MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/ ITEMS FOR CONSIDERATION:
A. Discussion of Zoning Ordinance 9.10.6 D, regarding poultry (chickens) in R-1 Zone: CodeEnforcement/City Manager in Lupe Chavez, Senior Code Enforcement Officer presented Zoning Ordinance 9.10.6D, regarding poultry (chickens) in R-1 Zone.
Antony Lopez, City Manager reported that backyard chickens there was a resolution to make a recommendation of no changes to the zoning ordinance procedurally that resolution was never brought back to the City Council. He knows this was one of the things that had been discussed that never came back to the Council. Also, Councilmember Woolley asked him a few times, when we were going to present it to City Council. So, formally we are presenting that resolution that five years ago the Planning Commission recommended no changes but understanding that things have changed. Staff is seeking direction from City Council of what would like they want to either go back to the drawing board, do more research, and see how things have changed in recent years. He has Lupe Chavez, Senior Code Enforcement Officer brushed up on the research and give a small presentation of how the lay of the land is with backyard chickens but after that just go back to the council and see where what direction you would like us to do go ahead Lupe Lupe Chavez, Senior Code Enforcement Officer presented Zoning Ordinance 9.10.6D, regarding poultry (chickens) in R-1 Zone. He met with representatives of relevant City departments: Code Enforcement, Public Works, Animal Control, Police, Community Development, and City Manager. This discussion brought insightful viewpoints and context explaining the current ordinance. Staff also reached out to neighboring cities and the county for their ordinances regarding chickens. The results of this research are provided below.
Research:
Section 9.10-6 D of the Avenal Zoning Ordinance states that:
³No poultry or fowl of any type if allowed in the R-1 Zone (chicken, rooster, duck, pheasant, geese, etc.)´ Staff is presenting requested research regarding City Staff opinions regarding chickensin Single-Family Residential Zones, and current ordinances in neighboring cities.
A. City Staff Discussion (Attachment A).
Staff Research pertaining to fowl ordinances in Kings County and corresponding cities (Attachment B) a. Kings County allows up to twelve chickens in single family residential and ruralestate zones; not allowed in multi-family residential zones.
b. City of Hanford does not allow any fowl and considers them a publicnuisance. c. City of Corcoran only allows fowl on lots of over 20,000 square feet. d. City of Lemoore considers chickens household pets and are allowed incertain residential zones. Lemoore does not allow roosters at all.
After a legthy discussion, the City Council is in consensuses to do a Town Hall meeting and get feedback regarding poultry (chickens) in R-1 Zone and see how big of an interest there is for chickens.

EVENTS SB 1383 PREPERATION
4th quarter of 2021 was spent establishing
objectives and preparing the necessary
materials to meet SB 1383 requirements.
Currently in 2022, Mid Valley Disposal and
the City of Avenal have met the educational
requirements set by SB 1383
Mid Valley Disposal participated in and contributed
to several events throughout 4th quarter.
• FARMERS MARKET
• PISTACHIO FEST
• HIGH SCHOOL FOOD DRIVES
• OPERATION GOBBLE GOBBLE
SB1383 is a bill that was passed to reduce organic
waste disposal from our landfills by 75 percent and
increase edible food recovery by 20 percent by 2025
and takes effect January 1, 2022.
All jurisdictions are required to adopt a mandatory
organic waste ordinance. Jurisdictions will enforce and apply fines and penalties on anyone who does not comply.
Everyone. Single residences, multiple family residences, businesses, schools, and special districts are all required to comply with SB 1383 and subscribe to recycling and
organic waste recycling services. This means that organic waste, including food scraps and green waste, must be
separated and placed in a green container, recyclables in a blue container, and trash in a gray container.
Organic waste that decomposes in a landfill releases
methane gas, a highly potent greenhouse gas. This is
why keeping food waste and green waste out of your
trash is so important. Sending food scraps and green
waste to a controlled composting facility through your
green containers helps to prevent the release of methane gas that contributes to poor air quality affecting your health. Reducing methane gas will also prevent extreme
climate change impact such as droughts and wildfires.
The organic waste collected by Mid Valley Disposal goes through it’s composting facility in Kerman where the
materials are processed to produce compost and mulch
used in the farming industry in the Central Valley to grow and produce nuts, vegetables, and fruits. You can help by making sure everything going in your organic container is compostable. Refer to our recycling guide to see what is compostable. If you have an alternative arrangement for your organic waste, you must be approved and comply
with City requirements.
WHAT IS SENATE BILL 1383?
KEEPING ORGANIC WASTE OUT OF THE LANDFILL
WAYS TO REDUCE ORGANIC WASTE AT HOME EDIBLE FOOD RECOVERY There is an urgent need for food donation. Early participation in food recovery programs will help feed people who face hunger daily. California protects food businesses from liability now more than ever through the California Good Samaritan Food Donation Act.
Visit MidValleyDisposal.com for information regarding
programs for the donation of edible food in your community.

