CITY OF AVALON CITY COUNCIL
MEETING DATE: March 3, 2026 AGENDA ITEM: _2
-
ORIGINATING DEP: Harbor Department CITY MANAGER:

PREPARED BY: Kevin Schmidt, Harbor Master
SUBJECT: Purchase of Two (2) Yamaha Outboard Engines and Hardware RECOMMENDED ACTION(S): Authorize the Harbor Master to purchase two (2) Yamaha 150 horsepower outboard engines, including necessary installation hardware and labor along with two spare gear cases, for an amount not-to-exceed $55,663.02.

REPORT SUMMARY: The City of Avalon Harbor Department applied for and was awarded Boating Safety Equipment Grant (BSE-25) funding through the Department of Parks and Recreation, Division of Boating and Waterways. The grant makes available $55,663.02 in funds to purchase two (2) Yamaha Outboard Engines and necessary installation hardware to replace existing stock of engines currently in use by the Avalon Harbor Department.

The Harbor Department currently has two (2) patrol boats that utilize outboard engines. Both are very high-time engines. One engine currently requires a major repair; the other is nearing the end of its useful life. The Yamaha 150XSA outboards for which grant funding has been approved will provide reliable and efficient powerplants for the patrol boats.

To fulfill the purchasing requirements set forth in Avalon Municipal Code Section 3-4.106, City Staff solicited vendor price quotes from three qualified venders. RJ Nautical, Mauer Marine and West Coast Marine Service of Newport Beach. Each vendor provided quotes for hardware and labor. The Avalon Boat Stand, a Yamaha-certified maintenance facility, provided a quote for installation of the two outboards.

Per the vendor solicitations:

Vendor Two (2) engines plus rigging Installation Spare Lower Units (w/o sales tax) (w/o sales tax)
West Coast Marine $41,941.64 $5,780.00 $6,254.72
RJ Nautical $45,666.00 $3,780.00 $5,500.00
Mauer Marine $42,293.00 $5,600.00 $6,337.10
Avalon Boat Stand DNB $3,640.00 DNB
City Staff recommends the City Council approves procurement of the equipment to the lowest responsive bidder. Staff will procure the outboard engines from West Coast Marine Services, lower unit gear assemblies from RJ Nautical and installation will be performed by Avalon Boat Stand. Shipping to the Island is estimated to be $386.52. This comes to an estimated total of $55,296.

FISCAL IMPACTS: $55,663.02 of this purchase is covered by the Boating Safety Equipment Grant (BSE-25) awarded to the City of Avalon.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: Avalon Harbor Department will need to use Harbor Funds to replace aging engines currently in use by Harbor Patrol.

FOLLOW UP ACTION: Implement City Council direction.

ADVERTISING, NOTICE AND PUBLIC CONTACT: Pursuant to the Brown Act.

Hey Kevin,

CITY OF AVALON CITY COUNCIL
MEETING DATE: March 3, 2026 AGENDA ITEM: 3
ORIGINATING DEP: Administration/Harbor CITY MANAGER: Dall PREPARED BY: Kevin Schmidt, Harbor Master
Aliana Gonzales, Administrative Analyst
SUBJECT: Adopt a Resolution Accepting the Grant from the State of California Department of Parks and Recreation Division of Boating
Waterways Boating Infrastructure Grant FY25
REPORT SUMMARY: The City submitted a grant application in July 2024 to replace the deteriorating city-owned harbor end float through the Division of Boating and Waterways Boating Infrastructure Grant Program. This project will replace an existing 30-year-old steel and wood end float attached to the fixed pedestrian Pleasure Pier and replace two non-ADA compliant aluminum gangways with a single 80 foot ADA compliant gangway. The size of the float will be approximately 60' × 20' and construction materials will be determined during the engineering and permitting phase, but will be such to exceed a useful life of 20 years.

The City was notified in late February 2026 that the grant request of $300,000.00 to replace the Pleasure Pier End Float was recommended for funding. This project will be funded with $300,000 of federal funds combined with a local cash match of at least $100,000 and the City contributing the remaining $100,000 to allow for ineligible use.

This project is budgeted in the Fiscal Year 2026-27 from account 10470-6504, CIP project number 267001 at $500,000.

