CITY OF AVALON CITY COUNCIL
MEETING DATE; October 17, 2023 AGENDA ITEM: 3
ORIGINATING DEP: City Attorney CITY MANAGER: OLLLL
PREPARED BY; Scott Campbell, City Attorney
SUBJECT: Findings to Continue to Hold Remote Teleconference/Virtual City Council Meetings Pursuant to Assembly Bill 361
RECOMMENDED ACTION(S): Reconsider the circumstances of COVID-1 9 state of emergency proclaimed by the Governor and COVID-19’s continued impact and determine that state or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19, and as such, that continuing to utilize the protections of Assembly Bill 361 will protect the health and safely of attendees.

REPORT SUMMARY: Traditionally, the Brown Act allows for teleconference or virtual meetings, provided that the physical locations of the legislative body’s members joining by teleconference are posted on the agenda, that those locations are open to the public and that a quorum of themembers is located within its jurisdiction. AB 361 provides an exception to these procedures in order to allow for fully virtual meetings during proclaimed emergencies, including the COVID-19pandemic.

Since March of 2020 and the issuance of Governor Newsom’s Executive Order N-29-20, which suspended portions of the Brown Act relating to teleconferencing, the City Council has had virtual meetings without having to post the location of the legislative body members attending virtually.

Most public agencies have been holding public meetings using virtual platforms since this time.In June of 2021, Governor Newsom issued Executive Order N-08-21, which provided that the exceptions contained in EQ N-29-20 would sunset on September 30, 2021.On September 10, 2021, the Legislature adopted AB 361, which allows public agencies to hold fully virtual meetings under certain circumstances without the posting of the agenda from each location a legislative body member is attending. Governor Newsom signed the bill into law on September 16, 2021. Because it contained an urgency provision, it took immediate effect.

Specific Findings Required underAB 361
As the State of Emergency has ended, the City Council can continue to hold virtual meetingswithout providing notice of the City Council’s teleconference location if the City Council makes the following two findings:

1. State or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19; and

2. The City Council reconsiders the circumstances of the state of the emergency and danger presented by CDVI D-19;
65059.00000\3452048 1.1
Having made the findings, the City Council can continue every 30 days to authorize meetings under AS 261 to protect the health or safety of attendees.

CCVI U-i 9 continues to present a threat to the health or safety of members of the public. Although vaccines are now widely available, many people in the State and County are still not fully vaccinated and remain susceptible to infection. The disease can still spread through person-toperson contact and those in close proximity. According to the most recently published data, 8% of those tested statewide for Covid-1 9 tested positive, down slightly from last month’s rates still too high. Covid-19 Hospitalizations are still too high, with a daily average of 314 persons each day. An average of 18 people in California die each day due to Covid-19, that is more than noted in the last report to the City Council.. Additionally, Cal/OHSA has implemented COVID-19Prevention Non-Emergency Regulations that will remain in effect until February 3, 2025. The City’s economy is dependent upon visitors to the island, the presence of which increases the likelihood of transmission of the disease. Also, having members of the public attend council meetings at locations where council members are in attendance due to their desire to avoid exposure to CDVI D-19 poses a risk to the health or safety of affendees.

Re-Authorization is Required Within 30 Days
The City Council made the required findings at its October 3, 2023 City Council meeting.

Consistent with the provisions of AS 361, the new findings must be made every 30 days. Thus,if the City Council desires to continue to meet remotely without having to post the location of each teleconference location, the City Council reconsider the facts of the state of emergency and continued impact of COVID-19, find that state or local officials have imposed or recommendedmeasures to promote social distancing in connection with COVID-19, and therefore, that remote meetings under AB 361 should continue in order to protect the health or safety of attendees.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City Council will have to follow the Brown Act provisions that existed prior to the COVID-1 9 pandemic.

FOLLOW UP ACTION: That the City Council make the findings under AB 361 at its November7, 2023 City Council meeting.

In 2022, Los Angeles County conducted a pilot program offering Online Candidate Statement Service. The County felt the Online Candidate Statement Service wassuccessful and is making the offering available for cities and schools to utilize for the March 5, 2024 Presidential Primary Election.

Jurisdictions now have the option to aHow candidates to have statements posted on the Registrar-Recorder/County Clerk’s website at lavote.gov without being printed in the Official Sample Ballot Booklet. The cost for candidate statements only published online is $279.60.However, Los Angeles County is offering complimentary online publication of candidate statements when a candidate opts to have their statement included in the Official Sample Ballot Booklet. Due to Avalons small voter registry, printing a candidate statement in the Official Ballot Booklet costs $200.

The City Council. by resolution, may authorize an option for Online Candidate Statements in lieu of a printed statement, or may authorize the publication of both.

The City Council must decide whether candidates or the City will pay for the translation and/or publication of the candidate statements, if the statements will appear online only, or both online and within the Official Sample Ballot Booklet, as well as determine the maximum length of candidate statements.

City Staff recommend adopting a resolution authorizing an option for Online Candidate Statements as well as printed in the Official Ballot Booklet, requiring candidates to pay for the translation and publication of the candidate’s statements, and limiting statements to 200 words.

