7 7

2.Infrastructure: maintain
roads, sidewalks, street
sweeping
•The City is now 43 years old since
incorporation in 1979
•A lot of deferred maintenance over the years
•Inflation, higher material cost mean the City
has to prioritize projects based on funding
•Smaller maintenance projects that Public
Works can do, require more man power
when always being called to water leaks or
other issues
•Street sweeper required dedicated driver,
City cannot afford part-time Class A licensed
drive

3 3.Beautify, clean up City,

Why does Avenal need Measures
“A” & “C” ?
•Revenues to the City have stagnated
• Inflation and deferred maintenance means money from
property and sales tax, DMV fees, and new
development, does not stretch as far
•City is in the process of modernizing processes, and
working more for the community, addressing
community concerns and keeping Avenal secure
•Additional revenues are stretched further with staff
who is used to innovating and being self-sufficient
21 22
What is
22 What is Measure A?
23 Measure A establishes a one-cent Transaction and Use Tax with revenues going directly to the City of Avenal. Measure A will be on the November 8, 2022 ballot and would pay for critical unfunded City programs and services such as police, fire, street and sidewalk repair, senior and youth recreation, animal control and other essential city services.

Measure “A” Taxable Items
•Furniture and Giftware
•Toys
•Antiques
•Clothing
•Prepared Food (Restaurants)
•Liquor
•Automobiles
Non-Taxable Items
•Prescription Drugs
•Grocery Foods
•Utility Bills (Phone, Electricity, Water)
•Doctors Visits
•Services (e.g. Mechanic, haircut, nails,etc)
23 Measure A
24 What would a new sales tax rate be if Measure A passes? The current sales and use tax rate in Avenal is 7.25%. If Measure A passes, Avenal's sales tax rate would be 8.25%.

What is the average sales and use tax for counties and cities in California?
The California State Legislative Analyst's Office states that the average sales tax rate in California in 2019 was 8.6%.

In Corcoran the sales tax rate is 8.25%; in Coalinga and Huron the sales tax rate is 8.975%; in Fresno the sales tax rate is 8.35%; in Selma the sales tax rate is 8.475%; and in Visalia the sales tax rate is 8.50%. 24 October 13, 2022 Pg. 10
10/11/22
7 What will Measure A cost me?
25 Measure A increases sales tax by one-cent for every taxable dollar spent.

FY 2019-2020 FY 2020-2021 FY 2021-2022
309,516.72 278,305.22 343,677.54
Current Sales Tax Revenues: In the previous three fiscal years, the City has received the following sales tax revenues:
-On average, the City receives $310,500 annually in sales tax revenue -Across an estimated 10,800 residents, 1 additional cent doubles the sales tax revenues to the City, or doing the math:
◦ $310,500 / 10,800 = $28.75 additional paid taxes per year per person. ◦ An average family of five would likely contribute $150 yearly to help fund critical City programs and services

What is
27 What is Measure C?
28 If approved, Measure C will establish a tax rate for cannabis businesses should they ever be permitted in Avenal. In 2016, a majority of Avenal residents voted in support of Proposition 64 that legalized the use of recreational cannabis in California. However, commercial cannabis activities and sales, like dispensaries, are currently prohibited in Avenal.

Measure “C” Taxable Items
•Dispensaries
•Cannabis based products
•Cultivation
Up to 15% tax rate
Non-Taxable Items
•Non-users or costumers of cannabis
products will not pay any tax, but will reap
the benefits.
28 October 13, 2022 Pg. 11
10/11/22
8 Does Measure C Allow the
Sale of Cannabis Products?
29 Measure C does not approve or allow for cannabis businesses to open and operate in Avenal. Instead, Measure C would establish local control and ensures that if allowed, commercial cannabis businesses operating in Avenal will pay a fair share of taxes.

This special tax will provide Avenal with additional revenue to pay for vital public services such as police, fire, roads and parks and recreation. 29 What will Measure C cost me?
30 At this point, until the ordinance is changed to allow the sale of cannabis products, it is unknown what the average cost for costumers will be.

