MD/03082017 - Avenal - Notice of Measure & Synopsis-1.rtf /S/ Maria A. Ortiz
MARIA A. ORTIZ, Avenal City Clerk and
City Elections Official
September 22, 2022 Pg. 8
What is Measure A ?
Measure A establishes a one-cent Transaction and Use Tax with revenues going directly to the City of Avenal. Measure A will be on the November 8, 2022 ballot and would pay for critical unfunded City programs and services such as police, fire, street and sidewalk repair, senior and youth recreation, animal control and other essential city services.

How is this different from existing sales taxes?
The current sales and use tax rate in Avenal is 7.25%. The City receives only 1% of the 7.25%; the rest goes to the State and to Kings County. If Measure A passes, the entire additional 1% Transaction and Use Tax would go to the City.

What purchases would be taxable under Measure A ?
The tax would not apply to prescriptions, grocery items, or utility bills (electricity, gas, phone).

The one cent tax is added to retail sales such as furniture, giftware, toys, antiques, clothing, prepared food, liquor, automobiles, etc.

How much money would Measure A raise?
Between $400,000 - $500,000 annually specifically for the City of Avenal's General Fund, which pays for most City services.

Why does the City need the additional money?
The City never fully recovered from the economic recession that started in 2008 and has experienced further financial burdens from the recent pandemic and high inflation, along with the long-term drought straining the General Fund budget.

Over the last several fiscal years the City's General Fund has suffered from a lack of revenues to meet rising expenses, especially related to critical programs and services such as public safety, parks and recreation, road maintenance, code enforcement, and animal control.

Despite new developments and growth, the City is operating at reduced staffing levels, implemented major cuts in all departments, and deferred maintenance on parks, roads, and other public amenities. Additionally, the City has relied on one-time revenues and General Fund reserves. These short-term and one-time fixes are not reliable solutions.

Based on the City's financial projections, the ongoing revenue deficit in the General Fund could deplete General Fund reserves by FY 2024-2025.

If approved by voters, the monies generated by Measure A would help restore service cuts and improve City services and start addressing the unfunded critical needs of the City.

MEASURE “A”

F R E Q U E N L T Y A S K E D Q U E S T I O N S
September 22, 2022 Pg. 9
What would a new sales tax rate be if Measure A passes? The current sales and use tax rate in Avenal is 7.25%. If Measure A passes, Avenal's sales tax rate would be 8.25%.

What is the average sales and use tax for counties and
cities in California?
The California State Legislative Analyst's Office states that the average sales tax rate in California in 2019 was 8.6%.

In Corcoran the sales tax rate is 8.25%; in Coalinga and Huron the sales tax rate is 8.975%; in Fresno the sales tax rate is 8.35%; in Selma the sales tax rate is 8.475%; and in Visalia the sales tax rate is 8.50%.

How will these funds be accounted for?
Measure A funds would be tracked and presented to the City Council publicly on a quarterly basis, and audited annually. Staff reports of those presentations to the City Council are available to the public before the Council hears the report.

What specifically would Measure A revenue pay for?
Measure A is a general purpose tax and therefore monies may be used towards police services firefighting services, parks and recreation programs, road maintenance, sidewalk construction and repairs, and other general expenses of the City. If Measure A is approved, the City Council with input from the community, will determine how Measure A funds are spent.

How long would Measure A be in effect?
Measure A would impose an ongoing local one-cent tax. The City Council has the ability to suspend the one-cent tax by resolution if so approved.

What are the impacts on major purchases, like cars?
Measure A would be charged on all tangible personal property that is delivered or placed into use within the Avenal city limits, including vehicles and boats that are purchased elsewhere, but registered to an Avenal resident. Someone who buys a car in Avenal but registers it elsewhere would not pay the Measure A tax.

C a n t h e S t a t e t a k e M e a s u r e A f u n d s t o b a l a n c e its budge t?
No. Measure A funds must stay in Avenal according to the State Constitution.

Questions about Measure A ?
If you have additional questions and or concerns about Measure A, please forward those to the City Clerk at the following email address: [email protected] September 22, 2022 Pg. 10
What is Measure C ?
If approved, Measure C will establish a tax rate for cannabis businesses should they ever be permitted in Avenal. In 2016, a majority of Avenal residents voted in support of Proposition 64 that legalized the use of recreational cannabis in California. However, commercial cannabis activities and sales, like dispensaries, are currently prohibited in Avenal.

Does Measure C allow the sale of cannabis products?
Measure C does not approve or allow for cannabis businesses to open and operate in Avenal. Instead, Measure C would establish local control and ensures that if allowed, commercial cannabis businesses operating in Avenal will pay a fair share of taxes. This special tax will provide Avenal with additional revenue to pay for vital public services such as police, fire, roads and parks and recreation.

Who pays the Measure C tax ?
Only those purchasing cannabis at a dispensary and/or cannabis businesses pay this tax. General members of the community who do not purchase, cultivate, test or process cannabis will not pay any additional taxes.

How much money would Measure C raise?
Current estimates are $400,000 - $600,000 annually specifically for the City of Avenal's General Fund, which pays for most City services.

Do other cities tax cannabis?
Yes. The City of Avenal studied other California cities for their tax rates. Cities across California tax this industry at different rates, with rates up to 30 percent of gross receipts. A study of those other cities shows that Avenal’s rates would be at approximately the midpoint, up to 15%. Cities such as Coalinga, Lemoore, and Hanford allow the sale of cannabis products and dispensaries, where those cities fully benefit from the tax revenue and not Avenal.

How would the Mea su r e C revenues be spent ?
Measure C would ensure tax revenue generated from cannabis businesses within the City limits contribute their fair share to the funding of vital public services such as police, fire, roads and parks and recreation.

By acting now, the City will have a tax in place if cannabis businesses are approved later or allowed by the State of California.

Would the sale of cannabis products increase crime?
If Measure C is adopted and later the City Council allows the sale of cannabis products, Measure C and the taxing cannabis businesses would help eliminate illegal cannabis operations and ensure the cannabis industry operates legally and contributes positively to the quality of life in the City of Avenal.

If you have additional questions and or concerns about Measure C, please forward those to the City Clerk at the following email address: [email protected] MEASURE “C”

Mayor Preciado and City Council welcomed Joshua Alvarado & Mathew Miller to the City of Avenal family and their families.

Veronica Aguirre sated following concerns:1) the compliant process with San Joaquin Valley Air District. she feels it is unfair because it takes five people to call within a 24-hour period and then an inspector from the San Joaquin Valley Air District is dispatched to inspect said complaint and that complaint could be gone. Also, invited the City Council to the next San Joaquin Valley Air District held at Central Region Office, Governing Board Room 1990 E. Gettysburg Avenue, Fresno, CA Thursday, August 18, 2022, 9:00 a.m. She would like support in speaking to this board regarding the compliant process.

on the East Coast and her husband is stationed in the Navy but live at the Lemoore Naval Base that means Gisselle is officially here in the Central Valley. Giselle started about three weeks ago and did not get a chance to introduce her and has been doing a really excellent job catching up a lot of things that Raul left pending. Also, works good with Highland Diversified. It is great to have extra help now and give it to Giselle.

Giselle stated that it is nice being a part of this small community and met a lot of people and absolutely love everything about Avenal.

Mayor Preciado and City Council welcome Giselle to the West Coast and City of Avenal family.

City Manager Lopez mentioned that Giselle has been a fantastic addition to the city, fit right in, has been great to work with and the community is taking well to her. So, we are lucky to have Giselle.

Mario Pesquera has the following concerns: 1) leash law feels it is not being enforced, because where he lives there are pit bulls left loose unattended; 2) noise nuisance feels it is not enforced because he has called numerous times on neighbors and they are given warnings and in the City of Avenal Ordinance does not give warnings the resident is cited as per municipal code; and 3) He would like to add these items to an the City Council Agenda if possible.

City Manager Lopez mentioned that this more appropriate for the Planning Commission is actually going through a comprehensive update. So, he will be sure to share with Mr. Pesquera the schedule for those meetings and come to the workshops.

Supervisor Richard Valle stated the following: 1) the Board of Supervisors pass their budget at over $423 million, and highlight is that the Board of Supervisors will be using $6 million of ARPA funds to help once again small businesses out with some grants. Also, recall about two years ago they used some County Cares funds about $5 million to helps businesses in the middle of that pandemic trying to help them recover and those were $20,000 grants. These $6 million can help businesses receive up to $25,000 grants and if receive money can be used for anything from payroll, benefit costs, pay rent, buildings, utilities, and other operating costs such as gas, delivering vehicles. Also, business owners investing in lights, shade, outdoor tables, and all they need is to fill out an application for grant this February 1st September. CURRENT PROJECTS:

Phone System: Staff is working with the Police Department and other outside facilities outside City Hall to inventory the handsets provided by ShoreTel. Our Account Manager reports we have 7 handsets but our total inventory reports 20. ShoreTel’s support services were depreciated in 2020 so staff works on trying to shorten the scope of work to only encompass PD until there is a better understanding of how their POTS (Plain Old Telephone System) lines tie into their alarms. Our AT&T account lead reached out to us regarding our inventory ticket as well, which will give us better insight to what numbers we can remove while maintaining out POTS and Fax lines. Avaya’s contract is set to expire by the end of November. Staff will not be renewing the contract.

Emails: On hold until support reaches back out with a solution.

Server:
-New computers have arrived. Zero-touch deployment is almost fully functional. Missing features include a proper EULA (End User License Agreement) similar to our Windows machines and a number of extra convenience applications that are not immediately deployable. Essentials are automatically installed upon first boot.
-Load balancing is in place for the handful of services requiring open ports. This is a security measure that limits unnecessarily opening and exposing network ports to the internet. -Automatic Time Machine backups for macOS devices are fully functional when connected to our network.

Clerk Software: City Clerk and IT work with our project lead to make progress on CivicClerk. As staff begins working with it, we are reporting minor changes we need to our agenda templates.

Other:

Staff:
-Submits the first drafts for our Technology Usage and Remote Work Policies, as well as a VPN Access Form.
-Attended a Water Cybersecurity Workshop hosted by Senator Hurtado. -Worked with Code Enforcement to scope the networking needs inside the Animal Shelter. -Prepared a demo Mac for inexperienced staff members to work with prior to the transition. -Attended a demo with SecureLink for third-party remote access to any internal systems. -Continues to work with KCAG to allow regular remote viewing and participation of their monthly Technical Advisory Committee and Transportation Policy Committee and KCAG Commission meetings.
-Continues to maintain the city website and provide tech support across all facilities.

As staff continues managing the day-to-day obligations of the City and working with the City Auditors, Sotomayor and Associates, and financial consultants, Price Paige, Staff is still awaiting some audited information to provide clean numbers for the full budget proposal.

Pending items are closing out FY 2021/2022, and working with recently hired police Chief to prioritize PD needs. In good news, Staff had previously projected health benefits increasing by 10%, and recently was informed that health benefits would only rise 5%, helping to create some savings.

Attached, Staff has prepared two items for consideration regarding the fees and charges, that could be adopted once the full budget is complete. First is clarifying language about rentals and services available to registered non-profit group in Avenal. Second is consideration of an additional opportunity for residents to host a yard sale, a total of four times.

RECOMMENDATION:

By motion, continue the Public Hearing to items 8A-8D to the next City Council meeting.

RE: Consider Extending Local Emergency Declaration (COVID-19) INFORMATION:

On March 24, 2020, the Avenal City Council adopted Resolution No. 2020-14 declaring a Local Emergency due to the existence or threatened existence of a local emergency: COVID 19 pandemic. Although case numbers have dropped to the single digits in Avenal, not all restrictions have been lifted, and the finding below is still required to be made to allow Councilmembers to attend meetings virtually.

The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.

On October 28, 2021, the Avenal City Council adopted Resolution No. 2021-48 to satisfy AB 361 in order to continue Teleconferenced Meetings. AB 361 provides that, if the state of emergency remains active for more than 30 days, a local agency must make the following findings by majority vote every 30 days to continue using the bill’s exemption to the Brown Act teleconferencing rules
• The legislative body has reconsidered the circumstances of the emergency; and • Either of the following circumstances exist: The state of emergency continues to directly impact the ability of members to meet safely in person, or State or local officials continue to impose or recommend social distancing measures.

At this time, staff is recommending the City Council consider the following action by motion:

Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.

Additionally, that the Council find that a state of emergency continues to directly impact the ability of members to meet safely in person, and that State and local officials continue to impose or recommend social distancing measures.

RECOMMENDATION:

Discussion/Action.

FISCAL IMPACT:

None.

RE: Consider Extending Local Emergency Declaration (Water) INFORMATION:

On May 27, 2021, the Avenal City Council adopted Resolution No. 2021-23 declaring a Local Emergency due to the existence or threatened existence of a local emergency: Severe Water Shortage.

The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.

As of May 18, 2022, USBR has conditionally allocated 2,000 acre feet of water to the City of Avenal as Public Health & Safety use. On average in the last few years, the City has utilized roughly 2,300 acre feet of water under Tier III drought emergency conditions. As the City continues growing and new houses being build, 2,000 acre feet of water may not be enough and additional water may be need.

By continuing the local emergency due to drought conditions, this action helps to show the Bureau that the City takes the drought emergency seriously and helps them accommodate the necessary Public Health & Safety water needs to the City.

Staff is recommending the City Council consider the following action by motion:

Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.
