PUBLIC HEARING

3. Fiscal Year 2024-2025 Miscellaneous Fee Schedule
For Fiscal Year 2024-2025, Staff recommends increasing the majority of fees based on the latest available calendar year consumer price index (CPI) information provided by the Bureau of Labor Statistics for Los Angeles County which shows an increase of 3.90% based for the twelve months ending April 2024, with the fees rounded to the nearest dollar.

Recommended Action

1. Hear a presentation regarding the Miscellaneous Fee Schedule. 2. Open the Public Hearing to hear public comments. 3. Close the Public Hearing. 4. If consensus, adopt a resolution accepting the fee schedule as proposed.

GENERAL BUSINESS

4. Resolution Approving New Classifications and Descriptions The job title of Lead Code Enforcement Officer is already in the SEIU General Employees salary schedule and an employee is assigned. However, no job description was ever formally adopted. The job title of Information Technology Manager is new to the City.

Recommended Action
Adopt a resolution approving new classifications and job descriptions for Lead Code Enforcement Officer and Information Technology Manager.

5. Cruise Ship Wharfage Discussion and Avalon Municipal Code Amendment Cruise ship passengers represent over 30% of visitors in the City's harbor while cruise ship wharfage currently represents less than 20% of harbor revenues. While cruise ship wharfage revenues have increased significantly from pre-COVID levels, both in terms of dollars and percentage of harbor revenues, as a result of the previously scheduled rate increases and increased passenger counts, revenues are forecasted to plateau in future years without further increases to the whartage rate.

Recommended Action
Discuss cruise ship wharfage. If consensus, direct City Staff to bring forward an amendment to the Avalon Municipal Code.

Elbow Enhancements
As a part of the City's development of its Active Transportation Plan, the community and consulting engineers identified the Pebbly Beach Elbow as a priority project. Due to a high volume of pedestrians, narrow sidewalks and significant vehicle traffic the study identified pedestrian safety as a major concern through this corridor.

Recommended Action

1. Hear a presentation regarding further enhancements to the area of Pebbly Beach Road known as the "Elbow." 2. If consensus, authorize a transfer of $25,000 from the Annual Traffic and Transportation Project #10550-6547.

CITY OF AVALON CITY COUNCIL
MEETING DATE: June 4, 2024 AGENDA ITEM: 3
ORIGINATING DEP: Finance CITY MANAGER: DuM
PREPARED BY: Matthew Baker, Finance Director
SUBJECT: Fiscal Year 2024-2025 Miscellaneous Fee Schedule RECOMMENDED ACTION(S): 1. Hear a presentation regarding the Miscellaneous Fee Schedule. 2. Open the Public Hearing to hear public comments. 3. Close the Public Hearing. 4.

If consensus, adopt the fee schedule as proposed.

REPORT SUMMARY: The City charges fees for miscellaneous public services, use of City facilities and equipment rental and other activities. User fees are assessed and collected for City services and programs provided by various departments. These are services that convey a benefit, grant a privilege, provide for review and enforcement of regulatory activities, enforce laws, or are a condition of development. Under State law, cities may charge fees to recoup the direct and indirect costs related to the provision of user services.

Each year, the City reviews its fees to establish new fees, modify existing fees, and eliminate fees that are no longer required to ensure that City fees are in-line with the costs incurred to provide them.

In Fiscal Year 2023-2024, City Council approved a 3.82% increase for the majority of fees, with the exception of transit and certain recreation fees. The percentage increase was based on the consumer price index (CI) information provided by the Bureau of Labor Statistics for Los Angeles County based on the latest available fiscal year information. Using the CPI as an average cost increase annually ensures the city does not unnecessarily burden the citizens with unusually large spikes in fees while also ensuring that the City continues to recoup costs associated with the increased costs to provide these services.

