prior two fiscal years due to restrictions on travel and in-person meetings and as part of the cost saving measures taken in response to the pandemic. These meetings and trainings have largely returned to in-person formats during the current fiscal year. In addition, as a result of turnover and retirements, there is a need to provide these training opportunities to new City staff. As a result, department leaders have requested budget amendments to provide additional funds for training and travel. Through December 31, the Fire Department has spent $7,116 on training and travel related expenditures (35.6% of budget). The Fire Department is requesting an additional $15,000 to 10245-5510 to cover additional training during the second half of the fiscal year.
Staff is also requesting budget amendments for fuel-related expenditures in the General Fund.
The Fire Department and Public Works have utilized approximately 2/3 of the total budgeted amounts through midyear. The increase in expenditures is attributable to both an increase in gallons used as well as a significant increase in the average price per gallon, with the average price per gallon up 25% over the prior year. Staff is requesting an additional $8,000 to the Fire Department (10245-5600) and $10,000 to Public Works (10250-5600) to account for the increase in fuel cost and usage.
In September 2022, the City experienced a large tropical storm event resulting in rockfall and debris along roadways and pedestrian walkways. In addition to the work performed by Public Works, the City contracted with vendors to assist with storm clean-up and seawall repairs along Pebbly Beach Road. The City had budgeted $10,000 for Storm Damage (10250-5701) but expenditures through midyear total $24,887. Staff is requesting an additional $25,000 to 10250- 5701 to provide additional funding for cleanup and repairs in case of another major storm event during the second half of the year.
At the November 1, 2022 City Council Meeting, City Council authorized staff to purchase a new Christmas tree for Wrigley Stage for a not to exceed amount of $50,000. However, the staff report did not include a request for a budget amendment. City Staff purchased the new tree for $35,801.65 and is requesting an amendment to increase the holiday decoration budget by $36,000 (10250-3610). The City's budget for Chamber marketing is determined based on 22% of the budgeted TOT revenue amount and paid in monthly installments to Love Catalina. The City then performs a true-up calculation to determine whether additional payments are due to Love Catalina based on actual TOT revenues received. Considering TOT revenues are currently on-track to exceed the prior year, Staff is requesting an amendment to increase the Chamber marketing budget by $660,000 (10260-5650) to provide the City with the ability to perform a mid- year true-up with Love Catalina, if requested. Lastly, the City received a donation of $25,000 to be applied to the outrigger program.
Harbor Fund Operations (Fund 103)
FY23 harbor operating revenues total $4,498,634 as of December 31st (65.9% of budgeted) compared to $3,902,680 (53.2% of actual) in FY22 and $3,044,442 (54.0% of actual) in FY21.
FY23 harbor operating expenditures, including internal service allocations, total $3,498,002 (53.6% of budgeted) at mid-year compared to $3,159,036 (53.2% of actual) in FY22 and $2, 909,080 (53.4% of actual) in FY21. Revenues dedicated to capital outlays and grant revenues are included in a separate section in this report. Harbor Fund Revenues
Cross channel wharfage charges are the largest source of operating revenues in the harbor, with $1.87 of the $3.00 per passenger charge each way used to fund operating costs, while the remainder is dedicated to funding capital projects in the harbor. Cross channel wharfage fees 6 represent 34.4% of the harbor's budgeted operating revenues in FY23. During FY21, wharfage revenues were negatively impacted by capacity restrictions on cross channel carriers to facilitate social distancing in response to the pandemic. These restrictions were lifted during the fourth quarter of FY21 and cross channel wharfage revenues in FY22 exceeded pre-COVID FY19 revenues by 10.5%. FY23 cross channel wharfage revenues are down 1.6% from FY22 revenues at mid-year, with decreases in visitor activity experienced from September through November. Both cross channel and cruise ship wharfage revenues, accounting for nearly half of the harbor's budgeted operating revenues, are charged on a per passenger basis and year-over- year increases in the number of visitors are required to grow revenues without increasing wharfage rates. FY23 revenues through mid-year exceed mid-year FY22 revenues due to cruise ship operations not resuming until late September 2021. Cruise ship wharfage revenues are ahead of budget estimates by $253,790 as a result of higher than anticipated occupancy rates and are on track to exceed budget estimates by a further $250,000 if the high occupancy rates are maintained during the second half of the year.
