PREPARED BY: Devin Hart, Assistant City Manager
SUBJECT: State of Emergency Proclamation in Preparation for Historic El Niño Conditions
RECOMMENDED ACTION(S): Adopt a resolution making the appropriate findings and proclaiming the threatened existence of a local emergency in preparation for historic El Niño REPORT SUMMARY: On September 21, 2026, Governor Gavin Newsom made a proclamation of a state of emergency California due to the developing and strong likelihood of a historic El Niño season.
During the past several years, Avalon has experienced increasingly severe and destructive storms including atmospheric river events that have caused coastal flooding, mud and debris flows, rock falls, high winds, road closures and damage to property and critical infrastructure.
As the City enters the 2026-2027 wet season, a number of scientific resources, including the National Oceanic and Atmospheric Administration's National Weather Service Climate Prediction Center, are predicting a historic El Niño event in the Pacific Ocean.
Due to Avalon and Santa Catalina Island's geographic isolation and limited resources, taking early, coordinated, and targeted preparedness actions to protect Avalon's visitors and residents as well as critical infrastructure and natural resources are in the City's best interest.
Ordinance No. 670(1979) of the City of Avalon (City) empowers the Director of Emergency Services (City Manager) to request the City Council to proclaim the existence or threatened existence of a local emergency. There is no fiscal impact to declaring a State of Emergency; however, the City may be limited or prohibited from applying for potential disaster related recovery funds without a formal declaration.
In making an emergency declaration, the Director of Emergency Services is directed to pursue all available funding and assistance for repairs, emergency services, clean-up and other necessary steps to respond to the local emergency as well as coordinate with local, State and Federal authorities to assess the next steps available to take action to protect and preserve the public satety, health and weltare.
FISCAL IMPACTS: To be determined.
GOAL ALIGNMENT: City Infrastructure.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City and private property owners negatively affected by storm damage may not have the opportunity to pursue county and state agency relief funding.
FOLLOW UP ACTION: City Staff will work to determine storm impacts and coordinate with county and state agencies to following steps required to pursue relief funding.

7. Three RECREATIONAL BOATING safety issues
This is a Federal Pass-Through 'Recreational Boating Safety Grant. The purpose of the grant is to promote boating safety and to decrease the number of accidents, injuries, and fatalities on U.S. waters. Clearly identify three BOATING safety issues that affect recreational boaters in your jurisdiction. Your answer to this question will be referenced throughout this grant application.
High Density Boating Activities
Avalon Harbor is a recreational boating haven that attracts thousands of visitors per year. These visitors enjoy the Island's waters and natural splendor on powerboats, dinghies, paddleboards, 4- drive rental boats, kayaks, and swimming. While the Harbor Department welcomes and promotes these activities, the congestion can pose as an issue when trying to assist boaters on their mooring or in the event of an emergency. Due to the high visitor traffic, moorings are often closer together than in other harbors which requires patrol boats to be equipped with reliable engines that are spry enough to start and stop on a moments notice.
Operator Inexperience
Avalon is the furthest offshore incorporated port within the Southern California boating community.
Many boat operators who visit the Harbor have yet to develop the adequare skill of open-water pilotage and are inexperienced with the Harbor's unique current, tidal conditions, and traffic pattern.
The combination of unskilled captains and vessels that are often unequipped for the open-ocean environment can create a variety of hazards on the water. Harbor Patrol are the first on-scene responders due to the Harbor's remote location. This requires Harbor Department boats to be prepared to maintain higher speeds for longer durations to assist with outer harbor incidents.
Boating Under the Influence
Many boaters come to Avalon in search of enjoying the island lifestyle and taking in the views of town from the back of their boats while enjoying their favourite alcoholic beverages. For most boaters, this is how they start their evening before making their way into town to one of the City's dinner or drinking establishments. While the City appreciates visitors enjoying the town and contributing to the City's economy which is heavily reliant on tourism, we consistently see issues with inebriated boaters heading back to their boats on dinghies for the night. One of the biggest safety issues the Harbor Department consistently sees is boating under the influence. This creates a variety of hazards both inside and outside the harbor. Harbor Patrol vessels must be quick and agile enough to assist in a dinght accident inside the harbor, but also capable of maintaining higher speeds for longer durations if an emergency were to occur outside the harbor.

