CITY OF AVALON CITY COUNCIL
MEETING DATE: November 7, 2023 AGENDA ITEM:
ORIGINATING DEP: City Attorney CITY MANAGER:
PREPARED BY: Scott Campbell, City Attorney
SUBJECT: Findings to Continue to Hold Remote Teleconference/Virtual City Council Meetings Pursuant to Assembly Bill 361
RECOMMENDED ACTION(S): Reconsider the circumstances of CCVID-1 9 state of emergencyproclaimed by the Governor and CCVI D-19’s continued impact and determine that state or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19, and as such, that continuing to utilize the protections of Assembly Bill 361 will protect the health and safely of attendees.
REPORT SUMMARY: Traditionally, the Brown Act allows for teleconference or virtual meetings.provided that the physical locations of the legislative body’s members joining by teleconference are posted on the agenda, that those locations are open to the public and that a quorum of themembers is located within its jurisdiction. AS 361 provides an exception to these procedures inorder to allow for fully virtual meetings during proclaimed emergencies, including the COVID-19pandemic.Since March of 2020 and the issuance of Governor Newsom’s Executive Order N-29-20, which suspended portions of the Brown Act relating to teleconferencing, the City Council has had virtual meetings without having to post the location of the legislative body members attending virtually.
Most public agencies have been holding public meetings using virtual platforms since this time.
In June of 2021, Governor Newsom issued Executive Order N-08-21, which provided that the exceptions contained in EO N-29-20 would sunset on September 30. 2021.
On September 10, 2021, the Legislature adopted AB 361, which allows public agencies to hold fully virtual meetings under certain circumstances without the posting of the agenda from each location a legislative body member is attending. Governor Newsom signed the bill into law on September 16,2021. Because it contained an urgency provision, it took immediate effect.
Specific Findings Required under AS 361
As the State of Emergency has ended, the City Council can continue to hold virtual meetings without providing notice of the City Council’s teleconference location if the City Council makesthe following two findings:
1. State or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19; and
2. The City Council reconsiders the circumstances of the state of the emergency and danger presented by CCVID-19;
65059.00000\3452048 I I
Having made the findings, the City Council can continue every 30 days to authorize meetings under AB 261 to protect the health or safety of attendees.
COVID-1 9 continues to present a threat to the health or safety of members of the public. Although vaccines are now widely available, many people in the State and County are still not fullyvaccinated and remain susceptible to infection. The disease can still spread through person-toperson contact and those in close proximity. According to the most recently published data, 6.5%of those tested statewide for Covid-19 tested positive, down from last month’s rates but still too high and higher than it was in July, when the rate was 8.7%. Covid-1 9 Hospitalizations are still too high, with a daily average of 268 per day. An average of 17 people in California die each daydue to Covid-19, the same rate as the last report.
Additionally, Cal/OHSA has implemented COVI D-1 9 Prevention Non-Emergency Regulations that will remain in effect until February 3, 2025. The City’s economy is dependent upon visitorsto the island, the presence of which increases the likelihood of transmission of the disease. Also, having members of the public attend council meetings at locations where council members arein attendance due to their desire to avoid exposure to COVID-19 poses a risk to the health or safety of attendees.Re-Authorization is Required Within 30 Days The City Council made the required findings at its October 17, 2023 City Council meeting.
Consistent with the provisions of AB 361, the new findings must be made every 30 days. Thus,if the City Council desires to continue to meet remotely without having to post the location of each teleconference location, the City Council reconsider the facts of the state of emergency and continued impact of COVID-19, find that state or local officials have imposed or recommended measures to promote social distancing in connection with COVID-19, and therefore, that remotemeetings under AB 361 should continue in order to protect the health or safety of attendees.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City Council will have to follow the Brown Act provisions that existed prior to the COVID-1 9 pandemic.FOLLOW UP ACTION: That the City Council make the findings under AB 361 at its November 28, 2023 City Council meeting.GOAL ALIGNMENT: N/A

MEETING DATE: November 7, 2023 AGENDA ITEM: AL,
ORIGINATING DEP: Finance CITY MANAGER: Ü(At*..PREPARED BY: Matthew Baker, Finance Director SUBJECT: Fiscal Year 2023-2024 First Quarter Treasurer’s Report RECOMMENDED ACTION(S): Adopt a resolution accepting the FY23-24 First Quarter Treasurer’s Report.