Only those purchasing cannabis at a dispensary and/or
cannabis businesses pay this tax. General members of the community who do not purchase, cultivate, test or process cannabis will not pay any additional taxes.

6. Veronica Ann Aguirre - Advocate, Community Organizer, Community Member

7. Jose Guadalupe “Lupe” Chavez - School Board Member - Reef-Sunset

8. Maria "Angie" Ortiz - City Clerk, Resident
31 How much revenue will
Measure “A” and “C” generate?
32 1. Measure A - Between $400,000 - $500,000 annually specifically for the City of Avenal's General Fund, which pays for most City services.

2. Measure C - Between $400,000 - $600,000 annually specifically for the City of Avenal's General Fund, which pays for most City services.

These revenues will help pay for and increase critical services to the City’s operations, bring in much needed staff, and expand the quality of life for every resident.

update on some projects that both boards are working on; 2) City has been working diligently with the community, providing utility assistance due to COVID; 3) If you're gone on the Avenal Cutoff or on SR269 and seen blue pipe city is working on the 18-inch water transmission pipeline to help provide reliable water to our city. It is a $7- million project Grant funded and start seeing some movement the coming weeks; 4) Also, last year the city received 2-million for the Community Center and had some luck with our elected officials who have supported our projects; 5) Safe Routes to School project traffic along Skyline Blvd. start seeing work in a few months and completed within a year; 6) Beautify California Grant with Caltrans and their investing $1-million to beautify Skyline Blvd. So, our city is very beautiful, but trying to little bit drier scape just make it more sustainable; 7) Also, in the pipeline community garden by the Skate Park and building boxes with the state prison and once boxes are back staff will be pulling the irrigation systems, putting in a gazebo, restroom and lighting; 8) Pocket park behind the Boxing club this project ready to go out to bid; 9) Chief recruited and hire Robert Nevarez and hope you all got a chance to meet him very sociable. Chief Nevarez has been an immense help and visionary for the Police Department and in the community focused on recruitment and retention of officers. Staff has been working closely on the SRO; 10) Staff & residents worked together for community beautification. So, they started at Vets Hall – painted doors, trim, polls, light polls and painted bike rake and next Rice Park, Police Department and other sites; 11) he shared valid initiatives: Measure A - November 8th ballot for a 1 cent tax increase, sales tax increase, and that would be to go towards cities, general fund and the ideas, help fund recreation, hire more officers, help improve our services that we're able to provide to the city. The City of Avenal sales tax - Kings 7.25 setting receives 1%, which has equated to $300,000 per year of overall sales tax. If an additional cent this would double it, 600, maybe $700,000 and allows us to purchase new street sweeper and one focus. Also, Measure C, which is the other initiative - cannabis business sales tax. So, everyone is aware, currently in the city does not allow sale of cannabis nor dispensaries. If we do see some movement, see that community does approve for it, there might be a change in the ordinance in the future. The idea there is that would again be put funding that would go directly to the General Fund it could help provide more jobs for recreation, police, and other more. Something like this. So likewise, as board member customers mentioned, you know how we could The City & District can collaborate, with fields, recreation opportunities, and more. Staff needs more funding to do.

The Board President Padilla mentioned that there are many projects and the New District Office / City Hall that their looking at grants due to the cost and would not want to take form the children. She will take all information and discuss at their meeting.

AGENDA ITEM NO. 5- C
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: October 14th, 2021
RE: Consider Entering into an M.O.U. with Avenal Rotary Club for 2022 Pistachio Days Celebration
INFORMATION:

For almost a decade, the Avenal Pistachio Days Festival has been a premier event in Avenal hosted and organized by the local Avenal Rotary Club. Established to mark the end of the harvest season, the Pistachio Days Festival also honors and celebrates the many Avenal residents who work in the pistachio industry for local partners such as Keenan Farms and the Wonderful Company. This festival aided in Avenal becoming officially trademarked as the Pistachio Capital of the World® since 2019.