11. Item Details
11 a. Is this equipment general all-purpose gear? NOTE: person-specific * Yes r No and fitted items will not be funded.
11 b. Describe exactly what is being requested and how this equipment will help mitigate the recreational boating safety issues you identified in Question 7. If the requested quantity is more than one for any item, explain the need for multiple items. (max. 2000 characters)
The City of Avalon Harbor Department relies on a fleet of patrol vessels to ensure safe boating within one of the busiest recreational boating areas in Southern California. One of the Department's 21-foot Crystaliner patrol boats requires repowering with a new Volvo Penta D3 engine to maintain operational readiness and effectiveness on the water.
The Volvo Penta D3 is a high-performance marine diesel engine specifically designed to deliver substantial low-end torque. This torque is essential for harbor operations, particularly when towing disabled or improperly moored vessels. Avalon Harbor frequently experiences high vessel traffic, including large recreational boats that can become hazards if they lose propulsion or drift. The Harbor Department must be able to quickly and safely maneuver these vessels out of navigational channels, away from moorings, and out of high-traffic zones. A diesel inboard engine like the D3 Date: 09/15/2026 Contract # C26L0601, City of Avalon Harbor Department, Boating Safety and Enforcement Page: 38 of 45 Equipment Grant - FY 2026/27
Exhibit G - BOATING SAFETY AND ENFORCEMENT EQUIPMENT GRANTEE APPLICATION provides the power and control necessary to safely conduct these operations.
In a harbor environment like Avalon, where confined waterways, heavy tourism, and inexperienced operators frequently intersect, the ability to safely and effectively tow large vessels is fundamental to public safety. Equipping Patrol Boat 4 with a Volvo Penta D3 diesel engine ensures that the Harbor Department can continue to uphold its mission of protecting life, property, and the marine environment.
11 c. Describe any negative impacts to boating safety and/or boating enforcement if your agency does not receive its requested grant award.
The City has seen an improvement in visitation and revenue since the COVID pandemic and is welcoming visitors at the pre-pandemic rate. Although the City has seen an increase in revenue, the City is still operating on strict funds and limited reserves. Higher priority CIP projects like failing infrastructure have taken a higher precedence than that of routine equipment maintenance. Standard maintenance is often ignored due to the frequency of incidents that need to be addressed in the Harbor, so the engines are operating with little to no off time. This creates problems when patrol boats become out of commission for engine repairs after such heavy usage. The City is anticipating another busy summer and having all boats operating at their full capacity is imperative to help maintain the safety of the harbor.
If the engine cannot be replaced, Patrol Boat 4 would have to come out of circulation for repair. This would leave the City with only one diesel boat in the event of an emergency. If the Department does not have the capacity to quickly remove large vessels that are causing risks to other boaters or waterway users, people will be unnecessarily put at risk.
11 d. Classify this request
Classify this request by choosing one of the following options and present a strong justification for the request
"Critical" (operations would cease without it)
"Increased efficiency" (if it would save staff time, identify how much time) [500 hours]
"Convenience" (it would make life a little easier)
"Protection" of existing equipment (ex: shade tents, hoists to get the vessels out of the water, etc. to extend longevity)
Justify your classification of this request. (max. 300 characters) A new diesel engine will increase efficiency with patrolling, search and rescue, and other various safety activities. Diesel engines are more effective for quickly removing large obstructions like stranded vessels.

If yes, what percentage can you supplement? 32
11 f. What other capabilities exist in your region for this equipment? Justify why it is not feasible to borrow this equipment from a neighboring agency.
Volvo is the only producer of diesel engines that fit the 21 foot Crystaliners that the Department currently uses for patrol boats. The City has used a marine supplier in Orange County, for the past few decades as they provide the best rates on equipment and are the cheapest option to bring equipment over on the barge. There are no local agencies that the City could borrow this equipment from given its unique location 26 miles offshore on Catalina Island.
1 g. How and why was this particular model selected? Explain if this is standard equipment or do you nee omething specialized for your waterbody to meet your agency's needs? List less expensive models considere and explain why they are not being requested. List other funding sources available to your agency that could be used to purchase or partially purchase this equipment.
The Volvo Penta D3 engine was selcted to repower Patrol Boat 4 following a targeted evaluation of operational needs. The Harbor's conditions require a propulsion system capable of delivering strong, consistent torque at low speeds, particularly for towing operations involving vessels larger than the patrol craft itself. The D3 platform provides the necessary low-end torque, durability, and control required to safely conduct these activities, while also integrating with the vessel's existing inboard configuration, minimizing retrofit complexity and downtime.
Gasoline outboard engines were evaluated and determined to be insufficient due to the cost of retrofitting the hulls and the Department's desire to have two diesel patrol boats in the fleet in order to ensure the ability to safely tow larger vessels. Smaller diesel engines and used or non-matching propulsion systems were considered but rejected due to inadequate performance capacity, and increased risk of mechanical failure.