As part of its review process, the City elected to not increase certain fees related to recreation and transit, with those services to be subsidized with general tax revenues. The City also updated ambulance service rates to align with the County of Los Angeles General Public Ambulance rates effective July 1, 2024. In addition, while the majority of fees were rounded to the nearest $1, City Staff elected to round certain fees with a relative high volume of transactions to the nearest $5, highlighted in yellow in the attached schedule. Lastly, the proposed fee schedule was further updated to identify specific municipal code violations and associated fines rather than grouping similar fines under Parking Enforcement as listed in prior versions of the miscellaneous fee schedule. Animal Control was also updated to combine control and roundup fees to a single impound fee and boarding fees were changed from a one-time $45 fee to a daily $25 fee.

GOAL ALIGNMENT: City costs will be offset by annual revenues.

FISCAL IMPACTS: Staff estimates that the new City fees, if adopted as proposed, should generate approximately $140,000 in additional General Fund revenues and $80,000 in Harbor Fund revenues.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The costs of special services will not be fully funded through fees paid by the users of those services. The unfunded portion of user services would then be subsidized by general tax revenues and/or available fund balances.

FOLLOW UP ACTION: Adopt the attached resolution establishing city rates and fees for services.

ADVERTISING, NOTICE AND PUBLIC CONTACT: Pursuant to the Brown Act.

17 CITY OF AVALON CITY COUNCIL
MEETING DATE: June 4, 2024 AGENDA ITEM: 4
ORIGINATING DEP: Administration CITY MANAGER:

PREPARED BY: Jocelyn Francis, Assistant City Manager
SUBJECT: Resolution Approving New Classifications and Descriptions RECOMMENDED ACTION(S): Adopt a resolution approving new classifications and job descriptions for Lead Code Enforcement Officer and Information Technology Manager.

REPORT SUMMARY: The job title of Lead Code Enforcement Officer is already in the SEIU General Employees salary schedule and an employee is assigned. However, no job description was ever formally adopted by City Council and this action will fix the oversight. The job description has been reviewed and recommended by both the employee and SEIU.

The job title of Information Technology Manager is new to the City. For the last decade, the City has contracted out services to a consultant that provides on-island support 60 days a year, which is equivalent to 0.25 FTE for 126 FTE.

Although this may have been adequate in 2012, it is no longer in 2024. This has no bearing on the work product of the current contractor, however the City has reached a point where additional services are required. It's apparent there is a need to improve information technology services both for City staff and the community. Having a dedicated staff person will ensure the timely completion of IT projects, trouble shooting, and further advance innovation through technology. Upon review of other cities and IT staffing ratios, it is clear there is a discrepancy that exists within the City of Avalon's resources into IT.

Agency Total FTE | IT FTE Ratio
City of Coronado 253 6 1:42
City of Goleta 96 2 1:48
City of Ojai 62 2 1:31
City of Pacific Grove 105 2 1:52
City of Redondo Beach 450 7 1:64
If approved, it's recommended this new management level position would handle the day- to-day responsibilities while maintaining the agreement with the current contractor. This would allow for a smooth transition to complete projects in-progress, cross-train, and allow the City to maintain a consultant agreement as a back-up alternative to the proposed City position. A salary survey was also conducted of nine agencies and found a median salary range of $123,451-$142,754.

FISCAL IMPACTS: City staff will request funding for these positions within the FY24/25 operating budget. It is recommended to replace (1) vacant Administrative Analyst with (1) Information Technology Manager, which equates to an estimated annual budget increase of approximately $50,000 (inclusive of salary and projected benefits).

GOAL ALIGNMENT: Fiscal and organizational stability.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City will continue to have no adopted job description for Lead Code Enforcement Officer and will continue status-quo with information technology support.

FOLLOW UP ACTION: Publish the new job descriptions on the City website and work to add the Information Technology Manager position and salary schedule to the Unrepresented-Confidential employee group.

ADVERTISING, NOTICE AND PUBLIC CONTACT: The item was properly listed on the posted agenda pursuant to the Brown Act.