Harbor Fund Expenditures
Harbor Fund operating expenditures include salaries, benefits, maintenance and operating costs, as well as certain contracted services in the harbor. Harbor operating expenditures have been divided into the following functions to facilitate review and include: Administration, which includes the Harbor Master and office support; Operations, which includes Harbor Patrol and dedicated harbor maintenance personnel; and Public Works, which includes contracted lifeguard services, waterfront trash collection and restroom maintenance. Below is a breakdown of activity by function and expenditure type.

7 Similar to Public Works, the City reduced staffing of Harbor Patrol Officers and Supervisors from
14.6 FTEs in the FY20 Budget to 13.1 FTEs in the current budget. The midyear budget proposes an additional 0.4 FTE, increasing the budget by $47 thousand in the current budget year and
1.0 FTE or approximately $108 thousand annually in future budgets.
In addition to citywide general liability and property insurance, the City purchases additional insurance to cover its harbor facilities, including the fuel dock. While the budget anticipated cost increases of 10%, actual premiums increased by 33%. The municipal insurance industry, as a whole, has been experiencing rapidly growing premium increases as a result of increasing settlement costs and a tightening of reinsurance markets. Staff is requesting a budget amendment to increase the Harbor's insurance account (10370-5501) by $14,000 to cover the increased premiums.
Similar to the Fire Department, the Harbor Department is requesting amendments to its training and travel budgets (10370-5510, 10371-5510) totaling $10,000 to provide additional funding for staff training. During the first half of the fiscal year, two Harbor personnel obtained their Emergency Medical Technician (EMT) certifications, which required classroom and ride-a-long training over-town.
Lastly, the Harbor Department has seen an increase in credit card payments relative to cash and checks, with fees associated with credit cards increasing as a result. Staff budgeted $50,000 for the fiscal year with credit card fees totaling $44,278 through the first half of the year. Staff is requesting an additional $30,000 to Account 10371-5520 to cover the second half of the year.
Other Enterprise Funds (Sewer, Saltwater, Solid Waste, Transit) Sewer, Saltwater, and Solid Waste Fund revenues are collected through direct assessment fees placed on property tax bills which the County collects on the City's behalf. The City receives its first major remittance of direct assessments in its December payment from the County.
Revenues received are in-line with estimates for Sewer, Saltwater and Solid Waste. Below is a breakdown of operating expenditure activity by fund.

The City developed its new website during the first half of the fiscal year. In order to expand the website's capabilities for Finance, record keeping and data management, the City is requesting an additional $15,000 to 10135-5005 for these website enhancements. The adopted budget also did not include funds for required sick and vacation payouts for separations and retirements as outlined in memorandums of understanding and management agreements. Staff is requesting a budget amendment to include these costs in the current year budget as outlined in Exhibit A.
The City's Insurance Fund includes expenditures related to general liability and property insurance, as well as expenditures related to litigation not covered by insurance. The City budgeted $615,000 for general liability and property insurance based on estimates received by CIRA in the spring of 2022. City Staff are requesting an additional $21,000 to the budget (11830- 5501) as actual premiums totaled $635,847. In addition, the City budgeted $150,000 to cover anticipated litigation expenditures, including a litigation with a trial scheduled for the first half of the year. Through December 31, litigation expenses totaled $212,772 compared to $150,000 9 budgeted. City Staff is requesting a budget amendment increasing litigation expenses by $100,000 (11830-5031) to cover the additional costs. As an internal service fund, the costs incurred by the Insurance Fund are allocated across the General Fund and other enterprise funds by fund and department. Please refer to Exhibit A for amended internal service allocations required to cover the requested amendments.