CITY OF AVALON CITY COUNCIL
MEETING DATE: October 6, 2026 AGENDA ITEM 5
ORIGINATING DEP: Recreation/Administration CITY MANAGER: DMIL PREPARED BY: Aliana Gonzales, Administrative Analyst
David Hart, Community Services Director
SUBJECT: Authorization to Submit a Grant Application to the Statewide Park Development and Community Revitalization Program
RECOMMENDED ACTION(S): Adopt a resolution authorizing the application of grant funds from the Statewide Park Development and Community Revitalization Program, and authorize the City Manager, or his designee, to be the authorized signature on the grant application.
REPORT SUMMARY: The Statewide Park Development and Community Revitalization Program (SPP), administered by the California Department of Parks and Recreation, provides competitive grants for the creation, expansion, or renovation of parks in underserved communities. The program prioritizes projects that improve recreational access, support environmental sustainability, and enhance community health and quality of life.
The City of Avalon has identified a need for improved recreational facilities within the community, particularly in areas that qualify as disadvantaged or park-deficient under SPP criteria. The current grant cycle offers an opportunity to secure significant funding for critical park development and revitalization initiatives.
Staff has evaluated potential project sites and recommends pursuing funding for the Knabe Park & VFW Memorial Corridor Revitalization and Expansion. Preliminary concepts include:
• Upgrades to playground and recreation equipment
• Improved accessibility features
• Expanded green space and picnic areas
• Renovation of sports courts
• A more enhanced and welcoming VFW Memorial area
Submitting an SPP grant application aligns with City priorities to enhance public spaces, support youth and family programs, and foster equitable access to recreational opportunities. If awarded, SPP funds could significantly offset project costs and accelerate implementation.
Grant guidelines require applicants to adopt a resolution confirming project eligibility, community engagement conducted, site control, and compliance with program requirements.
The State also requires authorization for designated staff to execute agreements and administer grant funds.
Securing SPP grant funding presents a valuable opportunity to advance park improvement goals within Avalon. Authorization to apply will enable staff to meet upcoming deadlines and position the City for potential funding.
GOAL ALIGNMENT: Community Improvement.
FISCAL IMPACTS: There is no direct fiscal impact associated with submitting the grant application. If awarded, staff will return with an item outlining funding allocations, grant match requirements (if any), and project budget implications.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: Failure to meet the required criteria will result in the City being responsible for funding the project.
FOLLOW UP ACTION: Complete the application by the deadline.

2. If consensus exists, provide direction on the letter to be submitted.
REPORT SUMMARY: This item appears on the agenda at the request of a member of the City Council.
On December 18, 2025, the California Public Utilities Commission passed Resolution T-17896 awarding grant funding in the amount $37,571,833 for a proposed project that would bring high- speed broadband service to more than 1,100 unserved locations and 10 community anchor institutions through the installation of undersea cables (the "Project"). The approved Project contemplated service of up to 10 Gbps and represented a significant public investment Avalon's broadband infrastructure.
The Project is supported by the City of Avalon as well as community stakeholders and local, county and state elected officials.
On August 6, 2026, the City received notice that the Communications Division of the CPUC prepared Draft Resolution T-17934 proposing to rescind and terminate the $37,571,833 Federal Funding Account ("FFA"). The grounds for the proposed rescission of the FFA were fully set forth in Draft Resolution T-17934 and communications between the CPUC and the awardee prior to the issuance of the Draft Resolution.
At the September 1st, 2026, council meeting, the council directed staff to send a letter to the CPUC which asked that if the Draft Resolution was adopted, the funding allocated for the project remain available. A copy of that letter is attached.
The hearing on the Draft Resolution was originally scheduled for September 17, 2026, and subsequently continued to October 8, 2026.
During the September 22, 2026 City Council Meeting, a member of the City Council requested placing this item on the next council agenda to consider sending an invitation to the CPUC to visit the island to experience the issues regarding broadband/internet connectivity and how the lack of reliable high-speed fiber impact residents and critical institutions such as the hospital, 65059.00000\45486297.1
school and safety forces. As such a letter should have council approval, the consideration of sending a letter is now presented.
Staff recommends City Council provide direction if an additional letter should be sent as well as the content of the letter. Any communication should be considered in light of, and consistent with, the prior correspondence to the CPUC in which the City took no position on the Draft Resolution and asked that if the Draft Resolution was adopted, that the subject funds remain available for the use in Avalon as the City supports a broadband cable project for its residents.
GOAL ALIGNMENT: Broadband infrastructure improvements.
FISCAL IMPACTS: None.

