The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.

On October 28, 2021, the Avenal City Council adopted Resolution No. 2021-48 to satisfy AB 361 to continue Teleconferenced Meetings. AB 361 provides that, if the state of emergency remains active for more than 30 days, a local agency must make the following findings by majority vote every 30 days to continue using the bill’s exemption to the Brown Act teleconferencing rules • The legislative body has reconsidered the circumstances of the emergency; and • Either of the following circumstances exist: The state of emergency continues to directly impact the ability of members to meet safely in person, or State or local officials continue to impose or recommend social distancing measures.

Staff is recommending the City Council consider the following action by motion:

Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled. NEW BUSINESS:

A. Consider Authorizing City Manager to sign Settlement Agreements to the National OpioidSettlements with Janssen and opioid Distributors (McKesson, Amerisource Bergen and Cardinal):

Mr. Lopez reported that Staff and legal counsel have been contacted the state Department of Justice regarding the City joining a national settlement on opioids against distributers and the pharmaceutical companies. This is part of a national settlement that arose out of Ohio litigation brought by states and cities against the three largest pharmaceutical distributors —McKesson, Cardinal Health and Amerisource Bergen — and the opioid manufacturer Janssen (owned by Johnson & Johnson). Together, these businesses account for 85 percent of opioid sales in America. The 3,800 litigantscontended the distributors and Janssen contributed to the national opioid crisis by ignoring signsof opioid addiction and overselling opioids. The proposed settlement is $26 billion and will cover all states, counties, and cities — even those not part of the litigation. The opioid distributors will pay $21 billion over 18 years and Janssen will pay $5 billion over 7 years.

He continues that California is to receive between $2.269 and $2.34 billion, which would be 9.9 percent of the total. It is the State’s responsibility to establish an intrastate allocation to distribute these funds tocities and counties, otherwise the funds will be distributed according to a default model includedin the settlement. Local governments must opt into the settlement by January 2, 2022 and City Councils or Board of Supervisors action is needed. This is not an ordinary class action in which a party is subject tothe settlement unless it affirmatively opts out. Instead, local governments must affirmatively approve the settlements. The League of Cities recommends action on this matter (attached), and a cohesive explanation of the settlements is also provided by a report from CHW Law Firm. According to the documents in the settlements, Avenal will receive 0.007% from the “AbatementFund” in both settlements.

These funds are not expected until sometime after April 2022.

Staff recommends by Resolution, authorizing the City Manager to execute both settlementagreements in the National Opioid Settlements with Janssen and opioid Distributors(McKesson, AmerisourceBergen and Cardinal).

City Attorney Moses Diaz stated that these agreements there's a couple of different settlements like their aggregate online. Its basically waiving any rights to sue.

After a brief discussion, the following action was taken.

RESOLUTION 2021-52: AUTHORIZING CITY MANAGER TO SIGN SETTLEMENT AGREEMENTS TO THE

NATIONALOPIOID SETTLEMENTS WITH JANSSEN AND OPIOID DISTRIBUTORS (MCKESSON, AMERISOURCEBERGEN AND CARDINAL): A motion was made by Mayor Pro Tem Ramirez, seconded by Councilman Verdugo, and carried.

B. Consider Awarding of ProfessionalServices Agreement for the Comprehensive Zoning and Land Division Ordinance:

Feb 10, 2022 Pg. 13
Joint City Council/Successor Agency/PFA Meeting - December 9, 2021.

Page 6 of 9 ends

Ms. Yang reported that the City's current zoning ordinance is a few of decades old, and staff has been patching it through minor amendments to keep up with any new state regulations and requirements. Through these amendments,it has become apparentthat some amendments are contradictory to the Adopted GeneralPlanas well as the State Regulations. In addition, a lack of staffing and resources since the adoption of the 2035General Plan has resulted in a zoning ordinance that is not reflective and sometimes inconsistent with the policies and goals of the City’s Municipal Code.

She continues that on September 23, 2021, The City posted a request for proposal (AVL 2021-01) with the intent to update the City's Zoning and Land Division Ordinance. Therefore, the city had opened bids to accept proposals from qualified land use firms with expertise in zoning and land divisions to comprehensively amend and update the City's Zoning and Land Division Ordinance. On November 1, 2021, the Request for Proposal Bid had closed, and the Staff had only received one (1) bid: QK. After contacting other Land Use firms that have worked with, they City in the past, all stated thatthey did not have the capacity or staffing to take up a project for the City due to the Pandemic. Therefore, Staff has decided that to move forward and be progressive and not hinder business and economic growth. This item has been reviewed by the City Manager and Director of Administrative Services – Finance Division.

Also, not exceed the amount for services estimated up to $100,000. Thisamount should be broken down by phasing and proposed deliverables. The funding for this contract is from the SB 2 Planning Grant and the Local Early Action Planning Grant awarded to the City in April 2020 and April 2021 by the California Department of Housing and Community Development. The city and the Consultant will be bound by the requirements of the grant.

Staff recommends approving and authorizing the City Manager or His Designee to Award the Proposal for Comprehensive Update for the Zoning and Land Division Ordinance to QK. Inc through Resolution No.2021-53. Authorize the City Manager or his designee to Sign the Professional Service Agreement and any other supplemental document With QK Inc.

RESOLUTION 2021-53: ACCEPTING Q.K. INC BID AS THE REASONABLE QUALIFIED BIDDERFOR AVL NO. 2021- 01 COMPREHENSIVE UPDATED OF ZONING AND LAND DIVISION. ORDINANCES. A motion was made by Councilman Gravelle, seconded by Councilman Verdugo, and carried.

