Study Session
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: February 9, 2023
RE: Discussion of replacing Mayor Pro Tempore title to Vice Mayor INFORMATION:
Upon request by the Council, Staff has explored the possibility of renaming the Mayor Pro Tempore title to that of Vice Mayor.
The Avenal Municipal Code references the appointment of a Mayor, and Mayor Pro Tem who can assume the roles an duties of the Mayor in their absence.
Exploring the charters and municipal code to other cities, Staff has concluded that using the term Mayor Pro Tem (acting Mayor) or Vice Mayor tends to be used interchangeably.
City of Corona provides perhaps the best example of what the Mayor and Mayor Pro Tem roles are designed to do, and explains that both titles of Mayor Pro Tem and Vice Mayor may be used interchangeably.
Regardless of title, the chief function of a Mayor Pro Tem or Vice Mayor is to assume to roles and duties of a Mayor in their absence. In some cases, like in City of Sacramento, the title of Mayor Pro Tem is reserved for whichever individual ultimately assumes the acting status, if both the Mayor and Vice Mayor are absent.
RECOMMENDATION:
Staff would like direction from the Council on exploring this topic further and perhaps introducing an amendment to the Municipal Code regarding adding or replacing Mayor Pro Tempore with Vice Mayor, or clarifying that the titles are interchangeable like City of Corona.
Staff may also recommend adoption a resolution of the same thing, and wait until full recodification of the municipal code to include updated language.

Pro tempore
Pro tempore (/ pro t mpəri, -e /), abbreviated pro tem or p.t., [1][2] is a Latin phrase which best
translates to "for the time being" in English. This phrase is often used to describe a person who acts as a locum tenens (placeholder) in the absence of a superior, such as the president pro tempore of the United States Senate, who acts in place of the president of the United States Senate—a position that is held ex officio by the current vice president of the United States. Legislative bodies can have one or more pro tempore for the presiding officer. These positions ostensibly go to legislators experienced in floor debate who are familiar with the content and application of relevant rules and precedents and who have a reputation for fairness among their colleagues. The phrase is also used to describe a officers appointed on a temporary basis, prior to the formalisation of their appointments.[3] A common use of pro tempore in the United States is in municipalities such as cities and towns with regard to the position of the mayor. In many cities, the city council appoints one of its members to act as mayor pro tempore (pro tem) (or vice mayor) in the absence of the actual mayor.[4] In judicial courts, attorneys that volunteer in proceedings are called "judge pro tem".[5] Universities sometimes appoint heads of faculties temporarily until ratified by a board of governors or senate committee. These positions are titled "Dean pro tem".[6] Ex tempore

MAYOR & COUNCIL MEMBERS/ SUCCESSOR AGENCY/ITEMS FOR CONSIDERATION:
A. Approval of Resolution 2023-11: Commendation for Coach William Vallem (Action/Presentation).:
Mayor Preciado stated that this evening, the City Council has the unique opportunity to recognize a hardworking and dedicated individual who has brought much prestige and fame to Avenal through his work with Avenal's youth and sports achievements. Coach William Vallem, has been a resident of Avenal for over 40 years, dedicating 38 years as an educator at Reef- Sunset Unified School District. He is originally from Palo Alto California; Coach Vallem moved into Avenal to make a difference and serve. Throughout his years, Coach Vallem has been part of youth sports on all levels, basketball, flag football, cross country, track, and field, and of course Soccer. Many in the community recognize Vallem for his multiple championships in regional, state, and national competitions. It is impossible to encapsulate all the good things and extra word Coach Vallem has put into that community by educating, mentoring, and coaching are due to excellence, and everyone recognizes his players running in town, along the heels or with training and always striving for greatness. I know of many personal stories of have coach parent help keep you out of trouble, focus on their education, and continue to help them even pass college. William Vallem is a wonderful kind individual that are below is lucky to have making it better each day leading by example one what one kind heart can do for an entire community coach falling. This resolution of commendation is recognition of all of you two and continue to do for. We continue wishing you the best and support you in all your endeavors.
Mayor Pro Tem Ramirez stated that this commemoration is an honor because he once was coached by Coach Vallem back in 2012- 2013. He practices what he learned in practice for cross country and track. He has applied that training into his life, which is the way he works the same mentality, the same thing that you must apply to your personal life. So that's something that he would like to tell the students.
Councilman Verdugo mentioned that the year Valle came to Avenal when he started 6th grade. And for an individual to dedicate all his life, Coach Vallem could have gone anywhere else to coach or teach or whatever, but he made Avenal his home. He and many other people thank you for it, for sticking to Avenal and seeing the accomplishments that Coach Vallem has brought to these kids.
Also, Coach Vallem’s work ethic installed building these kids. He thanked Coach Vallem.
Veronica Aguirre mentioned that it is wonderful to recognize somebody that everyone can identify of all ages. As Ricardo motioned she was also in 6th grade and see many years, decades of people that Coach Vallem has made such an important impact and part of everybody's life. She wanted to bring up today is something that was mentioned at the last Council meeting. The opportunity or the possibility, of naming the Sports Complex after Coach Vallem. She believes that is something that should be considered, because a new example and identify all to the community that, you know, people would really appreciate that to have something of such importance like Sports Complex to be named after somebody that everybody identifies.

