CITY OF AVALON CITY COUNCIL
MEETINGDATE: Augustl,2023 AGENDAITEM: 3
ORIGINATING DEP: Finance CITY MANAGER: ujp
PREPARED BY: Matthew Baker, Finance Director
SUBJECT: Fiscal Year 2022-2023 Fourth Quarter Treasurer’s Report RECOMMENDED ACTION(S): Adopt the resolution accepting the FY22-23 Fourth Quarter Treasurer’s Report.

REPORT SUMMARY: State and Municipal Codes require the Treasurer to submit within30 days following each fiscal quarter a report summarizing the City’s cash and investment balances. Attached is the Fourth Quarter Treasurer’s Report for FY22-23. The report was shared with the City Treasurer prior to presentation to City Council.

The purpose of the report is to inform, on a quarterly basis, the City’s cash and investment balances, the investment types, yields, and market values, and to ensure that the City’sinvestments are in compliance with the City’s adopted investment policy. The report shows that all of the Citys funds are in compliance with its investment policy. In general, operating cash isheld in US Bank checking accounts and any excess cash is invested in California’s Local Agency Investment Fund (LAIF) and various certificates of deposit (CDs). In accordance with Government Code sections 16429.1 and 53601 et seq., the City cannot invest more than 30%of its portfolio in CDs. CDs accounted for 19.3% of the unrestricted cash and investments for the quarter ended June 30, 2023.

The unrestricted cash balance for the fourth quarter of 2022-2023 totaled $21.16 million, an increase of $2.15 million from the third quarter of 2022-2023. The unrestricted cash balanceincludes cash for enterprise funds (e.g. Sewer, Saltwater, and Solid Waste) not available for general government functions. The increase in unrestricted cash is attributable to the seasonality of visitor-driven tax revenues and the timing of significant capital outlays. The unrestricted cash balance increased by $5.88 million from the fourth quarter of 2021-2022. Theincrease in unrestricted cash balance from the prior fiscal year is attributable to visitor-driven tax revenues and fees significantly exceeding pre-COVID revenues, as well as due to thetiming of significant capital outlays. The City expects to begin construction on several major capital projects, including the second phase of the Cabrillo Mole Ferry Terminal rehabilitationand the Five Corners Pedestrian Improvement project, during the next fiscal year which will reduce future unrestricted cash balances.

The restricted cash balance for the fourth quarter of 2022-2023 totaled $10.78 million, a decrease of $622 thousand from the third quarter of 2022-2023. The LAIF — Housing Authority account decreased by Si 06 million1 with $400 thousand transferred to the US Bank — Housing Authority fund, with Housing Successor funds previously held in the Housing Authority LAIF account for investment, and $750,000 to the US Bank General Account to reimburse for Housing Authority expenditures paid out of the US Bank General Account from Fiscal Year 2016-17 to Fiscal Year 2022-23. The remaining difference in the LAIF account is attributable to interest earned during the quarter. The increase in the Successor Agency Trustee Accounts is attributable to the timing of the Successor Agency’s Redevelopment Property Tax Trust Fund(RPTTF) payments rec&ved in June to cover debt service payments due in September 2023.

The increase in the City’s landfill trust account is attributable to the budgeted contributionmade in June 2023.

CITY OF AVALON CITY COUNCIL
MEETING DATE: August 1,2023 AGENDA ITEM: (p
ORIGINATING DEP: Public Works CITY MANAGER: hql.k
PREPARED BY: Robert Greenlaw, Public Works Director
SUBJECT: Wastewater Treatment Plant Backup Generator Procurement RECOMMENDED ACTION(S): Authorize the City Manager or his designee to procure a usedbackup generator in accordance with the City’s procurement standards for a not to exceed cost of $85,000.

REPORT SUMMARY: In April 2023 Montrose Engineering, Inc., identified that the backup generator at the City’s Wastewater Treatment Plant was non-operable.

After further evaluation, it was determined that the unit had reached the end of its useful life and it would be inefficient or impossible to facilitate repairs. Staff determined a replacement should be procured as soon as possible. A dependable primary and backup power source are essential to the function of the wastewater treatment facility. As a temporary stopgap measure, Staff located a rental portable generator for the facility to utilize. The cost of the rental is $6300 per month regardless of whether the generator is in use or not.