C. Consider First Reading of Adoption of ordinance implementing requirements for handling of organic waste and edible foods:

Mr. Lopez reported that In 2016, Governor Brown signed into law Senate Bill (SB) 1383 (Lara, Chapter 395, Statutes of 2016), establishing methane emissions reduction targets in a statewide effort to reduce emissionsof short-lived climate pollutants (SLCP) in various sectors of California's economy. SB 1383 is the State’s most ambitious waste reduction law in the last 30 years and enacts the following targets to reduce organic waste in landfills:
• Achieve a 50% reduction in the level of the statewide disposal of organic waste from the2014 level by 2020 and a 75% reduction by 2025
• Recover at least 20% of currently disposed surplus food by 2025 Since landfills are the third largest producer of methane, the State’s SLCP strategy includes managing organic waste. Food scraps, green waste, paper, and cardboard are organic materials that account for a significant portion of California's overall waste stream. Increasing food wasteprevention, encouraging edible food rescue, and expanding the composting and invessel digestion of organic waste will reduce methane from landfill operations. In addition to setting specific emissions reduction goals, SB 1383 mandates cities and counties to:
• Provide organic waste collection services to all residents and businesses • Develop and adopt an enforcement mechanism or ordinance by January 2022 • Establishan edible food recovery program • Update the City’s procurement policy to purchase recycled content paper and recycled organic waste products (e.g., compost, mulch, and renewable natural gas) at a volume of

0.08 tons/resident
• Provide outreach and education for generators, haulers, facilities, edible food recoveryorganizations, and municipal departments
• Plan and secure access for recycling and edible food recovery capacity • Monitor compliance and conduct enforcement
• Maintain accurate compliance records
Feb 10, 2022 Pg. 14
Joint City Council/Successor Agency/PFA Meeting - December 9, 2021.

Page 7 of 9 ends

He continued that to meet the SB 1383 regulations, jurisdictions throughout the State are required to adopt an ordinance or other similarly enforceable mechanism by January 1, 2022. The ordinance will mandate that organic waste generators, haulers, and other entities subject to the requirements of SB 1383 regulations and subject to the jurisdiction’s authority, comply with SB 1383 regulatory requirements. It will also help reduce food insecurity by requiring Commercial Edible Food Generators to arrange to have the maximum amount of their edible food, that would otherwise be disposed, be recovered for human consumption. With the help of Mid Valley Disposal, the City’s waste hauler, Ordinance 2021-02 addresses the SB 1383 regulatory requirements the City needs to enforce on other entities, including requirements for generators to participate in organic waste collection programs; multi-family andbusiness owners and property managers to support organic waste disposal reduction; commercialedible food generators to recover edible food through contracts or written agreements with food recovery organizations and services; and more. It is organized into the following sections:
• Requirements for Single-Family Generators
• Requirements for Commercial Businesses
• Waivers for Generators
• Requirements for Commercial Edible Food Generators
• Self-Hauler Requirements
• Inspections and Investigations by City
• Enforcement
In addition to adopting an organic waste recycling and food recovery ordinance, SB 1383requires that the City adopt an ordinance or other enforceable mechanism that requires compliance with Sections 492.6(a)(3)(B) (C), (D), and (G) of the Model Water Efficient Landscaping Ordinance (MWELO) as amended September 15, 2015 (“MWELO SB 1383 Baseline Requirements”). MWELO requires new construction and landscaping projects to meet water efficient landscape standards for compost and mulch application. Incorporating organic matter like compost and mulch in landscaping increases water retention and promotes productiveplant growth. Compost and mulch also provide many direct and indirect benefits when utilized inlandscaping and as a component of systems and treatments designed for carbon sequestration, erosion control, fire remediation, stormwater management, and other uses.

This ordinance is required to go into effect by January 1, 2022. Mid Valley Disposal will be handling the bulk of the new requirements by this ordinance and will coordinate with the city onhelping with inspections and investigations, while the City will ultimately be responsible with enforcement and issuing penalties. Staff as worked at lengths with Mid Valley Disposal and suspects that over time, this ordinance will require amending as organics disposal goes into practice throughout California – changes will likely be needed.

Staff recommends by motion, waive the first reading of Ordinance 2021-02. This ordinance will be broughtback for a second reading and adoption at the January 13, 2022 Regular City Council meeting. Adopt Resolution 2021-54 reaffirming said actions. Staff will publish a summary five days before the second reading/waiver and will publishthe summary again within 15 days after enactment.

City Attorney Moses Diaz stated that public hearing does not for this ordinance but once its implement proper noticing. The other business and item D. is the identical ordinates except that that one is urgency so it will go into effect if it's approved by four or fifth majority.

Mr. Lopez stated that it needs approval to be in compliance and having ordinance on the books by January 1 st requirement. Also, that
urgency ordinance the City Council wants to do it all in one motion and approving both the first reading on both Resolution 2021-54, Ordinances 2021-02 & Resolution 2021-55, Ordinances 2021-03.

After a brief, discussion the following action was taken:

RESOLUTION 2021-54 Adoption of ordinance implementing requirements for handling of organic waste and edible foods. A motion was made by Councilman Gravelle, seconded by Councilman Verdugo, and carried.

D. Consider First Reading of Adoption of urgency ordinance implementing requirements forhandling of organic waste and edible foods:

Mr. Lopez reported that Staff, working with Legal Counsel, considered it prudent to adopt an urgency ordinance that goesinto effect before the January 1, 2022 deadline to comply with the state and CalRecycle’s requirements. Attached is the exact same ordinance as previously presented, but with urgency clause, requiring 4/5 or greater majority council approval to go into effect immediate after its adoption.

Staff recommends by motion, introduce, and waive the first reading of Ordinance 2021-03. Adopt the urgencyordinance by a 4/5 or greater vote and adopt Resolution 2021-55. The City Clerk, within 15 days will certify a copy of the urgency ordinance and post a public copy at three public places within the City.

Also, this ordinance is specifying to State's guidance on who could be exempt from this requirement. It is specific businesses that may not actually be generating organic waste you know certain types of businesses.

MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/ ITEMS FOR
CONSIDERATION:

A. Discussion of Legislative needs to Local/State Elected Officials for 2022:

Mr. Lopez reported that Continued discussion from the December 9, 2021 City Council meeting, Staff is requestingdirection from Council on legislative items of importance to discuss with Avenal’s elected officials.

Staff has already met with Senator Hurtado’s Chief of Staff, Elizabeth Hess, and Congressman David Valadao, last month. Now is a good time to discuss and plan-ahead areas they may be ableto help Avenal, so we can strategically work together with its elected officials.

Last year’s requests included:
• Funding for the Cutoff Road project, $5+ million
• Funding assistance for fire contract services deficit, helping pay the 600k a year in totalservice. • Funding for the Community Center project ($5 million requested, $2 million awarded bystate – still awaiting Federal earmark news).
• Funding for a new well to increase water allocation by the canal.

Some ideas (in no particular order):
• Funding for transportation opportunities and EV Chargers. • Assistance in funding a new City Hall.
• Funding and program assistance for the Senior Program/Veterans Hall, either with meals or helping remodel the Vets Hall.

