CITY OF AVALON CITY COUNCIL
MEETING DATE: July 18, 2023 AGENDA ITEM: 3
ORIGINATING DEP: City Attorney CITY MANAGER: QJLJi(
PREPARED BY: Scott Campbell, City Attorney
SUBJECT: Findings to Continue to Hold Remote TeleconferenceNirtual City Council Meetings Pursuant to Assembly Bill 361
RECOMMENDED ACTION(S): Reconsider the circumstances of COVID-1 9 state of emergencyproclaimed by the Governor and COVID-1 9’s continued impact and determine that state or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19, and as such, that continuing to utilize the protections of Assembly Bill 361 will protect the health and safely of attendees.
REPORT SUMMARY: Traditionally, the Brown Act allows for teleconference or virtual meetings, provided that the physical locations of the legislative body’s members joining by teleconference are posted on the agenda, that those locations are open to the public and that a quorum of the members is located within its jurisdiction. AS 361 provides an exception to these procedures in order to allow for fully virtual meetings during proclaimed emergencies, including the COVID-19pandemic.
Since March of 2020 and the issuance of Governor Newsom’s Executive Order N-29-20, which suspended portions of the Brown Act relating to teleconferencing, the City Council has had virtual meetings without having to post the location of the legislative body members attending virtually.
Most public agencies have been holding public meetings using virtual platforms since this time.In June of 2021, Governor Newsom issued Executive Order N-08-21, which provided that the exceptions contained in EO N-29-20 would sunset on September 30, 2021.
On September 10, 2021, the Legislature adopted AS 361, which allows public agencies to hold fully virtual meetings under certain circumstances without the posting of the agenda from each location a legislative body member is attending. Governor Newsom signed the bill into law on September 16, 2021. Because it contained an urgency provision, it took immediate effect.
Specific Findings Required underAB 361
As the State of Emergency has ended, the City Council can continue to hold virtual meetingswithout providing notice of the City Council’s teleconference location if the City Council makes the following two findings:
1. State or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19; and
2. The City Council reconsiders the circumstances of the state of the emergency and danger presented by COVID-19;
6505900000\3452048 I I
Having made the findings, the City Council can continue every 30 days to authorize meetings under AR 261 to protect the health or safety of affendees.
COVID-1 9 continues to present a threat to the health or safety of members of the public. Although vaccines are now widely available, many people in the State and County are still not fully vaccinated and remain susceptible to infection. The disease can still spread through person-toperson contact and those in close proximity. According to the most recently published data, 4.7% of those tested statewide for COVID-19 tested positive and an average of 595 persons each day are hospitalized due to COVID-19. Additionally, Cal/OHSA has implemented COVID-19 Prevention Non-Emergency Regulations that will remain in effect until February 3, 2025. The City’s economy is dependent upon visitors to the island, the presence of which increases thelikelihood of transmission of the disease. Also, having members of the public attend council meetings at locations where council members are in attendance due to their desire to avoid exposure to COVID-1 9 poses a risk to the health or safety of attendees.
Re-Authorization is Required Within 30 Days
The City Council made the required findings at its June 20, 2023 City Council meeting. Consistent with the provisions of AB 361, the new findings must be made every 30 days. Thus, if the City Council desires to continue to meet remotely without having to post the location of each teleconference location, the City Council reconsider the facts of the state of emergency and continued impact of COVID-19, find that state or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19, and therefore, that remotemeetings under AR 361 should continue in order to protect the health or safety of attendees.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City Council will have to follow the Brown Act provisions that existed prior to the COVID-1 9 pandemic.
FOLLOW UP ACTION: That the City Council make the findings under AB 361 at its August 15, 2023 City Council meeting.

CITY OF AVALON CITY COUNCIL
MEETING DATE: July 18, 2023 AGENDA ITEM: (P
ORIGINATING DEP: Public Works CITY MANAGER: JU1Q.
PREPARED BY: Jamie Hmielak, Maintenance SuperintendentSUBJECT: Authorize Purchase of a 2016 Ford F-250 Pickup Truck for the Wastewater Treatment Plant
RECOMMENDED ACTION(S): Authorize the City Manager or designee to procure, per the City’s Purchasing Policy, a used 2016 Ford F-250 pickup truck from United Rentals for the Wastewater Treatment Plant (VWTFP). Allocate $28,500 from the vehicle replacement fund (account 13825-6781) to procure the vehicle.
REPORT SUMMARY: Public Works and PERC are requesting to procure a used 2016 Ford F250 pickup truck to replace the existing truck at the WWTP, which is a 2002 Dodge 2500 Ram.It is over 20 years old, is no longer operable, and is to be submitted to surplus. A used truck is preferred in this situation due to the harsh work environment it will be exposed to at the VWVTP.
A large pickup is required to transport chemicals, materials, and equipment on a daily basis for maintenance purposes. Crews at the plant have been using a truck assigned to Public Works to perform such tasks since the original truck has been inoperable. Having to assign a truck from Public Works to the WWTP has created an inefficiency for both departments. A dedicated large pickup truck for the PERC crew will increase efficiency for both the WWTP, and Public Works.
City mechanic, Louis Rubio, inspected the truck we wish to procure located at United Rentals in San Diego, CA, and found it to be in good condition. Expected life of the truck shall be no less than 10 years. Below are several other vehicle listings of similar nature which do not includesales tax. The amount requested includes additional funds for taxes, fees, and shipping.