AGENDA ITEM NO. 8. A
TO: The Honorable Mayor and City Council
FROM: Rob Williams, Public Works Director
DATE: March 24, 2022
RE: Consider 10-precent Retention for City Projects.
INFORMATION:
Recently, California Public Contractors Code 7201 (b) (4) now states that ³QRWZLWKVWDQGLQJ´DQ\SURYLVLRQVRIWKLVVXEGLYLVLRQWKHUHWHQWLRQSURFHHGVZLWKKHOG from any payment by the city from contractor may exceed 5 percent on specific projects where the governing body of the public entity or designee, including a director of an appropriate department, has approved a finding during a properly noticed and normally scheduled public hearing prior to bid that project is substantially complex and, therefore requires a higher retention amount than 5 percent and the City includes both this findings and actual retention amount in the bid amount
Staff will go out for the following bids: Seventh Avenue Street Project (SR 269 to Highway 33). Community Building Project, Whitney Street - Sewer Pipeline and 0DQKROH3URMHFWV
DQG´6HZHU5HSODFHPHQW3LSHOLQHDQG0DQKROHProjects.
Staff recommends that 10% be withheld form payment rather than 5% allowed, therefore, the need to make a finding that 10% be withheld is justified.
RECOMMENDATION:
The Projects: Seventh Avenue Street Project (SR 269 to Highway 33); Community Building Projects, Whitney Street - 6HZHU3LSHOLQHDQG0DQKROH3URMHFWV DQG´6HZHU
Replacement Pipeline and Manhole projects. This is a complex project due to the Safety and Health of the residents and, therefore, will require a higher retention in the amount of 10%.
FISCAL IMPACT:
This action will increase the amount the City of Avenal can withhold from progress payments to successful bidder from 5% to 10% for the Projects.

RE: Consider Extending Local Emergency Declaration (COVID-19) INFORMATION:
On March 24, 2020, the Avenal City Council adopted Resolution No. 2020-14 declaring a Local Emergency due to the existence or threatened existence of a local emergency: COVID 19 pandemic. Although case numbers have dropped to the single digits in Avenal, not all restrictions have been lifted, and the finding below is still required to be made to allow Councilmembers to attend meetings virtually.
The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.
On October 28, 2021, the Avenal City Council adopted Resolution No. 2021-48 to satisfy AB 361 in order to continue Teleconferenced Meetings. AB 361 provides that, if the state of emergency remains active for more than 30 days, a local agency must make the following ILQGLQJVE\PDMRULW\YRWHHYHU\GD\VWRFRQWLQXHXVLQJWKHELOO¶VH[HPSWLRQWRWKH%URZQ$FW teleconferencing rules
x The legislative body has reconsidered the circumstances of the emergency; and x Either of the following circumstances exist: The state of emergency continues to directly impact the ability of members to meet safely in person, or State or local officials continue to impose or recommend social distancing measures.
At this time, staff is recommending the City Council consider the following action by motion:
Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.
Additionally, that the Council find that a state of emergency continues to directly impact the ability of members to meet safely in person, and that State and local officials continue to impose or recommend social distancing measures.

RE: Consider Extending Local Emergency Declaration (Water) INFORMATION:
On May 27, 2021, the Avenal City Council adopted Resolution No. 2021-23 declaring a Local Emergency due to the existence or threatened existence of a local emergency: Severe Water Shortage.
The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.
On February 26, 2022, USBR published the water allocation for the 2022-2023 water year for Municipal & Industrial (M&I), being 25% of historic use. For the City of Avenal, 25% of 2,480 acre feet is 620 acre feet ± QRWHQRXJKWRPHHWWKH&LW\¶VQHHGVWKURXJK-XQH. Staff is awaiting response from USBR regarding additional allocation that could be provided as Public Health & Safety (PH&S).
By continuing the local emergency due to drought conditions, this action helps to show the Bureau that the City takes the drought emergency seriously and helps them accommodate the necessary Public Health & Safety water needs to the City.
Staff is recommending the City Council consider the following action by motion:
Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.