Ultimately, the generator is essential for operation and is due for replacement. This expenditure is identified in the wastewater treatment plant capital improvement plan and budgeted as part of the City’s annual Major Sewer Projects list for this year under CIP Project #205012.

Due to continued supply chain issues, lead times for new equipment may exceed one year. In order to facilitate a cost efficient replacement, Staff recommends procurement of a high quality, used, portable unit. The used generator would serve as an interim replacement at the wastewater treatment plant until a new permanent generator could be identified and procured.

As soon as a new generator is identified, this item will return to City Council for a formal procurement request. After a new generator is procured and successfully installed at the wastewater treatment facility, the used unit may be utilized citywide on a portable basis.

Staff recommends that the City Council authorize the City Manager or his designee to procure a used backup generator in accordance with the City’s procurement standards for a not to exceed cost of $85,000.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City will continue to incur monthly rental costs for a backup generator at the wastewater treatment facility while a permanent solution is identified and implemented.

FOLLOW UP ACTION: Implementation of City Council direction.

FISCAL IMPACTS: Undetermined. Expenditures budgeted in Sewer Capital Reserve Fund (#1085-6521 —CIP Project #205012).

CITY OF AVALON CITY COUNCIL
MEETING DATE: August 1,2023 AGENDA ITEM:

ORIGINATING DEP: Finance CITY MANAGER: tuVj
PREPARED BY: Matthew Baker, Finance Director
SUBJECT: Revised Fiscal Year 2023-2024 Miscellaneous Fee Schedule RECOMMENDED ACTION(S): 1. Hear a presentation regarding the Miscellaneous FeeSchedule. 2. Open the Public Hearing to hear public comments. 3. Close the Public Hearing. 4.

If consensus! adopt the fee schedule with revisions as proposed.

REPORT SUMMARY: The City charges fees for miscellaneous public services, use of City facilities and equipment rental and other activities. User fees are assessed and collected for City services and programs provided by various departments. These are services that convey abenefit, grant a privilege, provide for review and enforcement of regulatory activities, enforce laws, or are a condition of development. Under State law, cities may charge fees to recoup the direct and indirect costs related to the provision of user services.

Each year, the City reviews its fees to establish new fees, modify existing fees, and eliminate fees that are no longer required to ensure that City fees are in-line with the costs incurred to provide them. The City made a number of edits to the prior year’s fee schedule to better organize the grouping of fees. For example, the rental of City Hall Council Chambers has been moved from the Administration section to the Facility Rentals section of the document and a new section was created for vehicle-related fees. At the June 6, 2023 City Council Meeting, Council approved Staff’s recommendation increasing the majority of fees by 3.82%, with the fees rounded to the nearest dollar.

Upon further review of the adopted fee schedule, the following fees required further revisions as outlined below:
• Annual Lease Fees (Harbor) — Fee schedule adopted on June 6, 2023 applied CPI increase to FY22 annual lease rates rather than FY23 annual lease rates as intended Annual Lease Fees FY22 FY23 FY24 Adopted FY24 Proposed

• Special Events Permit (Community Services) — Fee was omitted from adopted fee schedule in error; Permit fee of $100 discounted by 50% for not-for-profit and governmental agencies
• Beach Permit — Four (4) Hour Maximum (City Facility Rentals) - Fee was omitted from adopted fee schedule in error; Rental fee of $200 discounted to $140 for residents, notfor-profits, and government agencies (similar to rental fee associated with Joe Machado Field half day rentals)
The revised tees have been highlighted in the proposed fee schedule attached.

GOAL ALIGNMENT: City costs will be offset by annual revenues.

FISCAL IMPACTS: Staff estimates that the new City fees, if adopted as proposed, should generate approximately $2,000 in the General Fund and $10,000 in Harbor Fund revenues.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The costs of specialservices will not be fully funded through fees paid by the users of those services. The unfunded portion of user services would then be subsidized by general tax revenues and/or available fund balances.

FOLLOW UP ACTION: Adopt the attached resolution establishing city rates and fees for services.

ADVERTISING, NOTICE AND PUBLIC CONTACT: Pursuant to the Brown Act.

ORIGINATING DEP: City Attorney CITY MANAGER: O.L&dA.

