CITY OF AVALON CITY COUNCIL
MEETING DATE: March 4, 2025 AGENDA ITEM: 5
ORIGINATING DEP: Finance CITY MANAGER:PREPARED BY: Matthew Baker, Finance Director SUBJECT: Fiscal Year 2024-2025 Miscellaneous Fee Schedule RevisionsRECOMMENDED ACTION(S): 1. Hear a presentation regarding the Miscellaneous Fee Schedule. 2. Open the Public Hearing to hear public comments. 3. Close the Public Hearing. 4.
If consensus, adopt the fee schedule as proposed.
REPORT SUMMARY: The City charges fees for miscellaneous public services, use of City facilities and equipment rental and other activities. User fees are assessed and collected for City services and programs provided by various departments. These are services that convey a benefit, grant a privilege, provide for review and enforcement of regulatory activities, enforcelaws, or are a condition of development. Under State law, cities may charge fees to recoup the direct and indirect costs related to the provision of user services.
Each year, the City reviews its fees to establish new fees, modify existing fees, and eliminate fees that are no longer required to ensure that City fees are in-line with the costs incurred to provide them.On June 4, 2024, City Council approved a 3.90% increase for the majority of fees effective July 1, 2024, with the exception of transit and certain recreation fees. The percentage increase was based on the consumer price index (CPI) information provided by the Bureau of Labor Statistics for Los Angeles County based on the latest available fiscal year information. Using the CPI as an average cost increase annually ensures the city does not unnecessarily burden the citizens with unusually large spikes in fees while also ensuring that the City continues to recoup costs associated with the increased costs to provide these services.
Since the adoption of the fee schedule, City Staff would like to propose the following new fees to be added:
• Major Encroachment Permit at $2,000• Various Towing and Storage Fees related to the new Vehicle Storage Lot• Waste Water Disposal Fee of $0.25 per gallon• Use of Labor and Equipment updated to include:
o Ditch Witch Equipment Rental at $47 per houro Maintenance Superintendent at $75 per hour City Staff would like to also propose the removal of the combined scheduled annual service fee as the personnel and equipment may vary depending on the location and nature of required service.
GOAL ALIGNMENT: City costs will be offset by annual revenues.FISCAL IMPACTS: Staff estimates that the new City fees, if adopted as proposed, would be nominal.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The costs of special services will not be fully funded through fees paid by the users of those services. The unfunded portion of user services would then be subsidized by general tax revenues and/or available fundbalances.
FOLLOW UP ACTION: Adopt the attached resolution establishing city rates and fees for services.
ADVERTISING, NOTICE AND PUBLIC CONTACT: Pursuant to the Brown Act.

SUBJECT: Presentation and Discussion on Revisions to Avalon Municipal Code § 4-4 Vehicles
RECOMMENDED ACTION(S): Receive a presentation to consider updates to AvalonMunicipal Code § 4-4 Vehicles and provide direction on revisions.
REPORT SUMMARY: Per California Vehicle Code 21100.5, the City of Avalon is uniquely bestowed the authority to manage and regulate vehicles including the size, number, vehicle class, noise limits, and maximum speed limits.
The City’s vehicle regulations have been in place for several decades with revisions every few years, addressing vehicle classifications, permits, and enforcement. Recent changes in vehicle technology, increased transportation demands, and evolving community expectations necessitate a comprehensive review. City staff are presenting considerations for City Council that introduce modernized definitions, permit categories, and administrative procedures while preserving core public safety and operational standards. Below are items staff is seeking discussion and direction on before returning to City Council with a draft ordinance.
1. Definitions and Classifications:
• More detailed definitions in a centralized location at the beginning of the code to clearly distinguish between vehicle types and terminology. Enhance clarityfor both enforcement and public understanding. • Consider changing Microcar Length from 120.1” to 135” to accommodate “Kei” trucks without modification and Oversize from 200” to 215” to acknowledge larger full size vehicle standards (currently 71 residential vehicles oversize). • Aflow residents in ADUs and JADU5 to qualify for Residential Autoette. • Allow Vehicle Hearing Officer to approve requests for more than 1 Residential Autoette for Senior and/or Disabled Roommate Living accommodations.
2. Permit Structure and Limitations:
• Add a Residential Motorcycle Permit definition (to include motorized scooters) and limit 1 per dwelling unit.
• Consider explicit limits (for example, no more than ## residential vehicle permits or ## commercial vehicle permits).
o Or, continue issuing 2 for 1 residential vehicle permits (blue sticker) and 1 for 1 commercial vehicle permits.
o And/or, set caps at today’s current issuance (including autoettes) with a 1 for 1 replacement for all vehicle types.
• More clearly outline a waitlist mechanism to manage demand more equitably and determine feasibility of “banking” stickers.
o Consider Annual Waitlist Renewalo Currently 41 autoette vehicles with Residential Blue Sticker and 34 permits renewed annually with no associated vehicle.
• Align overnight parking regulation hours (non-residential midnight to 6:00 am and commercial 7:00 pm to 6:00 am).
o Current Code requires Oversized Vehicles Park Off-Street (although not readily known or enforced).
• Address the Use of “Floaters” not currently in Code.
3. Replacement and Transfer Provisions:
• Allow Legacy permits to continue as long as renewed annually and on-time (currently totals roughly 128 residential vehicle permits). • Clearly delineate replacement conditions, including restrictions for oversized vehicles and mandates that commercial autoettes or rental autoettes be replaced with certified electric vehicles.
• Refine Transfer provisions, particularly for residential vehicle permits, to address situations such as death, dissolution of marriage, or intergenerational transfers regardless of when a permit was originally secured. • Consider transfers to full-time Residents or Real Property Owners.
4. Administrative and Enforcement Enhancements:
• Assign clear responsibilities to the Vehicle Clerk and Vehicle Hearing Officer, ensuring a more consistent application of the regulations. • Outline enhanced enforcement measures (e.g., detailed procedures for citations and fines for non-compliance), which are designed to better address repeat violations and unauthorized vehicles.
5. Additional Considerations:
• Create Residential Parking Program (by neighborhood application) ordinance.• Clarify Electrification Requirement for Commercial Autoette and Commercial Rental Autoette.
• Modify AMC 9-7-606 (a) Parking Space Dimensions (current autoette parking space is outdated at: 6’ in width x 10’ in length).
After input and public comment, staff expect to return to City Council at a later date with a draft ordinance for further discussion and review. Any requested changes would be reviewed by the City Attorney to make sure they are compliant with the Vehicle Code and any due process or property rights.