Page 3 of 6 ends

• Infrastructure, water/wastewater, and roads.
• Transmission Line Project 18” (5-year delayed) 10.5-million • Infrastructure -Broad Band
Staff recommends to direct staff on funding priorities to send to Avenal’s elected officials for 2022-2023.

Mr. Lopez states that Staff is hitting some roadblocks with the state in terms of what they're requiring form City and mitigate before able to finally work on the project. The Water Resource Board this project is certainly needed, and all are aware that there were two water leaks.

Mr. Davis reported that with the transmission projects and last week Brian Skaggs, Summers Engineering received a response from the State Water Resources Control Board. The Transmission Project this was the 4 th
-time it’s been sent out to entities for comment.

The State Water Resources Control Board decided to comment on the separation of the new 18-inch line at some of the crossings at existing pipelines that are up in the oil field area. Also, for instance on one page of the plans page 3 there's 14-pipeline crossings in that one area of replacement. The State Water Resources Control Board concerned about the under crossings separation not knowing what's in the pipelines and the unknown fluids could cause a potential contamination of our drinking water.

He continues that he spoke with Mr. Skaggs there going back through drawings for more area of concern. The State Water Resources Control Board will evaluate the layout, and this may delay project going out to bid. If the State Water Resources Control Board redesign pipeline to go deeper in some of these areas. So, it's unfortunate that our State Water Resources Control Board decided to wait until the final stretch to offer comments.

The City Council is in consensus to direct staff to apply for all grants that apply to City and Transmission Project priority.

Antony Lopez, City Manager announced that the lobby at City Hall is avaiable for the public for attendance.

NEW BUSINESS:

A. Consider Establishing Two Additional Employment Positions within Avenal Police Department and Two Additional Employment Position within City Hall:

Antony Lopez, City Manager reported with the recent announcement of Chief Stiver’s pending retirement, scheduled for April 4, 2022, the Police Department currently does not have an Assistant Chief who can assume the responsibilities of Acting Chief of Police in the interim while the search for a new Chief of Police is conducted. Staff has noted that the current jobs market for high level and experienced administrators for local governments is very competitive – added theCity’s location in the Central Valley where most qualified applicants are from out of the area and would have tomove closer and expect a high comparative salary, may mean the Chief position will be vacant for a few months. If a new Chief is not selected and appointed by Chief Stiver’s retirement date, Council directed Staff to prepare a contingency. Given the size and complex needs of the Police Department, Staff recommends the creation of two Captain positions who can equally handle separate duties and assist the Chief in running the day-to-day operations of the Department. In the Chief’s absence, both Captains would share the duties as ActingChief of Police. This structure would provide for more accountability and ensure coverage for this important City service (Attachment A). Upon Council’s approval, Staff will open the positions for internal recruitment, and plan to have two candidatesin place by early February, allowing time to train under Chief Stivers and prepare the Police Department for further changes and transitions.

Griselda Price, City Clerk reported that City Hall given the past year of staffing challenges due to COVID-19 and ever chaining regulations for worker health and safety, the current staff at City Hall has often, been overwhelmed in managing the day-to-dayduties of providing quality service to the residents of Avenal, while at the same time promptly responding to finance and human resources duties for fellow staff members.

On January 10, 2022, the Federal government published its Final Rule outlining the intended uses for the American Rescue Plan Act (ARPA) funds, which provided flexibility in the re-hiring and hiring of new staff tohelp local jurisdictions more adequately respond to COVID-19. Specifically:
“If the recipient wants to hire above the pre-pandemic baseline and/or would like to have flexibility in positions: Recipients may use SLFRF funds to pay for payroll and covered benefits associated with the recipient increasing its number of budgeted FTEs up to 7.5 percent above itspre-pandemic baseline.” (Treasury, p. 27, Attachment 1).

She contunes that based on the Dept. of Treasury’s formula of multiplying the pre-pandemic baseline of full-time equivalent (FTEs) hours by 1.075, Staff calculate that from a pre-pandemic baseline of 52 employees, the City would beallowed to re-hire full staff and hire up to four additional FTE employees, or about a total of 56 full-time equivalent hour employees.

Feb 10, 2022 Pg. 27
Considering the recent clarification for use of ARPA funds for Public Sector Capacity (employment), staffbelieves it is time to recommend two additional positions that will help City Hall work more efficiently andeffectively, to be paid for through the City’s ARPA budget:

1. Human Resources/Risk Management Assistant – under the general supervision of the Director of Administrative Services, the Human Resource/Risk Management Assistant will perform administrative tasks and services to support effective and efficient operations of the organizations Human Resource and Risk Management departments. Primarily assist in ensuring workplace safety and employee health(Attachment B).

2. Part-Time Customer Service Representative/Office Assistant – under general supervision to perform varied and moderately difficult clerical work; receives and receipts utility services and other services atthe counter and by mail; reporting of Utility Department records; and assists with clerical duties in other departments as needed (Attachment C).

Both positions would have a focus on helping City Hall work through the COVID-19 pandemic and meet newand changing regulations with regards to health and safety. The City Council has noted in the past that as the City continues to grow, staff needs will also continue to expand andCity Hall must grow accordingly.

Staff recommend by Resolution, approve establishing two additional employment positions within Avenal Police Department and two additional employment position within City Hall. Direct staff to reintroducethis item at the next regular City Council meeting for ratification.

FISCAL IMPACT: Police Department- In lieu of filling an Assistant Chief position at the S-9 salary range, two Captain positionswill be created as a S-7 salary range, which is a step above a top-level Sergeant in the K range (Attachment 2).These will be Management, exempt positions, which will provide a more predicable salary schedule in the Police Department as opposed to unexpected over-time for a non-exempt officer. No new positions or “bodies”are being created for the Department, instead Staff will re-arrange positions utilizing existing officers.

City Hall- As part of the City’s ARPA budget as approved in August of 2021, $300,000.00 was allocated to help reinstate staff, of which less than $20,000.00 has been expended as of January 2022 (Attachment 3). Staffwill utilize this budget to pay for both position and may later request an adjustment once a mid-year budget review is conducted After a brief discussion, the following action was taken.

A. Consider Adopting By-Laws for the Avenal Planning Commission: Resolution 2022-07 Kao Nou Yang, Director of Community and Economic Development reported that The Planning Commission is a body of citizens appointed by the City Council to serve as an advisory and authority decision maker on issues and polices relating to planning, land use regulation and community development. California Planning and Zoning Law allows cities and counties to establish planning commissions and provide for planning, subdivision, and land use regulation. Commission would serve as the Planning Commission instead. Each city or countyestablishing a Planning Commission shall pass an ordinance that defines its duties and scope, and which may identify the number of members, their qualifications, how vacancies are filled, the frequency of regularmeetings, who serves as their staff, and general operating procedures.