The festival’s activities have included closing down Kings Street to host food vendors; the Miss Teen Avenal pageant; concerts; religious services; horseshoe tournament; corn hole tournament; tri-tip/pork loin cook-off; bounce houses and playland; art show; free movies; 2k/5k Walk/Run; raffles; local performances; Avenal's famous pistachio ice cream; and many more activities.

This year the Avenal Rotary Club is preparing to host the 8th annual Pistachio Days Festival starting October 14-15, 2022.

Although Pistachio Days Festival is now a staple of Avenal’s culture and a long-lasting tradition, Staff is seeking formal consent by Council to collaborate and commit resources to this event in collaboration with Avenal Rotary. Examples of potential resources being used are: City facilities (which now have a charge to non-profits), staff time to help manage certain activities, advertising the event, and city equipment.

Staff has prepared a basic M.O.U. to be signed by both the City and Avenal Rotary Club to begin the process of more formally recognizing the collaboration between both the City and Avenal Rotary Club, and authorizing the waiving of fees for City facilities.

RECOMMENDATION:

Staff is recommending, authorizing the City Manager to sign an M.O.U. with Avenal Rotary Club regarding the collaborations for the 2022 Pistachio Days Festival.

FISCAL IMPACT:

None. This event was already budgeted by Community Activities. Small loss in revenue by waiving the rental fees for City facilities.

Telecommuting and Remote Work Policy
I. PURPOSE
a. To establish procedures for allowing City Employees to work remotely (telecommute), as determined by the City, under specified circumstances including, but not limited to a public health emergency. Working remotely is a temporary arrangement that allows City employees to fulfill their job responsibilities during regularly scheduled work hours at a site other that their onsite work location.
b. Telecommuting does not apply to situations where an employee works at home on an incidental or occasional basis (i.e.to complete a staff report that requires greater concentration and fewer interruptions). These alternate work site arrangements can be approved by an employee’s department on a case-by-case basis, and do not require a written agreement.

II. POLICY
a. The intent of this policy is to provide procedural guidance to employees, supervisors, and Department Heads in determining when a telecommuting arrangement is appropriate, and to outline criteria for implementation of such arrangement.
b. Allowing such an arrangement requires an assessment of employee job duties that may be conducive to telecommuting, employee work performance and work behaviors and operational needs.

Telecommuting shall be considered a privilege, not a right. Telecommuting in no way changes employees’ duties, obligations, responsibilities, or terms and conditions of employment with the City. Employees telecommuting must comply with all City policies and procedures. Individual departments may have additional requirements, guidelines, or procedures for telecommuting. c. Telecommute arrangements are for regular, ongoing telecommuting and must be supported by a written agreement that specifies the requirements and details of the arrangement. All telecommute arrangements will be regularly evaluated to ensure effectiveness and compliance with the agreement.

III. EVALUATION CRITERIA
a. Eligibility for working remotely is based on the position, the employee, and the needs of the department. Not every employee, and not every position, is suited for working remotely. b. An employee’s position may be suitable for working remotely when the job duties:
• Have specific objectives and performance standards that can be measured • Do not require frequent interaction at the regular worksite with supervisors, colleagues, or members of the public, in person or by phone
• Do not require ongoing supervision of staff at the regular worksite to address unscheduled events.
• Are such that performing them remotely does not negatively impact the productivity of the work unit/department by impeding workflow or creating additional work for other staff
c. Employees may be suitable for working remotely when their personal work characteristics, as determined by their supervisor, consistently include:
• Demonstrated motivation, dependability, productivity, and responsibility. • Effective communication with all those contacted in the course of work • The ability to work independently and complete work with minimal supervision/ October 13, 2022 Pg. 37
DRAFT 10/07/2022 FOR REVIEW ONLY
• A high level of skill and knowledge of their job
• The ability to prioritize work effectively and consistently meet deadlines. • Good organizational and time management skills
• The ability to perform specific job duties from a location separate from the worksite without negatively impacting the quantity or quality of the work performed, or the same time required to complete assignments.
• Having a record of meeting performance standards and does not have attendance issues. • Following all City policies and guidelines
d. The needs of the department may be suitable for employees to telecommute when the department/division will not be adversely affected.

