CITY OF AVALON CITY COUNCIL
MEETING DATE: May 20, 2025 AGENDA ITEM: _ 3
ORIGINATING DEP: Finance CITY MANAGER:_DMM
PREPARED BY: Matthew Baker, Finance Director
SUBJECT: Fiscal Year 2024-2025 Third Quarter Treasurer's Report RECOMMENDED ACTION(S): Adopt the resolution accepting the FY24-25 Third Quarter Treasurer's Report.

REPORT SUMMARY: State and Municipal Codes require the Treasurer to submit within 30 days following each fiscal quarter a report summarizing the City's cash and investment balances. Attached is the Third Quarter Treasurer's Report for FY24-25. The report was shared with the City Treasurer prior to presentation to City Council.

The purpose of the report is to inform, on a quarterly basis, the City's cash and investment balances, the investment types, yields, and market values, and to ensure that the City's investments are in compliance with the City's adopted investment policy. The report shows that all of the City's funds are in compliance with its investment policy. In general, operating cash is held in US Bank checking accounts and any excess cash is invested in California's Local Agency Investment Fund (LAIF) and various certificates of deposit (CDs). In accordance with Government Code sections 16429.1 and 53601 et seq., the City cannot invest more than 30% of its portfolio in CDs. CDs accounted for 17.6% of the unrestricted cash and investments for the quarter ended March 31, 2025.

The City did not having any CDs or treasuries that matured during the quarter ended March 31, 2025. The City takes a ladder approach with staggered maturities for its CD investments to balance its goals of high rates in the short-term with stability to withstand market fluctuations in the longer-term. The City will continue to assess for opportunities to increase its investment returns while maintaining necessary liquidity and compliance with its investment policy.

The unrestricted cash balance for the third quarter of 2024-2025 totaled $23.9 million, an increase of $2.9 million from the third quarter of 2023-2024. The unrestricted cash balance includes cash from enterprise funds (e.g. Harbor, Sewer, Saltwater, and Solid Waste) not available for general government functions. The increase in unrestricted cash is attributable to increases in visitor-driven tax revenues and the timing of significant capital outlays. While the majority of grant funding is performed on a cash reimbursement basis, the unrestricted cash and investments balance also includes $2 million in grant pre-funding received in preparation for construction of the second phase of the Cabrillo Mole Ferry Improvement project that has not been spent as of March 31, 2025. The unrestricted cash balance decreased by $2.9 million compared to the second quarter of 2024-2025. The decrease in unrestricted cash balance from the prior quarter is attributable to the seasonality of visitor-driven tax and property tax revenues and the timing of significant capital outlays, including $1.4 in outlays related to the Five Corners Pedestrian Improvement project expended during the quarter. The City expects significant capital outlays on several major capital projects, including the second phase of the Cabrillo Mole Ferry Terminal rehabilitation and the Five Corners Pedestrian Improvement project, to further reduce unrestricted cash balances over the next several quarters.

Below is a chart comparing unrestricted cash balances from the first quarter of Fiscal Year 2015-2016 to the second quarter of Fiscal Year 2025-2026.

CITY OF AVALON CITY COUNCIL
MEETING DATE: May 6, 2025 AGENDA ITEM: 4
ORIGINATING DEP: Administration CITY MANAGER:_DMM
PREPARED BY: David Maistros, City Manager
SUBJECT: Adopt an Ordinance Establishing Rules and Regulations for Use of Avalon Beaches and Parks
RECOMMENDED ACTION(S): Adopt an Ordinance establishing Chapter 10-8 and 10-9 of the Avalon Municipal Code setting forth rules and regulations for use of Avalon beaches and parks.

REPORT SUMMARY: This ordinance was introduced and all further readings were waived at the April 15, 2025 regular City Council Meeting.

In October 2024, the City Council discussed prohibition of tents on city-owned beaches. In summer of 2024, the City received complaints regarding large camping tents and pop-ups on beaches along Crescent Avenue. Specifically, residents and visitors noted the tents restricted access to the beach, inhibited enjoyment of the view, and were erected for many consecutive days without continual usage.