GOAL ALIGNMENT: Safety and Compliance.

FISCAL IMPACTS: This project is budgeted in the Fiscal Year 2026-27 from account 10470- 6504, CIP project number 267001 at $500,000.

CITY OF AVALON CITY COUNCIL
MEETING DATE: March 3, 2026 AGENDA ITEM: 4
ORIGINATING DEP: Administration CITY MANAGER:

PREPARED BY: Jocelyn Francis, Assistant City Manager
SUBJECT: Appeal of Commercial Vehicle Permit
BACKGROUND: On July 8, 2024 Jeff Skelton, owner of Catalina Island Horseback Adventures, met with City staff on vehicle permitting requirements for the City. City staff covered the process for both Commercial Autoette Permits, Commercial Vehicle Permits, and Temporary Commercial Vehicle Permits. In addition, staff indicated there was a waitlist for full-size Commercial Vehicle Permits in which Catalina Island Horseback Adventures was added to the waitlist that same day. Staff suggested he work with existing on-island businesses to assist with transportation of materials from the barge to the stables.

The property site has had active building permits (a qualifier for Temporary Commercial Vehicle Permits), however Mr. Skelton only purchased (1) Temporary 30-day Permit in January 2025, which has long since expired.

On January 9, 2026 Mr. Skelton submitted a Commercial Vehicle Hearing Application for a full- size Commercial Vehicle (2018 Ford F350, approximately 264" in length). On January 23, 2026, the Vehicle Hearing Officer conducted a hearing on the application and on January 30, 2026 subsequently denied the Commercial Vehicle Permit due to the fact the applicant is not eligible under waitlist provisions. A copy of the decision letter is attached to this report.

On February 11, 2026, Jeff Skelton submitted a request, and paid the applicable hearing fees, to appeal the decision to denying the Commercial Vehicle permit which is attached to this agenda report for Council consideration.

City Staff support the findings of the Vehicle Hearing Officer denying the permit, consistent with AMC §4-4-1703(b).

FISCAL IMPACTS: None.

GOAL ALIGNMENT: Not applicable.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: Council action could potentially set the City for legal consequences of those businesses on the Commercial Vehicle waitlist if they are bypassed in favor of granting Catalina Island Horseback Adventures a permit.

FOLLOW UP ACTION: Implement City Council direction.

ADVERTISING, NOTICE AND PUBLIC CONTACT: The item was properly listed on the posted agenda pursuant to the Brown Act.

DECISION DENYING APPLICATION FOR COMMERCIAL VEHICLE
APPLICANT:

Attention: Jeff Skelton
Mailing Address: P.O. Box 127

FINDINGS OF FACT AND CONCLUSIONS OF LAW

1. On January 9, 2026, Catalina Island Horseback Adventures (the "Applicant"), submitted an application for a commercial oversized vehicle permit pursuant to Section 4-4.1703(b) of the Avalon Municipal Code ("AMC").

2. The application was considered by the Hearing Officer at a duly noticed public hearing held on January 23, 2026, at City Hall. Jeff Skelton appeared on behalf of the Applicant. Rocio Hernandez, Vchicle Clerk, appeared on behalf of the City of Avalon.

3. The Applicant operates a horseback tour business in Avalon that has been in continuous operation since 2018, providing guided horse tours and related services.

4. The Applicant seeks authorization to obtain and operate a commercial vehicle for use in this business, and requests that the vehicle be oversized. The Applicant asserts that the vehicle is needed to transport horse feed, equipment, and supplies, and to transport horses, including for cmergency evacuation purposes.

5. Avalon Municipal Code § 4-4:1703(b) establishes a limited and discretionary permitting scheme for commercial vehicles and authorizes issuance of a permit only upon satisfaction of all statutory prerequisites, including but not limited to eligibility, waiting-list priority, and affirmative findings regarding necessity and compatibility with the City's streets and infrastructurc.
6: The City maintains a commercial vehicle waiting list pursuant to AMC § 4-4.1703(b), which governs cligibility to apply for and reccive newly available commercial vehicle permits. Under May Hall • 410 dalen Canyon Road- PO Bon 70 alon 04004-050- Telephone: 310.510,0230 - Farmandle: 310530.0401 • swed ayof\salon.com

Page 2 of 3 ends

this scheme, permits may be issued when a permit becomes available and the applicant is next in priority on the waiting list.