DATE: March 24, 2022
RE: Review TTHM Letter Noncompliance
INFORMATION:
On March 14, 2022, a compliance order from the State Water Resource Control Board (SWRCB) was received. Compliance order NO. 03_12_22R_001 is for a violation of the maximum contaminant level (MCL) for Total Trihalomethanes (TTHM). The Local Running Annual Average (LRAA) MCL for TTHM is 80 ug/L one of our four sites (1 Kings Way) has exceeded the limit with a LRAA of 84.0 ug/L. Utilities staff is aware of the issue and is working on solutions. Currently we have limited options available to resolve the issue but will do our best to get back into compliance within the next 6 months.
Staff will be exploring alternative treatment options to increase our ability to treat for TTHM in the future. Which will include treatment technique options such as aeration or enhanced coagulation. We will work with an engineering firm (not yet selected) to help find the best solution for our situation.
The following are some of the directives from the order which Staff is working diligently to complete and adhere to:
1. By March 14, 2025, comply with CCR, Title 22, Section 64533.
2. By April 10, 2022, notify all persons served by the Water System of the violation of CCR, Title 22, Section 64533, in conformance with CCR Title 22, Sections 64463.4 and 64465.
Public notification to the persons served by the Water System shall continue quarterly until the State Water Board determines that the Water System complies with CCR, Title 22, Section 64533.
3. Prepare for State Water Board approval, a Corrective Action Plan, identifying improvements to the water system designed to correct the water quality problems identified as an exceedance of the TTHM MCL and ensure that the Water System delivers water to consumers that meets primary drinking water standards. The plan shall include a time schedule for completion of each of the phases of the project such as design, construction, and startup, and a date as of which the Water System will be in compliance with the TTHM MCL, which date must be no later than March 14, 2025.
4. By May 20, 2022, submit and present a Corrective Action Plan to the State Water ŽĂƌĚ͛Ɛ office either via a virtual meeting, or in person located at 265 W. Bullard Avenue, Suite 101, Fresno, CA 93704

City of Avenal has levels of Total Trihalomethanes Above Drinking Water Standards Our water system recently failed a drinking water standard. Although this is not an emergency, as our customers, you have a right to know what you should do, what happened, and what we are doing to correct this situation.
We routinely monitor for the presence of drinking water contaminants. Testing results we received on 7/12/21 show that our system exceeds the standard, or maximum contaminant level (MCL), for Total Trihalomethanes. The MCL standards for Total Trihalomethanes are 80 ug/L. The average level of Total Trihalomethanes over the last year was 87.5 What should I do?
• You do not need to use an alternative (e.g., bottled) water supply. • This is not an immediate risk. If it had been, you would have been notified immediately. However, some people who drink water containing trihalomethanes in excess of the MCL over many years may experience liver, kidney, or central nervous system problems, and may have an increased risk of getting cancer. • If you have other health issues concerning the consumption of this water, you may wish to consult your doctor.
What happened? What was done?
The current water drought emergency has caused fluctuations in the raw water quality. These fluctuations make it difficult for the water treatment plants to remove the required amount of Total Organic Carbon (TOC). Additionally, there are naturally occurring organic material found in the water from the California Aqueduct, as this material combines with our primary disinfectant (chlorine), it forms trihalomethanes.
Without disinfection, the likelihood of a water customer contracting water borne illness could be serious and very high. We are working to minimize the formation of TTHM while ensuring we maintain an adequate level of disinfectant. Currently we have decreased tank levels to reduce the contact time and March 24, 2022 Pg. 40

will also be decreasing the chlorine residuals to help reduce the formation of TTHM. The City is also taking additional steps by seeking grant funds to help modernize the water treatment process and further reduce the formation of TTHM in the future.

INFORMATION:

Part of the problem is the rise in overhead costs, with chemicals and the need to replace a lot of aging equipment outpacing the budgets as proposed. Inflation and severe water droughts have also negatively impacted these funds, where the City receives less revenues when residents use less water, but the ongoing costs remain the same. For example, currently the Water Enterprise )XQGLVQRWFROOHFWLQJHQRXJKUHYHQXHWRPHHWWKH&LW\¶VFXUUHQW%RQG&RYHQDQWRI - ³Enterprise Revenues sufficient in each Fiscal Year to (i) provide Net Revenues equal to at least 1.25 times the sum of the Installment Payments coming due and payable during such Fiscal Year´
%RQG'HDOS
The Sewer Enterprise Fund is operating in the red, with reserves covering the shortfall in revenues for prior two years.
In 2017, the City conducted a Proposition 218 water and wastewater rate study to bring the enterprise fees up to date to current conditions to minimize this deficit ± after nearly eight years of not raising fees. This study was for five years of rate changes, with the last one going into effect on July 1, 2021. Last August, the City contracted Dan Bergman of IG Services, to conduct the Water/Waste Water Rate Study for the following five years, 2023-2027. Dan has extensive experience conducting these studies throughout the Central Valley and is aware of the challenges faces cities like Avenal, Huron, and Coalinga.
Throughout the last few PRQWKV'DQKDVGLVVHFWHGWKH&LW\¶V(QWHUSULVH)XQGVFKDOOHQJHVDQG opportunities. One major revelation is that the prior rate study did not do enough to help keep the City in the black in regards to operation costs and the bond covenant.
Dan will review a short presentation with Council on the latest findings and current recommendations to begin the process of the Proposition 2018 Noticing for the Water and Waste Water rates.
Lastly, Dan will return to Council on the April 28, 2022 meeting where Staff will request support to issue the Proposition 218 notice, with a rate hearing on June 26, 2022, and new rates becoming effective July 1, 2022.