CITY OF AVALON CITY COUNCIL
MEETING DATE: July 18, 2023 AGENDA ITEM:
ORIGINATING DEP: Administration CITY MANAGER: £Dwcj.ç
PREPARED BY: Jocelyn Francis, Assistant City Manager
SUBJECT: Electronic Signature Policy
RECOMMENDED ACTION(S): Approve the City of Avalon Electronic Signature Policy.
REPORT SUMMARY: The City desires to implement industry best practices of using electronic records and electronic signatures to effectively manage documents in accordance with California state law. It is recommended City Council formally authorize the use of electronic signatures for the execution of City business.
The City has invested in, and continues to improve, citywide business processes. The use of electronic signatures citywide will enable “digital to digital” processes increasing efficiencies, improving customer service, and enhancing records management bestpractices.
Electronic signatures cut down on the paper, time, and cost associated with transmitting and approving physical documents, supporting improved environmental stewardship.
Electronic signature software systems can also offer an easily accessible audit trail of the modification, editing, approval, and signature of documents.
Safeguards regarding the use of electric signatures are in the policy and will be further developed with direction from the City Attorney.
FISCAL IMPACTS: None.
GOAL ALIGNMENT: Improved Business Process
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: City contract execution and electronic record management practices would remain out of date and inefficient.
FOLLOW UP ACTION: Post the updated policy on the City website and implement a readily available and secure electronic signature system.
ADVERTISING, NOTICE AND PUBLIC CONTACT: The item was properly listed on the posted agenda pursuant to the Brown Act.

DRAFT
CITY OF AVALON
Electronic Signature Policy
APPLICABILITY
This Policy applies to all City of Avalon (“City”) employees, officers, and designated contractorswho, as part of their job responsibilities and requirements are tasked with executing legallybinding documents. The use of electronic signatures on legally-binding documents has become increasingly prevalent. The benefits of electronic signatures are simple and numerous: they cut down on the paper, time and cost associated with transmitting and approving physical documents, and can offer an easily accessible audit trail of the modification, editing, approval, and signature of documents.
STATEMENT OF PURPOSE
This Policy authorizes the City to accept an approved electronic signature, in lieu of a written signature, on a document in which a signature is required or used, which complies with the requirements of Government Code section 16.5 and this Policy. This Policy does not supersedelaws that specifically require a written signature. This Policy does not limit the right or option to conduct the transaction on paper or in non-electronic form and the right to have documents provided on paper.
DEFINITIONS
An electronic signature means an electric sound, symbol, or process attached to or logically associated with an electronic record and executed or adopted by a person with the intent to sign the electronic record.
A “digital signature” is a type of electronic signature that shall have the same force and effect as a manual signature if and only if it embodies the following attributes pursuant to Government Code § 16.5:
• It is unique to the person using it;
• It is capable of verification;
• It is under the sole control of the person using it;
• It is linked to data in such a manner that if the data are changed, the digital signature is invalidated; and
• It conforms to regulations adopted by the Secretary of State.
GENERAL POLICY GUIDELINES
1. In any document accepted by the City in which a signature is required or used, the City
DRAFT
may authorize the use of an electronic signature, so long as it complies with the requirements of this section.
2. To the fullest extent permitted by law, the City accepts electronic signatures as legally binding and equivalent to handwritten signatures to signify an agreement.
3. The final approval of any electronic signature method will be by the City Manager and City Attorney, with the recommendation of the Assistant City Manager.
4. The City Manager shall determine acceptable technologies and vendors consistent with industry best practices to ensure the security and integrity of the data and the signature.
5. The City Manager shall further determine the documents for which the City will accept electronic signatures. Periodic reviews will be implemented for appropriateness and continued applicability of electronic signatures.
6. If it is determined that an approved electronic signature method is no longer trustworthy, the City Manager must revoke the approval of that electronic signature method. If there is continued significance for the electronic signatures, which used the revoked method, the City Manager will take steps to see that any valid records signed with the revokedelectronic signature method are signed again either with a written signature or with an approved electronic signature method.
7. The City’s right or option to conduct a transaction on paper or in non-electronic form shall not affect the City’s right, option or obligation to have documents provided or made available in paper format.
8. Where a legal requirement, beyond City policy, requires a written document, that requirement is met when an electronic record has associated with it an electronic signature using an approved electronic signature method, which complies with applicablestate law.
9. This Policy applies only to transactions between parties, which have agreed to conduct transactions by electronic means with the use of the City’s approved electronic signature method.
10. This Policy shall not apply to any transaction that requires a person’s signature to be signed in the presence of a notary public.

Re: Contract Renewal
Dear Mr. Maistros,
I am writing to formally request that our Contract Agreement with the City of Avalon be renewed for a minimum of S(five) years under the terms and conditions as agreed by both parties. Our current contract expired June 30, 2023. We are seeking bids on materials at this time in order to prep for the 2024 season. This amounts to thousands of dollars that need at least 120 days lead time for delivery. All the material ordered needs to be fabricated throughout 2023 in order to be ready for timely installation in 2024.
Attached is our current rate sheet for 2023 as requested. 2024 rate increase and years beyond will be determined by local sales tax and CPI each year as previously agreed. Anyincreases beyond that will be brought to the City Manager/City Council if needed at that time.
Thank you in advance for your prompt attention.