7. City staff reviewed the commercial vehicle waiting list and confirmed that the Applicant is not currently at the top of the commercial vehicle waiting list and is therefore not eligible for issuance of a commercial oversized vehicle permit at this time.

8. The Hearing Officer acknowledges the Applicant's asserted operational need for an oversized commercial vehicle; however, under AMC § 4-4.1703(b), a determination regarding operational need or compatibility cannot serve as a basis for permit issuance unless and until the applicant is otherwise eligible under the waiting-list provisions of the Code.

9. Because the Applicant is not eligible for permit issuance under the waiting-list requirements of AMC § 4-4.1703(b), the Hearing Officer lacks authority to approve the application at this time, regardless of the Applicant's asserted need or the merits of the proposed vehicle use.

CONCLUSION

10. Based on the foregoing findings, the Hearing Officer concludes that the application for a commercial oversized vehicle permit must be DENIED for failure to satisfy the cligibility

11. This denial is without prejudice, and does not constitute a final determination regarding whether the Applicant may qualify for a permit in the future should eligibility requirements be

DECISION

12. The application for a commercial oversized vehicle permit submitted by Catalina Island Horseback Adventures is hereby DENIED WITHOUT PREJUDICE.

APPEAL RIGHTS

13. Pursuant to the Avalon Municipal Code governing vehicle permits, this decision may be appealed to the City Council by filing a written appeal with the City Clerk within fifteen (15) calendar days of the date of this decision. The appeal must state specific grounds for appeal and be accompanied by any required appeal fee.

14. Failure to timely appeal this decision shall constitute a failure to exhaust administrative remedies as provided by law.

February 11, 2026
Jocelyn Francis
Assistant City Manager
City of Avalon
410 Avalon Canyon Rd
Avalon, CA 90704
Dear Jocelyn Francis:

I am writing to formally request an appeal of the recent denial of our oversize vehicle permit application dated January 30, 2026, and to ask that this matter be placed before the Avalon City Council or appropriate designee for consideration of an exception.

We understand the basis for the denial relates primarily to our position on the current waiting list for oversize vehicle permits, and we respect the City's process and limitations regarding permit allocations.

However, we respectfully request special consideration due to the operational necessity of this vehicle in supporting our business activities and the broader community and visitor services we provide in Avalon.

Since opening for business in February 2025, Catalina Island Horseback Adventures has become an active part of the local tourism and community experience, providing guided horseback rides,, community events, and services that contribute to Avalon's community and visitor economy. The requested vehicle is necessary for safe and efficient transport of equipment and operational support related to horse care, guest services, and event logistics. Without access to an appropriately permitted vehicle, our ability to operate is significantly constrained.

We currently operate the vehicle on a temporary construction permit which has been necessary as we have built the infrastructure for our facility. As we look forward it is clear that this vehicle has become a necessary asset for the daily operation and safety protocols of the business.

The primary use(s) and critical need for the vehicle would be:

1. Transport of horse trailer in the event of required emergency evacuation / relocation of horses.

Jocelyn Francis
February 11, 2026

Page 2 ends

2. Transport of supplies including bi-monthly monthly delivery of equine feed supplies. Feed is transported in 2000lb super sacks. These are transported on our flatbed trailer with typically 3- 4 sacks used per week.

3. Transport of our portable toilets weekly between the Ranch location and Avalon Freight for cleaning
When not in use the vehicle is kept on the ranch property and is not parked on City streets.

We remain committed to complying with all City requirements and operating responsibly within Avalon.

We respectfully request that this appeal be forwarded to the City Council or appropriate designee so that our request may be considered, and we appreciate the City's continued cooperation and support of local businesses working to enhance Avalon's community and visitor experience.

