The insurance premium for this policy will be cost prohibitive. In order to get a builder’s risk quote will need to know the age of the structures and the structures’ replacement value and the value of the City supplied materials. Can the City delete the Builder’s Risk insurance requirement and if not can theCity supply the required information above? Builder’s Risk Insurance requirement has been omitted. 48. How will the piles be driven? Vibrated or hammered into the ground? Piles will be driven a minimum of 20 feet (less if refusal). Last project we jetted then hammered at least the last 5 feet.
49. What is the minimum thickness of the coating? (we use a PolyUrea coating applied by sprayer). I read on your specifications that for plastic wrap minimum of 1/10”. Does thatsame thickness apply to Polyurea coating? The typical spec for Polyurea applications is 150 mil (0.15”) to 250 mil (0.25”), anticipatethat fender piles are going to have the thicker coating.
50. How much of the pile will need to be coated? I read in the specifications that the coating must extend to at least 18” below the mudline and run all the way to the top.
Your typical coating spec will be sufficient. Last project we cut 5’ to 10’ feet off the butt.
51. We typically manufacture these piles with polyurea coverage starting at 5’ from the butt (top) to 10’ from the tip with 150 mils thickness. Will this coverage be acceptable for thepiles on this project? For the structural piles the lesser spec is sufficient. For the fender piles the thicker coating is required.
52. Assume for bidding purposes piles will only be hot dipped galvanized, with no coating.

CITY OF AVALON CITY COUNCIL
MEETING DATE: April 1, 2025 AGENDA ITEM:
ORIGINATING DEP: Administration CITY MANAGER:_________
PREPARED BY: David Maistros, City Manager
Devin Hart, Senior Management Analyst
SUBJECT: Discuss Revisions to Article 3 of Chapter 1 of Title 3 of the Avalon Municipal Code Modifying the Transient Rental licensing system RECOMMENDED ACTION(S): Review and discuss alternatives to proposed amendments to transient rental licensing system. If consensus, recommend the Planning Commission consider ordinance revisions regarding transient rental license regulations, and direct staff to revise the ordinance.
REPORT SUMMARY: In 2020, the City of Avalon modified the process by which it monitors and regulates transient rentals. Prior to 2020, transient rentals were authorized by Conditional Use Permit, “CUP” under the City’s Zoning Code. On December 15, 2020, the City Council adopted Ordinance No. 1192-20 (the “TRL Ordinance”), which modified the way that transient rentals are approved in the City. These changes are now reflected in Article 3 of Chapter 3-1 of Title 3 of the Avalon Municipal Code (AMC). In modifying the AMC, transient rentals would no longer be authorized with a CUP, which runs with the land irrespective of intensity of use or transfer of property ownership. Now, the City authorizes transient rentals through a Transient Rental License (TRL) system that requires the applicant to annually seek re-approval of the license.
Additionally, Article 3 of Chapter 3-1 of Title 3:
• Allows existing compliant CUPs for transient rentals to remain valid until the second sale of the property to which the CUP is tied (the amortization period). Upon the second sale, the CUP expires, and the property owner must apply for a Transient Rental License.
• Establishes guidelines and standards for the Planning Commission in deciding whether to approve the license (occupancy limits, management requirements, payment of transient occupancy tax, etc.). The City Council hears appeals from the Planning Commission’s decision.
• Prohibits transfer of Transient Rental Licenses, except as otherwise provided. • Requires the Planning Commission to notice and hold a public hearing prior to approving a Transient Rental License.
• Establishes a transient rental inspection program, sign requirements, advertising requirements, and other standards on the operation of an approved transient rental.
Council amended the TRL Ordinance on November 16, 2021 to require that all transient rental properties shall ensure a minimum of three nights per calendar year. The ordinance also imposed penalties for not meeting that minimum requirement.
On August 1, 2023, the City Council adopted Urgency Ordinance #U-121223 establishing a 45- day moratorium on the issuance of new Transient Rental Licenses. On September 15, 2023, the City Council adopted Urgency Ordinance #U-1213-23, extending the moratorium for an additional 10 month and 15-day period. This additional time was needed to further determine the level of impact of Transient Rentals in the City of Avalon.
On August 6, 2024, the City Council adopted Urgency Ordinance #U-1220-24, extending the moratorium until July 30, 2025 to allow City staff to develop a Transient License database and complete a comprehensive inventory of Transient Rental Licenses and existing CUPs in Avalon.
During the moratorium period, City Staff held two community/stakeholder meetings discussing quality of life issues, financial benefits and impacts, and the sustainability and housing impacts associated with transient rentals.
From December 1, 2023 to January 21, 2024, the City conducted a survey to determine the overall impact of Conditional Use Permits and Transient Rental Licenses amongst Island visitors, residents and property owners. The survey also provided insight into participant’s thoughts regarding potential enhanced regulations and/or additional enforcement. The City received 457 complete survey responses, but a total of 595 responses were submitted. Survey results were presented to the Planning Commission on February 21, 2024 and provided to the City Council on August 6, 2024.
When asked to rank the topics to be considered before imposing future short-term rental regulation by order of importance, survey respondents ranked the top five topics as follows:
Rank Topic Average Top Total
Response Response (out
of 457)
I Impacts on Affordable Housing 3.54 150 at#1
2 Penalties for Non-Compliance w/Existing Rules and Regulations 4.15 99 at #3 3 Establish a City-Wide Cap on Number of Short-Term Rentals (TRLs) 4.74 109 at#1 4 Preserving the Transient Rental Revenue for the City 4.76 60 at #6 85at#7
In terms of the regulation of short-term rentals in Avalon, survey respondents ranked the following options:
Rank Regulation # of Responses
1 Set a cap for a maximum number of overall transient rentals in the City. 223 — 48.8% 2 Determine saturation limits (by # of units or % of units) in each neighborhood. 134 — 29.3% 3 Increase Short-Term Rental License fees to fund enforcement and/or affordablel3l — 28.7% housing program.
4 Revoke inactive short-term rentals or CUPs. 115— 25.2% Limit the number of transient rental unitsa single person may own. 102—22.3% 6 For every new transient rental unit a person owns they must also have a long term94 — 20.6% rental available.
7 Establish clear penalties for noncompliance with Transient Rental License 84 — 18.4% regulations.
8 Establish a clear policy for owners that will lose their Transient Rental License if 77— 16% they violate the regulations three times.
9 Avalon has been a vacation rental destination for over 50 years, no new 73— 16% regulations are needed.
10 Create an online system with 24/7 monitoring and response to complaints with 64— 14% access to property managers.
11 More strictly enforce regulations regarding operations of Transient Rental 51 — 11.2% Licenses.
12 Property Managers must respond to a complaint within 30-60 minutes or they 39 — 8.5% will be fined.
Considering the survey responses, stakeholder and community feedback, and a comprehensive review of other California municipal short-term rental ordinances, City Staff recommends CityCouncil consider the following revisions to the Transient Rental License Ordinance:
1. Modify the regulatory guidelines to implement a revocation policy based on non compliance with the City’s noise ordinance, responsiveness of property manager tocomplaints, and the City’s policies and procedures regarding trash, parking, etc.
2. Establish an annual renewal license fee (i.e. $1 000) for all short-term rentals renting 20or more days a year. This fee will recoup expenses associated with City services (sewer, solid waste, LASD contract) as well as offset the cost of increased regulation and enforcement, administrative oversight, iWorq database, expanded Host Complianceagreement, and an inclusionary housing fee.
3. Establish an annual renewal license fee (i.e. $250) for all short-term rentals renting fewer than 20 days a year to offset administrative costs, the cost to maintain the iWorq database and an inclusionary housing fee.
a. Allow a waiver of the fee if the property owner provides proof that a long-term tenant is occupying the rental.
4. Require all online short-term rental postings include property’s City of Avalon Business License Number. This will allow for more definitive tracking of short-term rentals.
5. Require an on-site property manager meet the guest(s) and review the City’s rules and regulations and verify number of guests arriving are in compliance with unit’s occupancylimits.
6. Establish a maximum number of short-term rentals in Avalon by an adopted resolution. (City-wide Cap). This resolution will be reviewed every two-years, or by the request of theCity Council, to ensure the City is balancing the need to preserve affordable housing with the economic benefit of revenues derived from short term rentals.
7. If City-wide Cap is adopted, implement a waitlist policy and annual procedure for monitoring the waitlist.
In order to establish a maximum cap of short-term rentals, in Spring 2024, the City contracted with iWorks to assist in the development of a comprehensive database to assist in the management and tracking of the City’s Conditional Use Permits and Transient Rental Licenses.
Initially, an analysis was conducted by City Staff using the City’s business license database, as well as transient rental license records, to identify a total number of short-term rentals in Avalon.
According to the analysis of the business license database and transient rental license records, City Staff determined there are 373 properties with transient rental business licenses. • 260 are CUPs,
• 29 are TRLs, and
• 84 are “grandfathered.”
“Grandfathered” short-term rentals are rentals established before the 1994 modification of the Avalon Municipal Code to permit short-term rentals by issuance of a CUP. City Staff recommends that all “grandfathered” transient rental properties in good standing (with a valid business license and actively paying TOT) be consolidated to be included on the City’s shortterm rental list and be treated as active CUP holders. As such, the grandfathered properties would hold the ability to sell one time (amortization period).
To ensure that all CUPs have been identified and accounted for, City Staff took an additional step of culling through more than 40 years of historical records detailing the issuance, transfer and revocation of Conditional Use Permits within the City of Avalon.
After completing the analysis of historical records, City Staff identified an additional 62 properties that have obtained a CUP; however, these properties are not active business license holders and have not remitted TOT in recent history.
Before providing a recommendation to the City Council regarding a potential short-term rental cap, City Staff would like to first commence the revocation process for any properties not incompliance with the AMC, including those not holding an active business license and/or nonpayment of TOT, staff action shall include seeking termination of CUPs that are not in compliance with AMC § 9-8.4 1 1.
City Staff recommends that the City Council direct the Planning Commission consider theproposed revisions to the AMC at their next regular meeting. Planning Commission’srecommendations will be brought back to the City Council with a revised ordinance at a futuremeeting.
GOAL ALIGNMENT: Affordable housing.
FISCAL IMPACTS: To be determined.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: City Staff will not have direction on how to proceed in amending the AMC.
FOLLOW UP ACTION: Provide recommendations to the Planning Commission for consideration.
