CITY OF AVALON CITY COUNCIL
MEETING DATE: April 9, 2024 AGENDA ITEM: 5
ORIGINATING DEP: Planning & Building CITY MANAGER: OnOM PREPARED BY: Kelly Ribuffo, Contract Planner
SUBJECT: 2023 General Plan Housing Element Annual Progress Report RECOMMENDED ACTION(S): Receive and file the General Plan Housing Element Annual Report for 2023 and direct staff to submit the Housing Element Annual Progress Report to the California Department of Housing and Community Development and the Governor's Office of Planning and Research.

REPORT SUMMARY: Government Code §65400 mandates each elected board submit an annual progress report (APR) to the California Department of Housing and Community Development (HCD) and the Governor's Office of Planning and Research (OPR) on the status and progress of the City's Housing Element implementation. The report assists HCD with tracking a jurisdiction's progress toward meeting its regional housing needs assessment (RHNA) allocation. It also provides OPR information to assist with identifying statewide trends in land use decision-making and how local planning activities relate to statewide planning goals and policies. APRs may also identify needed modification and improvements to General Plan guidelines.

Submitting the City's annual housing progress report to HCD and OPR fulfills statutory requirements to report housing planning and development progress in meeting local housing needs. Prior to submittal to the State, the annual report must be presented to the City Council for review and acceptance.

In summary, building permits were issued for four (4) new residential units in 2023:

One residential duplex with an ADU (240 Descanso Avenue); and One attached duplex dwelling unit (201 E. Whittley Avenue).

CITY OF AVALON CITY COUNCIL
MEETING DATE: April 9, 2024 AGENDA ITEM: 6
ORIGINATING DEP: Planning & Building CITY MANAGER: DMM
PREPARED BY: Kelly Ribuffo, Contract Planner
SUBJECT: Consideration of a Planning Commission Resolution Recommending City Council Adoption of the 2024 Annual Growth Policy and Determination that the Adoption of the Resolution is Exempt from CEQA.

RECOMMENDED ACTION(S): Adopt a resolution establishing the City of Avalon's Annual Growth Policy for 2024.

REPORT SUMMARY: Section 9-12.102 of the Avalon Municipal Code (AMC) stipulates that the City Council, in conjunction with the Planning Commission, shall review the growth permitted in the preceding months, review the effects and demands of such development and any additional development upon the City's natural resources, and determine, by resolution, the amount and type of growth the City will permit in the succeeding year, as well as City priorities for growth.

A summary of local development activity during the past year (January 1 through December 31, 2023) has been tabulated and is attached as "Exhibit A" to the draft City Council Resolution (Attachment 1) and Planning Commission Resolution No. 24-03 (Attachment 2) recommending the adoption of the City's Annual Growth Policy for the year 2024 by the City Council.

Southern California Edison (SCE) is not currently in any stage of water rationing. Fresh water allocations assigned to applicants on the Fresh Water Allocation List will be honored and a waiting list is established for projects pending availability of new freshwater allocation (Attachment 3). However, at this time no new freshwater allocations will be assigned until SCE completes a water availability assessment to determine the available water supply and potential water surplus. SCE will notify the City once the assessment is complete with an anticipated timeline for when water will be available for new allocations.

As it is not anticipated that water availability will change during the 2024 calendar year, the Planning Commission recommends maintaining the Annual Growth Policy development limits as they were approved for the 2023 calendar year. A development project shall only be required to fall into one of the foregoing categories to qualify for consideration. The permitted classes of projects are set forth in greater detail in Attachment 1. • The repair, in-kind replacement, remodeling or enlargement of existing commercial and residential structures, subject to specified conditions; • In-fill projects involving limited new construction and subject to specified conditions; • Residential tract development, if specified conditions can be met; • An ADU or JADU is not allowed in any location within the City unless the water provider indicates there is sufficient water by issuing a water allocation or that no allocation is needed (Avalon Municipal Code§ 9-5.605(a)(3));
• Infrastructure projects authorized by the City/Successor Agency; • Projects which the Planning Commission determines will not have growth inducing effects; and
• Projects which are not in-fill in nature or involve existing residential or commercial structures but for which CEQA documents have been adopted and findings made that explain why the resulting growth is beneficial to the City and its residents.