REGARDING: Consider Approval to Purchase Police Equipment to Outfit Two Dodge Durango Vehicles
<><><><>
INFORMATION/BACKGROUND:
As our department gets back to full strength, we need to ensure there are a sufficient reliable patrol cars that officers can use in the handling of their emergency duties.
Our current vehicle inventory includes two Ford Explorers that will soon have 100,000 of patrol driven miles. These vehicles require increased maintenance and repairs that frequently takes them out of service. We also have two 2010 Ford Crown Victorias assigned to our “Community Response Team” (CRT) with 170,000 and 160,000 miles. The CRT team was recently brought back into service, and we expect to use them more in the future.
We recommend the purchase police equipment to outfit two 2023 Dodge Durango vehicles to replace the two aging cars in our patrol fleet. The police equipment is currently available from two vendors: Vincent Communications and LEHR, but require a Purchase Order from the City to secure their availability.
We intend to use the governmental “piggyback” process to obtain this police equipment to streamline the purchase process and allow us to ensure the current price and availability.
FISCAL IMPACT:
None to the General Fund since these vehicles will be purchased with COPS 19/20 funds.
RECOMMENDATION:
February 9, 2023 Pg. 16
Request Council to authorize the Chief of Police to purchase equipment to outfit two Dodge Durango vehicles using COPS funding.

RE: Consider Writing Letter of Support to Thermal Mechanical Energy Storage (THEMES) LLC for proposal involving Repurposing Idle Oil & Gas Wells for Long Duration Energy Storage in Saline Aquifers
INFORMATION:
On February 2, 2023, the City Manager and Mayor Preciado attended a roundtable meeting with County stakeholders of the Kings Economic Development Corporation to meet with Thermal Mechanical Energy Storage (THEMES) LLC and discuss their proposal for a 5 Megawatt (MW), 12+ hour Compressed Air Energy Storage (CAES) energy storage project utilizing old/abandoned oil wells in the Central Valley.
Although the meeting was missing other key elected officials and stakeholders, the presentation was very informative and convincing to the feasibility of CAES using old oil wells and the potential environmental benefits, minimum impacts, and positive returns to local electrical grids.
The potential benefits CAES and THEMES have to Avenal are the Kettleman North Dome oil fields primarily owned by California Resources Corporation (CRC). THEMES indicates that CRC is a key partner to the project and there is a high probability the 5MW project could be developed near Avenal, if not future 100MW projects will. If any of these projects were to happen in or near Avenal, the benefits include jobs, potential water, and relief to the electrical grid.
Ben Hoffman of THEMES shared the following presentation and draft Letter of Support which will help the group receive approval to continue with their proposal.
RECOMMENDATION:
Due to the low risk of signing onto a letter of support, Staff recommends that the council approval by motion to authorize the City Manager to write and send a letter of support to THEMES for their 5MW, 12+ hour Compressed Air Energy Storage (CAES) energy storage project.