The Avalon Municipal Code does prohibit tents in Avalon. Section 5-5.02 of the AMC states:

It shall be unlawful for any person to camp or to erect or maintain tents or other temporary shelters or occupy the same at any place within the City limits.

Concerns exist regarding the ability to enforce the existing code as it relates common activity encountered on our beaches. Section 5-5.02 could certainly be used to prohibit the pop-up canopies and four-pole tents that are so commonplace. However, would a regular beach umbrella be prohibited as an "other temporary shelters" pursuant to the AMC? Establishing a clear definition of what is prohibited would be recommended prior to moving forward with enforcement of Section 5.5.02 as it related to the beaches in Avalon.

During the October 22, 2024 City Council Meeting, the City Council requested City Staff bring back an ordinance establishing reasonable and enforceable regulations limiting the size of tents and shade structures on city-owned beaches.

City Staff conducted a survey of beach cities and noted that most beach cities have robust regulations regarding use of public property including beaches and parks. With the intention to maintain and maximize the natural beauty and aesthetic of beach and park areas; the availability of limited beach and park areas for diverse uses; and public safety, City Staff developed an ordinance to formally codify regulations for use of the City's beaches and parks.

These proposed regulations include:
• Provisions against overnight camping, fires, littering and the consumption of alcohol. • Provisions regarding the erection of shade covering devices on the beach. • Permit requirements for large gatherings on the beach. • Provisions regarding conduct in City Parks.

FISCAL IMPACTS: Undetermined.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City will not have updated regulations regarding conduct on beaches and parks.

FOLLOW UP ACTION: Implement Council direction.

ADVERTISING, NOTICE AND PUBLIC CONTACT: This item was properly listed on the posted agenda in compliance with the Brown Act.

CITY OF AVALON CITY COUNCIL
MEETING DATE: May 20, 2025 AGENDA ITEM: 6
ORIGINATING DEP: Administration CITY MANAGER: DMM
PREPARED BY: Devin Hart, Senior Management Analyst
SUBJECT: Tremont Street Easements for Five Corners Site Improvement Project
RECOMMENDED ACTION(S): Authorize the City Manager to set forth conditions and execute encroachment permits for property owners immediately adjacent to Tremont Street within the Five Corners Site Improvement Project Tremont Street including 357 Clemente Avenue, 358 Clarissa Avenue, 357 Clarissa Avenue, 359 Catalina Avenue, and 357 Descanso Avenue, in conformance with Avalon Municipal Code Section 4-

9.106.

REPORT SUMMARY: The Five Corner Site Improvement Project is a "complete streets" design improvement to the intersections of Tremont Street, Avalon Canyon Road, Country Club Drive, and Sumner Avenue. The project's goal is to provide safer transportation access along Tremont Street and through the "Five-Corners" intersection for pedestrians, bicyclists, motorists and transit riders of all ages and abilities.

Improvements include: new sidewalks, safer crossings, comfortable and accessible public transit stops, traffic calming, landscape beautification, and wayfinding.

The project also addresses existing private encroachments along Tremont Street Throughout the planning and implementation of this project, City Staff have worked with eight property owners with existing encroachments within the public right of way adjacent to Tremont Street. All property owners have been cooperative with the City in removing encroachments along the right of way to facilitate the Five Corners Site Improvement Project.

After completion of the public improvements along Tremont Street, an area of the public right of way will remain unused. Six of the property owners immediately adjacent to Tremont Street have expressed an interest in establishing legal encroachments:
- 357 Clemente Avenue - 358 Descanso Avenue
- 358 Clarissa Avenue - 359 Catalina Avenue
- 357 Clarissa Avenue - 357 Descanso Avenue
Article 1 of Chapter 4-9 of the Avalon Municipal Code establishes regulations for the approval, establishment of terms, and revocation of encroachment permits. Though the City Manager has authority to approve minor, temporary encroachments, per AMC Section 4-9.105, City Council approval, upon the recommendation of the City Manager, is required for:
(a) Encroachments for any permanent structures above, on or beneath the surtace.
(b) Encroachments upon any public street which closes the street to public use, or which substantially interferes with public use of the street, except parades for which a permit is issued under the provisions of this Code. (c) Any other type of encroachment other than temporary construction activity which does not constitute a minor encroachment.