PREPARED BY: Scott Campbell, City Attorney
SUBJECT: Moratorium on the Issuance of Transient Rental Licenses for Transient Rental Use to New Applicants
RECOMMENDED ACTION(S): Approve by four-fifths City Council vote an urgency ordinance of the City of Avalon establishing a forty-five day moratorium on the issuance of Transient Rental Licenses for transient rental use to new applicants.

REPORT SUMMARY: The City of Avalon Municipal Code AMC”) allows for the issuance of a Transient Rental License (“TRL”) for transient rental uses (AMC § 3-1309). The City seeks to balance the desire of property owners to supplement their income and provide alternative lodging for visitors against the strain on available City housing stock that such transient rentaluses place on full-time Avalon residents and employees of Avalon businesses. Previously, transient rental uses were authorized with a Conditional Use Permit (‘CUP) under AMC § 8404. Following the adoption of a new ordinance, transient rental uses are now authorized through the issuance of a TRL under the code section above, AMC § 3-1.309. The TRLs do not run with the land and must be renewed annually.

Currently, the City is addressing all factors that negatively impact long term housing stock, with an emphasis on affordable housing, and has received complaints from properly owners of the negative impacts that result from living in close proximity to property that has been granted either a CUP or TRL for transient rental uses. Specifically, the City has received numerouscomplaints in the form of public comment about noise impacts, traffic impacts, and safety impacts to residents relating to issuance of CUPs and TRLs. A temporary moratorium of the issuance of TRLs for transient rental uses is immediately necessary to protect existing housing stock, and to allow City Council, City staff and the City Attorney time to study appropriate regulations to maintain public safety and health of the community. Additionally, the moratorium will temporarily halt further issuance of TRLs so that the City can identify regulations which ensure that issuance of TRLs does not undermine the City’s goals to have affordable housing stock and maintain a safe community.

The proposed moratorium will disallow the issuance of any TRLs to persons who submit an application following the effective date of this ordinance. The proposed moratorium will not prevent those who have already been issued a TRL or CUP from continuing to operate transient rentals under those entitlements. Applicants who submitted a valid application and paid the application fee for a TRL before the effective date of this ordinance may still have their applications heard before the Planning CommissionS There are only three (3) pending applications for a TRL at the time of this meeting. Given the low number of pending applications, and the applicants’ compliance with the City’s existing regulations, Staffrecommends allowing those applications to move forward, since those applicants may havealready incurred costs in preparing for transient rental use.

If the City Council does not approve the urgency ordinance establishing a forty-five day moratorium on the issuance of TRLs for transient rental use by a four-fifths vote, and nonurgency ordinance may be adopted after two readings and such ordinance would go into effect 30 days after adoption. If no moratorium is passed, TRLs will continued to be process under existing regulations until such regulations are changed.

FISCAL IMPACTS: None.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The Citys existing rules for the granting of transient occupancy licenses will remain in place.

ESTABLISHING A FORTY-FIVE DAY MORATORIUM ON
THE ISSUANCE OF TRANSIENT RENTAL LICENSES FORTRANSiENT RENTAL USE TO NEW APPLICANTS WHEREAS. the City of Avalon (“City”) permits private property owners to rent their homes to visitors on a short-term basis under Avalon Municipal Code (“Code”) Section 3-1310 upon Planning Commission approval of a Transient Rental License for transient rental use: and
WHEREAS. current holders of Conditional Use Permits for transient rental and Transient Rental License holders will conunue to he allowed to rent out their units during this moratorium; and
WHEREAS, thc City Council wishes to study whether there is diminishing housing stock, including affordable housing for full-time Avalon residents and employees of Avalon businesses, as a result of the number of private property owners that havereceived approval via a Conditional Use Permit or Transient Rental License for transient rental use; and
WHEREAS. the City Council wishes to study to what the degree the City has been saturated by Conditional Use Permits and ‘Iransient Rental Licenses issued for transient rental use: and
WHEREAS. the City has received numerous complaints from surrounding property owners regarding visitors utilizing property for which a Conditional Use Permit or Transicnt Rental License for transient use has been issued; and, WHEREAS. complaints received by the City suggest that the issuance of Conditional Use Permits or transient Rental Licenses for transient use na he responsible for street congestion. excessive noise resulting in loss of sleep to residents. traffic hazards. inability to access parking. and certain property crimes within the City. and WHEREAS. the City Council wishes to consider further regulation, consistent with its adopted LCP and General Plan, on how to properly and fairly address any proliferation of transient rentals within the City while recognizing the significant need forthe public to have recreational access to the coast; and WHEREAS. in order to adequately study the effects of additional Transient Rental Licenses issued for transient rental use. including the impacts on available housing stock for Avalon residents and employees of Avalon businesses, and whether the existing requirements and standards for transient rental use sufficiently protect surroundingproperty owners, it is necessary for the City Council to impose a forty-five day moratorium on the issuance of Transient Rental Licenses for transient rental usc; and WHEREAS. if additional Transient Rental Licenses are issued, available housing stock for residents may he eroded and impacts of transient uses will continue to increase.

