A. Consider Ending Local Emergency Declared on May 27, 2021:
Antony Lopez, City Manager reported that 0n May 27, 2021, the Avenal City Council adopted Resolution No. 2021-23 declaring a Local Emergency due to the existence or threatened existence of a local emergency: Severe Water Shortage. The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists. By extending the emergency declaration, USBR and the community are reminded that the City takes water conservation and the drought seriously and taking all possible measures to curb water waste.
He continues that as of March, the Bureau announced that most South of the Delta water systems would receive 75% of its historic allocation. For Avenal that is roughly 1,860 ac. ft. of 2,480 historical. This is 540 short of the complete historical allocation, but Staff believes the City will need to request at least 300 ac. ft. extra to meet this year’s needs. The City also has Section 215 Water to count on, although how much will be made available is unknown at this time. Staff awaits to hear from the Bureau on how much additional Section 215 water may be available.
Staff recommends ending the local emergency declaration anticipating additional water being made available for the 2023/2024 water year. Staff is hesitant to lift the Tier III water restriction as the 2480 allocation would be anticipating using 2 days of watering. Once staff has a clearer idea of anticipated water delivery, Staff can bring a recommendation on amending the drought restriction watering schedule.
Councilman Verdugo motioned to approve ending Local Emergency Declared om May 27, 2021, second by Councilman Gravelle and motion carried.

AGENDA ITEM NO. 5. B
TO: The Honorable Mayor and City Council
FROM: Maria A. Ortiz, City Clerk
DATE: May 11, 2023
RE: Consider Entering into a one (1) Year Fire Services Agreement with Kings County Fire Department for FY 2023/24.
INFORMATION:
Kings County Fire Department has provided fire services to the City of Avenal for many years. In early2000, to continue receiving the same level of service, by agreement, the City began to fund a portion of fire service costs to assist the County in covering the full cost service within the City. The city has remained a funding contributor since that time.
City and County Staff have met and discussed the need to allocate more funding towards the contract to meet the full cost of rendering services, which as of 2021, were around $792,000. The County understands this price tag is far too expensive for the City to afford and have always worked in good faith with the City to accept a lower contribution in hopes of meeting the full cost at a later date.
The city would like to enter into another one (1) year Fire Services Agreement in FY 2023/24, July 1, 2023 - June 30, 2024, at a cost of $425,000. The City and Community, as well, appreciate the great service Station -12 has provided over the years. We also appreciate the continued good working relationship with Kings County Fire Department, William K. Lynch, Fire Chief, Kings County Fire Department, and his Staff.
The proposed agreement is, essentially the same agreement and format as in prior years; language was added that allows the City to exit the agreement with six months’ notice, but requires the City to pay any remaining balance of services rendered. The proposed funding amount for FY 2022-2023 is an additional $25,000 compared to the prior three fiscal years. Staff believes this is reasonable considering inflationary costs impacting services in every sector. The additional costs can be absorbed by the General Fund and aided by Measure A.
Prior Years:
FY 2013/14: $280,000
FY 2014/15: $290,000
FY 2015/16: $270,000
FY 2016/17: $280,000
FY 2018/19: $290,000
FY 2019/20: $365,000
FY 2020/21: $400,000
FY 2021/22: $400,000
FY 2022/23: $400,000
RECOMMENDATION:
By Resolution, enter into an "Agreement for County Fire Services within the City of Avenal" for FY 2023/24; and authorize the Mayor to sign and execute said agreement on behalf of the City.
FISCAL IMPACT:
Cost for Fires Services: $425,000 for FY 2023/24, taken from 1010000 - PUBLIC SAFETY account.

RE: Consider Suspending Tier III Water Conservation Measures for Water Year 2023/2023: March 2023 – February 2024
INFORMATION:
As of May 2, 2023, City Staff was made aware of the Bureau of Reclamation’s announcement that Central Valley Project water contracts would be provided with 100% of contracted allocation (Attached). For the City of Avenal, that means 3,500 acre feet is being made available to use for the 2023-2024 water year (March 1, 2023 – February 29, 2024). Staff is still awaiting to receive updated contract allocation letters from USBR.
This is great news for the community, considering the very wet season the previous winter provided, and reports that 2023 will be an El Niño year, meaning higher than expected precipitation throughout the year.
One important aspect to remember, that in order for the City to increase its historic allocation (actual used water during full 100% wet water allocation years), the City and community need to utilize as much of the 3,500 ac. ft. allocation to increase the historic allocation from the current 2,480 average. This means the water usage needs to increase ASAP to begin increasing the historic use.
Staff is recommending that for the 2023-2024 water year, that Council suspend the currently enacted Tier III Water Conservation Measures, to be revisited in March 2024 pending a new water year and allocation.
Speaking with Utilities Staff, we believe that even with the full allotment of 3,500 ac. ft., the community may only fully utilize 2,800 ac. ft., and the City may need to consider selling a portion of the allocation to another customer if possible.
If any additional water is needed beyond the 3,500 ac. ft., currently Section 215 water is available at half the cost, but it will not count towards the historic use. Section 215 water is only expected to last a few months.
RECOMMENDATION:
Discussion/Direction.
1. By Resolution adopt a temporary suspension to the Tier III Water Conservation Measures for Water Year 2023/2023 (March 1, 2023 – February 29, 2024).

For Release: April 20, 2023
Contact: Mary Lee Knecht, 916-978-5100, [email protected] Reclamation bolsters Central Valley Project 2023 water supply allocations
SACRAMENTO, Calif. – Today, the Bureau of Reclamation is increasing Central Valley Project 2023 water supply allocations for irrigation water service and repayment contractors. Both north- and south-of-Delta contractors are increased to 100% from 80%. All other CVP water supply allocations remain the same as noted in the March 28 announcement.
Initial allocations were announced in February and an update was made on March 28. Current status of all CVP allocations are:
North-of-Delta Contractors
Sacramento River
• Irrigation water service and repayment contractors north-of-Delta are allocated 100% of their contract supply.
• Municipal and industrial water service and repayment contractors north-of-Delta are allocated 100% of their contract supply.
• Sacramento River Settlement Contractors’ water supply is based upon settlement of claimed senior water rights. The 2023 water year is determined as non-critical, as defined in their Settlement Contracts, which allows for 100% of their contract supply.
American River
• M&I water service and repayment contractors north-of-Delta who are serviced by Folsom Reservoir on the American River are allocated 100% of their contract supply.
In-Delta Contractors
• M&I water service and repayment contractors who are serviced directly from the Delta are allocated 100% of their contract supply.
May 11, 2023 Pg. 36
South-of-Delta Contractors
• Irrigation water service and repayment contractors south-of-Delta are allocated 100% of their contract total.
• M&I water service and repayment contractors south-of-Delta are allocated 100% of their contract supply
• San Joaquin River Settlement Contractors and San Joaquin Exchange Contractors’ water supply is based upon settlement/exchange of claimed senior water rights. The 2023 water year is determined as non-critical, as defined in their contracts, which allows for 100% of their contract supply.
Eastside Water Contractors
• Eastside water service contractors (Central San Joaquin Water Conservation District and Stockton East Water District) are allocated 100% of their contract total.
Wildlife Refuges
• The 2023 water year is currently determined as non-critical, as defined in their contracts, which allows for 100% of contract supply for wildlife refuges (Level 2), both north- and south-of-Delta.
Friant Division Contractors
• Friant Division contractors’ water supply is delivered from Millerton Reservoir on the upper San Joaquin River via the Madera and Friant-Kern canals. The first 800,000 acre-feet of available water supply is considered Class 1; Class 2 is considered the next amount of available water supply up to
1.4 million acre-feet. Given the current hydrologic conditions, the Friant Division water supply allocation is 100% of Class 1 and 70% of Class 2 (from the initial 20% allocation).
Friant Dam is currently being operated for flood control purposes; as long as these conditions exist contractors may take delivery of all available water from Friant Dam to the maximum extent of their respective contracts.
As the water year progresses, changes in hydrology, actions that impact operations, and opportunities to deliver additional water will influence future allocations. Water supply updates and past year’s allocations are posted on Reclamation California-Great Basin Region’s website. ###
About Reclamation: The Bureau of Reclamation is a federal agency under the U.S. Department of the Interior and is the nation's largest wholesale water supplier and second largest producer of hydroelectric power. Our facilities also provide substantial flood control, recreation opportunities, and environmental benefits.