City of Avalon
Santa Catalina Island, CA
September 1, 2026
Dear President Reynolds and
Members of the California Public
Utilities Commission:
Re: Draft Resolution T-17934 — Request to Preserve Funding for the Catalina Island Cross-Channel Fiber Project
Please accept this communication submitted by the undersigned, Avalon City Council. On behalf of the City of Avalon and the residents, businesses, public agencies, and visitors who depend upon reliable communications infrastructure on Catalina Island, we write regarding Draft Resolution T- 17934 and the proposed termination of the Federal Funding Account grant previously awarded to AVX Networks.
The City recognizes and respects the Commission's responsibility to safeguard public funds and ensure that grant recipients possess the administrative, financial, technical, and operational capacity necessary to successfully administer substantial public investments. The allegations and findings described in Draft Resolution T-17934 concerning A VX Networks are serious. We do not write to defend AVX Networks, nor do we ask the Commission to disregard its concerns regarding AVX's performance or continued suitability as the recipient of these funds.
We do, however, strongly urge the Commission to distinguish between the grant recipient and the underlying infrastructure project.
In Resolution T-17896 (awarded on December 18, 2025), the Commission approved up to $37,571,833 for the Digital Equity for Coastal and North Orange County and Catalina Island project. The Commission determined at that time that the project would bring high-speed broadband service to more than 1,100 unserved locations and 10 community anchor institutions. The approved project contemplated service of up to 10 Gops and represented a significant public investment in communities where modern broadband infrastructure remains inadequate.
For Catalina Island in particular, the cross-channel fiber component represents far more than an ordinary broadband expansion project. Catalina's geographic isolation makes reliable telecommunications infrastructure essential to public safety, emergency response, healthcare. education, government operations, economic activity, and the daily lives of residents.
Draft Resolution T-17934 itself recognizes that terminating the grant means the affected areas "will not benefit from the communication and resilience improvements from broadband infrastructure investments." Those public benefits have not become less important because of concerns regarding the entity originally selected to construct the project.

Indeed, the circumstances described in the Draft Resolution support preserving the funding rather than abandoning the investment. The Commission states that no reimbursements or payments have been made to A VX Networks under the award. Consequently, the Commission has an opportunity to protect public funds while protecting the very real public purpose for which those funds were originally committed.
The City of Avalon therefore respectfully chooses not to take a position on who the grant recipient is provided the Commission not release the $37,571,833 allocation into the general pool of funding for unrelated future projects and preserve those funds for the Project.
The loss of funding for this Project would be devastating. We urge the Commission to preserve. reserve, or otherwise prioritize these funds for the construction of the originally contemplated broadband infrastructure serving Catalina Island and the other eligible communities within the project area, including the critical cross-channel fiber connection.
Draft Resolution T-17934 currently provides that terminating AV's award would make the full $37,571,833 available for future Federal Funding Account opportunities and merely make the affected unserved locations eligible to compete for future funding. That approach unnecessarily places the communities intended to benefit from this project at risk of losing an infrastructure investment that the Commission has clearly determined serves an important public need. That need is real and that need has not diminished.
We respectfully request that the Commission modify Draft Resolution T-17934 to accomplish two separate objectives:
1. Address the Commission's concerns regarding AVX Networks independently. If the Commission determines that AVX should no longer administer or receive this grant, the City respects the Commission's authority and responsibility to make that determination.
2. Preserve the approximately $37.6 million for the underlying broadband project and affected communities. The Commission should establish an expedited process to identify a qualified alternative provider, public agency, consortium, or other eligible entity capable of completing the project, with particular emphasis on preserving the cross-channel fiber connection to Catalina Island.
This approach would protect taxpayers while also protecting the communities for whom these funds were intended.
California has made extraordinary investments in broadband because reliable high-speed communications are now fundamental infrastructure. The Commission's own description of the Federal Funding Account recognizes broadband's importance to internet-based safety applications, telehealth, emergency services, and communications among first responders. Those needs are especially acute for the City of Avalon.
Catalina Island should not lose a once-in-a-generation opportunity to establish resilient fiber connectivity because of alleged deficiencies attributable to the originally selected grant recipient.
Accordingly, we respectfully urge the Commission to preserve the $37,571,833 commitment to the project area, maintain funding for the Catalina Island cross-channel fiber component, and establish an expedited and transparent process for selecting a qualified entity to complete the project.
Such an outcome would demonstrate that the Commission can exercise rigorous oversight of public funds without sacrificing the critical public infrastructure those funds were intended to deliver.
Thank you for your consideration and for the Commission's continued commitment to expanding reliable broadband infrastructure throughout California. The City of Avalon stands ready to work collaboratively with the Commission, Communications Division, and other qualified partners to ensure that this important project moves forward responsibly and successfully.
Respectfully,
Qunh. Marshal