WHEREAS. the moratorium, if adopted. will immediately temporardy halt the issuance of any new Transient Rental Licenses to those who apply afler August 1. 2O23 and
WHEREAS, there are cun’ently three (3) pending applications for TRLs. each applicant has undertaken significant steps to bring their application to the City in advance of this ordinance with the expectation that the City’s laws would remain in effect, so for purposes of fairness. the City Council intends that the moratorium not apply to those with pending applications for TRLs; and
WHEREAS. California Government Code Section 36937(b) authorizes the City Council to adopt by a four—fifths vote an urgency ordinance, effective immediately upon passage. if the ordinance relates to the “immediate preservation of the public peace. healthor safety” and such ordinance contains a declaration of the facts constituting the urgency.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AVALON
DOES ORDAIN AS FOLLOWS:

Section 1. Recitals. The recitals set forth above arc true and coriect and are hereby adopted as the urgency findings of the City Council in connection with the adoption of this urgency ordinance. In addition to the recitals stated above. the City Council hereby finds and determines that continued issuance of Transient Rental Licenses for transient rental use, without additional regulations, constitutes an immediate threat to the preservation of public peace. health, or safety until the impacts of Transient Rental Licenses on traffic, noise, safety to residents, housing availability, and housingaffordability arc properly studied. The adoption of this ordinance is necessary for the immediate protection of the public peace. health and safety.

Section 2. Purpose. The purpose of this urgency ordinance is to establish a forty-five day moratorium on the issuance of any new Transient Rental Licenses for transient rental use. until stteh time as the Avalon City Council can study the issue, and develop, clarify or amend Code requirements and standardsas it relates to transient rental use and its impact on City residents and property owners.

Section 3. Facts Constituting Urgency. Such a moratorium is immediately necessary for the preservation of the peace. health and safety of the residents of the Citx because:
(a) There is an immediate need to protect exisdng housing stockwithin the (‘it by ensitring transient rental use does not result in a lack of availability of housing in the City for those wishing to live in the City- long—term or for those who are employed in the Cit noting that those who commute to Catalina Island from the mainlandmust do so by boat; and (b) There is an immediate need to preserve availability of housing to ensure that. from a supply and demand perspective.additional transient rentals do not drive up the price of housing such that housing is unaffordable to its workforce. noting the need for the City to have housing which its workforcc can afford and noting recent increases in the cost of housing within the City: and (c) Transient Rental Licenses for transient rental use poses further public peace. health, and safety risk in that an overabundance of Transieni Rental Licenses for transient rental use may he responsible for street congestion. excessive noise resulting in loss of sleep to residents, traffic hazurds. inability to access parking. and certain property crimes within the City.

Section 4. MoratoriHm. The Planning Commission shall not issue any Transient Rental Licenses to any person who submitted a valid application and paid the application fee for a Transient Rental License following August 1.2023. however, those applicants who applied for a Transient Rental License before the effective date of this ordinance shall still be eligible to have such license issued b the Planning Commission during the moratorium.

Scetion 5. Hardship. Ihe Planning Commission may also consider, on a case-by-case basis and within its sole discretion, any application for Transient RentalLicenses for transient rental use otherwise banned by this moratorium where the applicant can demonstrate that the inability to receive a Transient RentalLicense tbr transient rental use during the time this moratorium is in place would cause the applicant undue hardship.