IV. EVALUATION PROCESS
a. An employee may submit a Telecommuting Request Form. The request will be considered first by the employee’s supervisor. The supervisor will make a recommendation to the Department Head, and the Department Head will make a recommendation to the Director of Administrative Services, and the Director of Administrative Services will make a recommendation to the City manager or designee, who will be the final decision-maker for the request. In evaluating whether to approve a request telecommuting and determine the appropriate parameters, the following will be considered:
• Evaluation criteria noted in Section III above.
• Determination that the job duties can effectively be performed while telecommuting • Business needs of the unit, communication, and impact of remote work on other team members and/or customers
• Employee readiness for telecommuting, including access to reliable technology, internet, confidential space to conduct work, limited outside distractions, etc. • Ability to effectively supervise the work of the employee who is telecommuting. • Changes needed to ensure the affected team can meet its objectives. • Ensure the employee and work product will be as effectively managed as their on-site colleagues
V. SUPERVISOR EXPECTATIONS
a. Expectations of supervisors who have employees telecommuting:
• Determine the number of hours reasonable for the employee to productively work remotely. Generally, time spent telecommuting during a workweek will be limited; employees are expected to work onsite on a regular basis. • Develop a set schedule of days and hours that will be devoted to performing work when telecommuting. To the extent possible, these should coincide with regular worksite hours to ensure availability for collaboration with staff and customers. • Establish and regularly communicate work expectation to employees who are telecommuting, including setting work priorities, deadlines, and reviewing work assignments.
• Establish specific expectations for regular communication (in person, video conferencing, telephone, etc.) with the telecommuting employee.
• Require regular written updates on assignment progress and completion and evaluate those to ensure work productivity.
• Develop a system to evaluate the telecommuting employee’s performance accurately and effectively.
• Establish a review period after which a decision can be made about whether the employee will be able to continue telecommuting.
b. Once a request to telecommute is approved by all required parties, the Director of Administrative October 13, 2022 Pg. 38

Services, working with the impacted department, will initiate a Telecommute Agreement outlining specific expectations. The Agreement will be retained in the employee personnel file. The City has the right to end or modify the Telecommute Agreement at any time without prior notification VI. EMPLOYEE EXPECTATIONS

• Have a working telephone or mobile phone at their remote location, and when appropriate, must ensure that incoming calls to their office phone are forwarded to their remote location phone or mobile phone.
• Arrange for child/dependent care as necessary for the hours in which the employee works from home. Telecommuting cannot be used to provide active care for a child or other dependent.
• Only perform personal tasks and errands during the employee’s scheduled breaks and lunches.
• Provide the supervisor with regular, ongoing updates on work assignment progress and completion.
• Maintain the same level of expected productivity as when working onsite • Comply with City policies when using paid sick leave, coordinate with and receive approval from their supervisor, in advance, for any periods of time during the work day they will not be working, and note those as appropriate on the timesheet (e.g sick leave for a doctor’s visit)
• Report to their onsite work location during their scheduled work hours when requested by their supervisor. Travel to and from the onsite work location is considered commute time, and telecommuting employees are not eligible to receive reimbursement for this travel. • Accurately record their work hours in the timekeeping system. Non-exempt employees may not work overtime without prior authorization.

VII. ALTERNATE WORK LOCATION

We are continuing to keep two (2) restrooms open at Rice Park.
9000 ANIMAL CONTROL DEPARTMENT:

Staff continues to maintain the Animal Shelter with animals rescued weekly. Staff continues to work with Corcoran and Animal Rescue. Staff is still waiting for the estimates for concrete work behind the shelter.

SEE ATTACHED REPORT.
13000 STREETS:

Staff maintains city streets, signs, flags, and banners. Staff is working with the City Engineer on the South Seventh St. project trying to get it out for bids soon. We installed the additional stop signs at locations close to Tamarack Elementary to help with traffic flow and slow traffic down for school children. There has been positive response from the public in that area. Staff is working to create a schedule for street sweeping with PW employees for the fall season. 14100 WATER DISTRIBUTION:

Staff continues to work with the City Engineer for the 18” water transmission replacement. We are continuing to review submittals from the contractor for the fittings and other parts for the project. Staff repaired two (2) water leaks on the 18” Main and one (1) leak on the 16” Main.

Staff will not be renewing an old Right of Way easement with the Bureau of Land Management that was granted in 1992 for a water line to Waste Management in Kettleman City, that was never installed and was intended to support an incinerator as the Kettleman Hills Facility. Renewing the unused easement would likely involve lengthy environmental studies and justifications, which the City nor Waste Management is interested in pursuing.

Staff continues to maintain and repair the distribution system. 15000 WASTEWATER COLLECTIONS:

Staff continues to report monthly to Regional Water Quality Control Board regarding overflows. There were two (2) calls for sewer plugs, both were on the customer side Staff is continuing the enzyme treatment for grease. 18000 VEHICLES, EQUIPMENT & BUILDING MAINTENANCE:

Staff continues to maintain city-owned property, vehicles, and equipment. Staff continues monthly/quarterly reporting to SJVAPCD.

RE: Consider Extending Local Emergency Declaration (COVID-19) INFORMATION:

On March 24, 2020, the Avenal City Council adopted Resolution No. 2020-14 declaring a Local Emergency due to the existence or threatened existence of a local emergency: COVID 19 pandemic. Although case numbers have dropped to the single digits in Avenal, not all restrictions have been lifted, and the finding below is still required to be made to allow Councilmembers to attend meetings virtually.

The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.

On October 28, 2021, the Avenal City Council adopted Resolution No. 2021-48 to satisfy AB 361 in order to continue Teleconferenced Meetings. AB 361 provides that, if the state of emergency remains active for more than 30 days, a local agency must make the following findings by majority vote every 30 days to continue using the bill’s exemption to the Brown Act teleconferencing rules
• The legislative body has reconsidered the circumstances of the emergency; and • Either of the following circumstances exist: The state of emergency continues to directly impact the ability of members to meet safely in person, or State or local officials continue to impose or recommend social distancing measures.

At this time, staff is recommending the City Council consider the following action by motion:

Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.

Additionally, that the Council find that a state of emergency continues to directly impact the ability of members to meet safely in person, and that State and local officials continue to impose or recommend social distancing measures.

RE: Consider Extending Local Emergency Declaration (Water) INFORMATION:

On May 27, 2021, the Avenal City Council adopted Resolution No. 2021-23 declaring a Local Emergency due to the existence or threatened existence of a local emergency: Severe Water Shortage.

The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.

As of May 18, 2022, USBR has conditionally allocated 2,000 acre feet of water to the City of Avenal as Public Health & Safety use. On average in the last few years, the City has utilized roughly 2,300 acre feet of water under Tier III drought emergency conditions. As the City continues growing and new houses being build, 2,000 acre feet of water may not be enough and additional water may be need.

By continuing the local emergency due to drought conditions, this action helps to show the Bureau that the City takes the drought emergency seriously and helps them accommodate the necessary Public Health & Safety water needs to the City.

Staff is recommending the City Council consider the following action by motion:

Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.

RE: Consider Authorizing City Manager to Sign a Letter of Support to Westlands Water District's Application of California Department of Water Resources' Water Desalination Grant Program Round 4
INFORMATION:

Over the past few months, Staff has networked with regional partners on the issue of water scarcity in the Central Valley. Knowing the allocation issues the City faces, and pursuing different avenues to secure either another source of water, or having Avenal State Prison secure its own allocation. Most recently Staff has been meeting with representatives of Westslands Water District: Jose Gutierrez, Chief Operating Officer, and Elizabeth Jonasson, Public Affairs Representative, who are keeping the City in mind for any projects that could help extend water availability to Avenal.

One such project Westlands is working on is a reservoir to store water in wet years, and release it during dry years that could benefit CVP customers in the Central Valley like Coalinga, Huron, and Avenal. Most recently, Westlands is requesting the City to write a letter of support for a desalination program grant to treat ground water that would be delivered back to the canal and could be used by Central Valley Project (CVP) customers like Avenal. “Our concept is to treat the upper aquifer brackish groundwater and deliver this treated groundwater to the San Luis Canal, which could then be conveyed to the City of Avenal.