SMW AA-CAES Long Duration Energy Storage Demonstration
Thermal Mechanical Energy Storage (THEMES) LLC is focused on commercializing geological Long Duration Energy Storage to provide low-cost, reliable, zero-carbon power by repurposing existing O&G infrastructure.
Our Goal in Kings county:
To gain community support to build a SMW demonstrations which can be expanded to lO0MW in the next 5 years with success. The project is tentatively expected to be built in the North Dome Kettleman Region.
Funding the Project:
The initial demonstration will be funded by the Department of Energy, and the CEC, who has offered to match federal funding to show support.
How it works:
" II
II
Excess renewables are pulled from the grid to compress air. Compressed air is injected into the saline aquifer zone via idle oil and gas wells. When energy is needed, air is pulled from the subsurface air bubble in the saline aquifer zone and expanded through a turbine to produce zero-carbon power. The demonstration will be able to provide SMW for 12 continuous hours.
This will be scaled to l00MW in under 3 years.
Create 5,000-10,000 New Jobs with local workforce training through local colleges. Provide potable water to the city for agriculture or other purposes Provide power at a 10-20% discount compared to todays

The Need for “Geologic” Storage
• Wind and Solar are the fastest-growing sources of
electricity globally, but they are intermittent.
• Lithium-ion batteries have dominated new storage
construction in recent years but can rarely deliver
power beyond 6 hours cost-effectively.
• The largest source of grid storage today is pumped
hydro (97%) which uses power to pump water to a
raised reservoir, then releases it and generates
power when needed. But these projects are hard to
build these days.
• The only other source of geological storage (beyond
caverns) is idle, depleted oil & gas reservoirs, many
of which are abandoned and leaking methane.

With all the rain staff has been very busy getting out property and weed abatements. Staff continues to work with the citizens regarding water waste, with the rain some people need a reminder. Code Enforcement is working on keeping the homeless from sleeping on Kings Street, it is not an easy task, but they do all they can.
SEE ATTACHED REPORT.
8100 PARKS & LANDSCAPE:
Staff continues to maintain Rice Park, landscaped areas on Skyline, Neighborhood Park, Skate Park, Sport Complex, the Ken Brown Public Safety Center, and Elliott Park. Staff has been spraying weeds to try and keep ahead of the growth after the rains we have had. We are continuing to keep two (2) restrooms open at Rice Park. 9000 ANIMAL CONTROL DEPARTMENT:
Staff continues to maintain the Animal Shelter. After receiving the grant for spay and neuter Staff has been working hard to get volunteers to help with transport to and from veterinary clinics as well as people willing to foster dogs after the procedures. They have also contacted more rescue organizations to get dogs into larger communities for adoption. Staff is doing an Outstanding Job with the number of dogs they are dealing with.
SEE ATTACHED REPORT.
13000 STREETS:
Staff maintains city streets, signs, flags, and banners. The high winds played havoc on the street signs, we replaced ones that had blown off and are working on a list of signs to be replaced. We will be patching when we can work it into the schedule.
Staff met with MidValley to discuss the new agreement. They agreed to all the City’s requests and are updating the contract for the City’s review: replacing dumpsters that smell; picking large items and helping cite property owners; assisting PW in cleaning up tumbleweeds; senior pickups three times a year; portable toilets for major City events; and running of the street sweeper. As part of the agreement, the street sweeper will be back in service on Tuesdays and Fridays.

Notes: With lots of rain came few problems. You might have seen or heard of homeless sleeping on Kings St. Staff have been getting complaints to remove them and have been active in doing that. There is a fine line as to how much the City can do but we are trying our best to keep downtown looking good. Also, with all the rain some of our residents’ thought drought was over even with rumors that council ended the restriction. Many were just starting to wash cars so verbal was giving along with schedule. Graffiti shows a good number but this time its little stuff like names nothing too big.