Almost all of the above development categories require confirmation from SCE that adequate fresh water is available to support the proposed project. Planning staff continues to coordinate with SCE regarding review of new planning applications within the city.

The proposed policy is exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15601(b)(3) because it has no potential to have a significant effect on the environment and is not subject to CEQA. The proposed policy establishes standards for the approval of allowed growth within the parameters of existing General Plan and municipal code regulations. It does not authorize any changes to land use limitations or approve any new development project. Therefore, there is no reasonable possibility that the activity in question may have a significant effect on the environment.

GOAL ALIGNMENT: The proposed resolution is aligned with the City's 2030 Vision and City Council goals regarding Natural Resources and City Infrastructure.

FISCAL IMPACTS: None.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: Failure to implement the Avalon Municipal Code mandate and continue to process development applications without the benefit or direction of an annual growth policy.

FOLLOWUP ACTION: Adherence to the growth policy when processing applications for land use entitlements during calendar year 2024.

ADVERTISING, NOTICE AND PUBLIC CONTACT: Pursuant to the Brown Act.

RESOLUTION NO. _

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AVALON ADOPTING THE 2024 ANNUAL

GROWTH POLICY AND DETERMINATION THAT THE

ADOPTION OF THE RESOLUTION IS EXEMPT FROM
CEQA
WHEREAS, the City of Avalon has adopted an Annual Growth Policy to balance he demands of residential and commercial development within the city limits with the vailability of freshwater resources to support community growth; an‹ WHEREAS, the City Council has authority per Avalon Municipal Code (AMC) Section 9-12.102 to review and take action on recommendations from the Planning Commission on the Annual Growth Policy; and
WHEREAS, the Planning Commission reviewed the growth permitted in the City during the preceding calendar year (attached as Exhibit A) and the effects and demands of such development and other development on the City's resources; and WHEREAS, on March 20, 2024, the Planning Commission held a duly-noticed public hearing, at which time written and oral evidence was considered regarding the development of a growth resolution for calendar year 2024 pursuant to Avalon Municipal Code Section 9-12.101; and
Annual Growth Policy; and
WHEREAS, the City Council has considered the Planning Commission recommendations, staff report, supporting documents, public testimony, and all pertinent information submitted.

WHEREAS, all other legal pre-requisites for the consideration of the 2024 Annual Growth Policy by the City Council have occurred.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AVALON DOES HEREBY RESOLVE AS FOLLOWS:

Section 1. The following facts were reviewed by the Planning Commission in adopting the recommended Annual Growth Policy and form the findings of fact upon which the City Council adopts this resolution:
a) New commercial construction and resort/vacation residential growth may contribute to the need for additional workforce, which in turn may create demand for additional housing.
b) The demand for City Services, such as wastewater treatment and saltwater service, public works, and police and fire services has increased without a corresponding increase in the funding for personnel and related infrastructure to provide these services.
c) Southern California Edison (SCE) has notified the City that while they are not currently operating at any stage of water rationing, no new freshwater allocations will be assigned in 2024 until SCE completes a water availability assessment to determine the available water supply and potential water surplus.

Section 2. The City Council finds that the 2024 Annual Growth Policy is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15061(b)(3) of the CEQA Guidelines (California Code of Regulations, Title 14, Chapter 3) because it has no potential to have a significant effect on the environment and is not subject to CEQA. The proposed policy establishes standards for the approval of allowed growth within the parameters of existing General Plan and municipal code regulations. It does not authorize any changes to land use limitations or approve any new development project. Therefore, there is no reasonable possibility that the activity in question may have a significant effect on the environment.