CITY OF AVALON CITY COUNCIL
MEETING DATE: June 4, 2024 AGENDA ITEM: 5
ORIGINATING DEP: Finance CITY MANAGER: DUM
PREPARED BY: Matthew Baker, Finance Director
SUBJECT: Cruise Ship Wharfage Discussion and Avalon Municipal Code Amendment
RECOMMENDED ACTION(S): Discuss cruise ship wharfage. If consensus, direct City Staff to bring forward an amendment to the Avalon Municipal Code.

REPORT SUMMARY: On February 7, 2017, the City of Avalon City Council adopted Ordinance No. 1153-17. The ordinance modified wharfage collected from cruise ship passengers to better recoup the costs of operating and maintaining the harbor and harbor facilities. Most notably, the ordinance increased the application of the wharfage fee from 80 to 100 percent of the cruise ship manifest, minus any crew members. The ordinance also established a tiered increase of the wharfage rate from $3.00 in FY 2018 to $5.00 in 2021. Lastly, the ordinance modified a marketing incentive for cruise lines deploying a second ship to Catalina for 50 or more calls per year.

While the City's last scheduled wharfage increase on cruise ship passengers went into effect on July 1, 2021, the per passenger fee paid by cruise operators has increased by $2.00 over the past three years as a result of the passage of Measure H in November 2020. Measure H imposes a special tax on passengers arriving by cruise ship for the sole purpose of improving or replacing the Catalina Island Medical Center with the taxes collected held separate from wharfage and other harbor revenues. The special tax went into effect on April 1, 2022 at a rate of $0.50 per passenger and increased to $1.00 per passenger on April 1, 2023 and $2.00 per passenger on April 1, 2024, the maximum amount provided under Measure H, for a current combined fee of $7.00 per passenger ($5.00 Wharfage / $2.00 Measure H) per passenger.

The Harbor Fund is an enterprise fund and the costs associated with harbor operations and the maintenance of harbor infrastructure should be recouped through various charges on users of harbor facilities. The cost to operate the harbor increases annually and revenues need to grow to cover these increased costs. The majority of harbor revenues are collected from wharfage fees which are charged to cross-channel and cruise ship operators on a per passenger basis.

Unlike other harbor use fees that are assessed as a percentage of the operator's gross receipts or are subject to annual increases through the miscellaneous fee schedule (e.g. nightly mooring rates), wharfage fees have not been scheduled to increase annually in recent years, requiring annual increases in the number of passengers in order to grow the revenues necessary to recoup the annual increased operating costs.

The table below provide a summary of cruise ship activity and revenues over the past ten fiscal years:

Fiscal FY16 FY17 FY18 FY19 FY20 FY21 FY22 FY23 FY24 FY25 Year
Rate $2.50 $2.50 $3.00 $3.50 $4.00 $4.50 $5.00 $5.00 $5.00 $5.00 Arrivals 110 116 112 116 79 83 107 116 112
Visitors 270,843 278,507 277,983 285,870 173,847 • 0 0 133,665 314,123 353,454 360,518 Average 2,462 2,401 2,482 2,464 2,200 1,610 3,035 3,047 3,219 Revenues $419,912 $485,012 $734,166 $603,572 $611,410 $0 $662,350 $1,570,615 $1,767,270 $1,802,590 Harbor revenues reported are net of the City's marketing incentive which one cruise ship operator qualified for during FY17, FY18, and FY19. The City has not had an operator qualify since FY19. While the number of cruise ships arriving in the harbor has been relatively consistent over this ten year period, after excluding the impacts of pandemic-related restrictions, the number of arrivals have been more evenly disbursed between operators and the average passenger counts on vessels has increased over the past ten years with operators transitioning to larger vessels.

The cities of Monterey and Santa Barbara are two other destinations in California serving cruise ship visitors. In April 2024, the City of Santa Barbara voted to limit cruise ship visits to 20 per year and prohibited visits from Memorial Day through Labor Day and on weekends year-round Santa Barbara collects a fee of $15 per manifest passenger, increasing from $10 on July 1, disembarking passengers. Prior to this action, the City of Monterey assessed a cruise ship passenger landing fee of $7.00 per passenger for processing passengers pursuant to policies required by the United States Department of Homeland Security for approximately 12-18 arrivals per year. Cruise ships are still allowed to dock, land, and discharge passengers in Monterey; however, the City is no longer providing the shore services for them.

In January 2020, the City of Avalon adopted a cruise ship policy establishing guidelines to provide an equitable community strategy in managing cruise ship requests for calling on Avalon as a port-ot-call. In general, the policy limits the number of regularly scheduled cruise ship vessels to not exceed three per week or to arrive on weekends without City Manager approval and limits the overall number of new arrivals to the City.

Cruise ship passengers represent over 30% of visitors in the City's harbor while cruise ship wharfage currently represents less than 20% of harbor revenues. While cruise ship wharfage revenues have increased significantly from pre-COVID levels, both in terms of dollars and percentage of harbor revenues, as a result of the previously scheduled rate increases and increased passenger counts, revenues are forecasted to plateau in future years without further increases to the wharfage rate, as the number of arrivals and number of passengers are not anticipated to increase significantly over the next several years. The proposed budget estimates cruise ship wharfage revenues to increase by 2.0% compared to current year estimates while operating expenditures are budgeted to increase by 7.1%. In the long-term, operating revenues either need to grow at the same pace as expenditures or reductions to operations will be required to manage the harbor in a sustainable manner.

Staff recommends increasing the cruise ship wharfage rate to $7.00 per passenger beginning July 1, 2025 and removing the marketing incentive from the Municipal Code. This action would generate an additional $700 thousand annually to ensure harbor revenues continue to cover the increasing costs to operate the harbor.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The Avalon Municipal Code will not be amended and cruise ship wharfage will remain at $5.00 per passenger.

FOLLOW UP ACTION: If direction is provided, prepare an ordinance to increase wharfage for introduction and adoption.

CITY OF AVALON CITY COUNCIL
MEETING DATE: June 4, 2024 AGENDA ITEM: 6
ORIGINATING DEP: Administration CITY MANAGER: DAL
PREPARED BY: Devin Hart, Management Analyst
Robert Greenlaw, CIP Director
SUBJECT: Elbow Enhancements
RECOMMENDED ACTION(S): 1. Hear a presentation regarding further enhancements to the area of Pebbly Beach Road known as the "elbow." 2. If consensus, authorize a transfer of $25,000 from the Annual Traffic and Transportation Project #10550-6547.

REPORT SUMMARY: As a part of the City's development of its Active Transportation Plan (ATP), the community and consulting engineers identified the Pebbly Beach Elbow as a priority project. Due to a high volume of pedestrians, narrow sidewalks and significant vehicle traffic the study identified pedestrian safety as a major concern through this corridor.

On May 7, 2024 the City Council heard a presentation from Robert Greenlaw, CIP Director, regarding enhancements at the elbow. Enhancements, implemented on May 9, 2024 included implementation of 6 traffic calming elements to help streamline pedestrian access, improve public safety and reduce congestion through the area, including:

Expanded the crosswalk at the intersection of Clarissa Avenue and Crescent Avenue; - Expanded the walkway in front of businesses along Crescent Avenue; - Eliminated four parking spaces in front of the Pancake Cottage; and - Added crosswalks from the walkway along Pebbly Beach Road to businesses.

The improvements were implemented to support traffic calming and improved multimodal safety.

After an initial three week trial period, City Staff, including the CIP Director and City Manager, met one-on-one with the businesses most directly affected by the traffic enhancements in the area - Catalina Island Golf Cart, Pancake Cottage, the Steamer Trunk, Island Threadz, and Catalina Island Conservancy.

The business feedback was overwhelmingly positive; however, some feedback was received regarding the placement of the crosswalk from the main walkway to the businesses on the other side of Crescent Avenue.

While the long term vision of the area includes repositioning the sidewalk through the shaded palapa seating area, City Staff are not able to replicate that improvement in the initial trial. After consideration of the feedback gathered by the stakeholders in the area, as well as observations of traffic flow, City Staff recommend the