She continued that pursuant to Ordinance No. 80-6 passed and adopted on March 27, 1980, by the City Council of the City ofAvenal, the City establish a Planning Commission under Title 2, Chapter 3 Article I of the Code of Ordinance. An Amendment to Title 2, Chapter 3 Article 1 was passed and adopted on February 17, 1994, to add additional language to appointments, clarify terms of office and create a standing meeting schedulefor the Commission.

The City Council of the City of Avenal established the Planning Commission and granted to its responsibilities in the area of land use, redevelopment issues and planning permit decisions. The intent of these by-laws is to assist and be used by the Planning Commission in performing its duties and conductingits meetings.Failure to adhere strictly to a provision of the by-laws shall notin of itself invalidate any actionof the Planning Commission or the City Council, nor shall it constitute a violation of law or procedures norprovide a basis for any claim or cause of action against the City. B. Consider Authorizing City Manager to Sign Letter of Commitment to GFO-21-303 - Vehicle-to-Building Technologies for Resilient Backup Power Research Project: Resolution 2022-08 After a brief discussion, the following action was taken.

Mr. Lopez reported that Staff was recently contacted by its partners at QuEST Inc. (Quantum Energy Services & Technologies), researchers who often partner with UC Berkeley to find solutions that promote energy efficiency and help create energy independence through research. Throughout 2018-2019,QuEST worked with City Staff to upgrade and monitor electrical and gas usage at several buildings (Veterans Hall; Avenal Theater & Event Center; Recreation Center; Animal Shelter; &Public Works Corporation Yard) through specialized equipment and upgraded the thermostats to Wi-Fi enabled devices that support remote scheduling. QuEST’s worked alongside researched at UC Berkeley to device schedules and methods to reduce energy costs at City buildings and provide tips for future upgrades. Overall, there were modest energy efficiency gains which resulted in big energy cost savings for the City.

He continues that today; QuEST is approaching the City again for another potential research project from the California Energy Commission’s grant opportunity: GFO-21-303 - Vehicle-to-Building Technologies for Resilient Backup Power (Attachment A).

QuEST’s proposal’s focuses on anidea of Vehicle to Building (V2B), using electric vehicle batteries to provide backup power to community buildings and grid support (Attachment B). To participate, QuEST is requesting a letter of commitment that they can include in theapplication, and in return, they have committed that:
“…through this research project to provide 1-3 EV chargers, the required electrical infrastructure upgrades, likely a battery for storage, and up to $18,000 to support stafftime on the project (e.g. providing building access and participating in other research activities.” Staff recommends approving Resolution 2022-08, authorizing the City Manager to sign a letter of commitment to QuEST Inc.’s application to the GFO- 21-303 - Vehicle-to-Building Technologies for Resilient Backup Power grant.

AGENDA ITEM NO. 5. C
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: February 10, 2022
RE: Approve Resolution Authorizing City Manager to Sign CALNET Next Generation Contracts for Wireless and Data Communications INFORMATION:

The City currently has an account with Verizon Wireless for cellular services with the Police Department as the master account. Sub-accounts are created under the master account for each city department as necessary based on department usage. Each city department is responsible for the payment of its respective invoices each month. Currently this is only for mobile/wireless devices – landline and static phones are with AT&T through a CALNET contract, although IT Department plans to change them over to a VOIP plan soon.

At this time, the City’s current contract with Verizon, through a deprecated NASPO contract has expired. Staff is unable to upgrade devices or make changes to the account until a new contract is signed. At this time, Staff has reviewed the two available options, CALNET Next Generation & NASPO Value Point contract plans. Staff met with Sr. Account Manager Public Sector, Marc Moser, and concluded that the CALNET Next Generation provided the better value and costs for the City. The only drawback to a CALNET contract, that any new services or features that the City may request in the future, requires a new sub-agreement.

To begin the process, Staff is requesting authorization to begin filling out the application and paperwork, and ultimately sign a new four (4) year agreement through a CALNET Next Generation contract for wireless services through Verizon; and any subsequent sub-agreements and contracts for telecommunication services for the City of Avenal.

RECOMMENDATION:

Approve the attached Resolution, 2022-09: Authorizing City Manager to Sign CALNET Next Generation Contracts for Wireless and Data Communications, and any subsequent sub-agreements and contracts for telecommunication services for the City of Avenal.

FISCAL IMPACT:

By renewing with a new contract, our Account Manager anticipates the City saving $2 on some lines, or even more for older lines that are on a per-minute cost. With this new contract, all lines will be reviewed and upgraded, with some phones potentially converted to a consumption only, with a lower costs and free minutes to fellow Verizon/City numbers.

Schedule A
Verizon Wireless
Pricing and Information Sheet
State of California CALNET Contract #C4-CVD-19-001-03
Subcategory 19.2
Scope. On May 23, 2019, Verizon Wireless and the State of California, acting through the California Department of Technology, entered into agreement number C4-CVD-19-001-03 for wireless services (together with its exhibits and any amendments, the "Contract"). The Contract includes terms allowing Verizon Wireless to provide Eligible Entities Custom Service Plans (“CSP”). The Contract also allows for a transition of active lines of service purchased under California Participating Addendum # 7-10-70-16 (“PA”). This Schedule A (“Schedule”) sets forth the method by which Verizon Wireless may make CSPs available to the Eligible Entity listed on the Signature Page contained within this Schedule (“Eligible Entity”) for purchase under the Contract. The Schedule also outlines the manner by which the Eligible Entity’s active lines of service will be transitioned from the PA to the Contract, and it lists the CSPs available for purchase by the Eligible Entity under the Contract. Verizon Wireless reserves the right to make changes to CSPs and this Schedule in its sole discretion, including add, discontinue, or alter any plan or Equipment (as defined below). Eligible Entity will be notified of any changes that affect its then-current CSP and a new CSP Acknowledgement or equivalent documents will be processed.

All capitalized terms not defined in this Schedule will have the meaning provided in the Contract.