REPORT SUMMARY: State and Municipal Codes require the Treasurer to submit within30 days following each fiscal quarter a report summarizing the City’s cash and investmentbalances. Attached is the First Quarter Treasurer’s Report for FY23-24. The report was shared with the City Treasurer prior to presentation to City Council.
The purpose of the report is to inform, on a quarterly basis, the City’s cash and investment balances, the investment types, yields, and market values, and to ensure that the City’s investments are in compliance with the City’s adopted investment policy. The report shows that all of the City’s funds are in compliance with its investment policy. In general, operating cash is held in US Bank checking accounts and any excess cash is invested in California’s Local Agency Investment Fund (LAIF) and various certificates of deposit (CD5). In accordance with Government Code sections 16429.1 and 53601 et seq., the City cannot invest more than 30% of its portfolio in CDs. CDs accounted for 17.3% of the unrestricted cash and investments for the quarter ended September 30, 2023. On July 26, 2023, the City purchased $5125 million of United State Treasury Bills maturing on January 25, 2024 with a yield to maturity of 5.265% using funds previously held in LAIF. The investment will yield the City approximately $50,000 policy.
The unrestricted cash balance for the first quarter of 2023-2024 totaled $23.27 million, an increase of $2.11 million from the fourth quarter of 2022-2023. The unrestricted cash balanceincludes cash from enterprise funds (e.g. Sewer, Saltwater, and Solid Waste) not available for general government functions. The increase in unrestricted cash is attributable to theseasonality of visitor-driven tax revenues and the timing of significant capital outlaysanticipated to increase during the second and third quarter of the fiscal year. The unrestrictedcash balance increased by $4.62 million compared to the first quarter of 2022-2023. The increase in unrestricted cash balance from the prior fiscal year is attributable to visitor-driven tax revenues and fees again significantly exceeding pre-COVID revenues, as well as due tothe timing of significant capital outlays. The City expects to begin construction on several major in additional investment income overLAIF over the same period. The Cityinvestment returns while maintaining the six month period compared to holding the funds in
will continue to assess for opportunities to increase its necessary liquidity and compliance with its investment
capital projects, including the second phase of the Cabrillo Mole Ferry Terminal rehabilitation and the Five Corners Pedestrian Improvement project, during the fiscal year which will reduce future unrestricted cash balances.
Below is a chart comparing unrestricted cash balances from the first quarter of Fiscal Year 2015-2016 to the current fiscal year.
Unrestricted Cash Balance
The restricted cash balance for the first quarter of 2023-2024 totaled $9.34 million, a decrease of $1.44 million from the fourth quarter of 2022-2023. The decrease is largely attributable to the decrease in the Successor Agency Trustee Accounts as the Successor Agency’s Redevelopment Property Tax Trust Fund (RPTTF) payments are received in June used to service debt payments made in September 2023.GOAL ALIGNMENT: Required disclosures.

CITY OF AVALON CITY COUNCIL
MEETING DATE: November 7, 2023 ADENDA ITEM: 5ORIGINATING DEP: Administration CITY MANAGER: tàW[kJ( PREPARED BY: Devin Hart, Management Analyst
SUBJECT: Avalon Kids Baseball Lease
RECOMMENDED ACTION(S): Authorize the City Manager to enter into a lease agreement with Avalon Kids Baseball to store a storage shed at Joe Machado Field.
REPORT SUMMARY: City Staff were contacted by representatives from Avalon Kids Baseball, a local non-profit organization that manages the local little league, regarding potentially leasing storage space on City property. Avalon Kids Baseball had previously utilized a storage container located on the Avalon Schools campus to house their various supplies — uniforms, balls, gloves, bats, etc. Due to construction at Avalon Schools, Avalon Kids Baseballhas been asked to relocate their storage.