Harbor Capital Fund (Fund 104)
Capital outlays in the harbor are funded by a dedicated portion of cross-channel wharfage revenues, as well from grant revenues. Cross channel wharfage in the Harbor Capital Fund totaled $789,542 (56.4% of budgeted) through December 31, 2022. The majority of expenditures in the fund relate to major capital improvement projects, with a portion dedicated to capital maintenance and for the administration of the capital program. Maintenance-related expenditures totaled $229,576 (38.5% of budgeted). Below is a summary of budgeted capital outlays in the Harbor Capital Fund for FY23:

CITY OF AVALON CITY COUNCIL
8 MEETING DATE: February 7, 2023 AGENDA ITEM:
ORIGINATING DEP: Administration CITY MANAGER: OMM
PREPARED BY: Devin Hart, Management Analyst
SUBJECT: Vehicle Citation Amnesty Program
RECOMMENDED ACTION(S): Review the proposed vehicle citation amnesty program. If consensus, adopt a resolution establishing guidelines for a one-time vehicle citation amnesty program reducing fine amounts for outstanding Vehicle Code and City of Avalon Municipal Code REPORT SUMMARY: During the December 14, 2022 Special City Council Meeting regarding vehicles, the City Council directed Staff to develop an amnesty program to allow illegal vehicles and owners with outstanding tickets financial support/incentives to legalize their vehicles.
Illegal vehicles are a significant issue in Avalon. City Staff estimate there are currently between 200 and 300 illegal, abandoned or non-operable vehicles on the streets of Avalon. These vehicles contribute to noise, congestion and emission issues.
Due to non-compliance with the Avalon Municipal Code (AMC), and/or State of California Vehicle Code, many of these vehicles have garnered thousands of dollars in citations and associated penalties and fines. For some individuals, the cost of outstanding citations is greater than the overall value of the vehicle. According to the City's citation system, for the time period of January 1, 2019 to present, there are approximately 2,425 outstanding citations accounting for approximately $164,000 in outstanding fines. The most citations owed by any single individual exceed $7,000.
In order to incentivize individuals to come into compliance with local and state requirements, Staff propose a 60-day amnesty program commencing on February 8, 2022. The goal of the program is to encourage settlement of existing, outstanding citations with the understanding that the individual will take steps to cure issues related to illegal vehicles - whether it is removal of the vehicle from the Island or compliance with State and local regulations so the vehicle may be appropriately registered.
Staff propose two options for citation forgiveness for individuals with $250 or more in outstanding citations:
1. Elimination of all outstanding late penalties and/or interest and 50 percent reduction of the outstanding fines; or
2. Elimination of 100% of all outstanding fines and associated late penalties and/or interest IF the individual voluntarily signs over the title of the vehicle to the City of Avalon for its removal from the Island.
Depending on qualifications, the program will offer individual the ability to make installment payments under an amnesty payment plan. Participants that default on an amnesty payment plans will receive notification of default by mail. The participant will have 30 days to make a payment or request a change in payment fee. If the participant fails to contact the City within 30 days, the City may refer the remaining outstanding debt to the appropriate institution for collection of the remaining balance, including but not limited to, the balance of all forgiven fines and costs. If an individual opts to make installment payments, the City may apply a $50 amnesty program fee. This fee will be added to offset any administrative costs including costs associated with administering an installment plan or accounts receivable plan.
Working cooperatively with the Los Angeles County Sheriff Department, the City anticipates establishment of an impound facility in the near future. After the amnesty period ends and the impound lot is established, vehicles and individuals that still do not comply with local and state vehicle requirements may have their vehicle impounded and formally removed from the Island.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City will not have a process to provide relief to qualified individuals who have accumulated fines and penalties due to noncompliance with the AMC.
FOLLOW UP ACTION: Implementation of City Council direction. If the proposed amnesty program fee is approved, there will be a public hearing held on February 21, 2023 to formally add the program fee to the fee schedule.
FISCAL IMPACTS: Undetermined.