Equipment: Verizon Wireless is able to make equipment under CSPs (“Equipment”) available to the Eligible Entity at significantly lower prices than the manufacturer’s list prices by offering various subsidies in exchange for the Eligible Entity meeting certain conditions. If the Eligible Entity moves the Equipment to a Lesser Price Plan (as defined below), or disconnects the Equipment from the Verizon network, at any time during the first 24 months after the Equipment is activated, the Eligible Entity must pay an Offer Recovery Fee (as defined below).

A Lesser Price Plan is any one of the following: (a) for smart phones, any plan that is less than $19.99 per month, plus required data feature (voice and data bundles qualify) after any applicable discounts; (b) for internet devices, any plan that is less than $19.99 per month after any applicable discounts; or (c) for basic phones, any plan that is less than $14.99 per month after any applicable discounts. The Offer Recovery Fee is the difference between the full retail price of the Equipment at time of purchase and the discounted price paid by the Eligible Entity for the Equipment, plus any additional service discounts, credits, waived fees, and other offers provided, less 1/24 of that amount for each month the Equipment was connected to the line of service at the original price plan.

Transition of California Participating Addendum # 7-10-70-16 (“PA”) Service Plans Contract: The Parties agree to move identified active lines of service purchased under the PA by the Eligible Entity to the same 4G cellular service plan(s) (each a “Service Plan”) available under the Contract. In the event a Service Plan purchased under the PA is not available for new lines-of-service under the Contract (including for purchase through the Site), the Eligible Entity will be allowed to continue with the Service Plan as a Customized Service Plan under the Contract until the line of service is either a) terminated, b) suspended or is otherwise set to inactive for more than 90 continuous days, or more than 180 days in any one year period, or c) moved to a different Service Plan available for purchase under the Site or otherwise under the Contract. All Purchase Orders issued as of the Effective Date must be placed under the Contract.

This Schedule together with the Contract set forth the entire agreement between the parties regarding the subject matter contained herein, and supersedes any and all previous communications, representations or agreements, whether oral or written. Any terms and conditions in a purchase order, acknowledgement, or any document other than a duly executed amendment to this Schedule or Contract, that are different or in addition to the terms and conditions of this Schedule or the Contract shall be deemed rejected and null and void.

Verizon Wireless Plan and Feature Details
Verizon Wireless Plan and Feature Details only apply to the Customized Service Plans available on the CALNET contract.

Certain agreed upon revisions to the Contractor’s standard terms are set forth in this Catalog Attachment A. Such mutually agreed upon terms shall take precedence over any conflicting terms in the Contractor’s standard Acceptable Use Policy as may be modified from time to time.

To the extent that this Catalog Attachment A conflicts with other provisions in the Contract, the terms set forth in the Contract shall take precedence, pursuant General Provisions Section 14 (Order of Precedence). Catalog Attachment A may be modified by the mutual written consent of the parties.

Plans and Associated Charges: Billing, shipping and end-user address must be within an area where Verizon Wireless is licensed and provides service. Charges for calls will be based on the cell sites used, which may be outside the calling plan coverage area even when the subscriber is physically within the coverage area. Time of the call is based on the telephone switching office that carries the call, which may be different from the time of day shown on subscriber’s phone. Unused monthly minutes and/or Megabytes are lost. On outgoing calls, charges start when subscriber presses SEND or the call connects to a network, and on incoming calls, when the call connects to a network (which may be before it rings). A call may end several seconds after subscriber presses END or the call disconnects. Calls made on the Verizon Wireless network are only billed if they connect (which includes calls answered by machines). Billing for airtime and related charges may sometimes be delayed. Calls to "911" and certain other emergency services are toll-free and airtime-free.

Airtime may be charged when dialing toll-free numbers.

Anytime Minutes: Anytime Minutes apply when making or receiving calls from a calling plan’s rate and coverage area. Coverage information is available at www.verizonwireless.com. Airtime is rounded up to the next full minute. Allowance minutes/Megabytes are not transferable except as may be available on plans with sharing. In order to gain access to coverage in newly expanding markets, subscribers must periodically dial *228 to update roaming information from voice or Smartphone devices; from the VZAccess Manager, go into “Options” and click “Activation,” while in the National Enhanced Services Rate and Coverage Area every three months. This may alter the rate and coverage area. Automatic roaming may not be available in all areas and rates may vary. Roaming charges may be delayed to a later bill.

Long Distance: Unlimited domestic long distance is included when calling from the plan’s rate and coverage area, unless otherwise specified in the plan.

Unlimited Messaging: Unlimited Messaging is included with select plans and is available in the National Enhanced Services rate and coverage area in the United States. Messaging applies when sending and receiving (i) text, picture and video messages to and from Verizon Wireless and Non-Verizon Wireless customers in the United States, (ii) Text, picture, and video messages sent via email, (iii) Instant messages, and (iv) Text messages with customers of wireless carriers in Canada, Mexico, Puerto Rico, and the U.S.

Virgin Islands. Messaging is subject to Text, Picture, and Video Messaging Terms and conditions. Premium messages are not included. Friends & Family for Business: Calls directed to and received from an account’s listed Friends & Family numbers shall not use Monthly Anytime Voice Minutes. For Nationwide for Business plans with 900 minutes or more or 450 minute plan with the share option can add up to ten (10) Friends & Family numbers. Only calls from Nationwide Coverage Area to designated domestic landline or wireless numbers (excluding Directory Assistance, 900 numbers, or customer’s own wireless or Voicemail access numbers) may be added; all qualifying lines on an account share the same Friends & Family numbers, up to account’s eligibility limits; My Verizon, My Business Account or Verizon Enterprise Center is required to set up and manage Friends & Family numbers.

Mobile to Mobile Calling: Mobile to Mobile Calling minutes apply when making calls directly to or receiving calls directly from another Verizon Wireless subscriber while in the Nationwide Rate and Coverage area.

Mobile to Mobile calls must originate and terminate while both Verizon Wireless subscribers are within the Mobile to Mobile Calling area. Mobile to Mobile Calling is not available (i) with fixed wireless devices with usage substantially from a single cell site, (ii) for data usage including Push to Talk Plus calls, Picture or Video Messaging (iii) if Call Forwarding or No Answer/Busy Transfer features are activated, (iv) for calls to Verizon Wireless customers using any of the International services, (v) for calls to check Voice Mail, (vi) in those areas of Louisiana and Mississippi where the users roaming indicator flashes, (vii) in Canada and Mexico and (viii) to users whose current wireless exchange restricts the delivery of Caller ID And (viiii) for incoming calls if Caller ID is not present or Caller ID Block is initiated. Mobile to Mobile Calling minutes will be applied before Anytime Minutes.