We hope to have this up and running by next year, which would be beneficial because we are expecting another poor water supply from the CVP.

The only assistance we need from Avenal in the near term is a letter of support.” RECOMMENDATION:

Authorize the City Manager to sign the Letter of Support for Westlands Water District’s application to the California Department of Water Resources' Water Desalination Grant Program Round 4.

RE: Support for Westlands Water District's Application of California Department of Water Resources' Water Desalination Grant Program Round 4
Dear Director Nemeth,
The City of Avenal is an incorporated city in Kings County that solely relies on Central Valley Project (CVP) water for our potable water needs. We also serve a State of California facility, the Avenal State Prison, which typically uses between 40-50% of the total amount of the City’s water supplied by the CVP.

In dry and critically dry years, the Health and Safety allocation received is insufficient to meet our City’s needs. Westlands has developed a solution that will improve our water supply reliability and ensure that our City can meet the needs of our residents, businesses, and State prison.

This letter is being provided in support of Westlands Water District's (District) application for the California Department of Water Resources' (DWR) Water Desalination Grant Program Round 4 providing funding to local agencies for the planning, design, and construction of projects to desalinate naturally occurring brackish water for potable water supply.

The Desalination and On-Farm Recycling Project being proposed by Westlands has the potential to provide price stability and a more reliable water supply for Disadvantaged Communities, especially during times of drought. Discussions are ongoing with the District to determine how the water produced by this project could help solve the City’s current water crisis while providing a cost-effective alternative to expensive and unreliable spot market water purchases.

We recognize the importance of the innovative efforts like these being undertaken to leverage underutilized brackish groundwater resources for both the District and non- district lands within and adjacent to the Westside Subbasin, and lend our support to the District's application.

Sincerely,
Antony V. López, MPA

RE: Consider Resolution to Recognize and Inaugurate New Park Space at 253 E.

Kings Street “Rotary Pop-Up Park”
INFORMATION:

Parks and open spaces are considered vital to the life of a community, and proven invaluable during difficult times such as the recent COVID-19 pandemic. Avenal is fortunate to have many spaces throughout the City for residents to enjoy, yet more spaces are always welcomed. Along Kings Street in the City’s downtown commercial areas, it is not uncommon to see residents congregate on the corners of 3rd and Kings next to Subway, at the bandstand, or the closed down Beverage Hut and Jesus Clothing store.

For many years, the City has maintained an empty lot on Kings Street next to the Subway as a storage for bulky items, tables and chairs for events that occur on Kings Street. Rotary has used this space in the past to store its stage and host the horseshoe tournaments during Pistachio Festival. Overtime this site became an eyesore and Staff worked on cleaning up the lot and improving the fence in the back of the alley.

A year ago, Rotary in an effort to continue contributing to the community, applied for a Rotary International grant along with the Avenal Historical Society & Museum, to develop a pop-up park in Avenal and help repurpose the City’s empty lot into an open space for all to enjoy.

Although progress was slow, Avenal Rotary did clean up the lot, and brought in synthetic grass, picnic tables, paint, and shade sails to fix up the space. The City’s Public Works crew helped bring all the items together laying down the synthetic grass and installing the poles for the shade sails.

The purpose of calling this space a “pop-up park” is to allow the City the option to again repurpose the property for another use in the future, without the risk of losing anything as all the new items can be moved to another location.

As the new park is finalized and opened to coincide with the 2022 Pistachio Days Festival, Staff recommends adopting a resolution to recognize the open space as a park and host an inauguration to welcome the community to this new space at the start of the Pistachio Festival on October 14, 2022. Due to the multiple partners involved in recreating this space, the pop-up park will be named “Rotary Pop-Up Park” and recognize all those involved (see attached), RECOMMENDATION:

Approve Resolution 2022-___, to recognizing and inaugurate a new park space at 253 E. Kings Street, “Rotary Pop-Up Park.”