FISCAL IMPACTS: The cost of holding an election, based on an estimate acquired fromLos Angeles County is $17,000.00 at minimum, not including legal costs associated with development of measures. CITY OF AVALON CITY COUNCIL
MEETING DATE: October 17, 2023 AGENDA ITEM: 5
City Clerk CITY MANAGER:

PREPARED BY: Gabriefle Morones, Deputy City Clerk/Sr. Admin. AssistantSUBJECT: Process in the Event of a Tie Vote at the March 5, 2024 Avalon Municipal Election
RECOMMENDED ACTION(S): 1. Determine appropriate action to take in case of a tie vote in the Avalon Municipal Election on March 5, 2024. The City Council may either: a) Adopt resolution providing for a Special Runoff Election in the event of a tie vote, or b) Do not adopt resolution and allow tie to be decided by lot. 2. Determine if the selected method should apply specifically to this election only, or to all subsequent elections until the City Council determines otherwise REPORT SUMMARY: Elections Code §15651 provides that unless the City Council adopts a resolution providing for a Special Runoff Election in the event of a tie vote, then tie votes are to be decided by the election board (the City Clerk and two designees) by lot (such as the flip of a coin). If the City Council decides to conduct a Special Runoff Election, it must decide whether this decision applies to only this election or to future elections until the City Council decides otherwise.

Historically the City Council has chosen to allow, on an election-by-election basis, that a tie vote be determined by drawing lots.

If the City Council decides to require a Special Runoff Election the election cannot be consolidated with Los Angeles County and therefore could exceed the cost of a regular, consolidated election. At the time this report was authored, City Staff had not yet received an estimate for a Special Runoff Election from Los Angeles County; however, based on previous election costs believe the sum will be in excess of $30,000. This is in addition to the cost of the regular General Election on March sthFISCAL IMPACTS: Dependent on City Council action.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: N/A
FOLLOW UP ACTION: Implement City Council direction.

CITY OF AVALON CITY COUNCIL
MEETING DATE: October 17, 2023 AGENDA ITEM:

ORIGINATING DEP: Public Works CITY MANAGER: _)\AM
PREPARED BY: Robert Greenlaw, Director of Public Works
Devin Hart, Management Analyst
SUBJECT: Avalon Wastewater Treatment Plant SDW 352 Screw Press Replacement Equipment Procurement
RECOMMENDED ACTION(S): 1. Make the affirmative finding that CCI Chemical Corporation is a sole source provider of a SDW 352 Screw Press as defined by the Avalon Municipal CodeSection 3-4111(b); and 2. Authorize the procurement of supplies, equipment and services for the replacement of the Avalon WWTP SDW 352 Screw Press Replacement for a not to exceed cost of $150,000.00.

REPORT SUMMARY: The City’s wastewater treatment plant operator, PERC Water Corporation (PERC), is completing major infrastructure repairs throughout the City’s Waste Water Treatment Plant (WWTP). These repairs include establishment of redundant operational systems that will allow for occasional mechanical failures without creating any interruptions in system operations.

At this time, there is no screw press in operations at the WWTP. The processing of solids within the plant is managed through the operation of a centrifuge system. Due to the high level of salinity within the waste product (due to the usage of saltwater toilets), the waste material is treated with additive chemicals as well as a high volume of potable water. Installation of a screw press system will allow for the centrifuge to work as a secondary redundancy system.

Utilizing a screw press to treat solids within the WWTP will alleviate the usage of some chemicalsas well as reduce the amount of potable water necessary to break down the materials.

Additionally this technology, and overall maintenance of this system, can be performed by current plant personnel and will not require specialized contractors/vendors.

City Staff met to see a demonstration of a screw press system in Vernon, California. Staff were impressed by the systems efficiency and arranged for a smaller level system to be implementedlocally for a trial period. During the trial period, City and PERC Staff were impressed with overall operations.

City Staff worked with PERO to identify CCI Chemical Corporation as a potential vendor for the SDW 352 Screw Press System. CCI Chemical Corporation confirmed that their firm is the solemanufacturer of the SDW 352 Screw Press System. As such, the City’s procurement policy provides for a sole source acquisition under AMC Section 3-4111 -Exceptions from Bidding and Other Competitive Procedures, (b) Sole Source Vendors:

When there is only one source that provides the necessary public project, senjices, goods and equipment to ensure compatibility with existing City public projects, se,’vices, goods or equipment, or the public project, se,vices, goods or equipment are proprietaiy in nature, the City may procure the public project, goods or seivices from the sole source.

CCI Chemical Corporation provided a proposal to the City of Avalon for $124380 to include dehvery and 3 days of onsite training for staff. The proposal provided by CCI Chemical Corporation does not include installation of the system. The system will be installed by PERC.

GOAL ALIGNMENT: Infrastructure reliability and safety.

FISCAL IMPACTS: Capital Project #205012 was approved by City Council in the 2023-24 budget and sufficient funding remains to implement the project CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: There will be no redundancy system for the WWTP centrifuge system.