Night and Weekend Minutes: Apply to calls made in a calling plan’s rate and coverage area only during the following hours: 12:00 am Saturday through 11:59 pm Sunday and 9:01 pm to 5:59 am Monday through Friday. If both Night and Weekend and Mobile to Mobile Calling minute allowances apply to a given call, Mobile to Mobile Calling minutes will apply before Night and Weekend minutes. However, if either allowance is unlimited, the unlimited allowance will always apply first.

Nationwide for Business Share Option: The Share Option is available to businesses with a minimum of five (5) Nationwide for Business lines on the same account with the share option. The Monthly Anytime Minutes of all lines on an account will be aggregated, and then allocated first to the line with the highest anytime minute usage, and then to the line with the next highest usage.

Push to Talk Plus: Push to Talk Plus (PTT+) capable Equipment required.

Push to Talk Plus capable Equipment can only be used with a Push to Talk Plus calling plan. Subscribers switching from a Push to Talk Plus Calling Plan to another calling plan may not be able to use certain Push to Talk Plus capable Equipment with the new plan. Push to Talk Plus calls may only be made with other Verizon Wireless Push to Talk Plus subscribers.

Push to Talk Plus Subscribers may initiate or participate on a call, simultaneously, with as many as 250 total participants (total is limited to (50) if interoperating between 3G and 4G participants). Administrators can be designated to manage the Push to Talk contact lists via a single website interface with a single user name/password. . Existing Push to Talk Subscriber Equipment may require a software upgrade to use Push to Talk Plus or replacement with a Push to Talk Plus capable device. Push to Talk Plus is only available within the National Enhanced Services Rate and Coverage Area and WiFi access points. There will be a delay from the time a Push to Talk Plus call is initiated until the Push to Talk Plus call is first received by the called party. If an incoming voice call is received while on a Push to Talk Plus call the voice call may be answered and the Push to Talk Plus placed on hold. If an incoming Push to Talk Plus call is received while on a Push to Talk Plus call the PTT call icon can be selected to connect to the Push to Talk Plus call. If the incoming voice or Push to Talk Plus call is not answered a missed call alert will display. Network registration information will be sent to the Equipment each time it is powered on in the National Enhanced Services Rate and Coverage Area, each time the Subscriber travels into the National Enhanced Services Rate and Coverage Area, and every 12 hours if the Subscriber stays within the National Enhanced Services Rate and Coverage Area. While the updated network registration information is being sent to the Equipment, incoming voice calls will go directly to voice mail. Contact list cannot be modified from certain Equipment. Subscriber cannot prevent others who Feb 10, 2022 Pg. 56
have the Subscriber’s MTN from entering the MTN into their Push to Talk contact list. Only one person can speak at a time during a Push to Talk Plus call. In-Call Talker Override (Talker Priority) allows a pre-determined user priority to take the floor to communicate urgent message over participant. Push to Talk Plus services cannot be used for (i) access to the Internet, intranets or other data networks, except as the device’s native applications & capabilities permit, (ii) any applications that tether Equipment to laptops, personal computers or other devices for any purpose. If you download an audio or video file, the file may be downloaded in sections or in its entirety; data charges will apply to the portion downloaded, regardless of whether you listen to or watch all of it. Note: 1A profile is defined as a Customer’s overarching account of record under which Customer may have multiple billing accounts Verizon Wireless’ pricing does not include federal, state, local or foreign fees, assessments or other charges (collectively “fees”), which must be billed based on the jurisdiction in which the subscriber’s cellular number is set up and located. Fees vary by state and local areas and are subject to change without notice.

Verizon Wireless cannot provide a comprehensive list of all charges and regulatory fees required and assessed when using a wireless device because they vary greatly from one jurisdiction to another.

In addition to taxes, surcharges and fees that we are required to collect, we will also collect charges to recover or help defray costs of taxes and governmental surcharges and fees imposed on us, and costs associated with governmental regulations and mandates on our business. These charges include, among others, a Regulatory Charge and a Federal Universal Service Charge, and are described below in more detail. These charges are Verizon Wireless charges, not taxes, and are subject to change. Because these charges are not taxes, your tax exemptions, if any, will not apply to these charges.

Federal Universal Service Charge
Wireless carriers are assessed by the federal government to fund the delivery of universally-affordable telecommunications and information services under the Federal Universal Service Fund (FUSF) program.

The Federal Universal Service Charge (FUSC) collected by Verizon is a percentage of the customer's monthly bill and is used to defray the costs of the FUSF. The FUSC is collected on most items on the bill, other than data charges for wireless broadband Internet access, equipment charges and taxes.

As of January 1, 2019, the basic FUSC rate is 20.00% and changes quarterly. The FUSC rate for bundled minute plans is 5.46% if the customer does not exceed the included number of minutes. The 20.00% rate applies to long distance interstate calls that exceed the customer's included bundle of minutes. Other services, such as VOIP, are charged a lower FUSC rate. • Cellular Access for voice calling plans (only on first 79% of this item) • Verizon Wireless Toll

August 10, 2020 State of CA CALNET Contract C4-CVD-19-001-03 Page 14 of 14 The quarterly percentage rate described above for the FUSC is applied in our billing system.

Verizon Wireless also imposes state universal service charges. These charges vary by jurisdiction and are subject to change depending on changes in the state universal service impositions on Verizon Wireless.

Regulatory Charge
The Regulatory Charge is an assessment that helps defray our ongoing costs of complying with various governmental mandates and assessments.

Examples include:
 The cost of the license fees assessed by the FCC.
 Costs assessed by the FCC to administer local number portability requirements.

This charge is subject to change over time upon notice and is taxable in most jurisdictions.

Regulatory fees impacting the wireless industry are constantly evolving and are subject to change without notice. For more information you can visit the FCC’s website at www.fcc.gov.

(See https://www.verizonwireless.com/support/one-talk-features/ for a listing of features currently available with the Service.) The following terms of service apply to the One Talk Service. “Customer” means the eligible entity purchasing the One Talk service under the Contract along with any Customer end users using the Service.

Customer Agreement. Customer’s use of the Service is subject to all Contract terms. This applies regardless of whether the end user device is on the Customer’s account or paid for by the end user (e.g. a Bring Your Own Device arrangement between Customer and end user).