RE: Consider Extending Local Emergency Declaration (COVID-19) INFORMATION:
On March 24, 2020, the Avenal City Council adopted Resolution No. 2020-14 declaring a Local Emergency due to the existence or threatened existence of a local emergency: COVID 19 pandemic. On October 17, 2022, Governor Newsom announced that the COVID-19 emergency will end on February 28, 2022. After that point, Staff recommends ending the Local Emergency Declaration.
The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.
On October 28, 2021, the Avenal City Council adopted Resolution No. 2021-48 to satisfy AB 361 in order to continue Teleconferenced Meetings. AB 361 provides that, if the state of emergency remains active for more than 30 days, a local agency must make the following findings by majority vote every 30 days to continue using the bill’s exemption to the Brown Act teleconferencing rules
• The legislative body has reconsidered the circumstances of the emergency; and • Either of the following circumstances exist: The state of emergency continues to directly impact the ability of members to meet safely in person, or State or local officials continue to impose or recommend social distancing measures.
At this time, staff is recommending the City Council consider the following action by motion:
Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.
Additionally, that the Council find that a state of emergency continues to directly impact the ability of members to meet safely in person, and that State and local officials continue to impose or recommend social distancing measures.
RECOMMENDATION:
Discussion/Action.
FISCAL IMPACT:
None.

RE: Consider Extending Local Emergency Declaration (Water) INFORMATION:
On May 27, 2021, the Avenal City Council adopted Resolution No. 2021-23 declaring a Local Emergency due to the existence or threatened existence of a local emergency: Severe Water Shortage.
The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists.
As of May 18, 2022, USBR has conditionally allocated 2,000 acre feet of water to the City of Avenal as Public Health & Safety use. On average in the last few years, the City has utilized roughly 2,300 acre feet of water under Tier III drought emergency conditions. As the City continues growing and new houses being build, 2,000 acre feet of water may not be enough and additional water may be need.
By continuing the local emergency due to drought conditions, this action helps to show the Bureau that the City takes the drought emergency seriously and helps them accommodate the necessary Public Health & Safety water needs to the City.
Staff is recommending the City Council consider the following action by motion:
Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency Resolution by sixty (60) days, unless a Councilmember or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.

RE: Approve Capital Expenditure from Wastewater Enterprise Fund for Solar PV System at the Waste Water Treatment Plant
INFORMATION:
In August 2017, the City submitted an application to the State Water Resources Control Board (SWRCB) Clean Water State Revolving Fund (CWSRF) for the construction of a Solar PV System at the City’s WWTP. In July 2019, the City executed a funding agreement for a CWSRF Construction Grant for the construction of the Solar PV System at the WWTP. AM Consulting Engineers prepared procurement documentation for the Solar PV System. The project was awarded to Kuykendall Solar. During the solar interconnection application process, the City found that PG&E’s grid that supplies power to the WWTP is at full capacity and export of solar energy would not be allowed. In order for the Solar PV System to work, there is a need to install a Battery Energy Storage System (BESS) to store excess Solar PV energy and release it during times when the solar system is not producing. At the January 12, 2023 City Council meeting, Council approved awarding the battery storage component to the project to R&D Electric for $3,745,250.
On Tuesday February 7, 2023, AM Consulting informed City Staff that the Contractor would like to proceed with ordering the batteries as soon as possible. They have submitted their first payment request for $850,000 to cover the deposit to order the batteries. The contractor has indicated that they would need payment within the next 30 to 45 days to be able to secure the price.
Alfonso Manrique called the State to see if the City could use the contingency funds in the current contract and they indicated that the City cannot because it does not mention the use of batteries. The amendment to the contract is expected to be ready in June 2023. Once the amendment is executed the City will be able to claim reimbursement for those funds.
DISCUSSION:
In order to continue progress with the Waste Water Solar project, City Staff would like to prioritize the ordering of the battery storage system to avoid further delays. Using the City’s reserve funds is the fastest way to secure the batteries. Waiting for a bridge loan to be approved and potential interest costs is not advisable.
Staff is recommending utilizing funds from the Wastewater Enterprise reserve account, which currently has approximately $2,886,000 dollars. Last year $150,000 was committed for the sewer line project of the Community Center. The $850,000 for the batteries would be reimbursed by the state around July or August of 2023.
FISCAL IMPACT:
Drawing down $850,000.00 from the Wastewater Enterprise Reserves account, until reimbursed by the State as part of the State Water Resources Control Board (SWRCB) Clean Water State Revolving Fund (CWSRF) construction grant.
RECOMENDATION:
Authorize by Resolution the temporary capital infrastructure expenditure of up to $850,000.00 from the Wastewater Enterprise Reserves account towards the Solar PV System at the Waste Water Treatment Plant.
Those funds are to be immediately returned as soon as the funds are reimbursed. 1 of 2