Thank you for your time and consideration. Please let us know if any additional information or documentation would assist in this request

CITY OF AVALON CITY COUNCIL
MEETING DATE: March 3, 2026 AGENDA ITEM: 5
ORIGINATING DEP: Fire CITY MANAGER: DuM
PREPARED BY: Michael Alegria, Fire Chief
SUBJECT: Repairs to Engine 7
ECOMMENDED ACTION(S): Per the City's procurement policy, authorize the Ci lanager or designee, to execute an agreement with Performance Truck Repair in Azus CA, to perform essential repairs to Fire Department Engine 7 for a not-to-exceed sum of $30,000.

REPORT SUMMARY: Avalon Fire Department's front-line engine, Engine 7 (a 2002 Weststates) has recently experienced a series of mechanical failures. The vehicle has had lights and siren issues, brake issues, and most importantly pump issues caused by corroding pipes. The city mechanics have worked very hard over the past month to fix the issues. However, after consultation with other mechanics, they were advised the best course of action may be to take the vehicle to a specialist.

In 2025, a mechanic from Performance Truck Repair - based in Azusa, CA - came to the Island to assess all Fire Department apparatuses. The Performance Truck Mechanic provided a list of necessary repairs for city mechanics to complete. However, fire crews have noticed that the pump pressures are off and not accurately working. Specifically, the pressure relief valve is not functioning correctly. A non-working pressure relief valve may be dangerous when fire crews are pumping at a fire. When fire crews connect to a fire hydrant a large surge in the pressure can occur. The pressure relief valve would prevent a significant change in line pressure. However, when it is not working a firefighter could become seriously injured while operating the hose line inside a building. Due to using salt water in the engine the piping has corroded and there are many pieces of debris are getting into the small orifice holes on the gauges.

Per the City's Procurement Policy, the Fire Department solicited bids from qualified vendors to make the necessary repairs to Engine 7.

Company Location Proposed Cost
Performance Truck Repair Azuza, CA $25,292.15
Inland Kenworth Fontana, CA Did Not Bid
Westrux Santa Fe, NM Did Not Bid
Only one qualified vendor - Performance Truck Repair - provided a bid to perform commercial truck repair and fire pump repair at the same place. Inland Kenworth and Westrux can only perform commercial truck repair.

Performance Truck Repair is ready for the engine to be shipped to the mainland and has the time to start right away.

While Engine 7 is on the mainland the Fire Department will utilize a new Type Ill engine - Engine 3 - as well as another Type 1 - Engine 2. We still also have Truck 3 that has the aerial ladder pipeline as well as the regular pre-connects on the truck. County Fire also has 2 Type III engines in town and 1 at Two Harbors.

City Staff recommends the City Council authorize the City Manager or designee, to execute an agreement with Performance Truck Repair in Azusa, CA, to perform essential repairs to Fire Department Engine 7 for a not-to-exceed sum of $30,000.

Sufficient funds are included in the FY 25-26 CIP Budget -CIP Project Number 234501, Fund Number 10245-6871.

FISCAL IMPACTS: Sufficient funds are included in the FY 25-26 CIP Budget -CIP Project Number 234501, Fund Number 10245-6871.

GOAL ALIGNMENT: Dependable and reliable pumping fire apparatus.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City will only have one fewer Type One Fire Engine within its fleet.

FOLLOW UP ACTION: Authorize the City Manager or designee, to execute an agreement with Performance Truck Repair

CITY OF AVALON CITY COUNCIL
MEETING DATE: March 3, 2026 AGENDA ITEM: 6
ORIGINATING DEP: Administration CITY MANAGER: DMIl
PREPARED BY: Jocelyn Francis, Assistant City Manager
SUBJECT: Authorize Filing of a Civil Complaint for Nuisance Abatement and Appointment of a Receiver for 343 Sumner Avenue
RECOMMENDED ACTION(S): Authorize the filing of a civil complaint for nuisance abatement and filing a petition for the appointment of a receiver for the real property at 343 Sumner Avenue, Avalon CA 90704 based on nuisance conditions resulting from health and safety violations of the Avalon Municipal Code.

REPORT SUMMARY: On September 17, 2025, Code Enforcement and Building initiated a public nuisance investigation into property located at 343 Sumner Avenue. On October 1, 2025, the Building Official mailed notice requesting an inspection of 343 Sumner Avenue. On October 23, 2025, the City Attorney's Office mailed additional notice of inspection, with Planning/Building posting an Imminent Danger Warning on the exterior of the building stating the site unsafe for occupancy pursuant to California Building Code Section 116.2 and California health and Safety Code Sec. 17980-17982.