How the Service Works. For the Service to work on wireless devices, Customer must select the line on your agency’s profile to which you wish to add the One Talk feature. Each One Talk phone number can be shared with up to eight (8) devices (which can include one (1) smartphone using One Talk in Basic Dialer mode (if available), five (5) smartphones and/or tablets using the One Talk Mobile App, and two (2) desk phones. (Note that desk phones are not required for the Service.) You may only make voice and/or video calls with up to three (3) devices per One Talk phone number at the same time. The Service is not compatible with all price plans and desk phones are not available under all contracts. Check with your sales representative for plan compatibility with the Service and the availability of desk phones under the Contract.

Customer is solely responsible for managing its end user access to the One Talk Service, management of end user devices and management of information transmitted via the Service. Addition of devices and associated Service features is managed and administered by the Customer through Verizon Wireless’ web portal.

A. One Talk Components
One Talk Basic Dialer. If available, the One Talk Basic Dialer adds various business features to a compatible device’s native dialer, which on a compatible smartphones (see https://www.verizonwireless.com/support/compatible-one-talk-devices/ for a current list of supported devices.) With One Talk in Basic Dialer mode, Customer’s One Talk phone number will be the same as its Verizon Wireless phone number. Other devices that you select will share the same One Talk phone number.

One Talk Mobile App. The One Talk Mobile App is available for smartphone and tablets either from the Google PlayTM Store for devices with AndroidTM 5.0 or higher or from the Apple® App Store for devices with iOS 9.0 or higher. To use the Service, Customer must add a One Talk phone number to the Mobile App and end users must use the Mobile App to make voice and video calls and to send and receive messages. You can also obtain access to One Talk features through the Mobile App.

With the Mobile App, the device will have two phone numbers – one for its original native dialer (if available), and the other for the One Talk number. Other associated devices will share the same One Talk number. Users may install the One Talk Mobile App on a compatible device, including devices receiving service from other carriers. In such circumstances, One Talk phone numbers must be added to their devices, and the users will be Verizon Wireless subscribers for purposes of the Service only, even if they continue to use a different carrier for their original mobile telephone numbers. In order to use messaging through the One Talk Mobile App, the customer also must add the Message + App.

Message+ App. The Message+ App provides an integrated and customized messaging experience across an end user’s mobile phone, tablet, PC, and other devices, and an integrated calling experience across a user’s mobile phone and tablet. (Note that integrated calling is not part of the One Talk Service.) An end user can also Feb 10, 2022 Pg. 64
July 12, 2021 State of CA CALNET Contract C4-CVD-19-001-03 Page 5 of 6 send group, location and other multimedia messages (“MMS”) in addition to traditional text messages. The Message+ App includes an Integrated Messaging feature that lets users send and receive text and multimedia messages on an end user’s smartphone, tablet, computer or the web using a user’s Verizon One Talk mobile telephone number. The service syncs up to 90 days of messages across an end user’s devices.

One Talk Desk Phones. One Talk desk phones are Voice-over-Internet Protocol (VoIP) devices, that must be purchased from Verizon Wireless. At your location, you will need separate broadband service (from Verizon or another ISP), either Ethernet or Wi-Fi connectivity, and AC power. Check with your Verizon Wireless sales representative for the availability of desk phones under the Contract.

Auto Receptionist: Hunt Group. In order to utilize either of these features, Customer must activate a new Verizon Wireless line or port in a line from another carrier.

The settings for the line must be configured using the One Talk section of the My Business web portal.

B. Charges
For each One Talk line, you will be charged a monthly recurring fee for the Service, in addition to the charges for data, voice, and messaging based on your service plan. Charges for international use may apply. You may be assessed additional 911 surcharges if required by law, for up to a maximum of three devices on each mobile phone number during the applicable billing cycle.

Desk Phones. Voice and video calls to and from One Talk desk phones will consume data on your existing broadband, cellular, or Wi-Fi connection.

The following applies if you use the VZW network to connect to the Service:

One Talk Basic Dialer. Adding the One Talk feature to a smartphone does not consume any data. If you have a device that supports video calling, the voice portion will be billed as minutes of use and the video portion will be billed as data. Voice calls will be billed as minutes of use only.

One Talk Mobile App. Your download of the One Talk Mobile App will consume approximately 30 MB of data. Your use of the Service (including your download of the One Talk Mobile App) will be billed as data.

Auto Receptionist; Hunt Group. You will be charged a monthly recurring fee for each Auto Receptionist and Hunt Group line in your company’s profile.

Integrated Calling Charges (Message+). Integrated Calling does not have a separate monthly service fee, but data usage charges will be incurred in accordance with Customer’s service plan. If a call is transferred among connected devices, each transfer will be billed as a separate call. Also, depending on the service address, Customer may be assessed an additional 911 charge if required by law. Any call made from a tablet to a U.S. number will be treated as a domestic call, no matter where the call originates. Any call made from a tablet to a non-U.S. number will be treated as an international long distance call that originates in the U.S., which is subject to U.S. taxes, fees and Verizon surcharges, no matter where the call actually originates. These calls will be billed in accordance with Customer’s international calling plan and/or international Contract rates.

Emergency 911 Calls. End users can make a 911 call over a Wi-Fi connection when using the Service, but whenever possible, end users should avoid doing so because 911 calls over a WiFi connection will not work if there is a failure of your broadband connection or electrical power, or if the 911 system doesn’t recognize the address. In addition, when using a One Talk desk phone, voice functionality (including the ability to make and receive 911 calls) will not be available during a power outage, broadband connection failure or other service disruption. Before any desk phone can be activated or the Service can be activated on any device, Customer must enter the U.S. address where Customer wants emergency services to be sent if end users call 911. It is not necessary to use the same address for all devices.

It is very important that Customer updates its 911 address whenever Customer changes its location for any of these devices because this is the location that will be given to emergency services when end users dial 911. End users can go to their mobile device’s Settings and change their 911 address at any time. Customer can change the 911 address for a desk phone on the One Talk section of the My Business web portal. (Note: With a smartphone using the One Talk Mobile App, emergency services will use the 911 address only if you use Wi-Fi to make the 911 call. If end users are using the Verizon Wireless Network, their smartphone’s built-in capabilities will provide the location of the end user’s device.)
Integrated Messaging Text Message Feature. To send and receive SMS messages, Mobile devices associated with either One Talk Basic Dialer (if available) or One Talk Mobile App must download the Message+ App to the device. The Integrated Messaging functionality of Message+ enables you to synchronize messages across multiple devices, including smartphones, tablets and the web. Text messages sent and received while using the Service are separate from the native texting app (dual numbers) and are only temporarily retained on the One Talk message platform in the cloud. End users with access to the Service on a Smartphone or the Mobile Client can retrieve/download any text message sent or received using the Service.