(iv) Surplus. The City shall manage, conserve and apply moneys in the Enterprise Revenue Fund in such a manner that all deposits required to be made pursuant to the Indenture and the Installment Sale Agreement shall be made at the times and in the amounts so required. If all of the foregoing transfers are made within the time required, any surplus moneys in the Enterprise Revenue Fund may be applied as follows. Subject to the foregoing, so long as no default shall have occurred and be continuing under the Installment Sale Agreement, the City may at any time and from time to time use and apply Net Revenues in the Enterprise Revenue Fund for the acquisition and construction of further extensions and betterments to the Enterprise or the redemption of any of the Bonds or Parity Lien Debt which are then subject to redemption or the purchase from time to time in the open market.
Rate Covenant. The City covenants in the Installment Sale Agreement that it shall prescribe, revise and collect such rates, fees and charges for the services and facilities of the Enterprise which, after allowances for contingencies and error in the estimates, shall produce Enterprise Revenues sufficient in each Fiscal Year to (i) provide Net Revenues equal to at least 1.25 times the sum of the Installment Payments coming due and payable during such Fiscal Year, all payments required with respect to Parity Lien Debt, and amounts required to replenish the Reserve Fund, as required by the Indenture, and (ii) provide Net Revenues at least equal to the sum of all debt obligations due and payable from Enterprise Revenues during such Fiscal Year.
If, in any Fiscal Year, rates, fees and charges for the services and facilities of the Enterprise which, after allowances for contingencies and error in the estimates, shall produce Enterprise Revenues insufficient in each Fiscal Year to provide Net Revenues equal to the required amounts as described in the immediately preceding paragraph, the City covenants in the Installment Sale Agreement to employ an independent consultant to make recommendations as to a revision of the rates, fees and charges of the Enterprise or the methods of operation of the Enterprise that will result in producing Net Revenues.in the amounts specified in the immediately preceding paragraph.
The City further covenants that it shall, promptly upon its receipt of such recommendations from such consultant, subject to applicable requirements or restrictions imposed by law, and subject to a good faith determination of the City Council that such recommendations, in whole or in part, are in the best interests of the City, revise its rate, fees and charges or its methods of operation or collections and shall take such other action as shall be in conformity with such recommendations. 1 City of Avenal Water and Sewer Rate Study
Preliminary Discussion
March 24, 2022

“Cost of Service Rate Study”
• Rates collected for each utility service are kept within each utility
• Rates collected are not more than necessary
• Rates charged to customers are proportional to the cost to serve them: “All customers are not equal.”
• Customers must be notified and may protest
2 Study Approach
1. Look back: Evaluate historical revenues vs expenses
2. Look forward: Forecast expenses over next five years
3. Consider capital improvement funding needed
4. Evaluate existing rate structure for fairness across customer groups
5. Adjust rates to achieve fairness and revenue needed
6. Communication and implementation
3 Conclusions - Water
• Revenue during the past few years has been insufficient to meet the 2005 bond covenant requirements
• An 18 percent immediate overall revenue increase is
needed, followed by 6 percent annual increases (PG&E
10% inflation)
• Avenal State Prison water costs have been subsidized by other customers
• Water fund balance is roughly $3 million (1 yr revenue) 4 Conclusions - Sewer
• Revenue during the past few years has been insufficient to cover operating expenses
• Annual 3 percent increases are needed to breakeven
over five years, including the benefit of solar panels
• Avenal State Prison sewer revenues have subsidized
other customers. (Opposite of water)
• Sewer fund balance is roughly $3 million, almost 2 yrs of revenue.

Two projected scenarios:
1. Revenue increased 18% first year, followed by 6%
increases next four years. PG&E increases are 10%
2. PG&E increases are 22% per year. To get same result
as 1, revenue increase is 18% first year, followed by
12% increases next four years.

Conclusions
• Fund balances are relatively healthy
• Debt burden is reasonable, water only
• Water rates must be increased
• Sewer rates should be increased
• PG&E is getting very expensive: Solar matters.
• Cost of service adjustments have significant impacts
• Don’t forget the need for projects: Preserve cash
• If subsequent increases not needed, city council may
suspend them without notice
23 Next Steps
• Discussion, Questions, Council and Public Comment
• Changes based on City Council input
• Revisit City Council in 4 – 6 weeks with final rates asking for authorization to issue rate increase notice to all
customers
• Issue notice, wait 45 days, rate hearing, implement rates 24