After conferring with City Staff, Avalon Kids Baseball agreed a smaller storage shed located at Joe Machado Field (JMF) would be an appropriate space.
Avalon Kids Baseball will purchase an 8 foot by 20 foot plastic storage shed. The shed will be positioned between the bathrooms and dugout on the southeasterly portion of the bricked area at JMF.
Staff recommend the City Council authorize the City Manager to enter into a lease agreement with Avalon Kids Baseball for the proposed 160 square foot storage space for $1 per year as is consistent with the City’s treatment of other non-profit lessees. The proposed lease will include all other terms consistent with the City’s standard lease template including the insurance requirements.
FISCAL IMPACTS: Undetermined.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: Avalon Kids Baseballwill not have a location to store supplies.
FOLLOW UP ACTION: Implement City Council direction.
ADVERTISING, NOTICE AND PUBLIC CONTACT: Pursuant to the Brown Act.

This item appeared on the November 2, 2023 Special City Council Meeting agenda at the collective request of the City Council. The requested changes were incorporated into the first reading of the ordinance and are contained in the ordinance to be adopted. At the November 2, 2023, meeting, the importance of the health, safety and welfare of City residents and visitors was discusses and many public comments in support of the ordinance were received.
During the October 17, 2023 regular City Council Meeting, the City Council heard a publicpresentation from the Catalina Island Conservancy regarding the planned Catalina IslandRestoration Project. During the same meeting, Council heard approximately two hours of public comments from 28 different speakers regarding the proposed Restoration Project and, specifically, the planned eradication of the island’s deer population — the majority spoke against the project. After thoughtful consideration, members of the City Council contacted City Staff and the CityAttorney’s office to request an amendment to the Avalon Municipal Code to more specifically address, strengthen protections, and prohibit hunting, trapping, feeding, luring, inhumane treatment, and killing of wild animals — including deer — within the City of Avalon.
In revising and clarifying the Municipal Code, the City Council makes the determination thathunting, pursuing, feeding, killing, or trapping animals within the City represents a threat to publichealth, safety, and welfare to the residents and visitors within the City of Avalon. Additionally, City Council makes the determination that the feeding, luring, pursuing, or trapping of wildanimals for the purposes of capturing and/or killing such wild animals can be cruel and abusive to such animals and inconsistent with the residential, recreational, and visitor-friendly nature ofthe City. Feeding wildlife can lead to overpopulation, the spread of diseases, and altered natural behaviors. Additionally, hunting and trapping within City boundaries poses significant safety risks to residents and visitors, and raises a plethora of ethical and environmental concerns. Hunting and trapping within city limits could cause death, accidents, or harm to residents and visitors alike, and ensures human safety. Trapped animals could harm residents and visitors, as frightened animals can become aggressive in their attempts to escape. Frightened animals can also move quickly and without warning, causing car or bike accidents, at times fatal. Even whenexercising the highest degree of care, hunting can pose a risk to residents and visitors of Avalonas it is densely populated, and the use of firearms for hunting purposes is incompatible with this densely-populated area. To address these issues, an ordinance disallowing the feeding, trapping, pursuing, killing, and hunting of animals within city limits has been proposed. The proposed ordinance establishes penalties for non-compliance including fines of up to $5,000 per occurrence.
The ordinance also provides exemptions for emergency action taken by trained authorized personnel to euthanize an animal found severely injured within the City as well as exemptions for trapping feral cats and dogs for the purpose of spayed or neutering. There is also anexception for bird feeders located on private property.
ENVIRONMENTAL REVIEW: The ordinance is not a project subject to the CaliforniaEnvironmental Quality Act (“CEQA”) pursuant to Section 15378 (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) of the State CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential forresulting in physical change to the environment, directly or indirectly. Additionally, the ordinanceis exempt under CEQA pursuant to Guidelines Section 15061(b)(3) (there exists no possibility that the activity will have a significant adverse effect on the environment) because this ordinancewill not cause a change in any of the physical conditions within the area affected by the ordinance. No development would result from implementation of the ordinance. The ordinancepreserves the status quo and avoids the potential for accidents related to hunting and use of firearms within a densely-populated area. The ordinance prohibits hunting within City limits, andwould not result in an increase in deer population, as it also prohibits feeding wildlife which could lead to overpopulation. The ordinance avoids indirect impacts related to hunting within City limits as the prohibition on hunting would avoid noise impacts, potential water quality impacts related to bullets, and other health and safety impacts related to firearm-related accidents. Theordinance does not result in any indirect impacts on the environment related to overpopulationof wild animals, including mule deer, as it is strictly limited to City limits and hunting may continueoutside of the City.
FISCAL IMPACTS: Undetermined.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The Avalon MunicipalCode will not be amended.
FOLLOW UP ACTION: Implement City Council direction.

TITLE 6, CHAPTER 6-1, SECTION 6-1.128 ANIMAL CAREOF THE AVALON MUNICIPAL CODE AND ADOPTION OF EXEMPTION FINDINGS UNDER THE CALIFORNIAENVIRONMENTAL QUALITY ACT.
WHEREAS, the Council has determined that hunting, pursuing, killing, or trapping of animals within the City of Avalon (“City’) represents a threat to public health and safety within the City; and,
WHEREAS, even with the exercise of the greatest level of care, discharge of firearms can result in loss of human life and the City is a highly-populated area; and WHEREAS, hunting, pursuing, killing, or trapping of animals are activities incompatible with the densely-populated areas of the City and pose safety hazards to residents and visitors in the City; and
WHEREAS, the Council has determined that the feeding, luring, or trapping of wild animals for the purposes of capturing and/or killing such wild animals can be cruel and abusive to such animals and inconsistent with the residential, recreational, and visitor-friendly nature of the City; and
WHEREAS, the Council has determined there is a need to ban any feeding of wild animals within City limits because feeding makes such animals dependent upon humans for their nourishment, may result in inappropriate diets for such animals, draws such animals into residential and urban areas which is inconsistent with their natural habitat, and creates a danger to such animals and/or to the City’s residents and visitors due to the natural behavior and disposition of wild animals; and WHEREAS, the specific purpose of the following amendments to the Municipal Code will have a primary public health and safety impact, with only an incidental effect on hunting; and

CITY OF AVALON CITY COUNCIL
MEETING DATE: November 7, 2023 AGENDA ITEM:
ORIGINATING DEP: Administration CITY MANAGER: ct2t<
PREPARED BY: Robert Greenlaw, Public Works Director
SUBJECT: Declaration of Exempt Surplus Property Pursuant to Government Code Section 54221 (f))(1)(B) — ‘Southwesterly 2 Feet” of Tremont Avenue
RECOMMENDED ACTION(S): (1) Adopt a resolution declaring the approximate 102 square foot area of land identified as the “southwesterly 2 feet” on sheet 4 of 11 of theCity’s Encroachment Survey as surplus; and (2) Authorize the City Manager or his designee to sell the property, in accordance with the City’s policy, to the adjacent landowners — Cow Hoyt and George Paquette.
REPORT SUMMARY: During a Closed Session of the May 16, 2023 City Council Meeting, the City Council considered real property negotiations regarding a portion of thepublic right of way located along Tremont Street and hereby referred to as the “southwesterly 2 feet”. The approximate 102 square foot area of land was first identified as the southwesterly 2 feet” in the 1937 grant deed when this portion of land was acquired by the City of Avalon from the property owner.
Control of this parcel is important to the City as it provides a needed setback of the existing building to the public right of way. That being said, the function of the existing access to the adjacent building is problematic, and the owner of the adjacent propertydesires to construct a fence to help with the building’s security.
Staff has determined that access/control of the property and establishing security can beaccomplished through the sale of the parcel back to the adjacent property owner and placement of a restriction on the deed that no building can be built on the parcel, except those elements specifically allowed in the side yard setback prescribed by the Avalon Municipal Code.
The intent of this sale is to sell the parcel conveyed by the 1937 grant deed back to the property owner. The parcel is described in the deed as:
LOT 26 AND THE SOUTHWESTERLY, TWO FEED OF LOT 27, BLOCK 20, OF
THE OFFICIAL MAP OF THE CITY OF AVALON, IN THE CITY OF AVALON, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, AS PER BOOK 1, PAGES 31 TO 46 OF OFFICIAL MAPS, IN THE OFFICE OF THE COUNTYRECORDER OF SAID COUNTY. EXCEPTING THEREFROM THE SOUTHWESTERLY 2 FEED OF LOT 26 AS CONVEYED TO THE CITY OF AVALON BY DEED RECORDED JULY 27, 1937, IN BOOK 15135, PAGE 1324 OF OFFICIAL RECORDS.
In August 2022, the property was appraised at a value of $11,000 to $16,000. A subsequent negotiation with the adjacent property owner resulted in an offer of $16000.
Historically, when City Staff determine a City asset is no longer useful or insufficient for current needs, the City Council will be presented with the list of items and declare it issurplu& Then the item is either sold, given to charity or otherwise disposed of.
Pursuant to Government Code Section 54221(fl(1)(B) a property that is less than 5Q00square feet in area and is not contiguous to land owned by a state or local agency that is used for open space or affordable housing is exempt surplus land if sold to the contiguous owner. This property meets the criteria of Section 54221(f)(1)(B).
FISCAL IMPACTS: Surplus property will be sold in a process to ensure fair value. If proceeds of the sale exceed $5,000 then the proceed will be recorded as a gain to offset the book loss of the disposed asset.
GOAL ALIGNMENT: City Infrastructure.CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION; The“southwesterly 2 feet” of property on Tremont Avenue will continue to exist as is.
FOLLOW UP ACTION: Implement City Council direction.

EXECUTIVE SUMMARY
EXECUTIVE SUMMARY
BackgroundNestled on Santa Catalina Island, Avalon is a unique city that holds the distinction of being the only incorporated city on the island. This charming city is renowned for itspicturesque setting, combining natural beauty with a touch of coastal allure.
The population size can vary due to seasonal tourism and the fact that it is a resortcommunity, however it is estimated that there are about 3,460 residents.
The population ofAvalon is influenced by several factors, including the number of residents who live there year-round, seasonal workers, and the influx of tourists, especially during peak vacation times. The city’s population might experience fluctuations, with more people during tourist seasons and potentially fewer during off-peak times.
Avalon’s community is known for its close-knit atmosphere, and the residents often engage in activities that reflect the island lifestyle. The City of Avalon: Governance structure Avalon’s municipal government follows the council—manager model. The Mayor is elected for a two-year term, and City Council Members serve four-year terms. The City Council directly appoints the City Manager, who acts as the city’s executive officerPurpose The City of Avalon actively pursues state and federal grant opportunities to assist with City identified unfunded projects and programs. Many funding agencies utilize USCensus income data to determine grant eligibility and funding reimbursement levels.
The City of Avalon Median Household Income (MHI), per the 2021 US Census American Community Survey 5-Year Estimates, is $77,644 (+1- $18,531). City staff believes this does not accurately capture the City of Avalon’s true MHI.In 2023, the City of Avalon, California, partnered with Zilo International Group, LLC, to complete a new survey to better capture the City’s MHI for future grant applicationsand funding considerations.

ENGAGEMENT PROCESS
Zilo team collaborated closely with the City of Avalon to formulate survey questions and design social media content and outreach strategies. Additionally, the City created a page on their website to keep the community informed about ongoing activities and guide them to the necessary resources for participation.
Various methods were employed to gather survey responses, encompassing online submissions, mailed responses, and in-person interactions to help ensure a statistically significant sample of Avalon’s population.Survey InstrumentThe survey followed CDBG guidelines and asked for the household’s approximate annualincome. Given the various participation methods, we included an address request tosafeguard against duplicate responses from the same household, enhancing the survey’s dataintegrity. Additionally, obtaining addresses served the dual purpose of confirming therespondent’s residency in Avalon, providing an added layer of authenticity to the collected data. Our commitment to respondent privacy was paramount, and we communicated transparently about how the data would be used, assuring participants that their informationwouldn’t be shared beyond the research team. The survey covered various other aspects, including the number of residents in the household, immediate family members residing together, homeownership or renting status, and whether the residence is employer-subsidized. Additionally, we inquired about the duration of their residency in Avalon, employment details, health coverage, internet access, transportationmodes, ferry frequency to the mainland, and demographic information.
To cater to a diverse audience, the survey was provided in both English and Spanish. Each survey packet included a cover letter in both languages explaining the survey’s purpose, English and Spanish versions of the two-page survey, and a stamped return envelope with the address. For reference, samples of the survey documents can be found in Appendix A.
Survey DistributionSurveys were mailed to reach every household with a PC Box on the island the week of August 14th, 2023. Due to Avalon’s mail system limitations, where mail is not delivered to street addresses, residents engaged in mail transactions are required to secure a post office box. Each survey package included Spanish and English translations, along with a stamped return envelope. The accompanying cover letter included information about the survey andprovided a link to the online survey and a QR code for those who preferred internet-basedresponses.
An online survey was available to cater to households favoring online participation. It commenced on Monday, August 21, 2023,This was complemented by a comprehensive inperson approach, including a door-to-door survey and designated stations at the Post Officeand local grocery store which began on Sunday, September 10, 2023, and extended through Thursday. This multichannel strategy guaranteed that every resident had at least one opportunity to participate in the survey in either English or Spanish. This methodology was designed to facilitate inclusivity and gather comprehensive data from the permanent resident population.
Avalon 2023 Community Wide Income Survey I 7
Survey Responses and Data Analysis
A grand total of 635 surveys were gathered, with 204 received via mail, 161 submitted online, and 270 conducted through door-to-door efforts. Among these, 65 were in Spanish, and 570 were in English.Acknowledging the notable presence of second homes and short-term rentals with temporary occupants in Avalon, these units were purposely omitted from the survey. The main objective was to collect information about permanent residents. Respondents who identified as living in Avalon for less than four months annually were also not included in the overall report results.
To be deemed valid, surveys needed both a valid address and income information.
Every survey underwent validation and was subsequently included in the final tabulations. Out of these, 451 surveys were deemed valid and incorporated in this report.
The overall survey results have a precision of +1-3.26% margin of error at the 99% confidence level, based on the population size of 3460 and 1074 individual represented in the 451 valid surveys. We can conclude that the results of this survey accurately represents the community.
The Statistical Research Value/Cost Model below presents a visualization of the relationship between necessary precision and associated cost of execution for creating an accuraterepresentation from a survey or research study. The required degree of precision is correlated to the expected application of the survey results. In the case of a research survey where the results are not utilized in an impactful way, the precision can be lower In the event the surveyis to determine the efficacy of a new drug for cancer patients, the precision must be significantly higher The survey conducted in Avalon is quite important, as it will help the Cityapply for funding and programming to address a wide range of community needs, includinghousing, recreational services, streets, broadband, the water/sewer system and more! CITY OF AVALON CITY COUNCIL
MEETING DATE: November 7, 2023 AGENDA ITEM:
ORIGINATING DEP: Administration CITY MANAGER: iLkPREPARED BY: Devin Hart, Management Analyst SUBJECT: First Reading of an Ordinance Amending Title 3, Chapter 3-1, Section 3-1.116 Revocation or Suspension of Licenses of the AvalonMunicipal Code RECOMMENDED ACTION(S): Introduce and waive the all further readings of an ordinance of the City of Avalon amending Title 3, Chapter 3-1, Section 3-1.116 Revocation or Suspension of Licenses of the Avalon Municipal Code.
REPORT SUMMARY: City Staff recommend amending Title 3, Chapter 3-1. Section 3-1116 Revocation or Suspension of Licenses of the Avalon Municipal Code (AMC) to broaden potential revocable or suspension violations to include noncompliance with any local, state or federal regulation.
As written, a City of Avalon Business License may only be suspended or revoked if a provision of the business license chapter has been violated, the license has been granted on false or fraudulent evidence, or the licensee has violated terms and conditions of the license.
With the current ordinance, if the licensee consistently violates other provisions of the AMC — compliance to the vehicle ordinance or parking regulations, participation in the City FOGprogram, compliance with noise ordinance, etc. — the business license cannot be revoked.
By broadening the potential grounds for revocation and suspension, City Staff hope to see greater compliance with other aspects of the AMCI as well as other state and federal regulations.
It should be noted, a suspension or revocation can only be processed if approved by the City Council — as outlined in AMC 3-1.116:
All matters pertaining to revocation or suspension shall be referred by the Director of Finance to the City Council. with a written statement of the reasons for the proposed revocation or suspension. The City Council shall give reasonable notice to the licensee to appear before the City Council at a time and place set for the hearing, to show causewhy the license shall not be revoked orsuspended. The notice shall state the grounds for the complaint or reasons for the proposed revocation or suspension in clear and concise language. The notice shall be sewed upon the licensee personally or by mail not less than 10 and not more than 20 days prior to the hearing date. CITY OF AVALON CITY COUNCIL
MEETING DATE: November 7, 2023 AGENDA ITEM: iiORIGINATING DEP: Public Works CITY MANAGER:
PREPARED BY: Robert Greenlaw. Director of Public Works
Devin Hart, Management Analyst
SUBJECT: Avalon Wastewater Treatment Plant Soffit Repair and Chlorine Tank Replacement Procurement
RECOMMENDED ACTION(S): 1 Make the affirmative finding that the City will not gain a competitive advantage by using the formal contract bid or other competitive procedure as outlined by the Avalon Municipal Code Section 3-4.111 (c); 2. Authorize the procurement of supplies, equipment and services for the replacement and repair of the WVVTP soffit for a not to exceed sum of $65,000; and 3. Authorize the procurement of supplies, equipment and services for the replacement and repair of the WWTP chlorine tank for a not to exceed sum of $145,000.
REPORT SUMMARY: The City’s wastewater treatment plant operator, PERC Water Corporation (PERC), is completing major infrastructure repairs throughout the City’s Waste Water Treatment Plant (WWTP), such as installation of a new screw press system as approved by the City Council on October 17, 2023.
In addition to the establishment of new systems, PERC and City Staff are working to repair and replace aging infrastructure. Two projects of significance include the repair and replacement of a soffit located in the facility’s basement and the rehabilitation of the VVWTP’s chlorine contact tank.
The soffit located in ceiling of the WWTP basement has spalled and delaminating concrete. The existing condition is not safe and continued deterioration may further result in a future, more costly repair as well as interfere with existing pump equipment located beneath the soffit. The scope of work for this project includes chipping out all of the spalled concrete, replacing any corroded rebar and then forming and repairing the concrete. The soffit repair and replacement project is expected to cost approximately $65000.
The chlorine contact tank is a critical processing component within the WWTP. At the end of the treatment process chlorine comes into contact with the processed wastewater within the chlorine contact tank. Chlorine is the primary disinfectant used across the United States to reduce odor, prevent algae growth, and remove iron and magnesium. The current tank has need of structural repairs and features spalled and delaminated concrete. The scope of work mirrors the soffit project including chipping out all of the spalled concrete, replacing any corroded rebar and then forming and repairing the concrete. This project is expected to cost approximately $145000.
While the chlorine tank is being repaired, the processed wastewater flow will be treated through a bypass. This diversion will allow Public Works and PERC crews the opportunity to repair and replace valves within the tank as well as clean and repair the adjacent slide gate.
Both projects are budgeted in FY 2023-24 and fall within the City’s Capital Improvement Plan — Capital Project #205012.
City Staff were made aware that a highly qualified contractor, Slater Waterproofing, Inc., that specializes in this scope of work was currently on the Island performing work for a private entity.
Slater Waterproofing, Inc. is a reputable firm that has previously provided contractor services for complex large-scale infrastructure projects for the City, including acting as the primary contractor for the Cabrillo Mole — Phase I Rehabilitation Project. SIster Waterproofing, Inc.’s experience, skill set, and the tact they are already mobilized and on the Island make them an ideal candidate to perform the work needed at the WWTP.
With Slater Waterproofing, Inc. currently mobilized, and on Island, there will be a significant cost savings for these two projects. City Staff have determined that the City will not gain a competitiveadvantage by using the formal contract bid or other competitive procedure. Per Avalon Municipal Code Section 3-4.111(c):
If a competitive market does not exist, or the City wilt not gain a competitive advantage by using the format contract bid or other competitive procedure, or where the public project, goods or services may be obtained more economically or efficiently without the procedure, the City may dispense with format bidding or other competitive procedures.
Additionally, during the late fall and early winter months the WWTP’s process flow is greatly reduced due to the reduced visitor counts. This time period is the best opportunity to complete this scope of work. Staff recommends the City Council makes the affirmative finding that the City will not gain a competitive advantage by using the formal contract bid or other competitive procedure as outlined by the Avalon Municipal Code Section 3-4.111 (c) and authorize the procurement of supplies, equipment and services for these projects.
GOAL ALIGNMENT: Infrastructure reliability and safety.
FISCAL IMPACTS: Capital Project #205012 was approved by City Council in the 2023-24 budget and sufficient funding remains to implement the project CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The repair and replacement of the aging infrastructure at the WWTP will not be completed in the most economic and efficient way.
FOLLOW UP ACTION: Direct City Staff to draft and execute agreements with Slater Waterproofing Inc. for repair and replacement of the WWTP’s soffit and chlorine tank.

(2) Approve the design and construction plans of the project. (3) Authorize the CityManager or his designee to modify plans as needed for compliance with funding agencies.
REPORT SUMMARY: Since 2018, work has proceeded on developing the construction contract documents to implement the reconstruction of the five corners intersection including the roadway segments of Tremont Avenue and Avalon Canyon Road in the near vicinity of the intersection.
The project proposes to construct new permanent sidewalks, median safety islands, trafficcalming (mini-roundabouts) and lighting in order to provide safer operations for all users. The total project is .25 miles in length.
Working with the City’s on call engineering firm ESG engineering, including traffic engineering firm W-Trans, landscape architectural firm RRM and environmental planning firm Birdseye Planning Group. a preliminary design was developed along with environmental studies and compliance documents. Different methods were employed to receive public input includingsurveys, community meetings, presentations to City Council and Planning Commission and a live demonstration of the roundabout layouts. The environmental document is a Mitigated Negative Declaration under CEQA, which was certified by the Planning Commission on August 21, 2019. The project was found to require no other permits.
The project was scheduled to go to construction in 2020 with above and underground utilities being relocated in the first construction season in the fall of 2020. However, with the Covid-1 9Pandemic causing logistically problems due to statewide shelter in place and also presenting uncertain financial conditions the project construction was delayed.
To expedite the project, City Staff separated the utility phase from the total scope of the project and developed a request for proposals for that specific scope of work. The RFP was circulated for a period of approximately 4 weeks; however, only one bid was submitted by the stated deadline. The submitted bid listed a total project cost that significantly exceeded the sum anticipated. City Staff made the determination it would be more efficient and cost effective to bid the project in total. To ensure that the project was fully funded the City applied for additional funding through the Active Transportation Program. The project was successful in receiving an additional $3.8 million construction funding. This project is primarily funded by grants including funds from Metro Local Transportation Funds, via the Los Angeles County Metropolitan Transportation Authority (Metro), State of California’s State Active Transportation Grant via the California Transportation Commission (Cal-Trans), anda local match from the City, primarily from City’s SB1 annual allocation from the state.Simultaneously to submission of this project to the City Council, the project’s granting authorities are reviewing the plans for compliance with the terms of funding. Staff anticipate minor revisions to the submitted design plans, and request the City Council authorizes the City Manager or hisdesignee to modify plans as needed for compliance with Metro and Cal-Trans agencies.
At this time, staff anticipate authorization from Metro and Cal-Trans by December 2023. The final project RFP will be circulated for review by the end of November. Bid results, financial analysis and Staff recommendation on contract award is planned to go before the City Councilon in late January or early February, 2024.
The project plans are available at City Hall for review.