The criteria for approval or denial of a permit is outlined in AMC Section 4-9.106:

Encroachment permits may be granted if each of the following criteria are met:
(a) The encroachment is necessary or desirable;
(b) The encroachment does not create a substantial adverse impact on persons or property; and
(c) The encroachment does not adversely affect the public health, welfare and safety.

With the exception of the property at 358 Descanso Avenue, the nature of the proposed encroachments) for the property owners adjacent to Tremont Street is limited to installation of various types of fences and landscaping within an approximate 2-foot area of the public right-of-way.

The encroachment permit for the property at 358 Descanso Avenue will be brought before the City Council at a separate meeting.

City Staff recommends the City Council authorize the City Manager to negotiate, set forth conditions, and execute encroachment permits for the property owners immediately adjacent to Tremont Street including 357 Clemente Avenue, 358 Clarissa Avenue, 357 Clarissa Avenue, 359 Catalina Avenue, and 357 Descanso Avenue, in conformance with Avalon Municipal Code Section 4-9.106.

Per AMC Section 4-9.109, the term of an encroachment permit issued, even by the City Council, shall not exceed five years and shall be revocable upon 30 day's written notice to the permittee.

Additionally, the City Manager will set forth conditions of the encroachment permits including establishing an appropriate level of insurance required as well as maintenance standards and any potential bond requirement.

FISCAL IMPACTS: Undetermined.

GOAL ALIGNMENT: Not Aligned.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: N/A.

FOLLOW UP ACTION: Negotiate and finalize encroachment permits for property owners adjacent to Tremont Street.

CITY OF AVALON CITY COUNCIL
MEETING DATE: May 20, 2025 AGENDA ITEM: 7
ORIGINATING DEP: Fire CITY MANAGER:_ DMM
PREPARED BY: Michael Alegria, Fire Chief
Devin Hart, Senior Management Analyst
SUBJECT: Ordinance Designating Fire Hazard Severity Zones Pursuant to Government Code Section 51179
RECOMMENDED ACTION(S): Introduce and waive all further readings of an ordinance designating fire hazard severity zones for the City of Avalon pursuant to Government Code Section 51179.

REPORT SUMMARY: The California Department of Forestry and Fire Protection (CalFire) periodically updates fire hazard severity zones maps for Local Responsibility Reas (LRA). These maps identify varying levels of fire hazard (Moderate, High and Very High) based on factors including vegetation, topography, weather, crown fire potential, and ember production and movement. The last time the City of Avalon fire map was updated was in October 2013 by Ordinance No. 1124-13. The update provided by CalFire is consistent with the 2013 map in that the entirety of the City of Avalon's jurisdiction is designated as a Very High Fire Hazard Severity Zone.

Pursuant to Government Code Section 51178.5, within 30 days of receipt of the fire maps from CalFire, the City made the information available for public inspection and comment.

At the time this report was authored, the City had not received any public comments.

Additionally, it should be noted that the City may only increase the level of fire hazard severity as identified by CalFire within their jurisdiction. The designated fire hazard severity cannot be decreased by the local jurisdiction.

State law requires local jurisdictions to formally adopt these maps by ordinance to ensure proper implementation of associated building standards and fire safety requirements in identified hazard zones.

The proposed ordinance formally adopts the recommended fire hazard severity zone map for the City, as identified by State Fire Marshal, and authorizes their use for determining applicable building standards for new construction, implementing defensible space requirements, disclosure requirements for real estate transactions, and emergency planning, and fire prevention efforts, among other things.

City Staff recommends the City Council accept and implement the updated CalFire LRA maps designating the fire hazard severity zones identified by the State Fire Marshal for our jurisdiction. If approved, City Staff further recommends that the City Clerk submit a copy of this ordinance to the State Board of Forestry and Fire Protection within 30 days after adoption and take any necessary and proper actions to post all notices required under Government Code Section 51179.

FISCAL IMPACTS: Undetermined.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City will not be in compliance with state law.

FOLLOW UP ACTION: Implement City Council direction.