Section 3. Based on the foregoing, the City Council adopts the following growth policies for calendar year 2024, providing that new development will be permitted only for the following classes of projects. A project shall only be required to fall into one of the foregoing categories to qualify:
a) Projects involving existing commercial and residential structures which are to be repaired, replaced in kind, or remodeled or enlarged, provided no additional bedrooms or dwelling units are added to existing residential structures other than inclusionary or density bonus units, and SCE confirms in writing that water is available to serve the project, if approved by the City. As used herein, a replacement in kind is construction which does not change the prior use, increase the total square footage, or increase the number of units in the replaced structure.

This section does not prohibit consideration and approval of conditional use permits for transient occupancy, subject to the limitations otherwise applicable to such permits.
b) An in-fill project. As used herein, an in-fill project shall mean:
i. any residential project which creates five or fewer units (including any bonus density units); or
ii. any non-recreational/visitor-serving commercial project that increases square footage by <50%; or
ili. any expansion of existing recreational/visitor serving development, not over 5,000 square feet;
In-fill projects must be located on a legally conforming parcel, provided that if the project is not categorically exempt, then the project proponents can mitigate any adverse environmental impacts, and SCE confirms in writing that water is available to serve the project if approved by the City. c) Residential tract development of greater than five units may be allowed if the project provides 20% of the units proposed or one unit, whichever is greater, to year-round, non-transient, affordable housing and SCE confirms in writing that water is available to serve the project, if approved by the City. d) An ADU or JADU is not allowed in any location within the City unless the water provider indicates there is sufficient water by issuing a water allocation or that no allocation is needed, unless such ADU or JADU is required by state law. e) Infrastructure projects authorized under or by the City/Successor Agency. f) Projects which the Planning Commission determines will not have growth inducing effects. By way of example, such projects would include non-inhabited uses such as industrial warehouses, mechanical, marine, or construction service areas and storage spaces and which do not create the need for additional employees. g) Projects which are not categorized as in-fill or existing residential or commercial structures for which a Negative Declaration, Mitigated Negative Declaration, or Environmental Impact Report, with or without Mitigation Monitoring Program, is adopted and for which specific findings are made that explain why the resulting growth is beneficial to the City of Avalon and its residents and SCE confirms in writing that water is available to serve the project, if approved by the City either via the existing safe annual yield or via an additional fresh water resource in accordance with SCE tariffs.
h) In any event, projects which have been granted a water allocation or water transfer, the City Council or their designee shall review and determine that water is available, and shall make an additional finding that any allocation or transfer of water for the project by SCE is consistent with the City's adopted General Plan and that the allocation or transfer of water for the project is done in a manner that is fair, transparent, and promotes the public health, safety, and welfare.

Section 1. he Planning Commission hereby finds that the foregoing recitals are true an orrect and are incorporated herein as substantive finding Section 2. The Planning Commission finds that the 2024 Annual Growth Policy is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15061(b)(3) of the CEQA Guidelines (California Code of Regulations, Title 14, Chapter 3) because it has no potential to have a significant effect on the environment Section 3. Based on the foregoing recitals and findings, the Planning Commission hereb ecommends that the City Council adopt a Resolution approving the 2024 Annua Growth Policy, establishing overall priorities for growth and determining the amount and type of development to be permitted in the succeeding year.

Section 4. Based on the foregoing, the Avalon Planning Commission adopts Resolution No. 24-03 and recommends the following growth policies for calendar year 2024, providing that new development will be permitted only for the following classes of projects. A project shall only be required to fall into one of the foregoing categories to quality:
a) Projects involving existing commercial and residential structures which are to be repaired, replaced in kind, or remodeled or enlarged, provided no additional bedrooms or dwelling units are added to existing residential structures other than density bonus units permitted by conditional use permit, and the Southern California Edison Company confirms in writing that water is available to serve the project, if approved by the City. As used herein, City. As used herein, a replacement in kind is construction which does not change the prior use, increase the total square footage, or increase the number of units in the replaced structure. As used herein, an in-fill project shall mean:
i. any residential project which creates five or fewer units (including any bonus density units); or
ii. any non-recreational/visitor-serving commercial project that increases square footage by <50%; or
iii. any expansion of existing recreational/visitor serving development, not over 5,000 square feet;

By way of example, such projects would include non-inhabited uses such as industrial warehouses, mechanical, marine, or construction service areas and storage spaces and which do not create the need for additional employees.
g) Projects which are not categorized as in-fill or existing residential or commercial structures for which a Negative Declaration, Mitigated Negative Declaration, or Environmental Impact Report, with or without Mitigation Monitoring Program, is adopted and for which specific findings are made that explain why the resulting growth is beneficial to the City of Avalon and its residents and the Southern California Edison Company confirms in writing that water is available to serve the project, if approved by the City either via the existing safe annual yield or via an additional fresh water resource in accordance with SCE h) In any event, projects which have been granted a water allocation or water transfer, the City Council or their designee shall review and determine that water is available, and shall make an additional finding that any allocation or transfer of water for the project by SCE is consistent with the City's adopted General Plan and that the allocation or transfer of water for the project is done in a manner that is fair, transparent, and promotes the public health, safety, and welfare.

BE IT FURTHER RESOLVED that a copy of this Resolution be delivered to the City of Avalon City Clerk for transmittal to the City of Avalon City Council.

MEETING DATE: April 9, 2024 AGENDA ITEM:

ORIGINATING DEP: City Attorney CITY MANAGER:

PREPARED BY: Scott H. Campbell, City Attorney
SUBJECT: Surplus and Excess Land Inventory Report
RECOMMENDED ACTION(S): Adopt a resolution adopting an inventory report of the City's and Housing Authorities surplus and excess land, pursuant to Government Code section 54230.

REPORT SUMMARY: Government Code section 54230 mandates that all California cities and Community Development ("HCD") provides the practical difference between these two categories of land is essentially one of timing. "Surplus land" is land that is no longer necessary for an agency's use and has been officially declared "surplus" by the local agency's governing body. "Excess land" is land that is beyond an agency's foreseeable needs but has not yet been declared surplus.

To be "necessary for [an] agency's use," land must be "used, ... planned to be used pursuant to a written plan adopted by the local agency's governing board for, or ... disposed [of] to property, land being used for conservation purposes, land for demonstration, exhibition, or educational purposes, related to greenhouse gas emissions, and buffer sites near sensitive governmental uses, including, but not limited to, wastewater treatment plants." (See Gov.

Code, § 54221 subd. (c) (1).)
Staff has determined that the City and Housing Authority do not have any surplus or excess land, as noted in the Inventory Report attached as Exhibit "A" to the proposed Resolution.

Staff recommends adopting the proposed Resolution adopting the Inventory Report, as required under Government Code section 54230.

GOAL ALIGNMENT: Compliance with state law.

FISCAL IMPACTS: None.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: Failure to adopt the Inventory Report will put the city out of compliance.

CITY OF AVALON CITY COUNCIL
MEETING DATE: April 9, 2024 AGENDA ITEM: 9
ORIGINATING DEP: Public Works CITY MANAGER:DWOM
PREPARED BY: Robert Greenlaw, Public Works Director
Devin Hart, Management Analyst
SUBJECT: Award Underground Fuel Tank Removal and Site Remediation Contract
RECOMMENDED ACTION(S): Authorize the City Manager to execute a contract for the removal of underground fuel tanks and site remediation with Wayne Perry, Inc. for a not to exceed sum of $100,000.

REPORT SUMMARY: The State of California requires the owners or operators of specific types of underground fuel storage tanks to permanently close by December 31, 2025. The City of Avalon owns four underground fuel tanks at the Avalon Fuel Dock that fall under this requirement.

With assistance from former Assemblymember Patrick O'Donnell, the City was awarded a $500,000 State budget earmark that is administered through the State of California Water Board to remove the underground fuel tanks located at the fuel dock and install an above ground system in compliance with the new regulations. The granting agreement requires the City to have construction completed and the project closed out by June 30, 2024.

The project is included in the FY22-23 Budget and Capital Improvement Plan - Project Number 207004, Account Number 11470-6547 - with $700,000 budgeted.

On March 21, 2023 City Council approved the design and construction documents for this project, and authorized Staff to post and receive informal bids to procure the fuel tank for an amount not to exceed $200,000. On June 27, 2023, the City Council awarded a contract to Western Pump for a not-to-exceed amount of $160,000.

As the second component of this project, on August 11, 2023 the City solicited bids by informal bid process from duly licensed and experienced contractors to provide site preparation, grading, concrete foundation, retaining wall installation and related construction services for the new location of the storage tank. After an extension of the bid deadline, bidding closed on August 28, 2023 at 1 p.m. Only Jordahl Construction, Inc. provided a bid of $274,710 by the stated deadline.

On September 5, 2023 the City Council determined the contract cost was reasonable and awarded the contract to Jordahl Construction by adopting Resolution 23-35 by a 4/5 vote.

On December 1, 2023, City Staff solicited a RFP for the a procurement component of this project - above ground fuel tank installation. On December 12, 2023, the City Council adopted Resolution 23-48 awarding the contract to Jordahl Construction, Inc. for a sum of $251,750.

The 53,000 pound fuel tank arrived on Island and was placed at its final location, adjacent to 2 Casino Way, on Monday, April 1, 2024. Wayne Perry, Inc. was contracted, under the City Manager's purchasing authority granted by Avalon Municipal Code (AMC) to assist with the placement of the new tank, as well as install all new fittings, pipes, pumps and sensors required to make the new unit functional. City Staff anticipate the tank being fully functional by May 1, 2024.

This final component of this complicated project is removal of the existing underground fuel tanks and performance of any necessary site remediation. Wayne Perry, Inc. is currently mobilized on the Island and is familiar with logistics and resource procurement processes in Avalon. City Staff recommend exception from bidding and other competitive procurement procedures as outlined in AMC 3-4.111 due to economic efficiency and authorization for the City Manager to execute a contract for the removal of the existing underground fuel tanks and necessary site remediation with Wayne Perry, Inc. for a not to exceed sum of $100,000.

Time is of the essence as this project must have construction completed and project closed out by June 30, 2024.

GOAL ALIGNMENT: City Infrastructure. Reduction of high-risk facilities.

FISCAL IMPACTS: Project budgeted in CIP project code 207004 (account 11470-6547).

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City may not meet the timeline required by the funding agreement with the State of California Water Board.

FOLLOW UP ACTION: Execute an agreement.

CITY OF AVALON CITY COUNCIL
MEETING DATE: April 9, 2024 AGENDA ITEM: 10
ORIGINATING DEP: Administration CITY MANAGER: OnM
PREPARED BY: David Maistros, City Manager
SUBJECT: Discussion of an Ordinance amending Title 6, Chapter 6-1, Section Catalina Island Conservanci
RECOMMENDED ACTION(S): 1. Provide direction on a proposed amendment to Title 6, Chapter 6-1, Section 6-1.128 Animal Care of the Avalon Municipal Code allowing for the capture and sterilization of deer within the City of Avalon. 2. If consensus, authorize the City Manager to negotiate and execute a Memorandum of Understanding with the Catalina Island Conservancy ("Conservancy") to • implement the terms of amendments into the implementation of Conservancy's Island Restoration Project should the pending Collection Permit be granted.

REPORT SUMMARY: The Catalina Island Conservancy (Conservancy") submitted a Scientific Collection Permit Application ("Permit") to the California Department of Fish and Wildlife (CDFW) on or about August 7, 2023 as part of the Conservancy's Island Restoration Project. The Permit proposes to eradicate all of the mule deer on Catalina Island beginning approximately August 2024. The original application proposes to eradicate the deer by way of aerial shooting.

Additionally, the Permit proposes capturing and/or hunting deer within City limits.

On October 17, 2023, City Council heard a public presentation from the Conservancy regarding the proposed Island Restoration Project. During the same meeting, Council heard approximately two hours of public comment regarding the proposed Restoration Project and, specifically, the eradication of the island's deer population. The vast majority of residents that spoke opposed the methodology of the plan, and specifically, the failure to incorporate hunting, and the use of aerial eradication of the mule deer.

After thorough consideration of the residents' concerns, on November 7, 2023, City Council amended the Avalon Municipal Code to more specifically address, strengthen protections, and prohibit hunting, trapping, feeding, luring, inhumane treatment, and killing of wild animals - including deer - within the City of Avalon. In revising and clarifying the Municipal Code, City Council determined that hunting, pursuing, feeding, killing, or trapping animals within the City represents a threat to public health, safety, and welfare to the residents and visitors within the City of Avalon. The Conservancy and CDFW have cautioned the City that the ordinance may be subject to scrutiny as being in conflict with the jurisdiction of the CDFW regarding animal management and control.

Since January, the Conservancy has conducted a number of forums in an effort to engage the public regarding the Island Restoration Project. There has been significant and legitimate opposition to the Conservancy's plan. Much of the public opposition focusses on a few central themes. 1. Proposed Methodology - there is strong opposition to the use of helicopters as the primary method of eradicating the deer; 2. Timing - Initiating the plan in August during the peak of the tourist season increases the risk of injury and negative economic impact from lost tourism revenues; 3. Resistance to incorporate hunting as part of the methodology; 4. Not recognizing deer as part of the fabric and history of the Island.

Over the last several months, the City and Conservancy have engaged in a number of extremely productive conversations in an effort to address some of the concerns voiced in the community.

The Conservancy has acknowledged a willingness to address some of the concerns of the residents while also staying true to the science behind the original Restoration Plan. As a direct result of these negotiations, the Conservancy would agree to amend the implementation of the Island Restoration Project should CDFW grant the pending Permit Application as follows:

1. The Conservancy will support a final hunting season from July-December 2024. The Conservancy will petition the Fish and Game Commission to increase the number of tags issued from 500 to at least 700 for the 2024 hunting season in order to incorporate the use of hunters. Additionally, this "Last Hunt" will be further supported by the Conservancy's commitment to remove the financial burden for local hunters by subsidizing the cost for all Catalina Island residents.

2. In order to preserve deer on the Island and recognizing that a certain number of deer are found in the City of Avalon, the Conservancy agrees to humanely capture, sterilize and identify by tagging healthy deer located within the City of Avalon. The ultimate number of tagged deer will be more fully determined and mutually agreed upon at the time of the identification and sterilization procedure. The City will be entitled to have a veterinarian (or similarly credentialed professional) observe and document the sterilization and tagging process. The "tagged" deer will be protected and remain unharmed throughout the completion of the Restoration Project. It is understood that "tagged" deer will not be hunted or intentionally harmed in any way during the remainder of the deer's lives. Tagged deer will be free to live out their lives whether they remain within City limits or migrate onto Conservancy or private property. The City will amend the existing ordinance to permit the capture of deer for the purpose of sterilization within City limits and to not be in conflict with state and wildlife laws.

3. As a direct result of the more robust final hunting season and the protection of the tagged deer, the number of deer that could be subject to aerial removal will be significantly reduced. The Conservancy agrees to not conduct any aerial-based deer removal operations during the months of June through September and the earliest such action can occur is 2025.

4. The Conservancy would further agree that they will not incorporate "netting and bolting" as a means to implement Island Restoration Proiect
The Conservancy and City acknowledge that the foregoing only allows for an amendment to the implementation of the pending Permit Application and the ultimate decision to grant, deny or further amend the permit application rests solely with CDFW. Should CDFW approve the plan as currently submitted, the Conservancy would agree to abide by the terms set forth herein and incorporated in the MOU if approved. If CDFW denies the Permit Application the MOU will become null and void.

FISCAL IMPACTS: Undetermined.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The CDFW will eventually issue a decision on the Conservancy's Permit as submitted and without an agreement with the Conservancy there will be no final hunting season or tagged and protected deer.

FOLLOW UP ACTION: Implement City Council direction by entering a written agreement with the Conservancy and presenting and amended ordinance for Council review.