FOLLOW UP ACTION: Direct City Staff to procure the supplies, equipment and services; and implement the project.

ADVERTISING, NOTICE AND PUBLIC CONTACT: This item was properly listed on the posted agenda pursuant to the Brown Act.

ATTACHMENTS: CCI Chemical Corporation SDW 352 Screw Press System Overview and Quote.

In most facilities over 80% of all wastewater treatment costs are directly tied to the sludge. These expenses including holding sludge, hauling the sludge and finallydisposal.

This Sludge Dewatering Machine features a slow-speed, low-wear screw within unique multi disc dewatering cylinder. The cylinder assembly is comprised of precision-made fixed, moving rings and screw shaft. When the washers (rings) are moved by the eccentric auger inside the tube a very narrow gap between the washers allows only the liquid excreted from the sludge to escape. The gap is too fine and does not allow the thickened sludge inside the cylinder to pass through.

Process Description
• Sludge is pumped from client process into the CCI Screw Press flocculation tank in accordance with manufactures instructions.
• The sludge is then gravity-fed into the dewatering screws and cylinders. As sludge moves up the screws, the pitch of the screws reduce and the shaft flareswhich amplifies sludge dewatering. • The water removed from the sludge (Filtrate) flows out of the cylinders falling directly into the filtrate chamber of the CCI Screw Press unit. The filtrate can then be drained to
a location of the clients choosing.
• The dewatered sludge is then driven through
a compression plate at the end of
the cylinder. The compression plate is adjustable and is set to create a plug
allowing the sludge to be further pressed into
a dewatered cake. Once the dry
sludge clears the end plate it falls down the chute into a client’s bin or conveyor
for disposal.

Advantages of
a screw press compared to other dewatering technologies:
• Extremely low power consumption (approx. 90% less than centrifuges). • Produces high-quality filtrate, which may not need to return to the head works (i.e. high solids recovery).
• Low noise and odor.
• Processes oily sludge.
• Low operational costs.• Simple labor-free operations and stress-free, low-labor maintenance. • Increases process stability (wasting can occur over long periods of time or several times daily).

CITY OF AVALON CITY COUNCIL
MEETING DATE: October 17, 2023 AGENDA ITEM: 7
ORIGINATING DEP: Administration CITY MANAGER: 1)IL1L(.

PREPARED BY: David Maistros, City Manager
Devin Hart, Management Analyst
SUBJECT: Transit Request for Proposals
RECOMMENDED ACTION(S): Authorize the City Manager or his designee to develop and solicit a request for proposals from qualified firms to provide public transportation services within the City of Avalon.

REPORT SUMMARY: During the February 21, 2023 regular City Council Meeting, the CityCouncil directed the City Manager to extend the contract with Transportation Concepts (TC), theCitys contracted public transit provider, for a one-year term to allow Staff time to determine next steps for the City’s public transportation program. The contract with TC will expire on March 31, 2024.

City Staff has developed a request for proposals from qualified firms/operators to provide public transportation services within an approximate 1 square mile area of Avalon. The goal of the operation is to improve transportation and wayfinding for Avalon’s approximately 1 million annual visitors and its 3,500 year round residents, as wefl as alleviate congestion and demand for onstreet parking in Avalon’s ‘downtown” area.

The City annually applies for Proposition A (Prop A) Incentive Funds through the Los Angeles County Metropolitan Transportation Authority (Metro). The City has received $1,000,000 in Prop A funds annually over the last several fiscal years with $700,000 earmarked for the commuter subsidy program, and $300,000 earmarked for the City’s land transit system. In addition to theseannual funds, the City received an additional $586,412 in ARPA Act equivalent Program Funds through Prop A to support transit programs impacted by the COVID-19 Pandemic. On May 16, 2023, the City Council authorized spending the extra sums to offer a one-time increase to thecommuter subsidy as well as add additional funding to support land transit improvements.

City Staff determined the best use of the additional land transit funding would be to invest in the transit fleet. On June 27, 2023 the City Council authorized the purchase of five (5) E6 GEM LSV vehicles, charging infrastructure and digital sign boards to support the development of a microtransit program. On September 5, 2023, the City Council authorized the purchase of one (1) 2022 Ford E-Transit 350 (12 passenger) electric van, and one (1) 2022 Ford E-Transit 350 (7+1passenger) electric van.

The new fleet is scheduled to be on island by early 2024. The City will provide overnight parking and charging facilities for these vehicles.

The City is asking prospective bidders to develop a micro-transit program to include an on demand point-to-point, fixed route and DAR transit offerings. The goal is for all offerings to beavailable to the public for little to no charge. At minimum, the City is requiring the on demandpoint-to-point system and DAR services be available seven (7) days a week with fixed route supplementing operations on busy, high-passenger days.

The City’s annual transit contract is budgeted at $750,000. The potential bidder may develop alternative revenue streams, including but not limited to advertising within the vehicles, sponsorships for extended hours of service, etc.

The prospective operator will be required to oversee all areas of day-to-day operations, fleet and facility management/maintenance as well as meet the reporting requirements established by Metro and the City.

The proposed timeline for the REP is as follows:
