CITY OF AVALON CITY COUNCIL
AGENDA ITEM: 3
MEETING DATE: May 21, 2024
ORIGINATING DEP: Administration ACM:_
PREPARED BY: David Maistros, City Manager
SUBJECT: Adopt an Ordinance Adding Chapter 5-22 to the Avalon Municipal Code Regarding Use of Projectiles and Adoption of Exemption Findings Under the California Environmental Quality Act RECOMMENDED ACTION(S): Adopt an ordinance of the City of Avalon adding Chapter 5-22 to the Avalon Municipal Code regarding use of projectiles and adoption of exemption findings under the California Environmental Quality Act.

REPORT SUMMARY: This ordinance was introduced and all further readings were waived at the May 7, 2024 regular City Council Meeting.

After the 2023 Fourth of July Parade, the City received a number of complaints regarding the malicious use of water balloons and other projectiles during the event. Additionally, City Staff observed and received a number of reports regarding litter and balloon debris throughout Crescent Avenue, Avalon Harbor, and the adjacent beaches.

In order to prevent harm to visitors and residents, as well as to reduce litter in Avalon, the City proposes to create an ordinance prohibiting the harmful use of projectiles at public events - including water balloons. During large, crowded events like the Fourth of July Parades, the use of projectiles is especially dangerous as the crowds have less room to maneuver to avoid projectiles and the potential for injuries is increased.

Violators of this ordinance may be subject to an Administrative Citation as outlined in Avalon Municipal Code Section 1-9. Administrative fines start at $100 for the first violation, $200 for the second violation, and $500 for the third and any subsequent violations occurring within one year from the date of the first violation.

ORDINANCE NO. _

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AVALON, CALIFORNIA ADDING CHAPTER 5-22 TO THE

AVALON MUNICIPAL CODE REGARDING USE OF

PROJECTILES AND ADOPTION OF EXEMPTION

FINDINGS UNDER THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT.

WHEREAS, pursuant to the authority granted to the City of Avalon ("City") by WHEREAS, the Council has determined that use of projectiles, including but not limited to, water balloons within the City represents a threat to public health and safety within the City because such projectiles can injure or harm those hit by such projectiles; WHEREAS, projectiles have been maliciously used on persons in the City, particularly at public events; and
WHEREAS, public events serve visitors, tourists, and other residents and promote the economy of the City and improve its general welfare; and WHEREAS, the use of projectiles at public events can be disruptive to these public events, disincentivize attendance, and may cause rapid movements of large groups of people which could risk serious injury to those who fall or collide into one another; and WHEREAS, the malicious use of projectiles-particularly at public events- undermines the safety and security of the City's citizenry; and WHEREAS, the inclusion of a prohibition regarding the use of projectiles in the City will preserve, promote, and protect the health, safety, and welfare of its citizens by penalizing such conduct; and
WHEREAS, on May 7, 2024, the City Council held a duly-noticed public meeting and considered the staff report, recommendations by staff, and any public testimony concerning this ordinance; and
WHEREAS, all legal prerequisites to the adoption of this ordinance have occurred.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AVALON DOES ORDAIN AS FOLLOWS:

Section 1. Incorporation of Recitals. The recitals set forth above true, correct, incorporated herein, and are adopted as the findings of the City Council in connection with the adoption of this Ordinance.

Section 2. Code Amendment. Chapter 5-22 of the Avalon Municipal Code is hereby added to the Avalon Municipal Code to read as follows:

Chapter 5-22
Projectiles
5-22.010 Purpose.

The purpose of this chapter is to prevent harm to visitors and residents that is caused by the throwing of projectiles, including water balloons or eggs. At public events in particular, attendees have been struck by such projectiles. The throwing of these projectiles is often done for mischievous and/or malicious purposes and the conduct is often nonconsensual on part of the attendees. Nonconsensual use of projectiles undermines the City's goals of creating a welcoming community, maintaining public safety and order, and attracting people to the island. Accordingly, the City implements this chapter to prevent such conduct.
5-22.020 Definitions. These definitions apply to this chapter:
(a) Object: A thing or physical material, including but not limited to, water balloons, eggs, or other solids, liquids, or gases.
(b) Projectile: A projectile is an object which is thrown, launched, or caused by a person to be moving through the air.
(C) Public events: An event or activity held open for the general public, either authorized by the City or conducted by a private group. 5-22.030 Projectiles Prohibited.

It shall be unlawful for any person to use an object as a projectile such that it causes harm or offense to a person or group of people or interferes with or disrupts a public event. 5-22.040 Exception.

This prohibition shall not apply to:
(a) Use of projectiles which occurs wholly on private property, where the projectile does not travel any further than the property line of the private property involved and the projectile is not intended to cause harm or offense. This exception does not apply when the private property is used for a public event.

Section 3. Severability. If any section, subsection, subdivision, sentence, clause, or phrase of this Ordinance, or any part thereof is for any reason held to be unconstitutional, void, or invalid, such decisions shall not affect the validity of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause, or phrase be declared unconstitutional, void, or invalid.

Section 4. CEQA Exemptions. The City Council finds that adoption of this Ordinance is not a project subject to the California Environmental Quality Act ("CEQA") pursuant to Section 15378 (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) of the State CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Additionally, this Ordinance is exempt under CEQA pursuant to Guidelines Section 15061(b)(3) (there exists no possibility that the activity will have a significant adverse effect on the environment) because this Ordinance will not cause a change in any of the physical conditions within the area affected by the Ordinance. None of the exceptions to the exemptions found in State CEQA Guidelines section 15300.2 apply. Staff is hereby directed to prepare, execute and file with the Los Angeles County Clerk a CEQA Notice of Exemption within five (5) working days of the adoption of this Ordinance.

Section 5. Certification. The City Clerk of the City of Avalon shall certify the passage and adoption of this Ordinance and shall cause the same, or a summary thereof, to be published and/or posted in the manner required by law.

Section 6. Effective Date. This Ordinance shall become effective thirty days from its adoption.

CITY OF AVALON CITY COUNCIL
MEETING DATE: May 21, 2024 AGENDA ITEM: 4
ORIGINATING DEP: Public Works ACM: JF
PREPARED BY: Jamie Hmielak, Maintenance Superintendent
SUBJECT: Authorization to Purchase New Pump for Catherine Lift Station RECOMMENDED ACTION(S): Authorize the purchase of a Flygt 6" submersible sewage pump from Xylem, Inc. for a cost not to exceed $31,000.00 REPORT SUMMARY: PERC Water maintains the City's Wastewater Treatment Plant, which includes the Catherine Sewage Lift Station. The sewage lift station is a key component of our wastewater infrastructure, and any operational downtime can lead to serious consequences, including potential public health risks and environmental concerns.

The Catherine Lift Station has two pumps. One of the pumps was recently replaced. To ensure consistency of operations, the City and PERC Water keep an available replacement pump in inventory at all times.

To replace the pump in inventory, a quote was obtained by California Electric Motor Source to rebuild the pump at a cost of $25,297.01. A second quote was obtained from Xylem, Inc. for a new replacement pump at a cost of $27,803.50. It was determined it would be most cost effective to purchase the new pump rather than rebuild the old one.

On November 28, 2023, the City of Avalon City Council made the affirmative finding that Xylem, Inc. satisfied the sole source requirements outlined in Avalon Municipal Code (AMC) Section 3-4.111(b).

After accounting for a contractually required mark up from PERC Water, the quote from Xylem totals $30,583.85. AMC Section 3-4.106 requires purchases of goods, services, supplies and equipment with a value over $25,000 be procured through a competitive process. However, AMC Section 3-4111 (b) allows the City to dispense with bidding and other competitive procedures: "When there is only one source that provides the necessary public project, services, goods and equipment to ensure compatibility with existing City public projects, services, goods or equipment, or the public project, services, goods or equipment are proprietary in nature, the City may procure the public project, goods or services from the sole source.'
As the City Council has made the affirmative finding that Xylem is a sole source vendor, and is the exclusive supplier for Flygt pumps in our region, Staff requests authority, per the City's procurement policy, to purchase the pump for a not to exceed cost of $31,000.

GOAL ALIGNMENT: Infrastructure reliability and safety.

FISCAL IMPACTS: A cost not to exceed of $31,000. Sufficient funds exist in FY 23-24 Sewer Fund 10850-6521.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: A redundant pump in essential to ensure no disruption of operations.

FOLLOW UP ACTION:. Authorize PERC Water to purchase the pump per attached ASA.

ADVERTISING, NOTICE AND PUBLIC CONTACT: This item was properly listed on the posted agenda pursuant to the Brown Act.

CITY OF AVALON CITY COUNCIL
MEETING DATE: May 21, 2024 AGENDA ITEM: 5
ORIGINATING DEP: Administration ACM: JF
PREPARED BY: Jocelyn Francis, Assistant City Manager
SUBJECT: Code Enforcement Officer Safety Policy
RECOMMENDED ACTION(S): Approve the City of Avalon Code Enforcement Officer Safety Policy.

REPORT SUMMARY: California State Senate Bill No. 296 found and declared that code enforcement officers are at risk for threats and injury due to the nature of their job responsibilities. California Penal Code 829.7 was adopted relating the requirement for local jurisdictions to develop safety standards appropriate for those assigned code enforcement duties. Although there is no set standard for code enforcement officers locally, statewide, or nationally, each jurisdiction is required to develop safety standards to ensure the best interest of the officers performing these duties are considered.

City staff developed the proposed policy receiving input of assigned staff, California Intergovernmental Risk Authority, and the California Association of Code Enforcement Officers. In addition, City staff assigned to code enforcement are currently enrolled in the 15-hour Code Official Safety Specialist training course as outlined in the proposed policy.

FISCAL IMPACTS: None.

GOAL ALIGNMENT: Risk Management Improvement
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: City would not be in compliance with SB-296.

FOLLOW UP ACTION: Post the updated policy on the City website and train assigned ADVERTISING, NOTICE AND PUBLIC CONTACT: The item was properly listed on the posted agenda pursuant to the Brown Act.

CITY OF AVALON
Code Enforcement Officer Safety Policy (SB 296)

APPLICABILITY
This Policy applies to all City of Avalon ("City") employees, officers, and designated contractors who, as part of their job responsibilities and requirements are tasked with Code Enforcement Officer duties, including: Code Enforcement Officer and Lead Code Enforcement Officer.

STATEMENT OF PURPOSE
Senate Bill (''SB") 296 established Penal Code Section 829.7, which requires each local jurisdiction that employs a Code Enforcement Officer to evaluate the risks, threats and hazards applicable to their Code Enforcement Officer(s) and develop appropriate safety standards. The purpose of this procedure is to comply with Senate Bill 296 by establishing standards and guidelines for the City of Avalon.

GENERAL POLICY GUIDELINES

1.1 Officer Safety
The safety and welfare of City personnel is extremely important and a high priority for management and supervisors. Code Enforcement Officers are expected to act in a professional manner when dealing with the public; however, if they are dealing with hostile individuals, officers are expected to avoid confrontation and remove themselves from the situation as quickly and safely as possible.

Many potential officer safety issues can be avoided by following proper techniques:
• Reviewing prior cases to determine any potential safety hazards or potential hostile individuals.

Becoming familiar with the geographical area of the complaint, prior to initial contact. • Speaking with officers who investigated previous complaints.

Having additional resources available, such as a second Code Enforcement Officer, a supervisor, or deputy when warranted.
• Ensuring co-workers, supervisor, and/or dispatch are regularly notified of officer location.

Supervisors will be made aware of all potentially harmful situations, prior to any initial contact, in order to develop strategies to best address those hazards.

1.2 Threats, Assaults and Batteries
All threats, assaults and batteries directed at staff, shall be reported to supervision, management, and the Los Angeles County Sheriff's Department immediately. Staff should obtain information DRAFT
as safely as possible about the subject making the threat, assault, or battery, including their intent, ability, and desire to carry out their actions. This information will be vital for law enforcement and supervisors.

Code Enforcement Officers and law enforcement are expected to share information regarding known and potential dangerous occupant(s) of properties under investigation by code enforcement, and take necessary steps to mitigate the risk of harm to the inspectors. These steps include, but are not limited to, obtaining assistance from law enforcement in making any and all contacts with such individual(s), officers reporting their location prior to making contact and after completing the inspection or other contact, and adhering to safety standards, training, and protocols.

1.3 Use of Force
Code Enforcement Officers will exercise good judgment at all times if force is necessary. The ability to leave the location prior to any confrontation taking place is the best course of action.

Code Enforcement Officers shall utilize the least amount of force necessary to mitigate the threat and safely leave the area.

Mere verbal threats of violence, verbal abuse, or hesitancy in following commands does not necessarily justify the use of physical force without additional facts or circumstances substantiating an imminent potential for physical harm. However, if a Code Enforcement Officer is receiving threats, particularly threats of violence even without additional manifestations of intent to carry it out, the Code Enforcement Officer should immediately retreat to a safe location and notify the law enforcement and a code enforcement supervisor.

1.4 General Safety

SELF-DEFENSE
Code Enforcement Officers have two defense options:

1. Leave the scene (walk, run, crawl, drive, etc.) and call for help.

2. If a Code Enforcement Officer cannot leave the scene, such as being cornered or held, they may defend themselves until they are able to leave the scene or assistance arrives. Code Enforcement Officers may use defensive tactics skills, as well as issued equipment as reasonable and not excessive to defend against an attack.

Unreasonable application of physical force on a person is a violation of law, which may result in criminal prosecution of the Code Enforcement Officer and potential civil liability to the Code Enforcement Officer and their agency.

PRIORITIES

1. A Code Enforcement Officer's safety is first priority. An officer cannot help others if hurt or incapacitated, and if the officer is injured, this compounds the original problem.

DRAFT

2. The safety of others is the next priority. Assistance should come from other department employees, or emergency service agencies, including the Los Angeles County Sheriff's Department.

ALERTNESS
A crucial part of officer safety is staying alert and anticipating potential risks. This requires the use of all senses to observe the surroundings, hear a threat, speak persuasively, or feel that an attack is imminent. Being alert applies not only in the field, but also at the office. • Pay attention to individuals who come to the office. Making eye contact and greeting them tells them that they have been noticed and acknowledged. • Watch for unusual circumstances and check in with them. If you find someone in a restricted area, inform them that the area is not open to the public, guide them to a public area of the building, and offer assistance. If you find a strange package in an unusual place notify a supervisor and do not touch it until it can be confirmed to be harmless. • Plan an escape route. This includes emergency escape routes as outlined in your agency's emergency action plan, and potential escape routes when in the field. Every time contact is made, consider what options are available if something goes wrong. This is extremely important when dealing with hostile people.
• Know the location of visits and inspections. If immediate help is necessary, it may not be possible to review a map for directions.
• When talking to individuals, try to maintain at least an arm's-length of distance and a bladed, balanced stance on firm ground to be able to dodge a sudden lunge, punch, or kick. A bladed stance is when one foot is in front of the other and the body is at an angle to the individual in front of the officer.
• Avoid standing downhill, facing the sun, or at the edge of something that could lead to a trip and tall.
• Be aware of nearby objects that could be used as weapons by a hostile individual, such as garden tools, screwdrivers, knives, 2x4s, pipes, etc. Guide the individual towards a more neutral area. If it is not possible to move to another area of the property, move objects out of reach.

The decision to use physical force places a tremendous responsibility on Code Enforcement Officers. Code Enforcement Officers should clearly understand that the standard for determining whether the force applied is that conduct which a reasonable Code Enforcement Officer would exercise based upon the information the officer had when the conduct occurred.

1.5 Reporting
Code Enforcement Officers are required to immediately report all officer safety issues to a supervisor. This includes any force used in self-defense, verbal altercations, or incidents where a police officer had to arrest a party. After notification, the Code Enforcement Officer will also submit a written report of the incident to a supervisor.

DRAFT

1.6 Use of Radio/Cell Phone Communications
Code Enforcement Officers are required to advise office staff and/or supervisor of where they generally will be during the course of a shift. Officers shall keep their electronic calendar up to date and keep their City-issued cell phone on while at work.

All Code Enforcement Officers will be assigned a radio and call sign.

Code Enforcement Officer will limit their use of the radio to only essential information to ensure the channel remains open for priority traffic.

1.7 Missing Officer
Staff shall call or radio Code Enforcement Officers periodically while out in the field. If a Code Enforcement Officer fails to promptly respond to phone calls or radio communication, staff shall contact Dispatch and the supervisor to ascertain the missing Code Enforcement Officer whereabouts. It is the policy of dispatch to monitor units assigned in the field. If a unit fails to respond to a dispatcher, then the Code Enforcement Officer's radio will receive an emergency page and available Los Angeles County Sheriff units shall be dispatched to the last known location.

1.8 Service of Inspection and/or Abatement Warrants
Code Enforcement Officers may need to obtain inspection and/or abatement warrants from time to time. Prior to serving or executing such warrant(s), the Code Enforcement Officer shall notify their supervisor and coordinate with the Los Angeles County Sheriff's Department to ensure a deputy is present at the service or execution of the warrants). The Code Enforcement Officer shall coordinate with law enforcement present on how to make contact with the occupant(s) and the best method for entry. Forcible entry shall not be used unless a judge has authorized it in the warrant(s). Code Enforcement Officers shall not serve or execute an inspection warrant without the presence of law enforcement and the Code Enforcement Officer shall report their position to dispatch when arriving and leaving the location subject to the warrants).

1.9 Protective Equipment
Code Enforcement Officers may encounter environmental conditions which may be hazardous, such as mold, asbestos, insect infestation, feces, and airborne contaminants. As such, each Code Enforcement Officer will be provided with an emergency medical kit and personal protective equipment. Based on the known or reasonably anticipated situation, each officer is required to wear or utilize the most appropriate equipment when entering hazardous areas. The protective equipment should be worn at all times until the Code Enforcement Officer believes hazardous conditions have been abated or when the officer has left the hazardous area or property. Below is a list of essential equipment provided to each officer. Each officer is responsible for periodic inspection and inventory of stated equipment. If an officer finds equipment to be defective or requires replacement, please notify supervisor immediately. Listed below is Agency-provided personal protective equipment:

1.10 License Plate Confidentiality
A Code Enforcement Officer shall not utilize their personal vehicle in the performance of job duties. If the Code Enforcement Officer is engaged in enforcing the Vehicle Code or municipal ordinances related to parking, the Code Enforcement Officer may apply for license plate confidentiality under Vehicle Code Section 1808.4(a) (19) or other applicable law.

1.11 Training
Continual training is essential for Code Enforcement staff to maintain the skills required for their individual positions. All Code Enforcement staff will receive initial training essential to perform their duties. This will be on-the-job training provided by supervisors and experienced Code Enforcement Officers.

All Code Enforcement Officers are required to successfully complete the 40-hour 832 PC course as prescribed by the Commission on Peace Officer Standards and Training (POST) and the 15-hour Code Official Safety Specialist Training by the Code Enforcement Officer Safety Foundation.

The department will require Code Enforcement Officers to attend training opportunities provided by the California Association of Code Enforcement Officers (CACEO). Lead Code Enforcement Officers are expected to become Certified Code Enforcement Officers and maintain continuing education requirements to maintain certification.

In addition to CACEO training, the City will provide Code Enforcement Officers with Cal/OSHA required and best risk management practices training, applicable to agency's exposures. Training may include, but not limited to: Hazard communication, bloodborne pathogens, hearing conservation, heat stress, respiratory protection, fire extinguisher safety, CPR/AED/First Aid Safety, tactical communication, traffic control/flagging, self-defense, driver safety, etc.

1.12 Record Keeping
It is essential the City document and maintain Code Enforcement staff training records, including copies of all outside training and certifications the officer receives in their personnel file.

CITY OF AVALON CITY COUNCIL
MEETING DATE: May 21, 2024 AGENDA ITEM: 6
ORIGINATING DEP: Administration ACM:

PREPARED BY: Gabrielle Morones, Deputy City Clerk/Sr. Administrative Assistant SUBJECT: Designate Matthews International as a Sole Source Vendor and Authorize Purchase of an Eco Bronze Niche
RECOMMENDED ACTION(S): Make the affirmative finding that Matthews International is a sole source vendor as described in Avalon Municipal Code Section 3-4.111(b), and authorize procurement of an Eco Bronze Niche for a not to exceed sum of $55,000.

REPORT SUMMARY: The City of Avalon owns and operates the Avalon Cemetery located at the intersection of Cabrillo Drive and Cemetery Road.

Over the last two decades, enhanced environmental regulations in California, and along the West Coast, has caused the foundry industry to severely contract. Many manufacturers of cemetery goods and foundries have closed, or have been relocated to the East Coast. The York Group, the manufacturer of the existing bronze niches at the Avalon Cemetery, was purchased by Matthews International, a foundry based in Pittsburg, Pennsylvania, in 2001.

The need now exists for installation of a new niche at the Avalon Cemetery. A niche is a compartment to hold cremated remains. After much effort, City Staff have not been able to identify another vendor capable of building an outdoor suitable, bronze niche to be installed in stone. Other manufacturers are able to provide niches made of granite, marble or glass that are free standing. The bronze columbarium is superior in strength and resistant to weathering.

According to Avalon Municipal Code (AMC) Sec.3-4.111(b) Sole Source Vendors, "When there Is only one source that provides the necessary services, goods and equipment to ensure compatibility with existing City services, goods or equipment, or the services, goods or equipment are proprietary in nature, the City may procure the goods or services from the sole source."
City Staff request that the City Council designate Matthews International as a sole source vendor as described in Section 3-4.111(b) of the AMC.

On May 10, 2024, City Staff received a quote from Matthews International for the appropriate Eco Bronze Niche. The initial costs, totaling $38,524.00, are as follows:

Materials: $31,284.00
Estimated Freight: $7,240.00
This estimate does not include tax or barge costs therefore, City Staff request the City Council authorize procurement for a not-to-exceed sum of $55,000.

FISCAL IMPACTS: Total expenditure is not-to-exceed $55,000 and is budgeted in the Capital Improvement Project Budget - Project Number 2055003, Account No. 13350-6605.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The Avalon Cemetery will not have sufficient space to house additional remains.

FOLLOW UP ACTION: Complete the equipment procurement as outlined in the City's purchasing policy.

CITY OF AVALON CITY COUNCIL
MEETING DATE: May 21, 2024 AGENDA ITEM:

ORIGINATING DEP: Administration ACM: JF
PREPARED BY: Devin Hart, Management Analyst
SUBJECT: Budget Amendment for Broadband Grant Pledge
RECOMMENDED ACTION(S): Modify the budget amendment that allocated $100,000 to Fund 10525-6547 to establish matching funds for a potential USDA ReConnect Round 5 to allow the allocation to be used for either the USDA ReConnect Round 5 or Last Mile Federal Funding Account if a grant is awarded.

REPORT SUMMARY: This item appears on the agenda at the request of a member of the City Council.

On May 7, 2024, the City Council adopted Resolution No. 24-16 amending the Fiscal Year 2023- 24 Budget to allocate $100,000 to establish General Fund Account No. 10525-6547. These funds are earmarked as matching support for a potential USDA ReConnect Round 5 Grant application submitted by Gateway Cities Council of Government in cooperation with the City of Avalon and AVX Networks.

Separately, AVX Networks has applied for a $35,591,843.63 Last Mile Federal Funding Account grant. Matching funds are not required for this grant; however, Staff have been advised that a financial commitment may help in securing a grant award.

The goal of the project is to establish a fiber system that would originate from the mainland to the Island and provide more reliable high speed internet access.

The total project cost, as defined in the grant application is $35,591,843.63. The matching funds pledged to support the USDA ReConnect could be allocated to this grant if awarded.

As with the pledge to support the USDA ReConnect Round 5 Grant, City funding would only be expended if the grant is awarded, and after an agreement is established to define ownership and/or potential credits for the new broadband services.

Any potential agreement would come before the City Council for approval.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: None.

FOLLOW UP ACTION: Implement City Council direction.

A description of the major infrastructure to be deployed Major infrastructure includes a fiber optic exchange/colocation location, fiber to the home and fiber to the premises, diverse fiber optic middle mile routes.

The distribution outside plant (OSP) will be entirely fiber optic with 48+ fiber count fiber from the beach landing site to the Avalon Central office. Additionally, a 24 strand system will be deployed throughout Avalon to support both passive XGS-PON services, as well as lit ethernet services including dark fiber, wavelength services, and carrier grade (MEF compliant) active ethernet.

A fiber backbone will be deployed across the spine of the island with branches to the populated areas at Middle Ranch, Two Harbors, as well as spurs to the coves which house year round residents.

Estimated breakdown of aerial and underground installation Approximately 30 miles of buried, armored subsea cable from each landing station on the island to diverse beach landing station on the mainland. Primary and backup locations have been identified and studied on both ends.

At AVX and DEFs suggestion, the city of Avalon has passed a resolution to accelerate permitting on the island side, and AVX has identified multiple existing, unused bores that may substantially expedite the installation on the mainland
The majority of the network on the island will be aerial fiber on existing utility poles. The total of this fiber build is approximately 75 miles, including Avalon, the inhabited areas of the interior, existing tower locations, and potential sites for mobile network deployments to enhance emergency coverage.

On the mainland the majority of the network will be underground using existing ducting whever possible.

Major Equipment Expenses
The major capital equipment expenses are as follows:

Routing and Switching Hardware
• UPS Equipment
Generation equipment (outside of CO)
• Microwave during project turn up and to provided connectivity to 45-55 workers housed on offshore oil platforms year round
• SIP Switching Equipment to support VolP and E911 intra island and off island Estimated project plan with major milestones and construction timeline A fully vetted project plan with major milestones is included in the file attachments.

Description of proposed broadband project plan for which FFA funding is being requested, including the type of technology to be provided in the proposed service areas The primary technologies to be used are:

1. a. Passive/un-repeated subsea fiber optic cable from the mainland to the island. b. The fiber will be terminated at diverse landing station at each end, through industry standard directional bores, terminating in an on-shore vault or "beach manhole".

C. The mainland side of the network will connect to via diverse fiber routes to one or more internet data centers in a highly redundant fashion. Excess fiber stands will be available as spares or future The AVX link from the mainland will be lit at 400Gbps per fiber pair (800 Gbps total) to begin with. With DWDM and other technologies this bandwidth can be readily increased to multiple terabits per pair.

2. AVX is ready to accept and provide open-access on the middle mile portions of this network and looks forward to increasing overall connectivity to the island and enabling broader consumer choices, combined with truly available bandwidth at the speeds published. AV will offer a variety of dedicated internet, Ethernet services, as well as wavelength and dark fiber upon bonafide request.

CITY OF AVALON CITY COUNCIL
MEETING DATE: May 21, 2024 AGENDA ITEM: 8
ORIGINATING DEP: Administration ACM: J
PREPARED BY: Devin Hart, Management Analyst
Robert Greenlaw, Capital Improvements Director
SUBJECT: Solicitation of Request for Proposals - Phase II of the Cabrillo Mole Ferry Terminal Rehabilitation Project - Utilities and Temporary Infrastructure Plan
RECOMMENDED ACTION(S): Authorize the City Manager, or his designee, to develop and solicit a request for proposals from qualified firms for the utilities package and temporary infrastructure construction of Phase II of the Cabrillo Mole Ferry Terminal Rehabilitation Project.

REPORT SUMMARY: The Cabrillo Mole Ferry Terminal is a multimodal transportation hub used by cross-channel carrier passengers traveling between the City and the mainland, cruise ship disembarkment/embarkment, and serves as the primary entry point to the City. In 2020, the City completed the first phase of its rehabilitation - reinforcing the existing concrete members, replacing the steel grates, and repairing the concrete deck and railing - for a total project cost of $5.10 million.

The second phase of the project, budgeted at $20 million, will replace and reconfigure the existing structures to improve passenger queuing and adjacent transportation circulation. In 2022, City Staff, working cooperatively with community stakeholders and the design firm Hart Howerton, developed a Design Intent document. This document has been shared in a number of town hall style public meetings and is available for review on the City's website.

To prepare for the renovation of the Cabrillo Mole, the current tenants must be temporarily relocated. City Staff have developed a plan to move many of the tenants to temporary facilities along Pebbly Beach Road. Utilities - gas, water, electricity, etc. - must be relocated to serve this area. Additionally, City Staff plan to raise the landscaping area adjacent to Float 4 and 5 to install decking to allow for queueing at the new temporary facilities.

City proposes the following timeline for this RFP, subject to modification in order to meet the needs of the City:

Tentative Deadline Task
June 10, 2024 Begin solicitation of the RFP
June 16, 2024 Deadline to submit proposals
City Council authorizes CM to negotiate and award contract to August 6, 2024 qualified contractor.

August 19, 2024 Notice to proceed.

Simultaneously to the solicitation of this RFP, City Staff will develop and finalize the procurement package for the temporary tenant buildings and public restrooms. The final temporary facility plan will come before City Council for approval.

It is the City's goal for tenants to be able to occupy the temporary facilities by November.

FISCAL IMPACTS: Undetermined.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City will not begin the process to determine qualified contractors for the utility and temporary infrastructure portion of Phase II of the Cabrillo Mole Ferry Terminal Rehabilitation Project.

FOLLOW UP ACTION: Solicit a request for proposals to determine qualified bidders.

ADVERTISING, NOTICE AND PUBLIC CONTACT: This item was properly listed on the posted agenda pursuant to the Brown Act.