On November 17, 2025, an Inspection Warrant was issued by the Court for the inspection of Avalon Municipal Code (AMC) violations at 343 Sumner Avenue, Avalon, CA 90704 (APN 748-032-030). The inspection commenced on November 21, 2025 with staff and contractors representing Code Enforcement, Planning/Building, Public Works, Fire, and LA County Sheriff's. During the inspection, numerous violations were found including extensive, severe, and systemic failures across all major structural, sanitation, electrical, mechanical, plumbing, and habitability systems of the building, making the property dangerous, substandard, and unfit for human occupancy, with several conditions present immediate threats to life, health, and safety.

Due to no efforts made for condition improvement by the property owner, it is recommended the City file a civil complaint for nuisance abatement and a petition for the appointment of a receiver for the real property at 343 Sumner Avenue, Health and Safety Code Receiverships
California Health and Safety Code §17980.7 allows a city to seek the appointment of a receiver over a substandard property that has been previously cited for violations that go unabated that pose health and safety risks.

Use of the Receivership process is one of the last code enforcement options used to mitigate substandard conditions of a property. Properties evaluated for the receivership process have nuisance conditions that are extensive and of such a nature, that the health and safety of the residents and the public are substantially endangered; and are maintained in violation of the AMC and State of California Health and Safety codes. More importantly, the property owner did not comply and have ignored the City's order to abate the substandard and dangerous conditions.

Health and Safety Code section §17980.7 has the authority to appoint a receiver over a substandard property. This allows a receiver to take full possession of the property, rehabilitate the substandard conditions, and bring the property into compliance with all laws. Many times, the property is sold to a single-family buyer, from the proceeds, the receiver and the City are paid their fees and the remainder of proceeds are given to the owner. The owner may reclaim the property from the receiver before it is sold, given the owner pays all the receiver's and city's fees.

The health and safety code and civil code sections provide a full picture of the nuisance abatement complaint and request for an appointment of a receiver.

The powers granted to a receiver are broad. The receiver may:
(1) take full and complete control of the property;
(2) manage the property and pay expenses of the operation of the property; (3) secure a cost estimate and construction plan from a licensed contractor for the repairs necessary to correct the substandard conditions; (4) enter into contracts and employ a licensed contractor as necessary to correct substandard conditions;
(5) borrow funds to pay for repairs necessary to correct substandard conditions; and
(6) secure debt, with Court approval, with a recorded first lien on the property, first in priority to all other liens.

The use of the receivership option is a dramatic, immediate, and a comprehensive process that eliminates slum conditions or habitually substandard properties at no expense to the referring agency when it is the prevailing party. This process also communicates to the public that the City is actively protecting residents and tenants from dangerous conditions created by absentee and recalcitrant property owners.

Civil Nuisance Abatement Lawsuit
In order to protect its residents, the City may abate a public nuisance by filing a civil nuisance action for violations of the Avalon Municipal Code and/or conditions which are offensive or annoying to the senses, detrimental to property values and community appearance, or injurious to the health, safety or welfare of the general public in such ways as to be a nuisance, (California Code of Civil Procedure §731; California Civil Code §34, §79, and §3480). Civil Code section §3480 further explains, "A public nuisance is one which affects at the same time an entire community or neighborhood, or any considerable number of persons, although the extent of the annoyance or damage inflicted upon individuals may be unequal." Through the civil nuisance abatement procedure, the City may seek temporary and permanent injunctions to prevent the property from continuing to operate or exist as a public nuisance. If the City prevails, it may seek recovery of attorney's fees and costs.

FISCAL IMPACTS: At the conclusion of the case, the City may recover attorney's fees and administrative costs associated with the case.

GOAL ALIGNMENT: Neighborhood improvement.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The building will continue to deteriorate and cause health and safety implications for neighboring properties and community members.

FOLLOW UP ACTION: File a receivership petition with the courts.

ADVERTISING, NOTICE AND PUBLIC CONTACT: The item was properly listed on the posted agenda pursuant to the Brown Act.