HIPAA. Integrated Messaging is not designed for secure transmission or storage of personal healthcare information. Therefore, Customer agrees not to use Service to store or transmit Protected Health Information (PHI) as defined in the Health Insurance Portability & Accountability Act of 1996 and the Health Information Technology for Economic and Clinical Health Act of 2009 and accompanying regulations (collectively “HIPAA”). Covered Entities and Business Associates (as defined by HIPAA) will not use Integrated Messaging to store or transmit PHI. Customers that do not want its end users to save messages to the cloud (including all Covered Entities and Business Associates, as defined by HIPAA), must have an authorized representative block Integrated Messaging. For further information, go to https://web.vma.vzw.com/BusinessProduct. To learn more about HIPAA, go to: http://www.hhs.gov/ocr/privacy/hipaa/understanding/index.html.

Service Limitations. The Service is not compatible with fax machines, credit card machines or certain security systems. Your Verizon Wireless representative can suggest other possible solutions for some of these functions. Please check with your provider to confirm the compatibility requirements of your security system.

RE: Consider Request from City of Coalinga to Transfer Surplus Water Allocation
INFORMATION:

On January 26, 2022, Sean Brewer, Assistant City Manager for the City of Coalinga reached out to City Staff in inquire about the City’s water allocation for the 2021-2022 water year, which ends on February 28, 2022. Similar to last year, Coalinga is running on a water deficit, and would like to end the water year as close to zero as possible, so to not have a negative balance carry over into the new water year and reduce their possible total allotment. At this time, City of Coalinga indicates they are at a negative ~300 acre feet of water allocation for this water year.

As of February 6, 2022, the City has utilized 2,203 acre feet of water out of a total allocation of 2,480 acre feet – or 277 acre feet remaining. On average, we are utilizing 6.9 acre feet a day, with 22 days remaining, Staff anticipates needing 152 acre feet through the end of the water year, leaving ~125 acre feet remaining.

The City Manager spoke to Erma Leal, Specialist at USBR, to discuss what would be needed to do such a transfer. She indicated that the City would simply have to send out an email requesting that any additional water the City does not utilize, be transferred over to City of Coalinga to help out their allocation numbers. Staff did ask USBR if there was any possibility of the City reserving or saving this extra water for the next water year, which the response was – no. The City’s surface water contract with USBR stipulates that water allocations are “use it or lose it.” Not having a place to store the water, passing along any excess water to City of Coalinga is a good gesture to the City’s neighbor.

RECOMMENDATION:

By Motion, Authorize the City Manager to send an email to the USBR indicating that the City would like to transfer any excess unused water allocation for the 2021-2022 water year, over to the City of Coalinga.

I wanted to follow up from our conversation earlier today to see if you had any additional excess allocation of water that may be able to be transferred to the City of Coalinga since we are currently working in a deficit for the remainder of the water year. Anything you guys may have in excess, since USBR typically does not carry over water, would be awesome!
Thanks,
Sean Brewer

RE: Information Technology Monthly Report January 2021
CURRENT PROJECTS:

Internet Access: Staff currently awaits results from Spectrum’s construction survey.

Phone System: Staff continues to work with AT&T to attempt to repair our current system while a more robust solution is available. In August 2, 2019. FCC order 19-72A1 granted phone and telecom carriers to abandon degrading copper wires, as well as dropping analog POTS availability to landline customers. This solves concerns regarding 911 emergency access for any VoIP services we choose to transfer over to.

Emails: Microsoft continues to roll out backend changes to their Exchange Admin services with limited success to our migration needs.

Server: Colfax has given us an ETA of March for our final server. Our temporary server is Linuxbased and will allow for a near seamless migration from the temporary to final server. As mentioned verbally in the previous report, practical usage is ready for file access, sharing, and scanning along with the permissions to lock out users from tampering with files outside of their assigned folders.

Wireless access has been configured. Dependencies for OpenVPN for remote access, OpenLDAP, and Windows Server 2021 for login management are installed and await configuration.

Clerk Software: On January 21st, staff received their final CivicClerk official training session.

Training recordings have been saved and consolidated for easy access. IT and City Clerk will review the trainings to familiarize with the administration portion, followed by the user portion for other City Staff users. Once staff is familiar with the software, the software will be live for both internal and public access.

Other:
-Staff repaired the laminator for Community Activities usage. -Staff continues to provide tech support across all facilities.

RE: Consider Extending Local Emergency Declaration (COVID-19) INFORMATION:

On March 24, 2020, the Avenal City Council adopted Resolution No. 2020-14 declaring a Local Emergency due to the existence or threatened existence of a local emergency: COVID 19 pandemic.

The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.

On October 28, 2021, the Avenal City Council adopted Resolution No. 2021-48 to satisfy AB 361 in order to continue Teleconferenced Meetings. AB 361 provides that, if the state of emergency remains active for more than 30 days, a local agency must make the following findings by majority vote every 30 days to continue using the bill’s exemption to the Brown Act teleconferencing rules
• The legislative body has reconsidered the circumstances of the emergency; and • Either of the following circumstances exist: The state of emergency continues to directly impact the ability of members to meet safely in person, or State or local officials continue to impose or recommend social distancing measures.

At this time, staff is recommending the City Council consider the following action by motion:

Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.

Additionally, that the Council find that a state of emergency continues to directly impact the ability of members to meet safely in person, and that State and local officials continue to impose or recommend social distancing measures.

RECOMMENDATION:

Discussion/Action.

FISCAL IMPACT:

None.

RE: Consider Extending Local Emergency Declaration (Water) INFORMATION:

On May 27, 2021, the Avenal City Council adopted Resolution No. 2021-23 declaring a Local Emergency due to the existence or threatened existence of a local emergency: Severe Water Shortage.

The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.

On July 20th, 2021, USBR informed City Staff that additional water for Public Health & Safety needs would be conditionally allocated, in the amount of 2,480 acre feet to the City of Avenal.

This amount equates to the City’s historic use for the past five years and should be adequate to meet the City’s needs for this water year – provided that conservation measures are still enforced. Given that this allocation is conditional and subject to change, staff will continue monitoring the situation in hopes that this new allocation is not reduced.

RECOMMENDATION:
